<section id="d68311e100" identifier="/us/pl/117/44/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4bd7b23-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t23/s101">23 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Surface Transportation Extension Act of 2021</shortTitle>”.</content></section>
<section id="d68311e115" identifier="/us/pl/117/44/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4bd7b24-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t23/s101">23 USC 101 note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xc4be1765-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yc4be1766-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Covered law</inline>.—</heading><chapeau>The term “<term>covered law</term>” means any of the following:</chapeau><subparagraph class="fontsize10" id="yc4be1767-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Titles I, II, III, IV, V, VI, VII, VIII, XI, and XXIV of the FAST Act (<ref href="/us/pl/114/94">Public Law 114–94</ref>; <ref href="/us/stat/129/1312">129 Stat. 1312</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="yc4be1768-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Division A, division B, subtitle A of title I and title II of division C, and division E of MAP–21 (<ref href="/us/pl/112/141">Public Law 112–141</ref>; <ref href="/us/stat/126/405">126 Stat. 405</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="yc4be1769-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Titles I, II, and III of the SAFETEA–LU Technical Corrections Act of 2008 (<ref href="/us/pl/110/244">Public Law 110–244</ref>; <ref href="/us/stat/122/1572">122 Stat. 1572</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="yc4be176a-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>Titles I, II, III, IV, V, and VI of SAFETEA–LU (<ref href="/us/pl/109/59">Public Law 109–59</ref>; <ref href="/us/stat/119/1144">119 Stat. 1144</ref>).</content></subparagraph>

<subparagraph class="fontsize10" id="yc4be176f-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1/I" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>Sections 116, 117, 330, 5128, 5505, and 24905 and chapters 53, 139, 303, 311, 313, 701, and 702 of <ref href="/us/usc/t49">title 49, United States Code</ref>.</content></subparagraph>
<subparagraph class="fontsize10" id="yc4be1770-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/1/J" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">(J) </num><content>Division B of the Continuing Appropriations Act, 2021 and Other Extensions Act (<ref href="/us/pl/116/159">Public Law 116–159</ref>; <ref href="/us/stat/134/725">134 Stat. 725</ref>).</content></subparagraph>

<paragraph class="fontsize10" id="yc4be1771-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Extension end date</inline>.—</heading><content>The term “<term>extension end date</term>” means October 31, 2021.</content></paragraph>
<paragraph class="fontsize10" id="yc4be1772-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Extension fraction</inline>.—</heading><chapeau>The term “<term>extension fraction</term>” means the quotient, expressed as a fraction, obtained by dividing—<page identifier="/us/stat/135/383">135 STAT. 383</page></chapeau><subparagraph class="fontsize10" id="yc4be1773-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of days in the extension period; by</content></subparagraph>
<subparagraph class="fontsize10" id="yc4be1774-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>365.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc4be1775-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Extension period</inline>.—</heading><content>The term “<term>extension period</term>” means the period that begins on October 1, 2021, and ends on the extension end date.</content></paragraph>
<paragraph class="fontsize10" id="yc4be1776-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Highway account</inline>.—</heading><content>The term “<term>Highway Account</term>” means the portion of the Highway Trust Fund that is not the Mass Transit Account.</content></paragraph>
<paragraph class="fontsize10" id="yc4be1777-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Mass transit account</inline>.—</heading><content>The term “<term>Mass Transit Account</term>” means the portion of the Highway Trust Fund established under section 9503(e)(1) of the Internal Revenue Code of 1986.</content></paragraph>
<paragraph class="fontsize10" id="yc4be1778-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Transportation.</content></paragraph>
<paragraph class="fontsize10" id="yc4be1779-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/s2/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term “<term>State</term>” means the 50 States and the District of Columbia.</content></paragraph>

<title id="d68311e327" identifier="/us/pl/117/44/tI" style="-uslm-lc:I658178"><num value="I">TITLE I—</num><heading>SURFACE TRANSPORTATION PROGRAMS</heading>
<section id="d68311e332" identifier="/us/pl/117/44/tI/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4be177a-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t23/s101">23 USC 101 note</ref>.</p></sidenote><heading>EXTENSION OF FEDERAL SURFACE TRANSPORTATION PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="yc4bf28eb-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4bf28ec-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Incorporation by reference.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Except as otherwise provided in this Act, the requirements, authorities, conditions, eligibilities, limitations, and other provisions authorized under the covered laws, which would otherwise expire on or cease to apply after September 30, 2021, are incorporated by reference and shall continue in effect through the extension end date.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc4bf28ed-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><paragraph class="fontsize10" id="yc4bf28ee-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Highway trust fund</inline>.—</heading><subparagraph class="fontsize10" id="yc4bf28ef-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Highway account</inline>.—</heading><content>There is authorized to be appropriated from the Highway Account for fiscal year 2022, for each program with respect to which amounts are authorized to be appropriated from such account for fiscal year 2021, an amount equal to the extension fraction of the amount authorized for appropriation with respect to the program from such account under the covered laws for fiscal year 2021.</content></subparagraph>
<subparagraph class="fontsize10" id="yc4bf28f0-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Mass transit account</inline>.—</heading><content>There is authorized to be appropriated from the Mass Transit Account for fiscal year 2022, for each program with respect to which amounts are authorized to be appropriated from such account for fiscal year 2021, an amount equal to the extension fraction of the amount authorized for appropriation with respect to the program from such account under the covered laws for fiscal year 2021.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc4bf28f1-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">General fund</inline>.—</heading><content>There is authorized to be appropriated for fiscal year 2022, for each program under the covered laws with respect to which amounts are authorized to be appropriated for fiscal year 2021 from an account other than the Highway Account or the Mass Transit Account, an amount that is not less than the extension fraction of the amount authorized for appropriation with respect to the program under the covered laws for fiscal year 2021.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc4bf28f2-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Use of Funds</inline>.—</heading><page identifier="/us/stat/135/384">135 STAT. 384</page>
<paragraph class="fontsize10" id="yc4bf28f3-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as described in paragraph (2), amounts authorized to be appropriated for fiscal year 2022 with respect to a program under subsection (b) shall be distributed, administered, limited, and made available for obligation in the same manner as amounts authorized to be appropriated with respect to the program for fiscal year 2021 under the covered laws.</content></paragraph>
<paragraph class="fontsize10" id="yc4bf28f4-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Apportionment to states</inline>.—</heading><subparagraph class="fontsize10" id="yc4bf28f5-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4bf28f6-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Notwithstanding subsections (c)(2) or (e)(1) of <ref href="/us/usc/t23/s104">section 104 of title 23, United States Code</ref>, the Secretary—</chapeau><clause class="fontsize10" id="yc4bf28f7-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>shall not apportion on October 1, 2021, amounts authorized to be appropriated for fiscal year 2022 under subsection (b)(1)(A) with a respect to a program described in subparagraph (B); and</content></clause>
<clause class="fontsize10" id="yc4bf28f8-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>shall not apportion such amounts before October 15, 2021.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc4bf28f9-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Programs described</inline>.—</heading><chapeau>A program referred to in subparagraph (A)(i) is a program—</chapeau><clause class="fontsize10" id="yc4bf28fa-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>for which amounts are authorized to be appropriated under subsection (b)(1)(A); and</content></clause>
<clause class="fontsize10" id="yc4bf28fb-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>under which amounts described in clause (i) will be apportioned to States as described in <ref href="/us/usc/t23/s104">section 104 of title 23, United States Code</ref>.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc4bf28fc-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Notice to states</inline>.—</heading><content><ref href="/us/usc/t23/s104/e/2">Section 104(e)(2) of title 23, United States Code</ref>, shall not apply for fiscal year 2022.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc4bf28fd-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Obligation Limitation</inline>.—</heading><paragraph class="fontsize10" id="yc4bf28fe-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to paragraph (2), a program for which amounts are authorized to be appropriated under subsection (b)(1) shall be subject to a limitation on obligations for fiscal year 2022 in an amount equal to the extension fraction of the limitation on obligations for the program for fiscal year 2021 and in the same manner as the limitation applicable with respect to the program for fiscal year 2021.</content></paragraph>
<paragraph class="fontsize10" id="yc4bf28ff-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Federal-aid highways</inline>.—</heading><subparagraph class="fontsize10" id="yc4bf2900-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In distributing a limitation on obligations for Federal-aid highways for qualifying programs, the Secretary—</chapeau><clause class="fontsize10" id="yc4bf2901-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>shall reserve, for qualifying programs, an amount of the limitation on obligations for Federal-aid highways equal to the amount calculated for the extension period for qualifying programs in effect on the date of enactment of this Act; and</content></clause>
<clause class="fontsize10" id="yc4bf2902-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4bf2903-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>if H.R. 3684 (117th Congress) is enacted, may distribute the amount determined under clause (i) among qualifying programs (including any qualifying programs established pursuant to such H.R. 3684) in a manner determined to be appropriate by the Secretary.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yc4bf2904-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Calculation</inline>.—</heading><content>Notwithstanding the enactment of H.R. 3684 (117th Congress), the Secretary shall calculate the amount under subparagraph (A)(i) in the manner described in section 120(a)(4) of division L of the Consolidated Appropriations Act, 2021 (<ref href="/us/pl/116/260">Public Law 116–260</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="yc4bf2905-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/C" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Definition of qualifying program</inline>.—</heading><chapeau>In this paragraph, the term “<term>qualifying program</term>” means a program for Federal-aid highways that is—<page identifier="/us/stat/135/385">135 STAT. 385</page></chapeau><clause class="fontsize10" id="yc4bf2906-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>allocated by the Secretary under—</chapeau><subclause class="fontsize10" id="yc4bf2907-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s101/d/2/C/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content><ref href="/us/usc/t23">title 23, United States Code</ref>;</content></subclause>

<section id="d68311e590" identifier="/us/pl/117/44/tI/s102" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>NATIONALLY SIGNIFICANT FREIGHT AND HIGHWAY PROJECTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xc4bf501b-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  During the extension period, until H.R. 3684 (117th Congress) is enacted, the matter preceding clause (i) in <ref href="/us/usc/t23/s117/d/2/A">section 117(d)(2)(A) of title 23, United States Code</ref>, shall be applied—</chapeau><paragraph class="fontsize10" id="yc4bf501c-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tI/s102/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by substituting “$700,000,000” for “$600,000,000”; and</content></paragraph>

<section id="d68311e634" identifier="/us/pl/117/44/tI/s104" style="-uslm-lc:I658143"><num class="fontsize12" value="104">SEC. 104. </num><heading>RAIL-RELATED PROVISIONS.</heading><content style="-uslm-lc:I658120">  <sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4bf7732-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote>During the extension period, until H.R. 3684 (117th Congress) is enacted, section 502(b)(3) of the Railroad Revitalization and Regulatory Reform Act of 1976 (<ref href="/us/usc/t45/s822/b/3">45 U.S.C. 822(b)(3)</ref>) shall be applied by substituting the extension end date for “September 30, 2021”.</content></section>
<section id="d68311e649" identifier="/us/pl/117/44/tI/s105" style="-uslm-lc:I658143"><num class="fontsize12" value="105">SEC. 105. </num><heading>PROHIBITION ON USE OF FUNDS.</heading><content style="-uslm-lc:I658120">  None of the funds authorized in this Act or any other Act may be used to adjust apportionments for the Mass Transit Account or withhold funds from apportionments for the Mass Transit Account pursuant to section 9503(e)(4) of the Internal Revenue Code of 1986 in fiscal year 2022.</content></section>

<title id="d68311e912" identifier="/us/pl/117/44/tIII" style="-uslm-lc:I658178"><num value="III">TITLE III—</num><heading>REPLACEMENT AUTHORIZATION</heading>
<section id="d68311e917" identifier="/us/pl/117/44/tIII/s301" style="-uslm-lc:I658143"><num class="fontsize12" value="301">SEC. 301. </num><heading>RESCISSION OF DUPLICATIVE CONTRACT AUTHORITY.</heading><subsection class="firstIndent0 fontsize10" id="yc4c0aed1-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Upon enactment of H.R. 3684 (117th Congress), subject to subsections (c) and (d), for each program described in subsection (b), there is permanently rescinded an amount of contract authority equal to the contract authority made available for that program under section 101.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc4c0aed2-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Programs Described</inline>.—</heading><content>A program referred to in subsection (a) is a program for which contract authority was made available for fiscal year 2022 under both section 101 and H.R. 3684 (117th Congress).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc4c0aed3-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><paragraph class="fontsize10" id="yc4c0aed4-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Application of rescission among certain programs</inline>.—</heading><content>The amount of contract authority rescinded under subsection (a) shall be applied among States for apportioned programs in the same amounts that contract authority would be apportioned to such States and distributed for such apportioned programs under section 101.</content></paragraph>
<paragraph class="fontsize10" id="yc4c0aed5-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc4c0aed6-e813-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Substantially similar and successor programs</inline>.—</heading><chapeau>The Secretary may implement subsection (a) in a manner that, as determined appropriate by the Secretary, accommodates a circumstance in which—</chapeau><subparagraph class="fontsize10" id="yc4c0aed7-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>section 101 makes available contract authority for fiscal year 2022 for a program; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc4c0aed8-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>H.R. 3684 (117th Congress) makes available contract authority for fiscal year 2022 for a program that is, in the judgment of the Secretary, substantially similar or a successor to the program referred to in subparagraph (A).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yc4c0aed9-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Deadline</inline>.—</heading><content>The Secretary shall implement the rescission under subsection (a) not later than September 30, 2022.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc4c0aeda-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/44/tIII/s301/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Apportionment Exception</inline>.—</heading><content>Notwithstanding subsection (c)(2) or (e)(1) of <ref href="/us/usc/t23/s104">section 104 of title 23, United States Code</ref>, or section 101(c)(2), the Secretary shall not be required to apportion any amounts of contract authority that are rescinded pursuant to this section.<page identifier="/us/stat/135/388">135 STAT. 388</page></content></subsection>

<section id="d68311e1003" identifier="/us/pl/117/44/tIII/s302" style="-uslm-lc:I658143"><num class="fontsize12" value="302">SEC. 302. </num><heading>PRIOR ENACTED AUTHORIZATION.</heading><content style="-uslm-lc:I658120">  If H.R. 3684 (117th Congress) is enacted before the date of enactment of this Act, this Act shall not take effect and the provisions of this Act shall not be executed.</content></section>
