<section id="d68595e92" identifier="/us/pl/117/4/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Strengthening and Amplifying Vaccination Efforts to Locally Immunize All Veterans and Every Spouse Act</shortTitle>” or the “<shortTitle role="act">SAVE LIVES Act</shortTitle>”.</content></section>
<section id="d68595e105" identifier="/us/pl/117/4/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AUTHORITY OF SECRETARY OF VETERANS AFFAIRS TO FURNISH COVID–19 VACCINE TO CERTAIN INDIVIDUALS NOT ENROLLED IN PATIENT ENROLLMENT SYSTEM OF DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="ye440ccf8-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary of Veterans Affairs may furnish a vaccine for COVID–19 to a covered individual during the COVID–19 public health emergency.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye440ccf9-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Prioritization</inline>.—</heading><chapeau>In furnishing vaccines for COVID–19 under the laws administered by the Secretary, the Secretary shall—</chapeau><paragraph class="fontsize10" id="ye440ccfa-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>prioritize the vaccination of veterans who are enrolled in the patient enrollment system, veterans who receive hospital care and medical services pursuant to subsection (c)(2) of <ref href="/us/usc/t38/s1705">section 1705 of title 38, United States Code</ref>, and accompanying caregivers of such veterans before the vaccination of covered individuals not otherwise described in this paragraph; and</content></paragraph>
<paragraph class="fontsize10" id="ye440ccfb-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>only furnish vaccines for COVID–19 to covered individuals under this section to the extent that such vaccines are available.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ye440ccfc-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Timing of Vaccines Provided to Spouses of Veterans</inline>.—</heading><content>The Secretary may determine the timing for offering a vaccine for COVID–19 to the spouse of a veteran from the Department of Veterans Affairs.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye440ccfd-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Vaccine Allocation</inline>.—</heading><content>It is the sense of Congress that, to the extent practicable based on the current national supply chain, the Secretary of Health and Human Services should adjust the allocation for the Department of Veterans Affairs for the vaccine for COVID–19 based on the additional eligibility of covered individuals under this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="ye440ccfe-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="ye440ccff-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Accompanying caregiver</inline>.—</heading><content>The term “<term>accompanying caregiver</term>” means a caregiver described in subparagraph (D), (E), or (F) of paragraph (2) who is accompanying a veteran who is receiving a vaccine for COVID–19 furnished by the Department.<page identifier="/us/stat/135/248">135 STAT. 248</page></content></paragraph>
<paragraph class="fontsize10" id="ye440cd00-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Covered individual</inline>.—</heading><chapeau>The term “<term>covered individual</term>” means any of the following individuals:</chapeau><subparagraph class="fontsize10" id="ye440cd01-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>A veteran who is not eligible to enroll in the patient enrollment system.</content></subparagraph>
<subparagraph class="fontsize10" id="ye440cd02-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>A veteran who is eligible for care under <ref href="/us/usc/t38/s1724">section 1724 of title 38, United States Code</ref>.</content></subparagraph>
<subparagraph class="fontsize10" id="ye440cd03-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>A beneficiary under section 1781 of such title.</content></subparagraph>
<subparagraph class="fontsize10" id="ye440cd04-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>A family caregiver of a veteran participating in the program of comprehensive assistance for family caregivers under section 1720G(a) of such title.</content></subparagraph>
<subparagraph class="fontsize10" id="ye440cd05-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>A caregiver of a veteran participating in the program of general caregiver support services under section 1720G(b) of such title.</content></subparagraph>
<subparagraph class="fontsize10" id="ye440cd06-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>A caregiver of a veteran participating in the Medical Foster Home Program, Bowel and Bladder Program, Home Based Primary Care Program, or Veteran Directed Care Program of the Department of Veterans Affairs.</content></subparagraph>
<subparagraph class="fontsize10" id="ye440cd07-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>A spouse of a veteran.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ye440cd08-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Covered public health emergency</inline>.—</heading><content>The term “<term>covered public health emergency</term>” means an emergency with respect to COVID–19 declared by a Federal, State, or local authority.</content></paragraph>
<paragraph class="fontsize10" id="ye440cd09-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">COVID–19</inline>.—</heading><content>The term “<term>COVID–19</term>” means the coronavirus disease 2019.</content></paragraph>
<paragraph class="fontsize10" id="ye440cd0a-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Patient enrollment system</inline>.—</heading><content>The term “<term>patient enrollment system</term>” means the system of annual patient enrollment of the Department of Veterans Affairs established and operated under <ref href="/us/usc/t38/s1705/a">section 1705(a) of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="ye440cd0b-e813-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/4/s2/e/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Veteran</inline>.—</heading><content>The term “<term>veteran</term>” has the meaning given that term in <ref href="/us/usc/t38/s101/2">section 101(2) of title 38, United States Code</ref>.</content></paragraph>
