<section id="d46729e92" identifier="/us/pl/117/360/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Energy Security and Lightering Independence Act of 2022</shortTitle>”.</content></section>
<section id="d46729e102" identifier="/us/pl/117/360/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>CHANGES IN NONIMMIGRANT CATEGORIES.</heading><subsection class="firstIndent0 fontsize10" id="y17297c95-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Transit Through United States</inline>.—</heading><content>Section 101(a)(15)(C) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a/15/C">8 U.S.C. 1101(a)(15)(C)</ref>) <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><subparagraph class="fontsize10" id="y1729a3a6-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C)</num><clause class="inline" id="y1729a3a7-e814-11f0-a1e4-69761a48a15a"><num value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1729a3a8-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><content>an alien in immediate and continuous transit through the United States, for a period not to exceed 29 days;</content></clause>
<clause class="indentUp0 fontsize10" id="y1729a3a9-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an alien who qualifies as a person entitled to pass in transit to and from the United Nations Headquarters District (as defined in section 209A(e) of the State Department Basic Authorities Act of 1956 (<ref href="/us/usc/t22/s4309a/e">22 U.S.C. 4309a(e)</ref>)) and foreign countries, under the provisions of paragraphs (3), (4), and (5) of section 11 of the Agreement regarding the Headquarters of the United Nations, done at Lake Success June 26, 1947 (<ref href="/us/stat/61/758">61 Stat. 758</ref>); or</content></clause>
<clause class="indentUp0 fontsize10" id="y1729a3aa-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>an alien passing in transit through the United States to board a vessel on which the alien will perform, or to disembark from a vessel on which the alien performed, ship-to-ship liquid cargo transfer operations to or from another vessel engaged in foreign trade, for a period not to exceed 180 days;”</content></clause>

<subsection class="firstIndent0 fontsize10" id="y1729a3ab-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Alien Crewmen</inline>.—</heading><chapeau>Section 101(a)(15)(D) of such Act (<ref href="/us/usc/t8/s1101/a/15/D">8 U.S.C. 1101(a)(15)(D)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y1729a3ac-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in clause (ii), by <amendingAction type="add">adding</amendingAction> “<quotedText>or</quotedText>” at the end; and</content></paragraph>
<paragraph class="fontsize10" id="y1729a3ad-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="fontsize10" id="y1729cabe-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii)</num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1729cabf-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote> an alien crewman performing ship-to-ship liquid cargo transfer operations to or from another vessel engaged in foreign trade, who intends to land temporarily solely in pursuit of the alien’s responsibilities as a crewman and to depart from the United States on the vessel on which the alien arrived or on another vessel or aircraft, for a period not to exceed 180 days;”</content></subsection>

<section id="d46729e201" identifier="/us/pl/117/360/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>CONDITIONAL PERMITS TO LAND TEMPORARILY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1729f1d0-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 252(a) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1282/a">8 U.S.C. 1282(a)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y1729f1d1-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>or</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="y1729f1d2-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (2), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; or</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y1729f1d3-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/360/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="y172a18e4-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x172a18e5-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>180 days, if the immigration officer determines that the crewman—</chapeau><subparagraph class="fontsize10" id="y172a18e6-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>intends to depart, within the period for which the crewman is permitted to land, on the same vessel or on a vessel or aircraft other than the vessel on which the crewman arrived; and</content></subparagraph>
<subparagraph class="fontsize10" id="y172a18e7-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>will perform ship-to-ship liquid cargo transfer operations to or from any other vessel engaged in foreign trade during such period.”</content></subparagraph>

<section id="d46729e265" identifier="/us/pl/117/360/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x172a18e8-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t8/s1101">8 USC 1101 note</ref>.</p></sidenote><heading>RULE OF CONSTRUCTION.</heading><content style="-uslm-lc:I658120">  For purposes of this Act, and the amendments made by this Act, the performance by a crewman of ship-to-ship liquid cargo transfer operations to or from any other vessel engaged in foreign trade shall not be considered, for immigration purposes, to be services, work, labor or employment by the crewman within the United States.</content></section>
