<section id="d47077e98" identifier="/us/pl/117/355/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x43ac7235-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">National Cemeteries Preservation and Protection Act of 2022</shortTitle>”.</content></section>
<section id="d47077e113" identifier="/us/pl/117/355/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x43ac7236-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Payment.</p><p class="leftAlign firstIndent0 fontsize8" id="x43ac7237-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s2303">38 USC 2303 note</ref>.</p></sidenote><heading>PLOT AND INTERMENT ALLOWANCES FOR VETERANS BURIED BEFORE MARCH 15, 2022, IN CEMETERIES ON TRUST LAND OWNED BY, OR HELD IN TRUST FOR, TRIBAL ORGANIZATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x43ac9948-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Secretary of Veterans Affairs shall pay a plot or interment allowance under paragraph (1) of <ref href="/us/usc/t38/s2303/b">section 2303(b) of title 38, United States Code</ref>, for a veteran if—</chapeau><paragraph class="fontsize10" id="y43ac9949-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the veteran was buried, before March 15, 2022, in a cemetery, or in a section of a cemetery, that is on trust land owned by, or held in trust for, a tribal organization;</content></paragraph>
<paragraph class="fontsize10" id="y43ac994a-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the tribal organization that is responsible for operating and maintaining the cemetery, or the section of cemetery, applies for such allowance;</content></paragraph>
<paragraph class="fontsize10" id="y43ac994b-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a plot or interment allowance was not already paid for the burial of such veteran under paragraph (2) of such section; and</content></paragraph>
<paragraph class="fontsize10" id="y43ac994c-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the burial of the veteran otherwise meets the requirements under paragraph (1) of such section.</content></paragraph>
</section>
<section id="d47077e150" identifier="/us/pl/117/355/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>GREEN BURIAL SECTIONS AT NATIONAL CEMETERIES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x43ace76d-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t38/s2404">Section 2404 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y43ace76e-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (c)(2)—</chapeau><subparagraph class="fontsize10" id="y43ace76f-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s3/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph>
<subparagraph class="fontsize10" id="y43ace770-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s3/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (D), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y43ace771-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s3/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subparagraph:<quotedContent><subparagraph class="indentDown1 fontsize10" id="y43ace772-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>in the case of grave sites in a green burial section designated under subsection (i), the Secretary may provide for grave markers of such type as the Secretary considers appropriate.”</content></subparagraph>

<paragraph class="fontsize10" id="y43ace773-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y43ad0e84-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i)</num><paragraph class="inline" id="y43ad0e85-e814-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>The Secretary may designate one or more sections in any national cemetery as green burial sections.<page identifier="/us/stat/136/6279">136 STAT. 6279</page></content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y43ad0e86-e814-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x43ad0e87-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>In this subsection, the term ‘<term>green burial section</term>’ means a section of a cemetery in which the remains of individuals interred in that section—</chapeau><subparagraph class="fontsize10" id="y43ad0e88-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>have been prepared for interment in a manner that does not involve chemicals or embalming fluids; and</content></subparagraph>
<subparagraph class="fontsize10" id="y43ad0e89-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>have been interred in a natural manner or in completely biodegradable burial receptacles.”</content></subparagraph>

<section id="d47077e250" identifier="/us/pl/117/355/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>TRANSFER OF ADMINISTRATIVE JURISDICTION OVER LAND AT FORT BLISS, TEXAS, FOR EXPANSION OF FORT BLISS NATIONAL CEMETERY.</heading><subsection class="firstIndent0 fontsize10" id="y43ad83ba-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Transfer Authorized</inline>.—</heading><content>The Secretary of the Army may transfer to the Secretary of Veterans Affairs administrative jurisdiction over a parcel of real property consisting of approximately two acres located at Fort Bliss, Texas, directly adjacent to, and contiguous with, Fort Bliss National Cemetery.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y43ad83bb-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Condition of Transfer</inline>.—</heading><paragraph class="fontsize10" id="y43ad83bc-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As a condition of the transfer authorized by subsection (a), the Secretary of Veterans Affairs may complete appropriate environmental, cultural resource, and other due diligence activities on the real property described in subsection (c) before determining whether the property is suitable for cemetery purposes.</content></paragraph>
<paragraph class="fontsize10" id="y43ad83bd-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><content>The Secretary of Veterans Affairs shall coordinate with the Secretary of the Army as needed during the performance of the activities described in paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y43ad83be-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Description of Property</inline>.—</heading><paragraph class="fontsize10" id="y43ad83bf-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x43ad83c0-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The exact acreage and legal description of the real property to be transferred under this section shall be determined by a survey satisfactory to the Secretary the Army.</content></paragraph>
<paragraph class="fontsize10" id="y43ad83c1-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Cost of survey</inline>.—</heading><content>The cost of the survey described in paragraph (1) shall be borne by the Secretary of Veterans Affairs.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y43ad83c2-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Additional Terms and Conditions; Costs of Transfer</inline>.—</heading><paragraph class="fontsize10" id="y43ad83c3-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Additional terms and conditions</inline>.—</heading><content>The Secretary of the Army may require such additional terms and conditions in connection with the transfer under this section as the Secretary considers appropriate to protect the interests of the United States.</content></paragraph>
<paragraph class="fontsize10" id="y43ad83c4-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Reimbursement of costs </inline>.—</heading><subparagraph class="fontsize10" id="y43ad83c5-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Veterans Affairs shall reimburse the Secretary of the Defense for costs incurred by the Secretary of the Army in implementing this section, including the costs of any surveys.</content></subparagraph>
<subparagraph class="fontsize10" id="y43ad83c6-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s4/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">No payment for value of real property</inline>.—</heading><content>Notwithstanding any other legal requirement that might otherwise apply, the Secretary of Veterans Affairs shall not be required to make payment of any kind for the value of the real property described in subsection (c).</content></subparagraph>

<section id="d47077e362" identifier="/us/pl/117/355/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>TRANSFER OF DEPARTMENT OF THE INTERIOR LAND FOR USE AS A NATIONAL CEMETERY.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x43ada9d7-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t38/s2406">Section 2406 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y43ada9d8-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s5/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>As additional lands</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>(a) <headingText class="smallCaps">In General</headingText>.—As additional lands</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y43ada9d9-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s5/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<page identifier="/us/stat/136/6280">136 STAT. 6280</page>
<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y43add0ea-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Transfer of Department of the Interior Land for Use as a National Cemetery</inline>.—</heading><chapeau>Notwithstanding section 204(d) of the Federal Land Policy and Management Act of 1976 (<ref href="/us/usc/t43/s1714/d">43 U.S.C. 1714(d)</ref>), if the Secretary and the Secretary of the Interior agree to a transfer under subsection (a) of any land for use by the Department as a national cemetery, the land shall be—</chapeau><paragraph class="fontsize10" id="y43add0eb-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>withdrawn from all forms of appropriation under the public land laws, including the mining laws, the mineral leasing laws, and the geothermal leasing laws;</content></paragraph>
<paragraph class="fontsize10" id="y43add0ec-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>subject to valid existing rights;</content></paragraph>
<paragraph class="fontsize10" id="y43add0ed-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>transferred to the administrative jurisdiction of the Secretary of Veterans Affairs; and</content></paragraph>
<paragraph class="fontsize10" id="y43add0ee-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>deemed to be property (as defined in section 102(9) of title 40) for as long as the land remains under the administrative jurisdiction of the Secretary of Veterans Affairs.”</content></paragraph>

<section id="d47077e437" identifier="/us/pl/117/355/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>EXPANSION OF PROHIBITION AGAINST INTERMENT OR MEMORIALIZATION IN THE NATIONAL CEMETERY ADMINISTRATION OR ARLINGTON NATIONAL CEMETERY OF PERSONS COMMITTING CERTAIN CRIMES.</heading><subsection class="firstIndent0 fontsize10" id="y43ae6d2f-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s6/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t38/s2411">Section 2411 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y43ae6d30-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in the section heading—</chapeau><subparagraph class="fontsize10" id="y43ae6d31-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s6/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>certain</b></quotedText>” before “<quotedText><b>Federal</b></quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y43ae6d32-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/355/s6/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>capital</b></quotedText>”;</content></subparagraph>

<subparagraph class="fontsize10" id="y43ae944a-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>has not been convicted of such crime by reason of such person not being available for trial due to death or flight to avoid prosecution.”</content></subparagraph>
