<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6176064b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Justice for Victims of War Crimes Act.</p></sidenote>
<section id="d69498e88" identifier="/us/pl/117/351/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6176064c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t18/s1">18 USC 1 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Justice for Victims of War Crimes Act</shortTitle>”.</content></section>
<section id="d69498e103" identifier="/us/pl/117/351/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>WAR CRIMES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x61762d5d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s2441">Section 2441 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y6176546e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/351/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (b) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y61767b7f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Jurisdiction</inline>.—</heading><chapeau>There is jurisdiction over an offense described in subsection (a) if—</chapeau><paragraph class="fontsize10" id="y61767b80-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the offense occurs in whole or in part within the United States; or</content></paragraph>
<paragraph class="fontsize10" id="y61767b81-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>regardless of where the offense occurs—</chapeau><subparagraph class="fontsize10" id="y61767b82-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>the victim or offender is—</chapeau><clause class="fontsize10" id="y61767b83-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a national of the United States or an alien lawfully admitted for permanent residence; or</content></clause>
<clause class="fontsize10" id="y61767b84-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a member of the Armed Forces of the United States, regardless of nationality; or</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y61767b85-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the offender is present in the United States, regardless of the nationality of the victim or offender.”</content></subparagraph>
</paragraph>
</subsection>

<paragraph class="fontsize10" id="y61767b86-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/351/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y6176a297-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplicability of Certain Limitations</inline>.—</heading><content>In the case of an offense described in subsection (a) and further described in subsections (c)(1) and (c)(3), an indictment may be found or an information may be instituted at any time without limitation.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y6176a298-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Certification Requirement</inline>.—</heading><paragraph class="fontsize10" id="y6176a299-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>No prosecution for an offense described in subsection (a) shall be undertaken by the United States except on written certification of the Attorney General, the Deputy Attorney General, or an Assistant Attorney General, which function of approving prosecutions may not be delegated, that a prosecution by the United States is in the public interest and necessary to secure substantial justice.</content></paragraph>
<paragraph class="fontsize10" id="y6176a29a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Offender present in united states</inline>.—</heading><chapeau>For an offense for which jurisdiction exists under subsection (b)(2)(B) (and does not exist under any other provision of subsection (b)), the written certification required under paragraph (1) of this subsection that a prosecution by the United States is in the public interest and necessary to secure substantial justice shall <page identifier="/us/stat/136/6266">136 STAT. 6266</page>
be made by the Attorney General or the Deputy Attorney General, which function may not be delegated. In issuing such certification, the same official shall weigh and consider, among other relevant factors—</chapeau><subparagraph class="fontsize10" id="y6176c9ab-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>whether the alleged offender can be removed from the United States for purposes of prosecution in another jurisdiction; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6176c9ac-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>potential adverse consequences for nationals, servicemembers, or employees of the United States.</content></subparagraph>

</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y6176c9ad-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Input From Other Agency Heads</inline>.—</heading><content>The Secretary of Defense and Secretary of State may submit to the Attorney General for consideration their views generally regarding potential benefits, or potential adverse consequences for nationals, servicemembers, or employees of the United States, of prosecutions of offenses for which jurisdiction exists under subsection (b)(2)(B).</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y6176c9ae-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">No Judicial Review</inline>.—</heading><content>Certifications under subsection (f) and input from other agency heads under subsection (g) are not subject to judicial review.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y6176c9af-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Rules of Construction</inline>.—</heading><chapeau>Nothing in this section shall be construed as—</chapeau><paragraph class="fontsize10" id="y6176c9b0-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>support for ratification of or accession to the Rome Statute of the International Criminal Court, which entered into force on July 1, 2002; or</content></paragraph>
<paragraph class="fontsize10" id="y6176c9b1-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>consent by the United States to any assertion or exercise of jurisdiction by any international, hybrid, or foreign court.”</content></paragraph>
