<section id="d69785e247" identifier="/us/pl/117/348/tI/stA/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><heading>AUTHORITY TO AWARD COMPETITIVE GRANTS TO ENHANCE COLLABORATION BETWEEN STATE CHILD WELFARE AND JUVENILE JUSTICE SYSTEMS.</heading><subsection class="firstIndent0 fontsize10" id="y7ff30c5f-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stA/s101/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Subpart 1 of part B of title IV of the Social Security Act (<ref href="/us/usc/t42/s621/etseq">42 U.S.C. 621 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="indentUp2 firstIndent-2" id="y7ff41dd0-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658144"><num class="bold" value="429A">“SEC. 429A. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff41dd1-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s628c">42 USC 628c</ref>.</p></sidenote><heading class="bold">GRANTS TO STATES TO ENHANCE COLLABORATION BETWEEN STATE CHILD WELFARE AND JUVENILE JUSTICE SYSTEMS.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y7ff41dd2-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><chapeau>The purpose of this section is to authorize the Secretary, in collaboration with the Attorney General and the Administrator of the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice—</chapeau><paragraph class="fontsize10" id="y7ff41dd3-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>to make grants to State child welfare and juvenile justice agencies and child- and youth-serving agencies to collaborate in the collection of data relating to dual status youth; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff41dd4-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff41dd5-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote><chapeau>to develop practices, policies, and protocols—</chapeau><subparagraph class="fontsize10" id="y7ff41dd6-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>to confront the challenges presented and experienced by dual status youth; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff41dd7-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>for the development of interoperable data systems.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7ff41dd8-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Authority to Award Grants</inline>.—</heading><paragraph class="fontsize10" id="y7ff41dd9-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to the availability of appropriations, from amounts reserved under section 423(a)(2) for a fiscal year, the Secretary shall award competitive grants jointly to a State child welfare agency and a State juvenile justice agency to facilitate or enhance collaboration between the child welfare and juvenile justice systems of the State in order to carry out programs to address the needs of dual status youth and their families.</content></paragraph>
<paragraph class="fontsize10" id="y7ff41dda-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Length of grants</inline>.—</heading><subparagraph class="fontsize10" id="y7ff41ddb-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to subparagraph (B), a grant shall be awarded under this section for a period of not less than 2 fiscal years and not more than 5 fiscal years.</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff41ddc-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Extension of grant</inline>.—</heading><content>Upon the application of the grantee, the Secretary may extend the period for which a grant is awarded under this section for not more than 2 fiscal years.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7ff41ddd-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Additional Requirements</inline>.—</heading><paragraph class="fontsize10" id="y7ff41dde-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><chapeau>In order for a State to be eligible for a grant under this section, the State shall submit an application, subject to the approval of the Secretary, that includes—</chapeau><subparagraph class="fontsize10" id="y7ff41ddf-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a description of the proposed leadership collaboration group (including the membership of such group), and how such group will manage and oversee a review and analysis of current practices while working to jointly <page identifier="/us/stat/136/6213">136 STAT. 6213</page>
address enhanced practices to improve outcomes for dual status youth;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff41de0-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>a description of how the State proposes—</chapeau><clause class="fontsize10" id="y7ff41de1-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>to identify dual status youth;</content></clause>
<clause class="fontsize10" id="y7ff41de2-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to identify individuals who are at risk of becoming dual status youth;</content></clause>
<clause class="fontsize10" id="y7ff41de3-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>to identify common characteristics shared by dual status youth in the State; and</content></clause>
<clause class="fontsize10" id="y7ff41de4-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>to determine the prevalence of dual status youth in the State;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7ff41de5-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>a description of current and proposed practices and procedures that the State intends to use—</chapeau><clause class="fontsize10" id="y7ff41de6-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>to screen and assess dual status youth for risks and treatment needs;</content></clause>
<clause class="fontsize10" id="y7ff41de7-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to provide targeted and evidence-based services, including educational, behavioral health, and pro-social treatment interventions for dual status youth and their families; and</content></clause>
<clause class="fontsize10" id="y7ff41de8-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>to provide for a lawful process to enhance or ensure the abilities of the State and any relevant agencies to share information and data about dual status youth, while maintaining confidentiality and privacy protections under Federal and State law; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7ff41de9-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff41dea-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Certification.</p></sidenote><content>a certification that the State has involved local governments, as appropriate, in the development, expansion, modification, operation, or improvement of proposed policy and practice reforms to address the needs of dual status youth.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7ff41deb-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">No supplantation of other funds</inline>.—</heading><content>Any amounts paid to a State under a grant under this section shall be used to supplement and not supplant other State expenditures on dual status youths or children involved with either the child welfare or juvenile justice systems.</content></paragraph>
<paragraph class="fontsize10" id="y7ff41dec-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Evaluation</inline>.—</heading><chapeau>Up to 10 percent of the amount made available to carry out this section for a fiscal year shall be made available to the Secretary to evaluate the effectiveness of the projects funded under this section, using a methodology that—</chapeau><subparagraph class="fontsize10" id="y7ff41ded-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>includes random assignment whenever feasible, or other research methods that allow for the strongest possible causal inferences when random assignment is not feasible; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff41dee-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>generates evidence on the impact of specific projects, or groups of projects with identical (or similar) practices and procedures.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7ff41def-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>A State child welfare agency and a State juvenile justice agency receiving a grant under this section shall jointly submit to the Secretary, the Attorney General, and the Administrator of the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice, a report on the evaluation of the activities carried out under the grant at the end of each fiscal year during the period of the grant. Such report shall include—</chapeau><subparagraph class="fontsize10" id="y7ff41df0-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a description of the scope and nature of the dual status youth population in the State, including the number of dual status youth;<page identifier="/us/stat/136/6214">136 STAT. 6214</page></content></subparagraph>
<subparagraph class="fontsize10" id="y7ff41df1-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a description of the evidence-based practices and procedures used by the agencies to carry out the activities described in clauses (i) through (iii) of paragraph (1)(C); and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff41df2-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff41df3-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Analysis.</p></sidenote><chapeau>an analysis of the effects of such practices and procedures, including information regarding—</chapeau><clause class="fontsize10" id="y7ff41df4-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the collection of data related to individual dual status youths;</content></clause>
<clause class="fontsize10" id="y7ff41df5-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>aggregate data related to the dual status youth population, including—</chapeau><subclause class="fontsize10" id="y7ff41df6-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>characteristics of dual status youths in the State;</content></subclause>
<subclause class="fontsize10" id="y7ff41df7-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>case processing timelines; and</content></subclause>
<subclause class="fontsize10" id="y7ff41df8-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>information related to case management, the provision of targeted services, and placements within the foster care or juvenile justice system; and</content></subclause>
</clause>
<clause class="fontsize10" id="y7ff41df9-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><chapeau>the extent to which such practices and procedures have contributed to—</chapeau><subclause class="fontsize10" id="y7ff41dfa-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>improved educational outcomes for dual status youths;</content></subclause>
<subclause class="fontsize10" id="y7ff41dfb-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>fewer delinquency referrals for dual status youths;</content></subclause>
<subclause class="fontsize10" id="y7ff41dfc-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>shorter stays in intensive restrictive placements for dual status youths; or</content></subclause>
<subclause class="fontsize10" id="y7ff41dfd-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">“(IV) </num><content>such other outcomes for dual status youths as the State child welfare agency and State juvenile justice agency may identify.</content></subclause>

</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7ff41dfe-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Training and Technical Assistance</inline>.—</heading><chapeau>The Secretary may support State child welfare agencies and State juvenile justice agencies by offering a program, developed in consultation with organizations and agencies with subject matter expertise, of training and technical assistance to assist such agencies in developing programs and protocols that draw on best practices for serving dual status youth in order to facilitate or enhance—</chapeau><paragraph class="fontsize10" id="y7ff41dff-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>collaboration between State child welfare agencies and State juvenile justice agencies; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff41e00-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the effectiveness of such agencies with respect to working with Federal agencies and child welfare and juvenile justice agencies from other States.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7ff41e01-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 3 years after the date of enactment of this section, and every 3 years thereafter, the Secretary, the Attorney General, and the Administrator of the Office of Juvenile Justice and Delinquency Prevention of the Department of Justice shall jointly submit to the Committee on Finance and the Committee on the Judiciary of the Senate and the Committee on Ways and Means and the Committee on Education and Labor of the House of Representatives, a report on the grants provided under this section.</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y7ff41e02-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y7ff41e03-e814-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Dual status youth</inline>.—</heading><content>The term ‘<term>dual status youth</term>’ means a child who has come into contact with both the child welfare and juvenile justice systems and occupies various statuses in terms of the individual’s relationship to such systems.</content></paragraph>
<paragraph class="fontsize10" id="y7ff41e04-e814-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Leadership collaboration group</inline>.—</heading><content>The term ‘<term>leadership collaboration group</term>’ means a group composed of senior <page identifier="/us/stat/136/6215">136 STAT. 6215</page>
officials from the State child welfare agency, the State juvenile justice agency, and other relevant youth and family-serving public agencies and private organizations, including, to the extent practicable, representatives from the State judiciary branch.</content></paragraph>
<paragraph class="fontsize10" id="y7ff41e05-e814-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">State juvenile justice agency</inline>.—</heading><content>The term ‘<term>State juvenile justice agency</term>’ means the agency of the State or Indian tribe responsible for administering grant funds awarded under the Juvenile Justice and Delinquency Prevention Act of 1974 (<ref href="/us/usc/t34/s11101/etseq">34 U.S.C. 11101 et seq.</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y7ff41e06-e814-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">State child welfare agency</inline>.—</heading><content>The term ‘<term>State child welfare agency</term>’ means the State agency responsible for administering the program under this subpart, or, in the case of a tribal organization that is receiving payments under section 428, the tribal agency responsible for administering such program.”</content></paragraph>

<section id="d69785e700" identifier="/us/pl/117/348/tI/stA/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>ELIMINATION OF SUNSET FOR ADVISORY COUNCIL ON HUMAN TRAFFICKING.</heading><content style="-uslm-lc:I658120">  The Survivors of Human Trafficking Empowerment Act (<ref href="/us/pl/114/22/s115">section 115 of Public Law 114–22</ref>)<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff4451f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s7103b">22 USC 7103b</ref>.</p></sidenote> <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> subsection (h).</content></section>
<section id="d69785e722" identifier="/us/pl/117/348/tI/stA/s103" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><heading>PILOT PROGRAM FOR YOUTH AT HIGH RISK OF BEING TRAFFICKED.</heading><content class="firstIndent0 fontsize10" id="x7ff46c30-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 202(b) of the Trafficking Victims Protection Reauthorization Act of 2005 (<ref href="/us/usc/t34/s20702/b">34 U.S.C. 20702(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y7ff4e161-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Pilot demonstration program</inline>.—</heading><subparagraph class="fontsize10" id="y7ff4e162-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>The Assistant Attorney General, in consultation with the Assistant Secretary, shall establish a pilot demonstration program, through which community-based organizations in underserved communities, prioritizing rural communities, in the United States may apply for funding to develop, implement, and build replicable treatment models, based on the type of housing unit that the individual being treated lives in, with supportive services and innovative care, treatment, and services.<page identifier="/us/stat/136/6216">136 STAT. 6216</page></content></subparagraph>
<subparagraph class="fontsize10" id="y7ff4e163-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Population to be served</inline>.—</heading><chapeau>The program established pursuant to subparagraph (A) shall primarily serve adolescents and youth who—</chapeau><clause class="fontsize10" id="y7ff4e164-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>are transitioning out of foster care;</content></clause>
<clause class="fontsize10" id="y7ff4e165-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>struggle with substance use disorder;</content></clause>
<clause class="fontsize10" id="y7ff4e166-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>are pregnant or parenting; or</content></clause>
<clause class="fontsize10" id="y7ff4e167-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>have experienced foster care involvement or involvement in the child welfare system, child poverty, child abuse or neglect, human trafficking, juvenile justice involvement, gang involvement, or homelessness.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7ff4e168-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Authorized activities</inline>.—</heading><chapeau>Funding provided under subparagraph (A) may be used for—</chapeau><clause class="fontsize10" id="y7ff4e169-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>providing residential care, including temporary or long-term placement as appropriate;</content></clause>
<clause class="fontsize10" id="y7ff4e16a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>providing 24-hour emergency social services response;</content></clause>
<clause class="fontsize10" id="y7ff4e16b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>providing clothing and other daily necessities needed to keep individuals from returning to living on the street;</content></clause>
<clause class="fontsize10" id="y7ff4e16c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>case management services;</content></clause>
<clause class="fontsize10" id="y7ff4e16d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>mental health counseling, including specialized counseling and substance abuse treatment;</content></clause>
<clause class="fontsize10" id="y7ff4e16e-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>legal services;</content></clause>
<clause class="fontsize10" id="y7ff4e16f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>specialized training for social service providers, public sector personnel, and private sector personnel likely to encounter sex trafficking and labor trafficking victims on issues related to the sex trafficking and labor trafficking of minors; and</content></clause>
<clause class="fontsize10" id="y7ff4e170-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">“(viii) </num><content>outreach and education programs to provide information about deterrence and prevention of sex trafficking and labor trafficking of minors.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7ff4e171-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Funding priority</inline>.—</heading><content>The Assistant Attorney General shall give funding priority to community-based programs that provide crisis stabilization, emergency shelter, and addiction treatment for adolescents and transitional age residential programs that have reputable outcomes.”</content></subparagraph>

<section id="d69785e855" identifier="/us/pl/117/348/tI/stB/s121" style="-uslm-lc:I658143"><num class="fontsize12" value="121">SEC. 121. </num><heading>COMPTROLLER GENERAL REPORT ON OVERSIGHT OF FEDERAL SUPPLY CHAINS.</heading><subsection class="firstIndent0 fontsize10" id="y7ff52e92-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than June 1, 2024, the Comptroller General of the United States shall submit to the appropriate congressional committees a report on Federal contract supply chain oversight related to the prevention of trafficking in persons.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff52e93-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff52e94-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required under subsection (a) shall include an assessment of the following:</chapeau><paragraph class="fontsize10" id="y7ff52e95-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The compliance of Federal agencies with the requirement under section 1704(c)(1) of the National Defense Authorization Act for Fiscal Year 2013 (<ref href="/us/usc/t22/s7104b/c/1">22 U.S.C. 7104b(c)(1)</ref>) to refer to suspension and debarment officials allegations of trafficking in persons activities on the part of contract, grant, and cooperative agreement recipients.<page identifier="/us/stat/136/6217">136 STAT. 6217</page></content></paragraph>
<paragraph class="fontsize10" id="y7ff52e96-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The compliance of Federal agencies with the requirement to include the contract clause regarding combating trafficking in persons provided for under section 222.50 of the Federal Acquisition Regulation (or successor regulations).</content></paragraph>
<paragraph class="fontsize10" id="y7ff52e97-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Federal agency enforcement and monitoring activities related to ensuring the compliance of Federal contractors and subcontractors with the annual certification requirements under such section 222.50.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff52e98-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate Congressional Committees Defined</inline>.—</heading><chapeau>In this section, the term “<term>appropriate congressional committees</term>” means—</chapeau><paragraph class="fontsize10" id="y7ff52e99-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Armed Services, the Committee on Homeland Security and Governmental Affairs, and the Committee on Appropriations of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff52e9a-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s121/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Armed Services, the Committee on Oversight and Reform, and the Committee on Appropriations of the House of Representatives.</content></paragraph>

<section id="d69785e921" identifier="/us/pl/117/348/tI/stB/s122" style="-uslm-lc:I658143"><num class="fontsize12" value="122">SEC. 122. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff52e9b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t5/s4103">5 USC 4103 note</ref>.</p></sidenote><heading>ENSURING ANTI-TRAFFICKING-IN-PERSONS TRAININGS AND PROVISIONS INTO CODES OF CONDUCT OF ALL FEDERAL DEPARTMENTS AND EXECUTIVE AGENCIES.</heading><subsection class="firstIndent0 fontsize10" id="y7ff618fc-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds the following:</chapeau><paragraph class="fontsize10" id="y7ff618fd-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Human trafficking is inimical to every Federal agency’s core values and inherently harmful and dehumanizing.</content></paragraph>
<paragraph class="fontsize10" id="y7ff618fe-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Through the adoption of a Code of Conduct, Federal agencies hold their personnel to similar standards that are required of contractors and subcontractors of the agency under Federal law.</content></paragraph>
<paragraph class="fontsize10" id="y7ff618ff-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Human trafficking is a violation of human rights and against Federal law.</content></paragraph>
<paragraph class="fontsize10" id="y7ff61900-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The United States Government seeks to deter activities that would facilitate or support trafficking in persons.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff61901-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Sense of Congress on Implementation of Anti-trafficking-in-persons Policies</inline>.—</heading><chapeau>It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y7ff61902-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff61903-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>beginning not later than 18 months after the date of the enactment of this Act, the head of every Federal agency should incorporate a module on human trafficking into its staff training requirements and menu of topics to be covered in the annual ethics training of such agency;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61904-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>such staff trainings should teach employees how to prevent, identify, and report trafficking in persons;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61905-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Federal agencies that already provide counter trafficking-in-persons training for staff should share their curricula with agencies that do not have such curricula;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61906-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the head of each agency should inform all candidates for employment about the anti-trafficking provisions in the Code of Conduct of the agency;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61907-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>employees of each Federal agency should sign acknowledgment of the agency’s Code of Conduct, which should be kept in the file of the employee; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff61908-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>a violation of the Code of Conduct should lead to disciplinary action, up to and including termination of employment.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff61909-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff6190a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p><p class="leftAlign firstIndent0 fontsize8" id="x7ff6190b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirements.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Policy for Executive Branch Employees</inline>.—</heading><chapeau>The President shall take such steps as may be necessary to ensure that each officer and employee (including temporary employees, persons stationed abroad while working for the United States, and detailees from other agencies of the Federal Government) of an agency in <page identifier="/us/stat/136/6218">136 STAT. 6218</page>
the executive branch of the Federal Government is subject to a policy with a minimum standard that contains—</chapeau><paragraph class="fontsize10" id="y7ff6190c-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a prohibition from engaging in human trafficking while employed by the Government in a full-time or part-time capacity;</content></paragraph>
<paragraph class="fontsize10" id="y7ff6190d-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a requirement that all Federal personnel, without regard to whether the person is stationed abroad, be sensitized to human trafficking and the ethical conduct requirements that prohibit the procurement of trafficking in persons;</content></paragraph>
<paragraph class="fontsize10" id="y7ff6190e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a requirement that all such personnel be equipped with the necessary knowledge and tools to prevent, recognize, report, and address human trafficking offenses through a training for new personnel and through regular refresher courses offered every 2 years; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff6190f-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>a requirement that all such personnel report to the applicable inspector general and agency trafficking in persons point of contact any suspected cases of misconduct, waste, fraud, or abuse relating to trafficking in persons.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff61910-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Timing</inline>.—</heading><chapeau>The policy described in subsection (c)—</chapeau><paragraph class="fontsize10" id="y7ff61911-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>shall be established or integrated into all applicable employee codes of conduct not later than 18 months after the date of the enactment of this Act;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61912-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>may not replace any preexisting code of conduct that contains more robust requirements than the requirements described in subsection (c); and</content></paragraph>
<paragraph class="fontsize10" id="y7ff61913-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>shall be signed by all personnel described in subsection (c) not later than 2 years after such date of enactment.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff61914-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff61915-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><chapeau>The Office of Inspector General of a Federal department or agency, in consultation with the head of such agency, shall submit an annual report to Congress, which shall be publicly accessible, containing—</chapeau><paragraph class="fontsize10" id="y7ff61916-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the number of suspected violations reported;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61917-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the number of investigations;</content></paragraph>
<paragraph class="fontsize10" id="y7ff61918-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the status and outcomes of such investigations; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff61919-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s122/e/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff6191a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x7ff6191b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>any recommended actions to improve the programs and operations of such agency.</content></paragraph>

<section id="d69785e1103" identifier="/us/pl/117/348/tI/stB/s123" style="-uslm-lc:I658143"><num class="fontsize12" value="123">SEC. 123. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff6191c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><heading>GOVERNMENT ACCOUNTABILITY OFFICE STUDY ON ACCESSIBILITY OF MENTAL HEALTH SERVICES AND SUBSTANCE USE DISORDER SERVICES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7ff6402d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Not later than 3 years after the date of the enactment of this Act, the Comptroller General of the United States shall—</chapeau><paragraph class="fontsize10" id="y7ff6402e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s123/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>conduct a study of the accessibility of mental health services and substance use disorder treatment and recovery for survivors of human trafficking in the United States of various ages; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff6402f-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s123/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>submit a report to Congress containing the findings of such study and recommendations for increased accessibility and affordability for survivors of trafficking.</content></paragraph>

<section id="d69785e1123" identifier="/us/pl/117/348/tI/stB/s124" style="-uslm-lc:I658143"><num class="fontsize12" value="124">SEC. 124. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff64030-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1862w">42 USC 1862w</ref>.</p></sidenote><heading>NSF SUPPORT OF RESEARCH ON IMPACTS OF SOCIAL MEDIA ON HUMAN TRAFFICKING.</heading><subsection class="firstIndent0 fontsize10" id="y7ff70381-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y7ff70382-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Human trafficking</inline>.—</heading><content>The term “<term>human trafficking</term>” means an act or practice described in section 103(11) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7102/11">22 U.S.C. 7102(11)</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y7ff70383-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Social media platform</inline>.—</heading><chapeau>The term “<term>social media platform</term>” means a website or internet medium that—<page identifier="/us/stat/136/6219">136 STAT. 6219</page></chapeau><subparagraph class="fontsize10" id="y7ff70384-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>permits a person to become a registered user, establish an account, or create a profile for the purpose of allowing users to create, share, and view user-generated content through such an account or profile;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff70385-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>enables 1 or more users to generate content that can be viewed by other users of the medium; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff70386-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>primarily serves as a medium for users to interact with content generated by other users of the medium.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff70387-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Support of Research</inline>.—</heading><chapeau>The Director of the National Science Foundation, in consultation with the Attorney General, the Secretary of Homeland Security, and the Secretary of Health and Human Services, shall support merit-reviewed and competitively awarded research on the impact of online social media platforms on the maintenance or expansion of human trafficking, which may include—</chapeau><paragraph class="fontsize10" id="y7ff70388-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>fundamental research on digital forensic tools or other technologies for verifying the authenticity of social media platform users and their materials, that are utilized in the promotion or operation of human trafficking networks;</content></paragraph>
<paragraph class="fontsize10" id="y7ff70389-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>fundamental research on privacy preserving technical tools that may aid law enforcement’s ability to identify and prosecute individuals or entities promoting or involved in human trafficking;</content></paragraph>
<paragraph class="fontsize10" id="y7ff7038a-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>social and behavioral research related to social media platform users who engage with those promoting or involved in human trafficking;</content></paragraph>
<paragraph class="fontsize10" id="y7ff7038b-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>research on the effectiveness of expanding public understanding, awareness, or law enforcement efforts in combating human trafficking through social media platforms; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff7038c-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>research awards coordinated with other Federal agencies and programs, including the Information Integrity Research and Development Interagency Working Group and the Privacy Research and Development Interagency Working Group of the Networking and Information Technology Research and Development Program, the Office for Victims of Crime of the Department of Justice, the Blue Campaign of the Department of Homeland Security, the Office to Monitor and Combat Trafficking in Persons of the Department of State, and activities of the Department of Transportation and the Advisory Committee on Human Trafficking.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff7038d-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Survivors</inline>.—</heading><content>To the extent possible, the Director of the National Science Foundation shall ensure that research supported under subsection (b) incorporates the experiences, input, and safety and privacy concerns of human trafficking survivors.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff7038e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y7ff7038f-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Findings and recommendations</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, the Director of the National Science Foundation shall report to the Committee on Commerce, Science, and Transportation of the Senate, the Subcommittee on Commerce, Justice, Science, and Related Agencies of the Committee on Appropriations of the Senate, the Committee on Science, Space, and Technology of the House of Representatives, and the Subcommittee on Commerce, Justice, Science, and Related Agencies of the Committee on Appropriations of the House of Representatives—</chapeau><subparagraph class="fontsize10" id="y7ff70390-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Director’s findings with respect to the feasibility for research opportunities, including with the private sector <page identifier="/us/stat/136/6220">136 STAT. 6220</page>
social media platform companies, to improve the ability to combat human trafficking operations; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff70391-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stB/s124/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>any recommendations of the Director that could facilitate and improve communication and coordination among the private sector, the National Science Foundation, and relevant Federal agencies to improve the ability to combat human trafficking operations through social media.</content></subparagraph>
</paragraph>

<section id="d69785e1272" identifier="/us/pl/117/348/tI/stC/s131" style="-uslm-lc:I658143"><num class="fontsize12" value="131">SEC. 131. </num><heading>TRANSPARENCY IN ANTI-TRAFFICKING EXPENDITURES.</heading><subsection class="firstIndent0 fontsize10" id="y7ff751b3-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s131/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff751b4-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x7ff751b5-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="x7ff751b6-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 90 days after the date of the enactment of this Act, and not later than October 1 of each of the following 5 years, the head of each Federal department or agency to which amounts are appropriated for the purpose of awarding grants for anti-trafficking in persons, and the head of each Federal department and agency contributing to the annual congressional earmark for counter-trafficking in persons, shall publish on the public website of the department or agency, with respect to the prior fiscal year—</chapeau><paragraph class="fontsize10" id="y7ff751b7-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s131/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>each obligation or expenditure of Federal funds for the purpose of combating human trafficking and forced labor; and</content></paragraph>
<paragraph class="fontsize10" id="y7ff751b8-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s131/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>subject to subsection (b), and with respect to each such obligation or expenditure, the name of a primary recipient, and any subgrantees, and their project location, activity, award amounts, and award periods.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7ff751b9-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s131/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff751ba-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Exception for Security Concerns</inline>.—</heading><chapeau>If the head of a Federal department or agency determines that a primary recipient or subgrantee for purposes of subsection (a) has a security concern—</chapeau><paragraph class="fontsize10" id="y7ff751bb-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s131/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the award recipients shall not be publicly identified pursuant to subsection (a)(2); and</content></paragraph>
<paragraph class="fontsize10" id="y7ff751bc-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s131/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>only the activity, award amounts, and award periods shall be publicly listed pursuant to such subsection.</content></paragraph>

<section id="d69785e1325" identifier="/us/pl/117/348/tI/stC/s132" style="-uslm-lc:I658143"><num class="fontsize12" value="132">SEC. 132. </num><heading>SENSE OF CONGRESS REGARDING UNITED STATES COMPANIES ADOPTING COUNTER-TRAFFICKING-IN-PERSONS POLICIES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7ff8150d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y7ff8150e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff8150f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><chapeau>companies headquartered or doing business in the United States that are not small business concerns (as defined in section 3 of the Small Business Act (<ref href="/us/usc/t15/s632">15 U.S.C. 632</ref>)) should adopt a written policy not later than 18 months after the date of the enactment of this Act that—</chapeau><page identifier="/us/stat/136/6221">136 STAT. 6221</page>
<subparagraph class="fontsize10" id="y7ff81510-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>prohibits trafficking in persons;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81511-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is published annually; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81512-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>is accessible in a prominent place on their public website; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7ff81513-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>such policy should expressly prohibit the company, its employees, or agents from—</chapeau><subparagraph class="fontsize10" id="y7ff81514-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>engaging in human trafficking;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81515-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>using forced labor for the development, production, shipping, or sale of its goods or services;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81516-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>destroying, concealing, confiscating, or otherwise denying access by an employee to the employee’s identity or immigration documents, such as passports or drivers’ licenses, regardless of issuing authority;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81517-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>using misleading or fraudulent practices during the recruitment of employees or offering of employment, such as—</chapeau><clause class="fontsize10" id="y7ff81518-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>failing to disclose, in a format and language understood by the employee or potential employee, basic information; or</content></clause>
<clause class="fontsize10" id="y7ff81519-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>making material misrepresentations during the recruitment of employees regarding the key terms and conditions of employment, including—</chapeau><subclause class="fontsize10" id="y7ff8151a-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>wages and fringe benefits;</content></subclause>
<subclause class="fontsize10" id="y7ff8151b-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the location of work;</content></subclause>
<subclause class="fontsize10" id="y7ff8151c-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>the living conditions;</content></subclause>
<subclause class="fontsize10" id="y7ff8151d-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>housing and associated costs (if employer- or agent-provided or arranged);</content></subclause>
<subclause class="fontsize10" id="y7ff8151e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>any significant costs to be charged to the employee or potential employee; and</content></subclause>
<subclause class="fontsize10" id="y7ff8151f-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/D/ii/VI" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">(VI) </num><content>the hazardous nature of the work, if applicable;</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y7ff81520-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>using recruiters that do not comply with local labor laws of the country in which the recruiting takes place;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81521-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>providing or arranging housing that fails to meet the host country housing and safety standards; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff81522-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><chapeau>failing to provide an employment contract, recruitment agreement, or other required work document—</chapeau><clause class="fontsize10" id="y7ff81523-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/G/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>in writing—</chapeau><subclause class="fontsize10" id="y7ff81524-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/G/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>in a language the employee understands; or</content></subclause>
<subclause class="fontsize10" id="y7ff81525-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/G/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>along with an independent interpreter if the document cannot be provided in a language the employee understands;</content></subclause>
</clause>
<clause class="fontsize10" id="y7ff81526-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/G/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff81527-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>not later than 5 days before the employee relocates, if relocation is required to perform the work; and</content></clause>
<clause class="fontsize10" id="y7ff81528-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s132/2/G/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>that includes details about work description, wages, work locations, living accommodations and associated costs, time off, round-trip transportation arrangements, grievance processes, and the content of applicable laws and regulations that prohibit trafficking in persons.</content></clause>
</subparagraph>
</paragraph>
</section>
<section id="d69785e1472" identifier="/us/pl/117/348/tI/stC/s133" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="133">SEC. 133. </num><heading>AMENDMENTS TO THE CHILD ABUSE PREVENTION AND TREATMENT ACT.</heading><content style="-uslm-lc:I658120">  Section 111(b)(1) of the Child Abuse Prevention and Treatment Act (<ref href="/us/usc/t42/s5106g/b/1">42 U.S.C. 5106g(b)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>a victim of</quotedText>” <page identifier="/us/stat/136/6222">136 STAT. 6222</page>
and all that follows and <amendingAction type="insert">inserting</amendingAction> “<quotedText>a victim of ‘child abuse and neglect’ and of ‘sexual abuse’ if the child is identified, by a State or local agency employee of the State or locality involved, as being a victim of human trafficking.</quotedText>”.</content></section>
<section id="d69785e1494" identifier="/us/pl/117/348/tI/stC/s134" style="-uslm-lc:I658143"><num class="fontsize12" value="134">SEC. 134. </num><heading>SENSE OF CONGRESS REGARDING TIMELY SUBMISSION OF DEPARTMENT OF JUSTICE REPORTS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7ff83c39-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y7ff83c3a-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s134/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Department of Justice has failed to meet its reporting requirements under title IV of the Trafficking Victims Protection Act of 2017 (<ref href="/us/usc/t34/s10101/etseq">34 U.S.C. 10101 et seq.</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y7ff83c3b-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s134/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>progress on critical data collection about human trafficking and crime reporting are in jeopardy as a result of such failure and must be addressed immediately.</content></paragraph>
</section>
<section id="d69785e1516" identifier="/us/pl/117/348/tI/stC/s135" style="-uslm-lc:I658143"><num class="fontsize12" value="135">SEC. 135. </num><heading>SENSE OF CONGRESS ON CRITERIA FOR CLASSIFYING VICTIMS OF CHILD SEX TRAFFICKING.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7ff8634c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y7ff8634d-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s135/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>all States (including the District of Columbia) and territories should evaluate whether to eliminate the requirement for third-party control to properly qualify a child as a victim of sex trafficking, to—</chapeau><subparagraph class="fontsize10" id="y7ff8634e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s135/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>aid in the identification and prevention of child sex trafficking;</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff8634f-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s135/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>protect children; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff86350-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s135/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>appropriately prosecute perpetrators to the fullest extent of the law; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7ff86351-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s135/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a person is qualified as a victim of child sex trafficking if the person is a victim, as a child, of human trafficking.</content></paragraph>

<section id="d69785e1548" identifier="/us/pl/117/348/tI/stC/s136" style="-uslm-lc:I658143"><num class="fontsize12" value="136">SEC. 136. </num><heading>MISSING AND ABDUCTED FOSTER CHILDREN AND YOUTH.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x7ff8b172-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  It is the sense of Congress that—</chapeau><paragraph class="fontsize10" id="y7ff8b173-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>each State child welfare agency should—</chapeau><subparagraph class="fontsize10" id="y7ff8b174-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>prioritize developing and implementing protocols to comply with section 471(a)(35) of the Social Security Act (<ref href="/us/usc/t42/s671/a/35">42 U.S.C. 671(a)(35)</ref>), as amended by section 137; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff8b175-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>report the information the agency receives about missing or abducted foster children and youth to the National Center on Missing and Exploited Children and to law enforcement authorities for inclusion in the Federal Bureau of Investigation’s National Crime Information Center database, in accordance with section 471(a)(34) of the Social Security Act (<ref href="/us/usc/t42/s671/a/34">42 U.S.C. 671(a)(34)</ref>);</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7ff8b176-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>the reports described in paragraph (1)(B)—</chapeau><subparagraph class="fontsize10" id="y7ff8b177-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>should be made immediately (and in no case later than 24 hours) after the information is received; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7ff8b178-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>were required to be provided to the Secretary of Health and Human Services beginning on September 30, 2016; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7ff8b179-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s136/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>according to section 471(a)(34) of such Act, each State child welfare agency was required to submit annual reports to the Secretary of Health and Human Services beginning on September 30, 2017, to notify the Secretary of the total number of children and youth who are victims of human trafficking.<page identifier="/us/stat/136/6223">136 STAT. 6223</page></content></paragraph>
</section>
<section id="d69785e1601" identifier="/us/pl/117/348/tI/stC/s137" style="-uslm-lc:I658143"><num class="fontsize12" value="137">SEC. 137. </num><heading>MODIFICATION TO STATE PLAN FOR FOSTER CARE AND ADOPTION ASSISTANCE.</heading><subsection class="firstIndent0 fontsize10" id="y7ff8ff9a-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s137/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">State Plan Amendment</inline>.—</heading><content>Section 471(a)(35)(B) of the Social Security Act (<ref href="/us/usc/t42/s671/a/35/B">42 U.S.C. 671(a)(35)(B)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> the semicolon at the end and <amendingAction type="insert">inserting</amendingAction> the following: “(referred to in this subparagraph as <quotedContent>“NCMEC”), and that the State agency shall maintain regular communication with law enforcement agencies and NCMEC in efforts to provide a safe recovery of a missing or abducted child or youth, including by sharing information pertaining to the child’s or youth’s recovery and circumstances related to the recovery, and that the State report submitted to law enforcement agencies and NCMEC shall include where reasonably possible—<clause class="indentUp3 fontsize10" id="y7ff8ff9b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a photo of the missing or abducted child or youth;</content></clause>
<clause class="indentUp3 fontsize10" id="y7ff8ff9c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a description of the child’s or youth’s physical features, such as height, weight, sex, ethnicity, race, hair color, and eye color; and</content></clause>
<clause class="indentUp3 fontsize10" id="y7ff8ff9d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>endangerment information, such as the child’s or youth’s pregnancy status, prescription medications, suicidal tendencies, vulnerability to being sex trafficked, and other health or risk factors;”</content></clause>

<subsection class="firstIndent0 fontsize10" id="y7ff8ff9e-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s137/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff8ff9f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s671">42 USC 671 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><paragraph class="fontsize10" id="y7ff8ffa0-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s137/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), the amendment made by subsection (a) shall take effect on the date of enactment of this Act.</content></paragraph>
<paragraph class="fontsize10" id="y7ff926b1-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/348/tI/stC/s137/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff926b2-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Delay if state legislation required</inline>.—</heading><content>In the case of a State plan under part E of title IV of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirements imposed by the amendment made by subsection (a), the State plan shall not be regarded as failing to comply with the requirements of such part solely on the basis of the failure of the plan to meet such additional requirements before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of the session shall be deemed to be a separate regular session of the State legislature.</content></paragraph>

<section id="d69785e1782" identifier="/us/pl/117/348/tII/s202" style="-uslm-lc:I658143"><num class="fontsize12" value="202">SEC. 202. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7ff99bec-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Appropriation authorization.</p><p class="leftAlign firstIndent0 fontsize8" id="x7ff99bed-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading>IMPROVING ENFORCEMENT OF SECTION 307 OF THE TARIFF ACT OF 1930.</heading><content style="-uslm-lc:I658120">  There is authorized to be appropriated $20,000,000, for each of fiscal years 2023 through 2028, to the Commissioner of U.S. Customs and Border Protection to strengthen the enforcement of section 307 of the Tariff Act of 1930 (<ref href="/us/usc/t19/s1307">19 U.S.C. 1307</ref>).</content></section>
