<paragraph class="fontsize10" id="y878bef31-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Homeless youth</inline>.—</heading><content>The term “<term>homeless youth</term>” has the meaning given the term “<term>homeless children and youths</term>” in section 725 of the McKinney-Vento Homeless Assistance Act (<ref href="/us/usc/t42/s11434a">42 U.S.C. 11434a</ref>).</content></paragraph>

<title id="d48215e295" identifier="/us/pl/117/347/tI" style="-uslm-lc:I658178"><num value="I">TITLE I—</num><heading>GRANTS RELATING TO HUMAN TRAFFICKING PREVENTION AND ASSISTANCE FOR VICTIMS OF HUMAN TRAFFICKING</heading>
<section id="d48215e300" identifier="/us/pl/117/347/tI/s101" style="-uslm-lc:I658143"><num class="fontsize12" value="101">SEC. 101. </num><heading>GRANTS FOR SPECIALIZED HUMAN TRAFFICKING TRAINING AND TECHNICAL ASSISTANCE FOR SERVICE PROVIDERS.</heading><subsection class="firstIndent0 fontsize10" id="y878bef32-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tI/s101/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 111(c)(1) of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<ref href="/us/usc/t34/s20708/c/1">34 U.S.C. 20708(c)(1)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, which may include programs to build law enforcement capacity to identify and respond to human trafficking that are funded through the Office of Community Oriented Policing Services of the Department of Justice, such as the Interdiction for the Protection of Children Program</quotedText>” before the semicolon.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y878bef33-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tI/s101/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>Section 107(c)(4)(A) of the Victims of Trafficking and Violence Protection Act of 2000 (<ref href="/us/usc/t22/s7105/c/4/A">22 U.S.C. 7105(c)(4)(A)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>in order to fulfill the purposes described in section 111 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<ref href="/us/usc/t34/s20708">34 U.S.C. 20708</ref>)</quotedText>” before the period at the end.</content></subsection>

<section id="d48215e346" identifier="/us/pl/117/347/tI/s102" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="102">SEC. 102. </num><heading>TECHNICAL AND CLARIFYING UPDATE TO CIVIL REMEDY.</heading><content style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s1595/a">Section 1595(a) of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> “<quotedText>or attempts or conspires to benefit,</quotedText>” after “<quotedText>whoever knowingly benefits,</quotedText>”.</content></section>
<section id="d48215e362" identifier="/us/pl/117/347/tI/s103" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="103">SEC. 103. </num><heading>ENSURING PROTECTION AND CONFIDENTIALITY FOR SURVIVORS OF HUMAN TRAFFICKING.</heading><content class="firstIndent0 fontsize10" id="x878c3d54-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7101/etseq">22 U.S.C. 7101 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y878c6465-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="114">“SEC. 114. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x878c6466-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t22/s7115">22 USC 7115</ref>.</p></sidenote><heading class="fontsize12">ENSURING PROTECTION AND CONFIDENTIALITY FOR SURVIVORS OF HUMAN TRAFFICKING.</heading><subsection class="firstIndent0 fontsize10" id="y878c6467-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="y878c6468-e814-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the term ‘<term>covered grant</term>’ means a grant from the Attorney General or the Secretary of Health and Human Services under section 106(b), 107(b), or 107(f); and</content></paragraph>
<paragraph class="fontsize10" id="y878c6469-e814-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the term ‘<term>covered recipient</term>’ means a grantee or subgrantee receiving funds under a covered grant.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y878c646a-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Grant Conditions</inline>.—</heading><chapeau>Covered grants and covered recipients shall be subject, at the election of the Attorney General or the Secretary of Health and Human Services, as applicable, to—<page identifier="/us/stat/136/6201">136 STAT. 6201</page></chapeau><paragraph class="fontsize10" id="y878c646b-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the conditions under section 40002(b)(2) of the Violence Against Women Act of 1994 (<ref href="/us/usc/t34/s12291/b/2">34 U.S.C. 12291(b)(2)</ref>) that apply with respect to grants under such Act and grantees and subgrantees for such grants; or</content></paragraph>
<paragraph class="fontsize10" id="y878c646c-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the conditions under section 306(c)(5) of the Family Violence Prevention and Services Act (<ref href="/us/usc/t42/s10406/c/5">42 U.S.C. 10406(c)(5)</ref>) that apply with respect to grants under such Act and grantees and subgrantees for such grants.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y878c646d-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Department of Justice-sponsored Research</inline>.—</heading><chapeau>Nothing in this section shall be construed to prohibit a covered recipient from sharing personally identifying information with researchers seeking the information for the purposes of conducting research—</chapeau><paragraph class="fontsize10" id="y878c646e-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>that is funded by the Department of Justice;</content></paragraph>
<paragraph class="fontsize10" id="y878c646f-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>for which protections are in place in accordance with the requirements under <ref href="/us/cfr/t28/pt22">part 22 of title 28, Code of Federal Regulations</ref>, or any successor thereto, and section 812(a) of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10231/a">34 U.S.C. 10231(a)</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y878c6470-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>for which a current privacy certificate is on file documenting how the researchers intend to fulfill the obligations under such part 22.”</content></paragraph>

<section id="d48215e472" identifier="/us/pl/117/347/tI/s104" style="-uslm-lc:I658143"><num class="fontsize12" value="104">SEC. 104. </num><heading>GRANTS FOR STATE IMPROVEMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y878d00b1-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tI/s104/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Enhancing the Ability of State, Local, and Tribal Child Welfare Agencies to Identify and Respond to Children Who Are, or Are at Risk of Being, Victims of Trafficking</inline>.—</heading><paragraph class="fontsize10" id="y878d00b2-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tI/s104/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Title II of the Trafficking Victims Protection Reauthorization Act of 2005 (<ref href="/us/usc/t34/s20701/etseq">34 U.S.C. 20701 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after section 204 the following:<quotedContent><section class="indentUp1 firstIndent-2" id="y878d75e3-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658144"><num class="bold" value="204A">“SEC. 204A. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x878d75e4-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s20705a">34 USC 20705a</ref>.</p></sidenote><heading class="bold">ENHANCING THE ABILITY OF STATE, LOCAL, AND TRIBAL CHILD WELFARE AGENCIES TO IDENTIFY AND RESPOND TO CHILDREN WHO ARE, OR ARE AT RISK OF BEING, VICTIMS OF TRAFFICKING.</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="y878d75e5-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Grants To Enhance Child Welfare Services</inline>.—</heading><chapeau>The Secretary of Health and Human Services may make grants to eligible States to develop, improve, or expand programs that assist State, local, or Tribal child welfare agencies with identifying and responding to—</chapeau><paragraph class="fontsize10" id="y878d75e6-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>children considered victims of ‘child abuse and neglect’ and of ‘sexual abuse’ under the application of section 111(b)(1) of the Child Abuse Prevention and Treatment Act (<ref href="/us/usc/t42/s5106g/b/1">42 U.S.C. 5106g(b)(1)</ref>) because of being identified as being a victim or at risk of being a victim of a severe form of trafficking in persons; and</content></paragraph>
<paragraph class="fontsize10" id="y878d75e7-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>children over whom such agencies have responsibility for placement, care, or supervision and for whom there is reasonable cause to believe are, or are at risk of being a victim of 1 or more severe forms of trafficking in persons.</content></paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y878d75e8-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y878d75e9-e814-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Child</inline>.—</heading><content>The term ‘<term>child</term>’ means an individual who has not attained 18 years of age or such older age as the State has elected under section 475(8) of the Social Security Act (<ref href="/us/usc/t42/s675/8">42 U.S.C. 675(8)</ref>). At the option of an eligible State, such term may include an individual who has not attained 26 years of age.<page identifier="/us/stat/136/6202">136 STAT. 6202</page></content></paragraph>
<paragraph class="fontsize10" id="y878d75ea-e814-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Eligible state</inline>.—</heading><chapeau>The term ‘<term>eligible State</term>’ means a State that has not received more than 3 grants under this section and meets 1 or more of the following criteria:</chapeau><subparagraph class="fontsize10" id="y878d75eb-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Elimination of third party control requirement</inline>.—</heading><content>The State has eliminated or will eliminate any requirement relating to identification of a controlling third party who causes a child to engage in a commercial sex act in order for the child to be considered a victim of trafficking or a victim of 1 or more severe forms of trafficking in persons for purposes of accessing child welfare services and care.</content></subparagraph>
<subparagraph class="fontsize10" id="y878d75ec-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Application of standard for human trafficking</inline>.—</heading><content>The State considers a child to be a victim of trafficking if the individual is a victim of a severe form of trafficking in persons, as described in subparagraph (A) of section 103(11) of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7102/11">22 U.S.C. 7102(11)</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y878d75ed-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x878d75ee-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p><p class="leftAlign firstIndent0 fontsize8" id="x878d75ef-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirements.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Development and implementation of state child welfare plan protocols</inline>.—</heading><chapeau>The State agency responsible for administering the State plan for foster care and adoption assistance under part E of title IV of the Social Security Act (<ref href="/us/usc/t42/s670/etseq">42 U.S.C. 670 et seq.</ref>) has developed and is implementing or will develop and implement protocols that meet the following reporting requirements:</chapeau><clause class="fontsize10" id="y878d75f0-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>The requirement to report immediately, and in no case later than 24 hours after receiving, information on children who have been identified as being a victim of a severe form of trafficking in persons to law enforcement authorities under paragraph (34)(A) of section 471(a) of the Social Security Act (<ref href="/us/usc/t42/s671/a">42 U.S.C. 671(a)</ref>).</content></clause>
<clause class="fontsize10" id="y878d75f1-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>The requirement to report immediately, and in no case later than 24 hours after receiving, information on missing or abducted children to law enforcement authorities, including children classified as ‘runaways’, for entry into the National Crime Information Center (NCIC) database of the Federal Bureau of Investigation, and to the National Center for Missing and Exploited Children, under paragraph (35)(B) of such section.</content></clause>
<clause class="fontsize10" id="y878d75f2-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>The requirement to report to the Secretary of Health and Human Services the total number of children who are victims of child human trafficking under paragraph (34)(B) of such section.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y878d75f3-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Trafficking-specific protocol</inline>.—</heading><content>The State has developed and implemented or will develop and implement a specialized protocol for responding to a child who is, or is at risk of being, a trafficking victim to ensure the response focuses on the child’s specific safety needs as a victim of trafficking, and that includes the development and use of an alternative mechanism for investigating and responding to cases of child human trafficking in which the alleged offender is not the child’s parent or caregiver without utilizing existing processes for investigating and responding to other forms of child abuse or neglect that require the filing of an abuse or neglect petition.<page identifier="/us/stat/136/6203">136 STAT. 6203</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y878d75f4-e814-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe; tribal organization</inline>.—</heading><content>The term ‘<term>Indian tribe</term>’ and ‘tribal organization’ have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>).</content></paragraph>

<paragraph class="fontsize10" id="y878efbc1-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stA/s311/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>increase the number of Federal prosecutions of cybercrimes against individuals.</content></paragraph>

<section id="d48215e1249" identifier="/us/pl/117/347/tIII/stB/s321" style="-uslm-lc:I658143"><num class="fontsize12" value="321">SEC. 321. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x878efbc3-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s30110">34 USC 30110</ref>.</p></sidenote><heading>IMPROVED INVESTIGATIVE AND FORENSIC RESOURCES FOR ENFORCEMENT OF LAWS RELATED TO CYBERCRIMES AGAINST INDIVIDUALS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x878f49e4-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Subject to the availability of appropriations to carry out this section, the Attorney General, in consultation with the Director of the Federal Bureau of Investigation and the Secretary of Homeland Security, including the Executive Associate Director of Homeland Security Investigations, shall, with respect to cybercrimes against individuals—</chapeau><paragraph class="fontsize10" id="y878f49e5-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s321/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>ensure that there are not fewer than 10 additional operational agents of the Federal Bureau of Investigation designated to support the Criminal Division of the Department of Justice in the investigation and coordination of cybercrimes against individuals;</content></paragraph>
<paragraph class="fontsize10" id="y878f49e6-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s321/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>ensure that each office of a United States Attorney designates at least 1 Assistant United States Attorney as responsible for investigating and prosecuting cybercrimes against individuals; and</content></paragraph>
<paragraph class="fontsize10" id="y878f49e7-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s321/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>ensure the implementation of a regular and comprehensive training program—</chapeau><subparagraph class="fontsize10" id="y878f49e8-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s321/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the purpose of which is to train agents of the Federal Bureau of Investigation in the investigation and prosecution of such crimes and the enforcement of laws related to cybercrimes against individuals; and</content></subparagraph>
<subparagraph class="fontsize10" id="y878f49e9-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s321/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>that includes relevant forensic training related to investigating and prosecuting cybercrimes against individuals.</content></subparagraph>
</paragraph>

<section id="d48215e1286" identifier="/us/pl/117/347/tIII/stB/s322" style="-uslm-lc:I658143"><num class="fontsize12" value="322">SEC. 322. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x878f49ea-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s20101">34 USC 20101 note</ref>.</p></sidenote><heading>REPORT.</heading><subsection class="firstIndent0 fontsize10" id="y878f70fb-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s322/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 1 year after the date on which the National Academy of Sciences submits the report required under section 3(c) of the Better Cybercrime Metrics Act (<ref href="/us/usc/t34/s30109">34 U.S.C. 30109 note</ref>), and once each year thereafter, the Director of the Office for Victims of Crime shall submit a report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives that addresses, to the extent data are available, the nature, extent, and amount of funding under the Victims of Crime Act of 1984 (<ref href="/us/usc/t34/s20101/etseq">34 U.S.C. 20101 et seq.</ref>) for victims of cybercrimes against individuals.</content></subsection>

<section id="d48215e1512" identifier="/us/pl/117/347/tIII/stB/s324" style="-uslm-lc:I658143"><num class="fontsize12" value="324">SEC. 324. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x878fe63f-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s30111">34 USC 30111</ref>.</p></sidenote><heading>TRAINING AND TECHNICAL ASSISTANCE FOR STATES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x87900d50-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Attorney General, in consultation with the Secretary of Homeland Security, the Director of the United States Secret Service, the Executive Associate Director of Homeland Security Investigations, and nongovernmental and survivor stakeholders, shall create, compile, evaluate, and disseminate materials and information, and provide the necessary training and technical assistance, to assist States and units of local government in—</chapeau><paragraph class="fontsize10" id="y87900d51-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s324/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>investigating, prosecuting, pursuing, preventing, understanding, and mitigating the impact of—</chapeau><subparagraph class="fontsize10" id="y87900d52-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s324/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>physical, sexual, and psychological abuse of cybercrime victims, including victims of human trafficking that is facilitated by interactive computer services;</content></subparagraph>
<subparagraph class="fontsize10" id="y87900d53-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s324/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>exploitation of cybercrime victims; and</content></subparagraph>
<subparagraph class="fontsize10" id="y87900d54-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s324/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>deprioritization of cybercrime; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y87900d55-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIII/stB/s324/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>assessing, addressing, and mitigating the physical and psychological trauma to victims of cybercrime.</content></paragraph>

<title id="d48215e1551" identifier="/us/pl/117/347/tIV" style="-uslm-lc:I658178"><num value="IV">TITLE IV—</num><heading>OTHER FEDERAL IMPROVEMENTS RELATING TO HUMAN TRAFFICKING</heading>
<section id="d48215e1556" identifier="/us/pl/117/347/tIV/s401" style="-uslm-lc:I658143"><num class="fontsize12" value="401">SEC. 401. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87903466-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s1534">6 USC 1534</ref>.</p></sidenote><heading>CYBERCRIME.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x87903467-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Subject to the availability of appropriations, and in accordance with the comparable level of the General Schedule, the Attorney General and the Secretary of Homeland Security shall provide <page identifier="/us/stat/136/6208">136 STAT. 6208</page>
incentive pay, in an amount that is not more than 25 percent of the basic pay of the individual, to an individual appointed to a position in the Department of Justice (including the Federal Bureau of Investigation) or the Department of Homeland Security (including positions in Homeland Security Investigations), respectively, requiring significant cyber skills, including to aid in—</chapeau><paragraph class="fontsize10" id="y87903468-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s401/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the protection of trafficking victims;</content></paragraph>
<paragraph class="fontsize10" id="y87905b79-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s401/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the prevention of trafficking in persons; or</content></paragraph>
<paragraph class="fontsize10" id="y87905b7a-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s401/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the prosecution of technology-facilitated crimes against children by buyers or traffickers in persons.</content></paragraph>

<section id="d48215e1586" identifier="/us/pl/117/347/tIV/s402" style="-uslm-lc:I658143"><num class="fontsize12" value="402">SEC. 402. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87905b7b-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s20145">34 USC 20145</ref>.</p></sidenote><heading>ELIMINATION OF BARRIERS.</heading><subsection class="firstIndent0 fontsize10" id="y87905b7c-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s402/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Minors</inline>.—</heading><content>A Federal agency may not require a survivor of human trafficking who is less than 18 years of age or a homeless youth to obtain the consent or signature of the parent or guardian of the survivor or homeless youth to receive a copy of a Government-issued identity card issued to the survivor or homeless youth.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y87905b7d-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s402/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Fees</inline>.—</heading><content>A Federal agency may not charge a survivor of human trafficking or a homeless youth a fee to obtain a copy of a Government-issued identity card issued to the survivor or homeless youth.</content></subsection>

<section id="d48215e1614" identifier="/us/pl/117/347/tIV/s403" role="instruction" style="-uslm-lc:I658143"><num class="fontsize12" value="403">SEC. 403. </num><heading>TIP ORGANIZATIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x8790828e-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t28/s524/c/1">Section 524(c)(1) of title 28, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y8790828f-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s403/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subparagraph (H), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>

<paragraph class="fontsize10" id="y87919425-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s406/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x87919426-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Secretary of Homeland Security shall establish a team of not less than 10 agents within the Center for Countering Human Trafficking of the Department of Homeland Security to be assigned to exclusively investigate labor trafficking.</content></paragraph>
<paragraph class="fontsize10" id="y87919427-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/347/tIV/s406/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of appropriations</inline>.—</heading><content>There are authorized to be appropriated to carry out paragraph (1) $2,000,000 for each of fiscal years 2022 to 2027, to remain available until expended.</content></paragraph>
