<section id="d69909e88" identifier="/us/pl/117/345/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x96847bb4-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t16/s1241">16 USC 1241 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Butterfield Overland National Historic Trail Designation Act</shortTitle>”.</content></section>
<section id="d69909e103" identifier="/us/pl/117/345/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x96847bb5-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">State listing.</p></sidenote><heading>DESIGNATION OF THE BUTTERFIELD OVERLAND NATIONAL HISTORIC TRAIL.</heading><content class="firstIndent0 fontsize10" id="x9684a2c6-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Section 5(a) of the National Trails System Act (<ref href="/us/usc/t16/s1244/a">16 U.S.C. 1244(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="fontsize10" id="y9684f0e7-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="31">“(31) </num><heading class="fontsize10"><inline class="smallCaps">Butterfield overland national historic trail</inline>.—</heading><subparagraph class="fontsize10" id="y9684f0e8-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Butterfield Overland National Historic Trail, a trail of approximately 3,292 miles following the route operated by the Butterfield Overland Mail Company, known as the ‘Ox-Bow Route’, to transport mail and passengers between the eastern termini of St. Louis, Missouri, and Memphis, Tennessee, and extending westward through the States of Arkansas, Oklahoma, Texas, New Mexico, and Arizona, to the western terminus of San Francisco, California, as generally depicted on the maps numbered 1 through 15, entitled ‘Study Route Maps’, and contained in the report prepared by the National Park Service entitled ‘Butterfield Overland Trail National Historical Trail Special Resource Study’ and dated May 2018.</content></subparagraph>
<subparagraph class="fontsize10" id="y9684f0e9-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9684f0ea-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Maps</inline>.—</heading><content>The maps described in subparagraph (A) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</content></subparagraph>
<subparagraph class="fontsize10" id="y9684f0eb-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><content>The trail established by subparagraph (A) shall be administered by the Secretary of the Interior.</content></subparagraph>
<subparagraph class="fontsize10" id="y9684f0ec-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Land acquisition</inline>.—</heading><content>The United States shall not acquire for the trail established by subparagraph (A) any land or interest in land outside of the exterior boundary of any federally administered area without the consent of the owner of the land or interest in land.</content></subparagraph>
<subparagraph class="fontsize10" id="y9684f0ed-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">No buffer zone created</inline>.—</heading><clause class="fontsize10" id="y9684f0ee-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Nothing in this paragraph, the acquisition of land or an interest in land authorized by this paragraph, or any management plan for the Butterfield Overland National Historic Trail creates <page identifier="/us/stat/136/6197">136 STAT. 6197</page>
a buffer zone outside of the Butterfield Overland National Historic Trail.</content></clause>
<clause class="fontsize10" id="y9684f0ef-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Outside activities</inline>.—</heading><content>The fact that an activity or use on land outside the Butterfield Overland National Historic Trail can be seen, heard, or detected from land or an interest in land acquired for the Butterfield Overland National Historic Trail shall not preclude, limit, control, regulate, or determine the conduct or management of the activity or use.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9684f0f0-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><heading class="fontsize10"><inline class="smallCaps">Effect on energy development, production, or transmission</inline>.—</heading><content>Nothing in this paragraph, the acquisition of land or an interest in land authorized by this paragraph, or any management plan for the Butterfield Overland National Historic Trail shall prohibit, hinder, or disrupt the development, production, or transmission of energy.</content></subparagraph>
<subparagraph class="fontsize10" id="y9684f0f1-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><heading class="fontsize10"><inline class="smallCaps">No eminent domain or condemnation</inline>.—</heading><content>In carrying out this paragraph, the Secretary of the Interior may not use eminent domain or condemnation.”</content></subparagraph>
