<section id="d70173e88" identifier="/us/pl/117/341/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbac381cf-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1305">42 USC 1305 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Dr. Joanne Smith Memorial Rehabilitation Innovation Centers Act of 2022</shortTitle>”.</content></section>
<section id="d70173e103" identifier="/us/pl/117/341/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PRESERVING ACCESS TO REHABILITATION INNOVATION CENTERS UNDER MEDICARE.</heading><subsection class="firstIndent0 fontsize10" id="ybac3cef0-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/341/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 1886(j)(7)(E) of the Social Security Act (<ref href="/us/usc/t42/s1395ww/j/7/E">42 U.S.C. 1395ww(j)(7)(E)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ybac3f601-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/341/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText><headingText class="smallCaps">Public availability of data submitted</headingText>.—The</quotedText>” and <amendingAction type="insert">inserting</amendingAction> <quotedContent>“<headingText class="smallCaps">Public availability of data submitted</headingText>.—<clause class="indentUp2 fontsize10" id="ybac3f602-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The”</content></clause>

<paragraph class="fontsize10" id="ybac3f603-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/341/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after clause (i), as redesignated by paragraph (1), the following new clauses:<quotedContent><clause class="indentUp2 fontsize10" id="ybac44424-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Public recognition of rehabilitation innovation centers</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbac44425-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p><p class="leftAlign firstIndent0 fontsize8" id="xbac44426-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xbac44427-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="xbac44428-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Lists.</p><p class="leftAlign firstIndent0 fontsize8" id="xbac44429-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Updates.</p></sidenote>Beginning not later than 18 months after the date of the enactment of this clause, the Secretary shall make publicly available on such Internet website, in addition to the information required to be reported on such website under clause (i), a list of all rehabilitation innovation centers, and shall update such list on such website not less frequently than biennially.</content></clause>
<clause class="indentUp2 fontsize10" id="ybac4442a-e814-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Rehabilitation innovation centers defined</inline>.—</heading><content>For purposes of clause (ii), the term ‘<term>rehabilitation innovation centers</term>’ means a rehabilitation facility that, as of the applicable date (as defined in clause (v)), is a rehabilitation facility described in clause (iv).</content></clause>
<clause class="indentUp2 fontsize10" id="ybac4442b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Rehabilitation facility described</inline>.—</heading><subclause class="fontsize10" id="ybac4442c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subject to subclause (II), a rehabilitation facility described in this clause is a rehabilitation facility that—</chapeau><item class="fontsize10" id="ybac4442d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>is classified as a rehabilitation facility under the IRF Rate Setting File for the Inpatient Rehabilitation Facility Prospective Payment System for Federal Fiscal Year 2019 (<ref href="/us/fr/83/38514">83 Fed. Reg. 38514</ref>), or any successor regulations that contain such information;<page identifier="/us/stat/136/6180">136 STAT. 6180</page></content></item>
<item class="fontsize10" id="ybac4442e-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>holds at least one Federal rehabilitation research and training designation for research projects on traumatic brain injury or spinal cord injury from the National Institute on Disability, Independent Living, and Rehabilitation Research at the Department of Health and Human Services, based on such data submitted to the Secretary by a facility, in a form, manner, and time frame specified by the Secretary;</content></item>
<item class="fontsize10" id="ybac4442f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>submits to the Secretary a description of the clinical research enterprise of the facility and a summary of research activities of the facility that are supported by Federal agencies;</content></item>
<item class="fontsize10" id="ybac44430-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">“(dd) </num><content>has a minimum Medicare estimated average weight per discharge of 1.20 for the most recent fiscal year for which such information is available according to the IRF Rate Setting File described in item (aa), or any successor regulations that contain such information; and</content></item>
<item class="fontsize10" id="ybac44431-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="ee">“(ee) </num><content>has a minimum teaching status of 0.075 for the most recent fiscal year for which such information is available according to the IRF Rate Setting File described in item (aa), or any successor regulations that contain such information.</content></item>
</subclause>
<subclause class="fontsize10" id="ybac44432-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.—</heading><content>The Secretary may, as determined appropriate, waive any of the requirements under items (aa) through (ee) of subclause (I).</content></subclause>

<clause class="indentUp2 fontsize10" id="ybac44433-e814-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><heading class="fontsize10"><inline class="smallCaps">Applicable date defined</inline>.—</heading><chapeau>For purposes of clauses (iii) and (iv), the term ‘<term>applicable date</term>’ means—</chapeau><subclause class="fontsize10" id="ybac44434-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>with respect to the initial publication of a list under clause (ii), the date of the enactment of such clause; and</content></subclause>
<subclause class="fontsize10" id="ybac44435-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>with respect to the publication of an updated list under clause (ii), a date specified by the Secretary that is not more than one year prior to the date of such publication.</content></subclause>
</clause>
<clause class="indentUp2 fontsize10" id="ybac44436-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>Notwithstanding any other provision of law the Secretary may implement clauses (ii) through (v) by program instruction or otherwise.</content></clause>
<clause class="indentUp2 fontsize10" id="ybac44437-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><heading class="fontsize10"><inline class="smallCaps">Nonapplication of paperwork reduction act</inline>.—</heading><content><ref href="/us/usc/t44/ch35">Chapter 35 of title 44, United States Code</ref>, shall not apply to data collected under clauses (ii) through (v).”</content></clause>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ybac44438-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/341/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 3 years after the date of the enactment of this Act, the Secretary of Health and Human Services—</chapeau><paragraph class="fontsize10" id="ybac44439-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/341/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbac4443a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xbac4443b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>shall submit to Congress a report containing any recommendations on action as the Secretary determines appropriate to preserve access to rehabilitation innovation centers (as defined in section 1886(j)(7)(E)(iii) of the Social Security Act, as added by subsection (a)); and<page identifier="/us/stat/136/6181">136 STAT. 6181</page></content></paragraph>
<paragraph class="fontsize10" id="ybac4443c-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/341/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>may, in the report described in paragraph (1), as permitted by law, disseminate research, best practices, and other clinical information identified or developed by such rehabilitation innovation centers, as determined appropriate by the Secretary.</content></paragraph>
