<section id="d48945e88" identifier="/us/pl/117/340/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbc2b9d3c-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s101">36 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Equal Pay for Team USA Act of 2022</shortTitle>”.</content></section>
<section id="d48945e103" identifier="/us/pl/117/340/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>MODIFICATIONS TO UNITED STATES OLYMPIC AND PARALYMPIC COMMITTEE AND NATIONAL GOVERNING BODIES.</heading><subsection class="firstIndent0 fontsize10" id="ybc2cfccd-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">United States Olympic and Paralympic Committee</inline>.—</heading><paragraph class="fontsize10" id="ybc2cfcce-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau><ref href="/us/usc/t36/s220505/d">Section 220505(d) of title 36, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="ybc2cfccf-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>in paragraph (1)—</chapeau><clause class="fontsize10" id="ybc2cfcd0-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>in subparagraph (B)(ii), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></clause>
<clause class="fontsize10" id="ybc2cfcd1-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>in subparagraph (C), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></clause>
<clause class="fontsize10" id="ybc2cfcd2-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="indentDown1 fontsize10" id="ybc2d23e3-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><chapeau>with respect to a sport for which the corporation conducts separate programs for female and male athletes, to ensure that female and male athletes who represent the United States in international amateur athletic events receive, from funds directly provided by the corporation to the athlete (excluding any prize or award based on the athlete’s performance in an international amateur athletic competition), equivalent and nondiscriminatory compensation, wages, benefits, medical care, travel arrangements, and payment or reimbursement for expenses, all insofar as these are implemented in connection with such amateur athletic events, where ‘equivalent’ means ‘equal’ except that it shall be permissible—</chapeau><clause class="fontsize10" id="ybc2d23e4-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>to consider merit, performance, seniority, or quantity of play in determining contract or other terms of participation; and</content></clause>
<clause class="fontsize10" id="ybc2d23e5-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to provide more beneficial terms of participation to athletes representing the United States in international events to address disparities in outside income, including in compensation made available by international sports federations and other event organizers, or the need to foster underdeveloped programs <page identifier="/us/stat/136/6176">136 STAT. 6176</page>
or address documented and justifiable personal need on the part of specific athletes or teams.”</content></clause>
</subparagraph>

<subparagraph class="fontsize10" id="ybc2d23e6-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (2) as paragraph (3); and</content></subparagraph>
<subparagraph class="fontsize10" id="ybc2d23e7-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (1) the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="ybc2d23e8-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Advocacy</inline>.—</heading><content>The corporation shall take all reasonable steps, in collaboration with affected athletes, to advocate to international sports federations and other event organizers to equalize prizes, compensation, funding, and other support provided to athletes by such federations and organizers.”</content></paragraph>

<paragraph class="fontsize10" id="ybc2d23e9-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Annual report on equal treatment of athletes</inline>.—</heading><subparagraph class="fontsize10" id="ybc2d23ea-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/a/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subchapter I of <ref href="/us/usc/t36">title 36, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="ybc2d23eb-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658166"><num class="fontsize12" value="220514">“§ 220514.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbc2d23ec-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s220514">36 USC 220514</ref>.</p></sidenote> Annual report on equal treatment of athletes</heading><subsection class="indentDown2 firstIndent0 fontsize10" id="ybc2d23ed-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not less frequently than annually, the corporation shall submit to Congress a report on the compliance of the corporation with paragraphs (1)(D) and (2) of section 220505(d).</content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ybc2d4afe-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Matters To Be Included</inline>.—</heading><content>Each report required by subsection (a) shall include detailed information on the median, minimum, and maximum stipends and bonuses provided to athletes, disaggregated by gender, race, and, as applicable, status of participation on a professional sports team.”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="ybc2d4b02-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">National Governing Bodies</inline>.—</heading><paragraph class="fontsize10" id="ybc2d4b03-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Duties</inline>.—</heading><chapeau><ref href="/us/usc/t36/s220524/a">Section 220524(a) of title 36, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="ybc2d4b04-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraphs (7) through (14) as paragraphs (9) through (16), respectively; and</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ybc2d7123-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbc2d7124-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s220505">36 USC 220505 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation Period and Reports to Congress</inline>.—</heading><chapeau>Not later than 1 year after the date of the enactment of this Act—</chapeau><paragraph class="fontsize10" id="ybc2d7125-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the corporation shall—</chapeau><subparagraph class="fontsize10" id="ybc2d7126-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>attain full compliance, and require as a condition of continued certification that each national governing body attains and maintains full compliance, with the applicable amendments made by this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="ybc2d7127-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>submit to Congress a report describing such compliance of the corporation and each national governing body; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ybc2d7128-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>each national governing body shall—</chapeau><subparagraph class="fontsize10" id="ybc2d7129-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>attain full compliance with the applicable amendments made by this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="ybc2d712a-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>submit to Congress a report describing such compliance.</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="ybc2d712b-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xbc2d712c-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t36/s220505">36 USC 220505 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><chapeau>Nothing in this Act shall be construed—</chapeau><paragraph class="fontsize10" id="ybc2d712d-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to supersede, nullify, or diminish the rights of any individual under any Federal law or the law of any State or political subdivision of any State or jurisdiction;</content></paragraph>
<paragraph class="fontsize10" id="ybc2d712e-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to prohibit an individual athlete or a group of athletes from receiving compensation from an individual or entity other than a national governing body or the corporation for the use of, as applicable, the name, image, or likeness of the individual athlete or the names, images, or likenesses of the group of athletes; or</content></paragraph>
<paragraph class="fontsize10" id="ybc2d712f-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/340/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to prohibit a team or group of athletes from accepting outside sponsorships or endorsements, or from participating in outside promotional events or marketing campaigns, even if a team or group of athletes of another gender are not offered <page identifier="/us/stat/136/6178">136 STAT. 6178</page>
equivalent sponsorships, endorsements, or participation in outside promotional events or marketing campaigns.</content></paragraph>
