<section id="d70363e90" identifier="/us/pl/117/337/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd411ed89-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s2901">25 USC 2901 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Durbin Feeling Native American Languages Act of 2022</shortTitle>”.</content></section>
<section id="d70363e105" identifier="/us/pl/117/337/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ENSURING THE SURVIVAL AND CONTINUING VITALITY OF NATIVE AMERICAN LANGUAGES.</heading><subsection class="firstIndent0 fontsize10" id="yd41262ba-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/337/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 106 of the Native American Languages Act (<ref href="/us/usc/t25/s2905">25 U.S.C. 2905</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="yd41289cb-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd41289cc-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><inline class="smallCaps">Evaluation; Report</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this subsection, the President shall—</chapeau><paragraph class="fontsize10" id="yd41289cd-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd41289ce-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirements.</p></sidenote><content>require the heads of the various Federal departments, agencies, and instrumentalities to carry out an evaluation described in subsection (a)(1); and</content></paragraph>
<paragraph class="fontsize10" id="yd41289cf-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>submit to Congress a report that describes—</chapeau><subparagraph class="fontsize10" id="yd41289d0-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the results of the evaluations; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd41289d1-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the recommendations of the Secretary of the Interior, the Secretary of Health and Human Services, and the Secretary of Education, after consultation with Indian tribes, traditional leaders, and representatives of Native American language communities, for amendments to Federal laws that are needed—</chapeau><clause class="fontsize10" id="yd41289d2-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>to bring the Federal laws into compliance with this Act;</content></clause>
<clause class="fontsize10" id="yd41289d3-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to improve interagency coordination for purposes of supporting revitalization, maintenance, and use of Native American languages; and</content></clause>
<clause class="fontsize10" id="yd412b0e4-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>to reduce duplication, inefficiencies, and barriers Native American language communities face in accessing Federal programs to support efforts to revitalize, maintain, or increase the use of Native American languages.”</content></clause>
</subparagraph>
</paragraph>
</subsection>

<subsection class="firstIndent0 fontsize10" id="yd412b0e5-e814-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/337/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Survey on Native American Languages</inline>.—</heading><content>The Native American Languages Act (<ref href="/us/usc/t25/s2901/etseq">25 U.S.C. 2901 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="yd4137436-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="108">“SEC. 108. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4137437-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s2907">25 USC 2907</ref>.</p></sidenote><heading class="fontsize12">SURVEY ON NATIVE AMERICAN LANGUAGES.</heading><subsection class="firstIndent0 fontsize10" id="yd4137438-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4137439-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 18 months after the date of enactment of this section, and every 5 years thereafter, the <page identifier="/us/stat/136/6154">136 STAT. 6154</page>
Secretary of Health and Human Services, acting through the Commissioner of the Administration for Native Americans (referred to in this section as the ‘Secretary’), shall undertake a survey of the use of all Native American languages in the United States.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd413743a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Updates</inline>.—</heading><content>Prior to conducting each subsequent survey after the initial survey under subsection (a), the Secretary shall update the survey in accordance with this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd413743b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Consultation Required</inline>.—</heading><chapeau>The Secretary shall design the initial survey under subsection (a) and each updated survey under subsection (b)—</chapeau><paragraph class="fontsize10" id="yd413743c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>in consultation with Indian tribes; and</content></paragraph>
<paragraph class="fontsize10" id="yd413743d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>after considering feedback received from Native American language speakers and experts.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd413743e-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each survey under subsection (a) shall solicit—</chapeau><paragraph class="fontsize10" id="yd413743f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>information on which Native American languages are currently spoken;</content></paragraph>
<paragraph class="fontsize10" id="yd4137440-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>estimates of the number of speakers of each Native American language;</content></paragraph>
<paragraph class="fontsize10" id="yd4137441-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>any language usage statistics or information that the Secretary, in consultation with Indian tribes and Native American language speakers and experts, determines to be relevant and appropriate;</content></paragraph>
<paragraph class="fontsize10" id="yd4137442-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>information on the types of Native American language maintenance and revitalization projects and practices that are currently being carried out;</content></paragraph>
<paragraph class="fontsize10" id="yd4137443-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>information on any unmet Native American language resource needs of Indian tribes and Native American language communities; and</content></paragraph>
<paragraph class="fontsize10" id="yd4137444-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>any other information that the Secretary, in consultation with Indian tribes and Native American language speakers and experts, determines to be necessary.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd4137445-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4137446-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><content>The Secretary may coordinate, and enter into cooperative agreements with, the Director of the Bureau of the Census for the purposes of carrying out this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd4137447-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Outreach and Engagement</inline>.—</heading><paragraph class="fontsize10" id="yd4137448-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall carry out outreach and engagement activities to provide Indian tribes, Native American language communities, and the public information about—</chapeau><subparagraph class="fontsize10" id="yd4137449-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>opportunities to provide input on the development and design of each survey under subsection (a), including information on the consultations required under subsection (c);</content></subparagraph>
<subparagraph class="fontsize10" id="yd413744a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the goals and purpose of the surveys conducted under subsection (a); and</content></subparagraph>
<subparagraph class="fontsize10" id="yd413744b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the benefits and importance of participation in surveys under subsection (a).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd413744c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Grants, contracts, and cooperative agreements authorized</inline>.—</heading><chapeau>The Secretary may carry out the outreach and engagement activities required under paragraph (1)—</chapeau><subparagraph class="fontsize10" id="yd413744d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>directly;</content></subparagraph>
<subparagraph class="fontsize10" id="yd413744e-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>in partnership with the Bureau of the Census; or</content></subparagraph>
<subparagraph class="fontsize10" id="yd413744f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>through grants to, or contracts or cooperative agreements with—</chapeau><clause class="fontsize10" id="yd4137450-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>Indian tribes;<page identifier="/us/stat/136/6155">136 STAT. 6155</page></content></clause>
<clause class="fontsize10" id="yd4137451-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>tribal organizations; and</content></clause>
<clause class="fontsize10" id="yd4137452-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>nonprofit organizations that work with Indian tribes, Native American language programs, and Native American language communities.</content></clause>
</subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd4137453-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><chapeau>Nothing in this section requires an Indian tribe, Native American language community, or Native American language speaker—</chapeau><paragraph class="fontsize10" id="yd4137454-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>to participate in a survey under subsection (a); or</content></paragraph>
<paragraph class="fontsize10" id="yd4137455-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>to provide specific or culturally sensitive information in completing such a survey.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd4137456-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Availability of Survey Materials and Findings</inline>.—</heading><paragraph class="fontsize10" id="yd4137457-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd4137458-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xd4137459-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote>—</heading><chapeau>Not later than 1 year after the date of enactment of this section, and prior to conducting each survey under subsection (a), the Secretary shall submit to the Committee on Indian Affairs of the Senate and the Committees on Education and Labor and Natural Resources of the House of Representatives, and make publicly available, a description of—</chapeau><subparagraph class="fontsize10" id="yd413745a-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the feedback received under subsection (c) on the design of the survey;</content></subparagraph>
<subparagraph class="fontsize10" id="yd413745b-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the form and content of the survey;</content></subparagraph>
<subparagraph class="fontsize10" id="yd413745c-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the plan for deploying the survey to ensure a robust response; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd413745d-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>how the Secretary will ensure any survey enumeration efforts are culturally informed and appropriate.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd413745e-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd413745f-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xd4137460-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Results</inline>.—</heading><content>Not later than 90 days after the date on which analysis of each survey under subsection (a) is completed, the Secretary shall submit to the Committee on Indian Affairs of the Senate and the Committees on Education and Labor and Natural Resources of the House of Representatives, and make publicly available, the results of the survey.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yd4137461-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><chapeau>There is authorized to be appropriated to carry out this section $1,500,000 for each fiscal year—</chapeau><paragraph class="fontsize10" id="yd4137462-e814-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>preceding a fiscal year during which a survey under subsection (a) is conducted; and</content></paragraph>
