<section id="d50785e92" identifier="/us/pl/117/332/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Hazard Eligibility and Local Projects Act</shortTitle>”.</content></section>
<section id="d50785e102" identifier="/us/pl/117/332/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AUTHORITY TO BEGIN IMPLEMENTATION OF ACQUISITION AND DEMOLITION ASSISTANCE PROJECTS.</heading><subsection class="firstIndent0 fontsize10" id="yff399948-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yff399949-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term “<term>Administrator</term>” means the Administrator of the Federal Emergency Management Agency.</content></paragraph>
<paragraph class="fontsize10" id="yff39994a-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Covered project</inline>.—</heading><chapeau>The term “<term>covered project</term>” means a project that—</chapeau><subparagraph class="fontsize10" id="yff39994b-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is an acquisition and demolition project for which an entity began implementation, including planning or construction, before or after requesting assistance for the project under a hazard mitigation assistance program; and</content></subparagraph>
<subparagraph class="fontsize10" id="yff39994c-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>qualifies for a categorical exclusion under the National Environmental Policy Act of 1969 ( <ref href="/us/usc/t42/s4321/etseq">42 U.S.C. 4321 et seq.</ref>).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yff39994d-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Hazard mitigation assistance program</inline>.—</heading><chapeau>The term “<term>hazard mitigation assistance program</term>” means—</chapeau><subparagraph class="fontsize10" id="yff39994e-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any grant program authorized under section 203 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5133">42 U.S.C. 5133</ref>);</content></subparagraph>
<subparagraph class="fontsize10" id="yff39994f-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the hazard mitigation grant program authorized under section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5170c">42 U.S.C. 5170c</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="yff399950-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the flood mitigation assistance program authorized under section 1366 of the National Flood Insurance Act of 1968 (<ref href="/us/usc/t42/s4104c">42 U.S.C. 4104c</ref>).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yff399951-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility for Assistance for Covered Projects</inline>.—</heading><paragraph class="fontsize10" id="yff399952-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>An entity seeking assistance under a hazard mitigation assistance program may be eligible to receive that assistance for a covered project if—</chapeau><subparagraph class="fontsize10" id="yff399953-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>the entity—</chapeau><clause class="fontsize10" id="yff399954-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>complies with all other eligibility requirements of the hazard mitigation assistance program for acquisition or demolition projects, including extinguishing all incompatible encumbrances; and<page identifier="/us/stat/136/6120">136 STAT. 6120</page></content></clause>
<clause class="fontsize10" id="yff399955-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>complies with all Federal requirements for the covered project; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yff399956-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xff399957-e814-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><chapeau>the Administrator determines that the covered project—</chapeau><clause class="fontsize10" id="yff399958-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>qualifies for a categorical exclusion under the National Environmental Policy Act of 1969 (<ref href="/us/usc/t42/s4321/etseq">42 U.S.C. 4321 et seq.</ref>);</content></clause>
<clause class="fontsize10" id="yff399959-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>is compliant with applicable floodplain management and protection of wetland regulations and criteria; and</content></clause>
<clause class="fontsize10" id="yff39995a-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>does not require consultation under any other environmental or historic preservation law or regulation or involve any extraordinary circumstances.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yff39995b-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Costs incurred</inline>.—</heading><content>An entity seeking assistance under a hazard mitigation assistance program shall be responsible for any project costs incurred by the entity for a covered project if the covered project is not awarded, or is determined to be ineligible for, assistance.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yff39995c-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>This Act shall apply to covered projects started on or after the date of enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yff39995d-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, and annually thereafter for 3 years, the Administrator shall submit to Congress a report on use of the authority under this Act, including—</chapeau><paragraph class="fontsize10" id="yff39995e-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>how many applicants used the authority;</content></paragraph>
<paragraph class="fontsize10" id="yff39995f-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>how many applicants using the authority successfully obtained a grant;</content></paragraph>
<paragraph class="fontsize10" id="yff399960-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>how many applicants were not able to successfully obtain a grant;</content></paragraph>
<paragraph class="fontsize10" id="yff399961-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/d/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the reasons applicants were not able to obtain a grant; and</content></paragraph>
<paragraph class="fontsize10" id="yff399962-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/d/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the extent to which applicants using the authority were able to comply with all necessary Federal environmental, historic preservation, and other related laws and regulations.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yff399963-e814-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/332/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>The authority provided under this Act shall cease to be effective on the date that is 3 years after the date of enactment of this Act.</content></subsection>
