<section id="d92271e93" identifier="/us/pl/117/324/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Preventing Organizational Conflicts of Interest in Federal Acquisition Act</shortTitle>”.</content></section>
<section id="d92271e103" identifier="/us/pl/117/324/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>PREVENTING ORGANIZATIONAL CONFLICTS OF INTEREST IN FEDERAL ACQUISITION.</heading><subsection class="firstIndent0 fontsize10" id="y67ab929a-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x67ab929b-e815-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>—</heading><chapeau>Not later than 18 months after the date of the enactment of this Act, the Federal Acquisition Regulatory Council shall revise the Federal Acquisition Regulation—</chapeau><paragraph class="fontsize10" id="y67ab929c-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x67ab929d-e815-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Updates.</p></sidenote><chapeau>to provide and update—</chapeau><subparagraph class="fontsize10" id="y67ab929e-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>definitions related to specific types of organizational conflicts of interest, including unequal access to information, impaired objectivity, and biased ground rules;</content></subparagraph>
<subparagraph class="fontsize10" id="y67ab929f-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>definitions, guidance, and illustrative examples related to relationships of contractors with public, private, domestic, and foreign entities that may cause contract support to be subject to potential organizational conflicts of interest, including undue influence; and</content></subparagraph>
<subparagraph class="fontsize10" id="y67ab92a0-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>illustrative examples of situations related to the potential organizational conflicts of interest identified under this paragraph, including an example of the awarding by a Federal regulatory agency of a contract for consulting services to a contractor if employees of the contractor performing work under such contract are permitted by the contractor to simultaneously perform work under a contract for a private sector client under the regulatory purview of such agency;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y67ab92a1-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to provide executive agencies with solicitation provisions and contract clauses to avoid or mitigate organizational conflicts of interest, for agency use as needed, that require contractors to disclose information relevant to potential organizational conflicts of interest and limit future contracting with respect to potential conflicts of interest with the work to be performed under awarded contracts;</content></paragraph>
<paragraph class="fontsize10" id="y67ab92a2-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to allow executive agencies to tailor such solicitation provisions and contract clauses as necessary to address risks associated with conflicts of interest and other considerations that may be unique to the executive agency;</content></paragraph>
<paragraph class="fontsize10" id="y67ab92a3-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x67ab92a4-e815-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirements.</p><p class="leftAlign firstIndent0 fontsize8" id="x67ab92a5-e815-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote><chapeau>to require executive agencies—</chapeau><page identifier="/us/stat/136/4440">136 STAT. 4440</page>
<subparagraph class="fontsize10" id="y67ab92a6-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to establish or update as needed agency conflict of interest procedures to implement the revisions to the Federal Acquisition Regulation made under this section; and</content></subparagraph>
<subparagraph class="fontsize10" id="y67ab92a7-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to periodically assess and update such procedures as needed to address agency-specific conflict of interest issues; and</content></subparagraph>

<paragraph class="fontsize10" id="y67ab92a8-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/a/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x67ab92a9-e815-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Update.</p><p class="leftAlign firstIndent0 fontsize8" id="x67ab92aa-e815-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Procedures.</p></sidenote><content>to update the procedures set forth in section 9.506 of the Federal Acquisition Regulation to permit contracting officers to take into consideration professional standards and procedures to prevent organizational conflicts of interest to which an offeror or contractor is subject.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y67ab92ab-e815-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/324/s2/b" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Executive Agency Defined</inline>.—</heading><content>In this section, the term “<term>executive agency</term>” has the meaning given the term in <ref href="/us/usc/t41/s133">section 133 of title 41, United States Code</ref>.</content></subsection>
