<section><heading class="varAlign fontsize10 smallCaps" style="-uslm-lc:I658174">wellness program</heading><num style="-uslm-lc:I658120 -uslm-lc:emspace2" value="301"><inline class="smallCaps">Sec. 301.</inline> </num><subsection class="inline" id="yd88509b3-e815-11f0-a1e4-69761a48a15a"><num value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd88509b4-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1901">2 USC 1901 note</ref>.</p></sidenote><heading class="smallCaps">Application of Law<inline class="noSmallCaps">.—</inline></heading><content>The wellness program of the United States Capitol Police shall be known and designated as the “Howard C. Liebengood Center for Wellness”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd88509b5-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>This section shall apply with respect to fiscal year 2021 and each succeeding fiscal year.</content></subsection>

<section><heading class="varAlign fontsize10 smallCaps" style="-uslm-lc:I658174">capitol police salary cap adjustment</heading><num style="-uslm-lc:I658120 -uslm-lc:emspace2" value="302"><inline class="smallCaps">Sec. 302. </inline> </num><content class="inline">For the purposes of administering pay during calendar year 2021, the maximum annual payable rate for any member or civilian employee of the Capitol Police whose compensation includes overtime pay under the Fair Labor Standards Act of 1938 (<ref href="/us/usc/t29/s201/etseq">29 U.S.C. 201 et seq.</ref>) shall be set at Executive Schedule II at $199,300. Excluded from this limitation for calendar year 2021 shall be retention bonuses and hazard bonuses related to the events of January 6th.</content></section>

<content style="-uslm-lc:I658120">  For an additional amount for “Capital Construction and Operations”, $21,869,069, to remain available until September 30, 2022, to prevent, prepare for, and respond to coronavirus, for necessary expenses of the Architect of the Capitol to supplement the funding made available in <ref href="/us/pl/116/136">Public Law 116–136</ref>, as amended by <ref href="/us/pl/116/159/s159/3">section 159(3) of Public Law 116–159</ref>, and for the same purposes; and for related purchases for Congressional offices, including in Congressional Districts and State Offices, wherever located: <proviso><i> Provided</i>, That any funds transferred by the Architect to restore amounts, either directly or through reimbursement, for obligations incurred for the purposes provided herein prior to the date of enactment of this Act shall be merged with and made available for the same purposes, and period of availability, as the appropriations to which the funds are transferred: </proviso><proviso><i> Provided further</i>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</proviso></content></appropriations>

<content style="-uslm-lc:I658120">  For an additional amount for “Capitol Police Buildings, Grounds and Security”, $300,000,000, to remain available until September 30, 2023, to respond to the events at the United States Capitol on January 6, 2021: <proviso><i> Provided</i>, That of such amount $283,000,000 shall be for necessary upgrade or replacement of windows and <page identifier="/us/stat/135/314">135 STAT. 314</page>
doors in the Capitol Building and the House of Representatives and Senate office buildings on the Capitol grounds, as well as any related work to harden or enhance physical security of such structures: </proviso><proviso><i> Provided further</i>, That of such amount, $17,000,000 shall be for the purchase and installation of cameras at the Senate and House of Representatives office buildings for the purposes of safety and security: </proviso><proviso><i> Provided further</i>, That amounts necessary for the purpose in the preceding proviso may be transferred between the Architect of the Capitol and the United States Capitol Police, as needed: </proviso><proviso><i> Provided further</i>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</proviso></content></appropriations>

<level style="-uslm-lc:I658174"><heading class="smallCaps" style="-uslm-lc:I658174">GENERAL PROVISIONS—THIS TITLE</heading>
<section style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="310"><inline class="smallCaps">Sec. 310. </inline> </num><content class="inline">None<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd88557d6-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t2/s1965a">2 USC 1965a</ref>.</p></sidenote> of the funds made available in this or any other Act in prior fiscal years, this fiscal year, or any fiscal year thereafter may be used to install permanent, above-ground fencing around the perimeter, or any portion thereof, of the United States Capitol Grounds, as described in <ref href="/us/usc/t40/s5102">section 5102 of title 40, United States Code</ref>.</content></section>

<paragraph class="fontsize10" id="yd886b782-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required by paragraph (1) shall include the following:</chapeau><subparagraph class="fontsize10" id="yd886b783-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The total number of visas issued under such program, disaggregated by fiscal year.</content></subparagraph>
<subparagraph class="fontsize10" id="yd886b784-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>With respect to principal aliens issued special immigrant visas under such program, a description of the types of roles performed for which such aliens earned eligibility for such visas.</content></subparagraph>
<subparagraph class="fontsize10" id="yd886b785-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>Information regarding the average processing times for visa applicants under such program, disaggregated by the fiscal year in which visa applications under the program were submitted.</content></subparagraph>
<subparagraph class="fontsize10" id="yd886b786-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The number of individuals who have pending applications for visas under such program, including—</content></subparagraph>

<paragraph class="fontsize10" id="yd886b787-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The number of individuals approved of the total number of applications processed by the Chief of Mission; and</content></paragraph>
<paragraph class="fontsize10" id="yd886b788-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>The number of successful appeals of the total number of application appeals filed.</chapeau><subparagraph class="fontsize10" id="yd886b789-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd886b78a-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Estimate.</p></sidenote><content>The estimated total number of individuals who have performed the requisite employment to apply for a visa under such program, but who have not yet applied for or received a visa, including a description of the methodology used to create such an estimate.</content></subparagraph>

<paragraph class="fontsize10" id="yd886b78b-e815-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees defined</inline>.—</heading><chapeau>In this section, the term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="yd886b78c-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Appropriations, the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Relations, and the Committee on Homeland Security and Governmental Affairs of the Senate; and</content></subparagraph>

<section><heading class="varAlign fontsize10 smallCaps" style="-uslm-lc:I658174">waiver of medical examination for afghan allies</heading><num style="-uslm-lc:I658120 -uslm-lc:emspace2" value="402"><inline class="smallCaps">Sec. 402.</inline> </num><subsection class="inline" id="yd8877ade-e815-11f0-a1e4-69761a48a15a"><num value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd8877adf-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t8/s1101">8 USC 1101 note</ref>.</p></sidenote><heading class="smallCaps">Authorization<inline class="noSmallCaps">.—</inline></heading><content>The Secretary of State and the Secretary of Homeland Security may jointly issue a blanket waiver of the requirement that aliens described in section 602(b)(2) of the Afghan Allies Protection Act of 2009 (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101</ref>) undergo a medical exam under section 221(d) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1201/d">8 U.S.C. 1201(d)</ref>), or any other applicable provision of law, prior to issuance of an immigrant visa or admission to the United States.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd8877ae0-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd8877ae1-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Extensions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Duration</inline>.—</heading><content>A waiver under subsection (a) shall be for a period of 1 year, and, subject to subsection (g), may be extended by the Secretary of State and Secretary of Homeland Security for additional periods, each of which shall not exceed 1 year.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd8877ae2-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Notification</inline>.—</heading><content>Upon exercising the waiver authority under subsection (a), or the authority to extend a waiver under subsection (b), the Secretary of State and the Secretary of Homeland Security shall notify the appropriate congressional committees.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yd8877ae3-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Requirement for Medical Examination After Admission</inline>.—</heading><paragraph class="fontsize10" id="yd8877ae4-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd8877ae5-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p><p class="leftAlign firstIndent0 fontsize8" id="xd8877ae6-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p><p class="leftAlign firstIndent0 fontsize8" id="xd8877ae7-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall establish procedures to ensure, to the greatest extent practicable, that any alien who receives a waiver of the medical examination requirement under this section completes such an exam not later than 30 days after the date on which the alien is admitted to the United States.</content></paragraph>
<paragraph class="fontsize10" id="yd8877ae8-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Conditional basis for status</inline>.—</heading><subparagraph class="fontsize10" id="yd8877ae9-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, an alien who receives a waiver of the medical examination requirement under this section shall be considered, at the time of admission to the United States, as an alien lawfully admitted for permanent residence on a conditional basis.</content></subparagraph>
<subparagraph class="fontsize10" id="yd8877aea-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Removal of conditions</inline>.—</heading><content>The Secretary of Homeland Security shall remove the conditional basis of the alien’s status upon the Secretary’s confirmation that such alien has completed the medical examination and is not inadmissible under section 212(a)(1)(A) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1182/a/1/A">8 U.S.C. 1182(a)(1)(A)</ref>).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd8877aeb-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd8877aec-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 1 year after the date on which the waiver authority under subsection (a) is exercised, or such waiver is extended under subsection (b), as applicable, the Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall submit to the appropriate congressional committees a report on the status of medical examinations required under paragraph (1), including—</chapeau><subparagraph class="fontsize10" id="yd8877aed-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of pending and completed examinations; and</content></subparagraph>

<section id="d52599e1397" identifier="/us/pl/117/31/tVI/s601" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="601"><inline class="smallCaps">Sec. 601. </inline> </num><content class="inline">Each amount appropriated or made available by this Act is in addition to amounts otherwise appropriated for the fiscal year involved.</content></section>
