<section id="d52747e92" identifier="/us/pl/117/308/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Improving Access to the VA Home Loan Benefit Act of 2022</shortTitle>”.</content></section>
<section id="d52747e102" identifier="/us/pl/117/308/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xed59d570-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading>RECOMMENDATIONS FOR IMPROVING APPRAISAL DELIVERY TIMES.</heading><content style="-uslm-lc:I658120">  Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives recommendations for improving the delivery times for appraisals for loans guaranteed by the Department of Veterans Affairs.</content></section>
<section id="d52747e112" identifier="/us/pl/117/308/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>UPDATE OF APPRAISAL REQUIREMENTS FOR CERTAIN LOANS GUARANTEED BY THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="yed5a4aa1-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xed5a4aa2-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Updated Regulations Required</inline>.—</heading><content>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall prescribe updated regulations or program requirements to clarify when an appraisal is required, how an appraisal is to be conducted, and who is eligible to conduct an appraisal for a loan guaranteed by the Department of Veterans Affairs under <ref href="/us/usc/t38/ch37">chapter 37 of title 38, United States Code</ref>, for any purpose described in section 3710(a) of such title. In prescribing updated regulations or program requirements under this section, the Secretary shall take into consideration the recommendations of the Secretary submitted under section 2.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yed5a4aa3-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Waiver of Requirement for Certain Properties</inline>.—</heading><chapeau>In prescribing updated regulations or program requirements under subsection (a), the Secretary shall consider making changes applicable to—</chapeau><paragraph class="fontsize10" id="yed5a4aa4-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>certification requirements for appraisers;</content></paragraph>
<paragraph class="fontsize10" id="yed5a4aa5-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>minimum property requirements;</content></paragraph>
<paragraph class="fontsize10" id="yed5a4aa6-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the process for selecting and reviewing comparable sales;</content></paragraph>
<paragraph class="fontsize10" id="yed5a4aa7-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>quality control processes;</content></paragraph>
<paragraph class="fontsize10" id="yed5a4aa8-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the Assisted Appraisal Processing Program; and</content></paragraph>
<paragraph class="fontsize10" id="yed5a4aa9-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the use of waivers or other alternatives to existing appraisal processes.<page identifier="/us/stat/136/4394">136 STAT. 4394</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yed5a4aaa-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xed5a4aab-e815-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Guidelines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Desk Top Appraisals</inline>.—</heading><chapeau>In prescribing updated regulations or program guidance under subsection (a), the Secretary shall provide guidance for the use of the authority under <ref href="/us/usc/t38/s3731/b/3">section 3731(b)(3) of title 38, United States Code</ref>, taking into consideration—</chapeau><paragraph class="fontsize10" id="yed5a4aac-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>situations in which the use of such authority would provide for cost savings for the borrower; and</content></paragraph>
<paragraph class="fontsize10" id="yed5a4aad-e815-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/308/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>situations in which a traditional appraisal requirement could cause a delay substantial enough to jeopardize the ability of a borrower to complete a transaction.</content></paragraph>

<section id="d52747e203" identifier="/us/pl/117/308/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
