<section id="d93311e92" identifier="/us/pl/117/303/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">MST Claims Coordination Act</shortTitle>”.</content></section>
<section id="d93311e102" identifier="/us/pl/117/303/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>VETERANS HEALTH ADMINISTRATION AND VETERANS BENEFITS ADMINISTRATION COORDINATION FOR CERTAIN CLAIMS ARISING FROM MILITARY SEXUAL TRAUMA.</heading><subsection class="firstIndent0 fontsize10" id="y124f3230-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Coordinated Provision of Materials</inline>.—</heading><paragraph class="fontsize10" id="y124f3231-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Required materials</inline>.—</heading><chapeau>During or immediately after each covered event, and together with each covered document, in a claim for compensation arising from military sexual trauma experienced by a covered individual, the Under Secretary for Benefits of the Veterans Benefits Administration, in coordination with the Under Secretary for Health of the Veterans Health Administration, shall provide, to the covered individual—</chapeau><subparagraph class="fontsize10" id="y124f3232-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>outreach letters;</content></subparagraph>
<subparagraph class="fontsize10" id="y124f3233-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>information on the Veterans Crisis Line;</content></subparagraph>
<subparagraph class="fontsize10" id="y124f3234-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>information on how to make an appointment with a mental health provider; and</content></subparagraph>
<subparagraph class="fontsize10" id="y124f3235-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>other information on available resources relating to military sexual trauma (including information on military sexual trauma coordinators of the Veterans Health Administration, mental health providers trained in military sexual trauma issues, and peer support specialists).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y124f3236-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Format of materials</inline>.—</heading><content>Materials described in paragraph (1) may be provided electronically.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y124f3237-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Automatic Notification System</inline>.—</heading><chapeau>In a claim for compensation arising from military sexual trauma experienced by a veteran, if the veteran is enrolled in the patient enrollment system of the Department of Veterans Affairs under <ref href="/us/usc/t38/s1705">section 1705 of title 38, United States Code</ref>, and consents to the notification system under this subsection, the Under Secretary for Benefits shall automatically notify the Under Secretary for Health shortly before the veteran—</chapeau><paragraph class="fontsize10" id="y124f5948-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>participates in any covered event; or</content></paragraph>
<paragraph class="fontsize10" id="y124f5949-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>receives any covered document.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y124f594a-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Implementation Deadline</inline>.—</heading><content>The Secretary of Veterans Affairs shall implement this Act not later than 18 months after the date of the enactment of this Act.<page identifier="/us/stat/136/4388">136 STAT. 4388</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y124f594b-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y124f594c-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The term “<term>compensation</term>” has the meaning given that term in <ref href="/us/usc/t38/s101">section 101 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y124f594d-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The term “<term>covered document</term>” means a determination (including a rating determination) that the Secretary of Veterans Affairs provides to the claimant in connection with a claim for compensation.</content></paragraph>
<paragraph class="fontsize10" id="y124f594e-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>The term “<term>covered event</term>” includes, with respect to a claim for compensation—</chapeau><subparagraph class="fontsize10" id="y124f594f-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a medical examination under <ref href="/us/usc/t38/s5103A">section 5103A of title 38, United States Code</ref>;</content></subparagraph>
<subparagraph class="fontsize10" id="y124f5950-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a hearing before the Board of Veterans’ Appeals under section 7107 of such title; and</content></subparagraph>
<subparagraph class="fontsize10" id="y124f5951-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>any other event determined relevant by the Secretary of Veterans Affairs.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y124f5952-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The term “<term>covered individual</term>” means a former member of the Armed Forces (as that term is defined in <ref href="/us/usc/t38/s1720D">section 1720D of title 38, United States Code</ref>) who elects to receive materials under subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y124f5953-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>The term “<term>military sexual trauma</term>” has the meaning given that term in <ref href="/us/usc/t38/s1166">section 1166 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y124f5954-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/303/s2/d/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>The term “<term>Veterans Crisis Line</term>” means the toll-free hotline for veterans established under <ref href="/us/usc/t38/s1720F/h">section 1720F(h) of title 38, United States Code</ref>.</content></paragraph>
