<section id="d53087e85" identifier="/us/pl/117/300/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>REQUIREMENT FOR TRAINING ON CLAIMS INVOLVING MILITARY SEXUAL TRAUMA PRIOR TO ASSIGNMENT OF CERTAIN PROCEEDINGS.</heading><subsection class="firstIndent0 fontsize10" id="y2aa954a0-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s1/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><content><ref href="/us/usc/t38/s7102">Section 7102 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y2aa954a1-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c)</num><paragraph class="inline" id="y2aa954a2-e816-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><content>The Secretary shall ensure that there is offered to each member of the Board an annual training on military sexual trauma and proceedings that concern a claim for compensation based on military sexual trauma experienced by a veteran.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y2aa954a3-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>A proceeding that concerns a claim specified in paragraph (1) may not be assigned to an individual member of the Board or to a panel of members unless the individual member, or each member of the panel, as the case may be, has completed the annual training most recently offered to that member pursuant to such paragraph.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y2aa954a4-e816-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>In this subsection, the term ‘<term>military sexual trauma</term>’ has the meaning given that term in section 1166(c) of this title.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y2aa954a5-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aa954a6-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x2aa954a7-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7102">38 USC 7102 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">First Training</inline>.—</heading><content>The Secretary of Veterans Affairs shall ensure that each member of the Board of Veterans’ Appeals is offered the first annual training under <ref href="/us/usc/t38/s7102/c">section 7102(c) of title 38, United States Code</ref>, as amended by subsection (a), by not later than 180 days after the date of the enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2aa954a8-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aa954a9-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7102">38 USC 7102 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The limitation under <ref href="/us/usc/t38/s7102/c/2">section 7102(c)(2) of title 38, United States Code</ref>, as added by subsection (a), shall apply with respect to the assignment of proceedings on or after the date that is 180 days after the date of the enactment of this Act.</content></subsection>

<section id="d53087e167" identifier="/us/pl/117/300/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aa954aa-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s1166">38 USC 1166 note</ref>.</p></sidenote><heading>REVIEW OF LANGUAGE AND PRACTICES USED IN CONNECTION WITH CLAIMS INVOLVING MILITARY SEXUAL TRAUMA.</heading><subsection class="firstIndent0 fontsize10" id="y2aaa3f0b-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Board of Veterans’ Appeals</inline>.—</heading><paragraph class="fontsize10" id="y2aaa3f0c-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau><ref href="/us/usc/t38/s7112">Section 7112 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="y2aaa3f0d-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="insert">inserting</amendingAction> “<quotedText>(a)<headingText class="smallCaps"> Remanded Claims.—</headingText></quotedText>” before “<quotedText>The Secretary</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2aaa3f0e-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsections:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="y2aaa661f-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Claims Involving Military Sexual Trauma</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aaa6620-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote>The Board shall promptly determine whether a notice of disagreement filed with the Board is a covered case.<page identifier="/us/stat/136/4380">136 STAT. 4380</page></content></subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="y2aaa6621-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y2aaa6622-e816-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>The term ‘<term>covered case</term>’ means a case—</chapeau><subparagraph class="fontsize10" id="y2aaa6623-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>that concerns a claim for compensation based on military sexual trauma; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2aaa6624-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>for which the appellant has requested a hearing in the notice of disagreement filed with the Board pursuant to section 7105 of this title.</content></subparagraph>

<paragraph class="fontsize10" id="y2aaa6625-e816-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The term ‘<term>military sexual trauma</term>’ has the meaning given that term in section 1166 of this title.”</content></paragraph>

<paragraph class="fontsize10" id="y2aaa6626-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Clerical amendments</inline>.—</heading><subparagraph class="fontsize10" id="y2aaa6627-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a/2/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Section heading</inline>.—</heading><content>The heading of such section <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText><b>remanded</b></quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><b>certain</b></quotedText>”.</content></subparagraph>
<subparagraph class="fontsize10" id="y2aaa6628-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/a/2/B" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Table of sections</inline>.—</heading><content>The table of sections at the beginning of chapter 71 of such title<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aaa6629-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s7101">38 USC 7101</ref> prec.</p></sidenote> <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> the item relating to section 7112 and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><toc>

<subsection class="firstIndent0 fontsize10" id="y2aaa662a-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Audit and Modification of Denial Letters</inline>.—</heading><paragraph class="fontsize10" id="y2aaa662b-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><chapeau>The Secretary of Veterans Affairs shall conduct an audit of the language used in letters sent to individuals to explain the decision by the Secretary to deny covered claims.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aaa662c-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote> Not later than 180 days after the date of the enactment of this Act, the Secretary shall modify the letters to ensure that—</chapeau><subparagraph class="fontsize10" id="y2aaa662d-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the letters use trauma-informed language; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2aaa662e-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>veterans are not re-traumatized through insensitive language.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y2aaa662f-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Secretary shall carry out paragraph (1) in consultation with veterans service organizations and other stakeholders as the Secretary determines appropriate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y2aaa6630-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x2aaa6631-e816-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Protocols.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Examinations</inline>.—</heading><content>The Secretary shall establish protocols for Department of Veterans Affairs medical providers and contract medical providers to ensure that the medical providers conduct examinations regarding covered claims using trauma-informed practices.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y2aaa6632-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y2aaa6633-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The term “<term>compensation</term>” has the meaning given that term in <ref href="/us/usc/t38/s101">section 101 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y2aaa6634-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>The term “<term>contract medical provider</term>” means a medical provider who contracts with the Department of Veterans Affairs to provide a medical examination or a medical opinion when such an examination or opinion is necessary to make a decision on a claim under the laws administered by the Secretary of Veterans Affairs.</content></paragraph>
<paragraph class="fontsize10" id="y2aaa6635-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>The term “<term>covered claim</term>” means a claim for compensation based on military sexual trauma experienced by a veteran.</content></paragraph>
<paragraph class="fontsize10" id="y2aaa6636-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>The term “<term>military sexual trauma</term>” has the meaning given that term in <ref href="/us/usc/t38/s1166">section 1166 of title 38, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y2aaa6637-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><chapeau>The term “<term>trauma-informed</term>” means, with respect to language or practices, using language or carrying out practices in a manner that—</chapeau><subparagraph class="fontsize10" id="y2aaa6638-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>is based on a knowledge of the awareness of the prevalence and impact of trauma on the physical, emotional, and mental health of an individual, the behaviors <page identifier="/us/stat/136/4381">136 STAT. 4381</page>
of the individual, and the engagement by the individual to services;</content></subparagraph>
<subparagraph class="fontsize10" id="y2aaa6639-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>is aimed at ensuring environments and services are welcoming and engaging to the individual who receives such services and the staff who provide such services; and</content></subparagraph>
<subparagraph class="fontsize10" id="y2aaa663a-e816-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/300/s2/d/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>ensures that the language or practices do not retraumatize the individual.</content></subparagraph>
