<section id="d93995e85" identifier="/us/pl/117/289/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>INDEPENDENT REVIEW OF ASSESSMENTS BY THE SECRETARY OF VETERANS AFFAIRS OF MENTAL AND PHYSICAL CONDITIONS LINKED TO MILITARY SEXUAL TRAUMA FOR PURPOSES OF AWARDING DISABILITY COMPENSATION.</heading><subsection class="firstIndent0 fontsize10" id="y97e99eea-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x97e99eeb-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Agreement</inline>.—</heading><content>Not later than 90 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine (in this Act referred to as the “National Academies”) to perform the services covered by this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y97e99eec-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x97e99eed-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Comprehensive Review</inline>.—</heading><chapeau>Under an agreement between the Secretary and the National Academies under this section, the National Academies shall conduct a comprehensive review of examinations, furnished by the Secretary to individuals who submit claims to the Secretary for compensation under <ref href="/us/usc/t38/ch11">chapter 11 of title 38, United States Code</ref>, for mental and physical conditions linked to military sexual trauma (in this Act referred to as “MST”), for the purpose of assessing the impairments of such individuals arising from MST. The review carried out pursuant to paragraph (1) shall include the following elements:</chapeau><paragraph class="fontsize10" id="y97e99eee-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>A determination of the adequacy of tools and protocols used by the Secretary to provide examinations described in this subsection, including—</chapeau><subparagraph class="fontsize10" id="y97e99eef-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Disability Benefits Questionnaires;</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef0-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Department’s schedule of rating disabilities;</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef1-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>consideration of whether certain conditions linked to MST should require referral for both a mental health examination and a physical health examination; and</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef2-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>the necessity of internal pelvic examinations to diagnose certain conditions linked to MST, and whether alternatives to such examinations could be considered if a veteran objects to or cannot complete such examination.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y97e99ef3-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>A determination of what credentials and training are necessary for a health care specialist or provider to perform <page identifier="/us/stat/136/4367">136 STAT. 4367</page>
such examinations related to physical conditions linked to MST, for men and for women, including—</chapeau><subparagraph class="fontsize10" id="y97e99ef4-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>sexual dysfunction;</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef5-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>pelvic pain;</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef6-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>pelvic dysfunction;</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef7-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>musculoskeletal disabilities; and</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99ef8-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>cardiovascular conditions (including stroke).</content></subparagraph>

<paragraph class="fontsize10" id="y97e99ef9-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>A determination of what credentials and training are necessary for a health care specialist or provider to perform such examinations related to mental health conditions linked to MST, for men and for women.</content></paragraph>
<paragraph class="fontsize10" id="y97e99efa-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x97e99efb-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p><p class="leftAlign firstIndent0 fontsize8" id="x97e99efc-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x97e99efd-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>An assessment of the quality of MST training for individuals who perform such examinations, including recommendations for improvements to such training.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y97e99efe-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y97e99eff-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Report of the national academies</inline>.—</heading><chapeau>Not later than 540 days after the date on which the Secretary enters into an agreement under subsection (a), the National Academies shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the comprehensive review conducted under subsection (b). Such report shall include the following elements:</chapeau><subparagraph class="fontsize10" id="y97e99f00-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The findings of the National Academies under subsection (b).</content></subparagraph>
<subparagraph class="fontsize10" id="y97e99f01-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x97e99f02-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x97e99f03-e816-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>Recommendations of the National Academies regarding legislative or administrative action to improve of the adjudication of claims described in subsection (b).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y97e99f04-e816-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/289/s1/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report of the secretary</inline>.—</heading><content>Not later than 90 days after submission of the report under paragraph (1), the Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a report on the plans of the Secretary to carry out any action based on the findings and recommendations of the National Academies.</content></paragraph>
