<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0c9cce0f-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Old Pascua Community Land Acquisition Act.</p></sidenote>
<section id="d94521e88" identifier="/us/pl/117/275/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">   This Act may be cited as the “<shortTitle role="act">Old Pascua Community Land Acquisition Act</shortTitle>”.</content></section>
<section id="d94521e98" identifier="/us/pl/117/275/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x0c9d4340-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y0c9d4341-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Compact-designated area</inline>.—</heading><content>The term “<term>Compact Designated Area</term>” means the area south of West Grant Road, east of Interstate 10, north of West Calle Adelanto, and west of North 15th Avenue in the City of Tucson, Arizona, as provided specifically in the Pascua Yaqui Tribe—State of Arizona Amended and Restated Gaming Compact signed in 2021.</content></paragraph>
<paragraph class="fontsize10" id="y0c9d4342-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Tribe</inline>.—</heading><content>The term “<term>Tribe</term>” means the Pascua Yaqui Tribe of Arizona, a federally recognized Indian tribe.</content></paragraph>
<paragraph class="fontsize10" id="y0c9d4343-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe</inline>.—</heading><chapeau>The term “<term>Indian Tribe</term>”—</chapeau><subparagraph class="fontsize10" id="y0c9d4344-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>means any Indian tribe, band, nation, or other organized group or community, including any Alaska Native village that is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0c9d4345-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>does not include any Alaska Native regional or village corporation.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0c9d4346-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>

<section id="d94521e151" identifier="/us/pl/117/275/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>LAND TO BE HELD IN TRUST.</heading><content style="-uslm-lc:I658120">  Upon the request of the Tribe, the Secretary shall accept and take into trust for the benefit of the Tribe, subject to all valid existing rights, any land within the Compact-Designated Area that is owned by Tribe.</content></section>
<section id="d94521e159" identifier="/us/pl/117/275/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>APPLICATION OF CURRENT LAW.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x0c9d9167-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Gaming conducted by the Tribe in the Compact-Designated Area shall be subject to—</chapeau><paragraph class="fontsize10" id="y0c9d9168-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Indian Gaming Regulatory Act (<ref href="/us/usc/t25/s2701/etseq">25 U.S.C. 2701 et seq.</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y0c9d9169-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s4/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>sections 1166 through 1168 of <ref href="/us/usc/t18">title 18, United States Code</ref>.<page identifier="/us/stat/136/4185">136 STAT. 4185</page></content></paragraph>

<section id="d94521e186" identifier="/us/pl/117/275/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>REAFFIRMATION OF STATUS AND ACTIONS.</heading><subsection class="firstIndent0 fontsize10" id="y0c9e069a-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><chapeau>Land placed into trust pursuant to this Act shall—</chapeau><paragraph class="fontsize10" id="y0c9e069b-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>be a part of the Pascua Yaqui Reservation and administered in accordance with the laws and regulations generally applicable to land held in trust by the United States for an Indian Tribe; and</content></paragraph>
<paragraph class="fontsize10" id="y0c9e069c-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>be deemed to have been acquired and taken into trust on September 18, 1978.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0c9e069d-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Rules of Construction</inline>.—</heading><chapeau>Nothing in this Act shall—</chapeau><paragraph class="fontsize10" id="y0c9e069e-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>enlarge, impair, or otherwise affect any right or claim of the Tribe to any land or interest in land in existence before the date of the enactment of this Act;</content></paragraph>
<paragraph class="fontsize10" id="y0c9e069f-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>affect any water right of the Tribe in existence before the date of the enactment of this Act;</content></paragraph>
<paragraph class="fontsize10" id="y0c9e06a0-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>terminate or limit any access in any way to any right-of-way or right-of-use issued, granted, or permitted before the date of the enactment of this Act; or</content></paragraph>
<paragraph class="fontsize10" id="y0c9e06a1-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/275/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>alter or diminish the right of the Tribe to seek to have additional land taken into trust by the United States for the benefit of the Tribe.</content></paragraph>
