<section id="d94870e88" identifier="/us/pl/117/27/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4524b2fb-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">VOCA Fix to Sustain the Crime Victims Fund Act of 2021</shortTitle>”.</content></section>
<section id="d94870e103" identifier="/us/pl/117/27/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>COMPREHENSIVE FIX OF CRIME VICTIMS FUND AND COMPENSATION.</heading><subsection class="firstIndent0 fontsize10" id="y45254f3c-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Crime Victims Fund</inline>.—</heading><chapeau>Section 1402 of the Victims of Crime Act of 1984 (<ref href="/us/usc/t34/s20101">34 U.S.C. 20101</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y45254f3d-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y45254f3e-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (4), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph>
<subparagraph class="fontsize10" id="y45254f3f-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (5)(B), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y45254f40-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentDown1 fontsize10" id="y45257651-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><chapeau>any funds that would otherwise be deposited in the general fund of the Treasury collected pursuant to—</chapeau><subparagraph class="fontsize10" id="y45257652-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a deferred prosecution agreement; or</content></subparagraph>
<subparagraph class="fontsize10" id="y45257653-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>a non-prosecution agreement.”</content></subparagraph>
</paragraph>

<paragraph class="fontsize10" id="y45257654-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (e), by <amendingAction type="delete">striking</amendingAction> “<quotedText>Director</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>Director, except that renewals and extensions beyond that period may be granted at the discretion of the Attorney General</quotedText>”.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y45257655-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Crime Victim Compensation</inline>.—</heading><chapeau>Section 1403 of the Victims of Crime Act of 1984 (<ref href="/us/usc/t34/s20102">34 U.S.C. 20102</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y45257656-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)—</chapeau><subparagraph class="fontsize10" id="y45257657-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>40 percent in fiscal year 2002 and of 60 percent in subsequent fiscal years</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>75 percent</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y45257658-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (2), by <amendingAction type="delete">striking</amendingAction> “<quotedText>of 40 percent in fiscal year 2002 and of 60 percent in subsequent fiscal years</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y45257659-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> paragraph (3) as paragraph (4); and</content></subparagraph>
<subparagraph class="fontsize10" id="y4525765a-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/1/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>by <amendingAction type="insert">inserting</amendingAction> after paragraph (2) the following new paragraph:<quotedContent><paragraph class="indentDown1 fontsize10" id="y4525765b-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>For the purposes of calculating amounts awarded in the previous fiscal year under this subsection, the Director shall not require eligible crime victim compensation programs <page identifier="/us/stat/135/302">135 STAT. 302</page>
to deduct recovery costs or collections from restitution or from subrogation for payment under a civil lawsuit.”</content></paragraph>

<paragraph class="fontsize10" id="y4525765c-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (b)(2) by <amendingAction type="delete">striking</amendingAction> “<quotedText>authorities;</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>authorities, except if a program determines such cooperation may be impacted due to a victim’s age, physical condition, psychological state, cultural or linguistic barriers, or any other health or safety concern that jeopardizes the victim’s wellbeing;</quotedText>”; and</content></paragraph>
<paragraph class="fontsize10" id="y4525765d-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>in subsection (d)—</chapeau><subparagraph class="fontsize10" id="y4525765e-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>; and</quotedText>” and <amendingAction type="insert">inserting</amendingAction> a semicolon;</content></subparagraph>
<subparagraph class="fontsize10" id="y4525765f-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (4), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> “<quotedText>; and</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y45257660-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s2/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="indentDown1 fontsize10" id="y45257661-e817-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x45257662-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Definition.</p></sidenote><content>the term ‘<term>recovery costs</term>’ means expenses for personnel directly involved in the recovery efforts to obtain collections from restitution or from subrogation for payment under a civil law suit.”</content></paragraph>

<section id="d94870e322" identifier="/us/pl/117/27/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>WAIVER OF MATCHING REQUIREMENT.</heading><subsection class="firstIndent0 fontsize10" id="y45259c73-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 1404(a) of the Victims of Crime Act of 1984 (<ref href="/us/usc/t34/s20103/a">34 U.S.C. 20103(a)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="fontsize10" id="y4525c384-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7)</num><subparagraph class="inline" id="y4525c385-e817-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><content>Each chief executive may waive a matching requirement imposed by the Director, in accordance with subparagraph (B), as a condition for the receipt of funds under any program to provide assistance to victims of crimes authorized under this chapter. <sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4525c386-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote>The chief executive shall report to the Director the approval of any waiver of the matching requirement.</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y4525c387-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4525c388-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Public information.</p></sidenote>Each chief executive shall establish and make public, a policy including—</chapeau><clause class="fontsize10" id="y4525c389-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the manner in which an eligible crime victim assistance program can request a match waiver;</content></clause>
<clause class="fontsize10" id="y4525c38a-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4525c38b-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Criteria.</p></sidenote>the criteria used to determine eligibility of the match waiver; and</content></clause>
<clause class="fontsize10" id="y4525c38c-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>the process for decision making and notifying the eligible crime victim assistance program of the decision.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="y4525c38d-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/27/s3/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">National Emergency Waiver</inline>.—</heading><content>Section 1404(a) of the Victims of Crime Act of 1984 (<ref href="/us/usc/t34/s20103/a">34 U.S.C. 20103(a)</ref>), as amended by subsection (a), is further amended by <amendingAction type="insert">inserting</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="fontsize10" id="y4525ea9e-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4525ea9f-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote>Beginning on the date a national emergency is declared under the National Emergencies Act (<ref href="/us/usc/t50/s1601/etseq">50 U.S.C. 1601 et seq.</ref>) with respect to a pandemic and ending on the date that is one year after the date of the end of such national emergency, each chief executive shall issue waivers for any matching requirement, in its entirety, for all eligible crime victim assistance programs contracted to provide services at that time.”</content></paragraph>

Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
