<section id="d95073e88" identifier="/us/pl/117/266/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">   This Act may be cited as the “<shortTitle role="act">Don Young Alaska Native Health Care Land Transfers Act of 2022</shortTitle>”.</content></section>
<section id="d95073e98" identifier="/us/pl/117/266/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x635545cc-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  For the purposes of this Act:</chapeau><paragraph class="fontsize10" id="y635545cd-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Consortia</inline>.—</heading><content>The term “<term>Consortia</term>” means the Alaska Native Tribal Health Consortium and Southeast Alaska Regional Health Consortium.</content></paragraph>
<paragraph class="fontsize10" id="y635545ce-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Council</inline>.—</heading><content>The term “<term>Council</term>” means the Tanana Tribal Council located in Tanana, Alaska.</content></paragraph>
<paragraph class="fontsize10" id="y635545cf-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of Health and Human Services.</content></paragraph>

<section id="d95073e132" identifier="/us/pl/117/266/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x635545d0-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>CONVEYANCES OF PROPERTY.</heading><subsection class="firstIndent0 fontsize10" id="y635593f1-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Conveyance of Property to the Tanana Tribal Council</inline>.—</heading><paragraph class="fontsize10" id="y635593f2-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As soon as practicable, but not later than 180 days, after the date of the enactment of this Act, the Secretary shall convey to the Council all right, title, and interest of the United States in and to the property described in paragraph (2) for use in connection with health and social services programs.</content></paragraph>
<paragraph class="fontsize10" id="y635593f3-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Property described</inline>.—</heading><content>The property referred to in paragraph (1), including all land, improvements, and appurtenances, described in this paragraph is the property included in U.S. Survey No. 5958 in the village of Tanana, Alaska, within surveyed lot 12, T. 4 N., R. 22 W., Fairbanks Meridian, Alaska, containing approximately 11.25 acres.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y635593f4-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conveyance of Property to the Southeast Alaska Regional Health Consortium</inline>.—</heading><paragraph class="fontsize10" id="y635593f5-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As soon as practicable, but not later than 2 years, after the date of the enactment of this Act, the Secretary shall convey to the Southeast Alaska Regional Health Consortium located in Sitka, Alaska, all right, title, and interest of the United States in and to the property <page identifier="/us/stat/136/4172">136 STAT. 4172</page>
described in paragraph (2) for use in connection with health and social services programs.</content></paragraph>
<paragraph class="fontsize10" id="y635593f6-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Property described</inline>.—</heading><content>The property referred to in paragraph (1), including all land and appurtenances, described in this paragraph is the property included in U.S. Survey 1496, lots 4 and 7, partially surveyed T. 55 S., R. 63 E., Copper River Meridian, containing approximately 10.87 acres in Sitka, Alaska.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y635593f7-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Conveyance of Property to the Alaska Native Tribal Health Consortium</inline>.—</heading><paragraph class="fontsize10" id="y635593f8-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>As soon as practicable, but not later than 1 year, after the date of the enactment of this Act, the Secretary shall convey to the Alaska Native Tribal Health Consortium located in Anchorage, Alaska, all right, title, and interest of the United States in and to the property described in paragraph (2) for use in connection with health programs.</content></paragraph>
<paragraph class="fontsize10" id="y635593f9-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Property described</inline>.—</heading><chapeau>The property referred to in paragraph (1), including all land, improvements, and appurtenances, is the following:</chapeau><subparagraph class="fontsize10" id="y6355bb0a-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Lot 1A in Block 31A, East Addition, Anchorage Townsite, United States Survey No. 408, Plat No. 96–117, recorded on November 22, 1996, in the Anchorage Recording District.</content></subparagraph>
<subparagraph class="fontsize10" id="y6355bb0b-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s3/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Block 32C, East Addition, Anchorage Townsite, United States Survey No. 408, Plat No. 96–118, recorded on November 22, 1996, in the Anchorage Recording District.</content></subparagraph>

</subsection>
</section>
<section id="d95073e233" identifier="/us/pl/117/266/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>CONDITIONS OF THE CONVEYANCE OF THE PROPERTIES.</heading><subsection class="firstIndent0 fontsize10" id="y6355e21c-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Conditions</inline>.—</heading><chapeau>The conveyance of the properties under section 3—</chapeau><paragraph class="fontsize10" id="y6355e21d-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>shall be made by warranty deed; and</content></paragraph>
<paragraph class="fontsize10" id="y6355e21e-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>shall not—</chapeau><subparagraph class="fontsize10" id="y6355e21f-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>require any consideration from the Consortia or the Council for the property;</content></subparagraph>
<subparagraph class="fontsize10" id="y6355e220-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>impose any obligation, term, or condition on the Consortia or the Council regarding the property; or</content></subparagraph>
<subparagraph class="fontsize10" id="y6355e221-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>allow for any reversionary interest of the United States in the property.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6355e222-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Effect on Any Quitclaim Deed</inline>.—</heading><content>The conveyance by the Secretary of title by warranty deed under subsection (a)(1) shall, on the effective date of the conveyance, supersede and render of no future effect any quitclaim deed to the properties described in section 3 executed by the Secretary and the Consortia or the Council.</content></subsection>

<section id="d95073e281" identifier="/us/pl/117/266/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>ENVIRONMENTAL LIABILITY.</heading><subsection class="firstIndent0 fontsize10" id="y63563043-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Liability</inline>.—</heading><paragraph class="fontsize10" id="y63563044-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, neither the Consortia nor the Council shall be liable for any soil, surface water, groundwater, or other contamination resulting from the disposal, release, or presence of any environmental contamination on any portion of the property described in section 3 that occurred on or before the date on which the Consortia or the Council controlled, occupied, and used the properties.</content></paragraph>
<paragraph class="fontsize10" id="y63563045-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Environmental contamination</inline>.—</heading><content>An environmental contamination described in paragraph (1) includes any oil or <page identifier="/us/stat/136/4173">136 STAT. 4173</page>
petroleum products, hazardous substances, hazardous materials, hazardous waste, pollutants, toxic substances, solid waste, or any other environmental contamination or hazard as defined in any Federal or State of Alaska law.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y63563046-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Easement</inline>.—</heading><content>The Secretary shall be accorded any easement or access to the property conveyed under this Act as may be reasonably necessary to satisfy any retained obligation or liability of the Secretary.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y63563047-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x63563048-e817-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Compliance.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Notice of Hazardous Substance Activity and Warranty</inline>.—</heading><content>In carrying out this section, the Secretary shall comply with section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<ref href="/us/usc/t42/s9620/h">42 U.S.C. 9620(h)</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y63563049-e817-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/266/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Limitation on Applicability</inline>.—</heading><content>The provisions in this section apply only to the property conveyances specifically required by this Act.</content></subsection>
