<section id="d115191e108" identifier="/us/pl/117/258/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Safeguard Tribal Objects of Patrimony Act of 2021</shortTitle>”.</content></section>
<section id="d115191e118" identifier="/us/pl/117/258/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab083f6-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3071">25 USC 3071</ref>.</p></sidenote><heading>PURPOSES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1ab0f927-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  The purposes of this Act are—</chapeau><paragraph class="fontsize10" id="y1ab0f928-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to carry out the trust responsibility of the United States to Indian Tribes;</content></paragraph>
<paragraph class="fontsize10" id="y1ab0f929-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to increase the maximum penalty for actions taken in violation of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act), in order to strengthen deterrence;</content></paragraph>
<paragraph class="fontsize10" id="y1ab0f92a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>to stop the export, and facilitate the international repatriation, of cultural items prohibited from being trafficked by the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act) and archaeological resources prohibited from being trafficked by the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>) by—</chapeau><subparagraph class="fontsize10" id="y1ab0f92b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>explicitly prohibiting the export;</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab0f92c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>creating an export certification system; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab0f92d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>confirming the authority of the President to request from foreign nations agreements or provisional measures to prevent irremediable damage to Native American cultural heritage;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab0f92e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>to establish a Federal framework in order to support the voluntary return by individuals and organizations of items of tangible cultural heritage, including items covered by the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act) and the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>);</content></paragraph>
<paragraph class="fontsize10" id="y1ab0f92f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>to establish an interagency working group to ensure communication between Federal agencies to successfully implement this Act, the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act), <page identifier="/us/stat/136/2373">136 STAT. 2373</page>
the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>), and other relevant Federal laws;</content></paragraph>
<paragraph class="fontsize10" id="y1ab0f930-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>to establish a Native working group of Indian Tribes and Native Hawaiian organizations to assist in the implementation of this Act, the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act), the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>), and other relevant Federal laws;</content></paragraph>
<paragraph class="fontsize10" id="y1ab0f931-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><chapeau>to exempt from disclosure under <ref href="/us/usc/t5/s552">section 552 of title 5, United States Code</ref> (commonly known as the “Freedom of Information Act”)—</chapeau><subparagraph class="fontsize10" id="y1ab0f932-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>information submitted by Indian Tribes or Native Hawaiian organizations pursuant to this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab0f933-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>information relating to an Item Requiring Export Certification for which an export certification was denied pursuant to this Act; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab0f934-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>to encourage buyers to purchase legal contemporary art made by Native artists for commercial purposes.</content></paragraph>

<section id="d115191e250" identifier="/us/pl/117/258/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab0f935-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3072">25 USC 3072</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1ab1bb86-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y1ab1bb87-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Archaeological resource</inline>.—</heading><content>The term “<term>archaeological resource</term>” means an archaeological resource (as defined in section 3 of the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470bb">16 U.S.C. 470bb</ref>)) that is Native American.</content></paragraph>
<paragraph class="fontsize10" id="y1ab1bb88-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Cultural affiliation</inline>.—</heading><content>The term “<term>cultural affiliation</term>” means that there is a relationship of shared group identity that can be reasonably traced historically or prehistorically between a present day Indian Tribe or Native Hawaiian organization and an identifiable earlier group.</content></paragraph>
<paragraph class="fontsize10" id="y1ab1bb89-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Cultural item</inline>.—</heading><content>The term “<term>cultural item</term>” means any 1 or more cultural items (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>)).</content></paragraph>
<paragraph class="fontsize10" id="y1ab1bb8a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Indian tribe</inline>.—</heading><content>The term “<term>Indian Tribe</term>” has the meaning given the term “<term>Indian tribe</term>” in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y1ab1bb8b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Item prohibited from exportation</inline>.—</heading><chapeau>The term “<term>Item Prohibited from Exportation</term>” means—</chapeau><subparagraph class="fontsize10" id="y1ab1bb8c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>a cultural item prohibited from being trafficked, including through sale, purchase, use for profit, or transport for sale or profit, by—</chapeau><clause class="fontsize10" id="y1ab1bb8d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content><ref href="/us/usc/t18/s1170/b">section 1170(b) of title 18, United States Code</ref>, as added by the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>); or</content></clause>
<clause class="fontsize10" id="y1ab1bb8e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any other Federal law or treaty; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab1bb8f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>an archaeological resource prohibited from being trafficked, including through sale, purchase, exchange, transport, receipt, or offer to sell, purchase, or exchange, including in interstate or foreign commerce, by—</chapeau><clause class="fontsize10" id="y1ab1bb90-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>subsections (b) and (c) of section 6 of the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470ee">16 U.S.C. 470ee</ref>); or</content></clause>
<clause class="fontsize10" id="y1ab1bb91-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/5/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any other Federal law or treaty.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab1bb92-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Item requiring export certification</inline>.—</heading><page identifier="/us/stat/136/2374">136 STAT. 2374</page>
<subparagraph class="fontsize10" id="y1ab1bb93-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/6/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The term “<term>Item Requiring Export Certification</term>” means—</chapeau><clause class="fontsize10" id="y1ab1e2a4-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/6/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>a cultural item; and</content></clause>
<clause class="fontsize10" id="y1ab1e2a5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/6/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>an archaeological resource.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab1e2a6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/6/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Exclusion</inline>.—</heading><content>The term “<term>Item Requiring Export Certification</term>” does not include an item described in clause (i) or (ii) of subparagraph (A) for which an Indian Tribe or Native Hawaiian organization with a cultural affiliation with the item has provided a certificate authorizing exportation of the item.</content></subparagraph>

<paragraph class="fontsize10" id="y1ab1e2a7-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Native american</inline>.—</heading><chapeau>The term “<term>Native American</term>” means—</chapeau><subparagraph class="fontsize10" id="y1ab1e2a8-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Native American (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>)); and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab1e2a9-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>Native Hawaiian (as so defined).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab1e2aa-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><heading class="fontsize10"><inline class="smallCaps">Native hawaiian organization</inline>.—</heading><content>The term “<term>Native Hawaiian organization</term>” has the meaning given the term in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>).</content></paragraph>
<paragraph class="fontsize10" id="y1ab1e2ab-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/9" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>
<paragraph class="fontsize10" id="y1ab1e2ac-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/10" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><heading class="fontsize10"><inline class="smallCaps">Tangible cultural heritage</inline>.—</heading><chapeau>The term “<term>tangible cultural heritage</term>” means—</chapeau><subparagraph class="fontsize10" id="y1ab1e2ad-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/10/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Native American human remains; or</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab1e2ae-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s3/10/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>culturally, historically, or archaeologically significant objects, resources, patrimony, or other items that are affiliated with a Native American culture.</content></subparagraph>

<section id="d115191e464" identifier="/us/pl/117/258/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>ENHANCED NAGPRA PENALTIES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1ab1e2af-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  <ref href="/us/usc/t18/s1170">Section 1170 of title 18, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y1ab1e2b0-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s4/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>5 years</quotedText>” each place it appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>10 years</quotedText>”; and</content></paragraph>

<section id="d115191e501" identifier="/us/pl/117/258/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab1e2b2-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3073">25 USC 3073</ref>.</p></sidenote><heading>EXPORT PROHIBITIONS; EXPORT CERTIFICATION SYSTEM; INTERNATIONAL AGREEMENTS.</heading><subsection class="firstIndent0 fontsize10" id="y1ab60163-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Export Prohibitions</inline>.—</heading><paragraph class="fontsize10" id="y1ab60164-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>It shall be unlawful for any person—</chapeau><subparagraph class="fontsize10" id="y1ab60165-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>to export, attempt to export, or otherwise transport from the United States any Item Prohibited from Exportation;</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab60166-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to conspire with any person to engage in an activity described in subparagraph (A); or</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab60167-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>to conceal an activity described in subparagraph (A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab60168-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><content>Any person who violates paragraph (1) and knows, or in the exercise of due care should have known, that the Item Prohibited from Exportation was taken, possessed, transported, or sold in violation of, or in a manner unlawful under, any Federal law or treaty, shall be fined in accordance with <ref href="/us/usc/t18/s3571">section 3571 of title 18, United States Code</ref>, imprisoned for not more than 1 year and 1 day for a first violation, and not more than 10 years for a second or subsequent violation, or both.</content></paragraph>
<paragraph class="fontsize10" id="y1ab60169-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Detention, forfeiture, and repatriation</inline>.—</heading><page identifier="/us/stat/136/2375">136 STAT. 2375</page>
<subparagraph class="fontsize10" id="y1ab6016a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Detention and delivery</inline>.—</heading><chapeau>The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall—</chapeau><clause class="fontsize10" id="y1ab6016b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>detain any Item Prohibited from Exportation that is exported, attempted to be exported, or otherwise transported from the United States in violation of paragraph (1); and</content></clause>
<clause class="fontsize10" id="y1ab6016c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>deliver the Item Prohibited from Exportation to the Secretary.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab6016d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Forfeiture</inline>.—</heading><content>Any Item Prohibited from Exportation that is exported, attempted to be exported, or otherwise transported from the United States in violation of paragraph (1) shall be subject to forfeiture to the United States in accordance with <ref href="/us/usc/t18/ch46">chapter 46 of title 18, United States Code</ref> (including section 983(c) of that chapter).</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab6016e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Repatriation</inline>.—</heading><chapeau>Any Item Prohibited from Exportation that is forfeited under subparagraph (B) shall be expeditiously repatriated to the appropriate Indian Tribe or Native Hawaiian organization in accordance with, as applicable—</chapeau><clause class="fontsize10" id="y1ab6016f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act); or</content></clause>
<clause class="fontsize10" id="y1ab60170-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/a/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>).</content></clause>

</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab60171-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Export Certification System</inline>.—</heading><paragraph class="fontsize10" id="y1ab60172-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Export certification requirement</inline>.—</heading><subparagraph class="fontsize10" id="y1ab60173-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>No Item Requiring Export Certification may be exported from the United States without first having obtained an export certification in accordance with this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab60174-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab60175-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Federal Register, publication.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab60176-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notice.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Publication</inline>.—</heading><chapeau>The Secretary, in consultation with Indian Tribes and Native Hawaiian organizations, shall publish in the Federal Register a notice that includes—</chapeau><clause class="fontsize10" id="y1ab60177-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><chapeau>a description of characteristics typical of Items Requiring Export Certification, which shall—</chapeau><subclause class="fontsize10" id="y1ab60178-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><chapeau>include the definitions of the terms—</chapeau><item class="fontsize10" id="y1ab60179-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/I/aa" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">(aa) </num><content>“cultural items” in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>); and</content></item>
<item class="fontsize10" id="y1ab6017a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/I/bb" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>“archaeological resource” in section 3 of the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470bb">16 U.S.C. 470bb</ref>);</content></item>
</subclause>
<subclause class="fontsize10" id="y1ab6017b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><chapeau>describe the provenance requirements associated with the trafficking prohibition applicable to—</chapeau><item class="fontsize10" id="y1ab6017c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/II/aa" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">(aa) </num><content>cultural items under <ref href="/us/usc/t18/s1170/b">section 1170(b) of title 18, United States Code</ref>; and</content></item>
<item class="fontsize10" id="y1ab6017d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/II/bb" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>archaeological resources under subsections (b) and (c) of section 6 of Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470ee">16 U.S.C. 470ee</ref>);</content></item>
</subclause>
<subclause class="fontsize10" id="y1ab6017e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III)</num><item class="inline" id="y1ab6017f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/III/aa"><num value="aa">(aa) </num><content>include the definitions of the terms “Native American” and “Native Hawaiian” in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>); and<page identifier="/us/stat/136/2376">136 STAT. 2376</page></content></item>
<item class="indentUp0 fontsize10" id="y1ab60180-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/III/bb" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>describe how those terms apply to archaeological resources under this Act; and</content></item>
</subclause>
<subclause class="fontsize10" id="y1ab60181-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><chapeau>be sufficiently specific and precise to ensure that—</chapeau><item class="fontsize10" id="y1ab60182-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/IV/aa" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">(aa) </num><content>an export certification is required only for Items Requiring Export Certification; and</content></item>
<item class="fontsize10" id="y1ab60183-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/i/IV/bb" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>fair notice is given to exporters and other persons regarding which items require an export certification under this subsection; and</content></item>

</clause>
<clause class="fontsize10" id="y1ab60184-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>a description of characteristics typical of items that do not qualify as Items Requiring Export Certification and therefore do not require an export certification under this subsection, which shall clarify that—</chapeau><subclause class="fontsize10" id="y1ab60185-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>an item made solely for commercial purposes is presumed to not qualify as an Item Requiring Export Certification, unless an Indian Tribe or Native Hawaiian organization challenges that presumption; and</content></subclause>
<subclause class="fontsize10" id="y1ab60186-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/1/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>in some circumstances, receipts or certifications issued by Indian Tribes or Native Hawaiian organizations with a cultural affiliation with an item may be used as evidence to demonstrate a particular item does not qualify as an Item Requiring Export Certification.</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab60187-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility for export certification</inline>.—</heading><chapeau>An Item Requiring Export Certification is eligible for an export certification under this subsection if—</chapeau><subparagraph class="fontsize10" id="y1ab60188-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Item Requiring Export Certification is not under ongoing Federal investigation;</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab60189-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the export of the Item Requiring Export Certification would not otherwise violate any other provision of law; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab6018a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>the Item Requiring Export Certification—</chapeau><clause class="fontsize10" id="y1ab6018b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>is not an Item Prohibited from Exportation;</content></clause>
<clause class="fontsize10" id="y1ab6018c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>was excavated or removed pursuant to a permit issued under section 4 of the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470cc">16 U.S.C. 470cc</ref>) and in compliance with section 3(c) of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3002/c">25 U.S.C. 3002(c)</ref>), if the permit for excavation or removal authorizes export; or</content></clause>
<clause class="fontsize10" id="y1ab6018d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><chapeau>is accompanied by written confirmation from the Indian Tribe or Native Hawaiian organization with authority to alienate the Item Requiring Export Certification that—</chapeau><subclause class="fontsize10" id="y1ab6018e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/C/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the exporter has a right of possession (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001">25 U.S.C. 3001</ref>)) of the Item Requiring Export Certification; or</content></subclause>
<subclause class="fontsize10" id="y1ab6018f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/2/C/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the Indian Tribe or Native Hawaiian organization has relinquished title or control of the Item Requiring Export Certification in accordance with section 3 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3002">25 U.S.C. 3002</ref>).</content></subclause>

<paragraph class="fontsize10" id="y1ab60190-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Export certification application and issuance procedures</inline>.—</heading><page identifier="/us/stat/136/2377">136 STAT. 2377</page>
<subparagraph class="fontsize10" id="y1ab60191-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Applications for export certification</inline>.—</heading><clause class="fontsize10" id="y1ab60192-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>An exporter seeking to export an Item Requiring Export Certification from the United States shall submit to the Secretary an export certification application in accordance with clause (iii).</content></clause>
<clause class="fontsize10" id="y1ab628a3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Consequences of false statement</inline>.—</heading><chapeau>Any willful or knowing false statement made on an export certification application form under clause (i) shall—</chapeau><subclause class="fontsize10" id="y1ab628a4-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>subject the exporter to criminal penalties pursuant to <ref href="/us/usc/t18/s1001">section 1001 of title 18, United States Code</ref>; and</content></subclause>
<subclause class="fontsize10" id="y1ab628a5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>prohibit the exporter from receiving an export certification for any Item Requiring Export Certification in the future unless the exporter submits additional evidence in accordance with subparagraph (B)(iii)(I).</content></subclause>
</clause>
<clause class="fontsize10" id="y1ab628a6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Form of export certification application</inline>.—</heading><chapeau>The Secretary,<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628a7-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirements.</p></sidenote> in consultation with Indian Tribes and Native Hawaiian organizations, and at the discretion of the Secretary, in consultation with third parties with relevant expertise, including institutions of higher education, museums, dealers, and collector organizations, shall develop an export certification application form, which shall require that an applicant—</chapeau><subclause class="fontsize10" id="y1ab628a8-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>describe, and provide pictures of, each Item Requiring Export Certification that the applicant seeks to export;</content></subclause>
<subclause class="fontsize10" id="y1ab628a9-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>include all available information regarding the provenance of each such Item Requiring Export Certification; and</content></subclause>
<subclause class="fontsize10" id="y1ab628aa-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/A/iii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>include the attestation described in subparagraph (B)(i).</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628ab-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Evidence</inline>.—</heading><clause class="fontsize10" id="y1ab628ac-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628ad-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Attestation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In completing an export certification application with respect to an Item Requiring Export Certification that the exporter seeks to export, the exporter shall attest that, to the best of the knowledge and belief of the exporter, the exporter is not attempting to export an Item Prohibited from Exportation.</content></clause>
<clause class="fontsize10" id="y1ab628ae-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Sufficiency of attestation</inline>.—</heading><content>An attestation under clause (i) shall be considered to be sufficient evidence to support the application of the exporter under subparagraph (A)(iii)(III), on the condition that the exporter is not required to provide additional evidence under clause (iii)(I).</content></clause>
<clause class="fontsize10" id="y1ab628af-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628b0-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notifications.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Additional requirements</inline>.—</heading><subclause class="fontsize10" id="y1ab628b1-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628b2-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall give notice to an exporter that submits an export certification application under subparagraph (A)(i) that the exporter is required to submit additional evidence in accordance with subclause (III) if the Secretary has determined under subparagraph (A)(ii) that the exporter made a willful or knowing false statement on the application or any past export certification application.<page identifier="/us/stat/136/2378">136 STAT. 2378</page></content></subclause>
<subclause class="fontsize10" id="y1ab628b3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><heading class="fontsize10"><inline class="smallCaps">Delays or denials</inline>.—</heading><chapeau>The Secretary shall give notice to an exporter that submits an export certification application under subparagraph (A)(i) that the exporter may submit additional evidence in accordance with subclause (III) if the issuance of an export certification is—</chapeau><item class="fontsize10" id="y1ab628b4-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/iii/II/aa" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">(aa) </num><content>delayed pursuant to the examination by the Secretary of the eligibility of the Item Requiring Export Certification for an export certification; or</content></item>
<item class="fontsize10" id="y1ab628b5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/iii/II/bb" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>denied by the Secretary because the Secretary determined that the Item Requiring Export Certification is not eligible for an export certification under this subsection.</content></item>
</subclause>
<subclause class="fontsize10" id="y1ab628b6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/B/iii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><heading class="fontsize10"><inline class="smallCaps">Additional evidence</inline>.—</heading><content>On receipt of notice under subclause (I), an exporter shall, or on receipt of a notice under subclause (II), an exporter may, provide the Secretary with such additional evidence as the Secretary may require to establish that the Item Requiring Export Certification is eligible for an export certification under this subsection.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628b7-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Database applications</inline>.—</heading><clause class="fontsize10" id="y1ab628b8-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall establish and maintain a secure central Federal database information system (referred to in this subparagraph as the “database”) for the purpose of making export certification applications available to Indian Tribes and Native Hawaiian organizations.</content></clause>
<clause class="fontsize10" id="y1ab628b9-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Collaboration required</inline>.—</heading><content>The Secretary shall collaborate with Indian Tribes, Native Hawaiian organizations, and the interagency working group convened under section 7(a) in the design and implementation of the database.</content></clause>
<clause class="fontsize10" id="y1ab628ba-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>Immediately on receipt of an export certification application, the Secretary shall make the export certification application available on the database.</content></clause>
<clause class="fontsize10" id="y1ab628bb-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/C/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><heading class="fontsize10"><inline class="smallCaps">Deletion from database</inline>.—</heading><content>On request by an Indian Tribe or Native Hawaiian organization, the Secretary shall delete an export certification application from the database.</content></clause>
<clause class="fontsize10" id="y1ab628bc-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/C/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><heading class="fontsize10"><inline class="smallCaps">Technical assistance</inline>.—</heading><content>If an Indian Tribe or Native Hawaiian organization lacks sufficient resources to access the database or respond to agency communications in a timely manner, the Secretary, in consultation with Indian Tribes and Native Hawaiian organizations, shall provide technical assistance to facilitate that access or response, as applicable.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628bd-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Issuance of export certification</inline>.—</heading><clause class="fontsize10" id="y1ab628be-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628bf-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>On receipt of an export certification application for an Item Requiring Export Certification that meets the requirements of subparagraphs (A) and (B), if the Secretary, in consultation with Indian Tribes and Native Hawaiian organizations with a cultural affiliation with the Item Requiring Export Certification, <page identifier="/us/stat/136/2379">136 STAT. 2379</page>
determines that the Item Requiring Export Certification is eligible for an export certification under paragraph (2), the Secretary may issue an export certification for the Item Requiring Export Certification.</content></clause>
<clause class="fontsize10" id="y1ab628c0-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628c1-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab628c2-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reviews.</p></sidenote><chapeau>On receipt of an export certification application for an Item Requiring Export Certification that meets the requirements of subparagraphs (A) and (B)—</chapeau><subclause class="fontsize10" id="y1ab628c3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628c4-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote><content>the Secretary shall have 1 business day to notify the relevant Indian Tribes and Native Hawaiian Organizations of an application for export of an Item Requiring Export Certification;</content></subclause>
<subclause class="fontsize10" id="y1ab628c5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>Indian Tribes and Native Hawaiian organizations shall have 9 business days to review the export certification application;</content></subclause>
<subclause class="fontsize10" id="y1ab628c6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>if an Indian Tribe or Native Hawaiian organization notifies the Secretary that the Item Requiring Export Certification may not be eligible for an export certification under paragraph (2), the Secretary shall have 7 business days to review the application;</content></subclause>
<subclause class="fontsize10" id="y1ab628c7-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>if no Indian Tribe or Native Hawaiian organization so notifies the Secretary, the Secretary shall have 1 business day to review the application;</content></subclause>
<subclause class="fontsize10" id="y1ab628c8-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628c9-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab628ca-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Extension.</p></sidenote><content>with notice to the exporter, the Secretary may extend the review of an application for up to 30 business days if credible evidence is provided that the Item Requiring Export Certification may not be eligible for an export certification under paragraph (2); and</content></subclause>
<subclause class="fontsize10" id="y1ab628cb-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/D/ii/VI" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="VI">(VI) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628cc-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><content>the Secretary shall make a determination to approve or deny the export certification application within the time allotted.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628cd-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><heading class="fontsize10"><inline class="smallCaps">Revocation of export certification</inline>.—</heading><clause class="fontsize10" id="y1ab628ce-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/E/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If credible evidence is provided that indicates that an item that received an export certification under subparagraph (D) is not eligible for an export certification under paragraph (2), the Secretary may immediately revoke the export certification.</content></clause>
<clause class="fontsize10" id="y1ab628cf-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/3/E/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628d0-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Determination</inline>.—</heading><content>In determining whether a revocation is warranted under clause (i), the Secretary shall consult with Indian Tribes and Native Hawaiian organizations with a cultural affiliation with the affected Item Requiring Export Certification.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab628d1-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Detention, forfeiture, repatriation, and return</inline>.—</heading><subparagraph class="fontsize10" id="y1ab628d2-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Detention and delivery</inline>.—</heading><chapeau>The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall—</chapeau><clause class="fontsize10" id="y1ab628d3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>detain any Item Requiring Export Certification that an exporter attempts to export or otherwise transport without an export certification; and</content></clause>
<clause class="fontsize10" id="y1ab628d4-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>deliver the Item Requiring Export Certification to the Secretary, for seizure by the Secretary.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628d5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Forfeiture</inline>.—</heading><content>Any Item Requiring Export Certification that is detained under subparagraph (A)(i) shall be subject to forfeiture to the United States in accordance <page identifier="/us/stat/136/2380">136 STAT. 2380</page>
with <ref href="/us/usc/t18/ch46">chapter 46 of title 18, United States Code</ref> (including section 983(c) of that chapter).</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab628d6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Repatriation or return to exporter</inline>.—</heading><clause class="fontsize10" id="y1ab628d7-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628d8-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab628d9-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 60 days after the date of delivery to the Secretary of an Item Requiring Export Certification under subparagraph (A)(ii), the Secretary shall determine whether the Item Requiring Export Certification is an Item Prohibited from Exportation.</content></clause>
<clause class="fontsize10" id="y1ab628da-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Repatriation</inline>.—</heading><chapeau>If an Item Requiring Export Certification is determined by the Secretary to be an Item Prohibited from Exportation and is forfeited under subparagraph (B), the item shall be expeditiously repatriated to the appropriate Indian Tribe or Native Hawaiian organization in accordance with, as applicable—</chapeau><subclause class="fontsize10" id="y1ab628db-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act); or</content></subclause>
<subclause class="fontsize10" id="y1ab628dc-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>).</content></subclause>

<clause class="fontsize10" id="y1ab628dd-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><heading class="fontsize10"><inline class="smallCaps">Return to exporter</inline>.—</heading><subclause class="fontsize10" id="y1ab628de-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/iii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab628df-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If the Secretary determines that credible evidence does not establish that the Item Requiring Export Certification is an Item Prohibited from Exportation, or if the Secretary does not complete the determination by the deadline described in clause (i), the Secretary shall return the Item Requiring Export Certification to the exporter.</content></subclause>
<subclause class="fontsize10" id="y1ab628e0-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/4/C/iii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><heading class="fontsize10"><inline class="smallCaps">Effect</inline>.—</heading><content>The return of an Item Requiring Export Certification to an exporter under subclause (I) shall not mean that the Item Requiring Export Certification is eligible for an export certification under this subsection.</content></subclause>

</paragraph>
<paragraph class="fontsize10" id="y1ab628e1-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><subparagraph class="fontsize10" id="y1ab628e2-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Items requiring export certification</inline>.—</heading><clause class="fontsize10" id="y1ab628e3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>It shall be unlawful for any person to export, attempt to export, or otherwise transport from the United States any Item Requiring Export Certification without first obtaining an export certification.</content></clause>
<clause class="fontsize10" id="y1ab628e4-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Penalties</inline>.—</heading><chapeau>Except as provided in subparagraph (D), any person who violates clause (i) shall be—</chapeau><subclause class="fontsize10" id="y1ab628e5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>assessed a civil penalty in accordance with such regulations as the Secretary promulgates pursuant to section 10; and</content></subclause>
<subclause class="fontsize10" id="y1ab628e6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>subject to any other applicable penalties under this Act.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628e7-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Items prohibited from exportation</inline>.—</heading><content>Whoever exports an Item Prohibited from Exportation without first securing an export certification shall be liable for a civil money penalty, the amount of which shall equal the total cost of storing and repatriating the Item Prohibited from Exportation.<page identifier="/us/stat/136/2381">136 STAT. 2381</page></content></subparagraph>
<subparagraph class="fontsize10" id="y1ab628e8-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Use of fines collected</inline>.—</heading><chapeau>Any amounts collected by the Secretary as a civil penalty under subparagraph (A)(ii)(I) or (B) shall be credited to the currently applicable appropriation, account, or fund of the Department of the Interior as discretionary offsetting collections and shall be available only to the extent and in the amounts provided in advance in appropriations Acts—</chapeau><clause class="fontsize10" id="y1ab628e9-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>to process export certification applications under this subsection; and</content></clause>
<clause class="fontsize10" id="y1ab628ea-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>to store and repatriate the Item Prohibited from Exportation.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y1ab628eb-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Voluntary return</inline>.—</heading><clause class="fontsize10" id="y1ab628ec-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Any person who attempts to export or otherwise transport from the United States an Item Requiring Export Certification without first obtaining an export certification, but voluntarily returns the Item Requiring Export Certification, or directs the Item Requiring Export Certification to be returned, to the appropriate Indian Tribe or Native Hawaiian organization in accordance with section 6 prior to the commencement of an active Federal investigation shall not be prosecuted for a violation of subparagraph (A) with respect to the Item Requiring Export Certification.</content></clause>
<clause class="fontsize10" id="y1ab628ed-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Actions not commencing a federal investigation</inline>.—</heading><chapeau>For purposes of clause (i), the following actions shall not be considered to be actions that commence an active Federal investigation:</chapeau><subclause class="fontsize10" id="y1ab628ee-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>The submission by the exporter of an export certification application for the Item Requiring Export Certification under paragraph (3)(A)(i).</content></subclause>
<subclause class="fontsize10" id="y1ab628ef-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>The detention of the Item Requiring Export Certification by the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, under paragraph (4)(A)(i).</content></subclause>
<subclause class="fontsize10" id="y1ab628f0-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>The delivery to the Secretary of the Item Requiring Export Certification by the Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, under paragraph (4)(A)(ii).</content></subclause>
<subclause class="fontsize10" id="y1ab65001-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/5/D/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><content>The seizure by the Secretary of the Item Requiring Export Certification under paragraph (4)(A)(ii).</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab65002-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><heading class="fontsize10"><inline class="smallCaps">Fees</inline>.—</heading><subparagraph class="fontsize10" id="y1ab65003-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary may assess reasonable fees to process export certification applications under this subsection, subject to subparagraph (B).</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab65004-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/6/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Availability of amounts collected</inline>.—</heading><content>Fees authorized under subparagraph (A) shall be collected and available only to the extent and in the amounts provided in advance in appropriations Acts.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab65005-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><heading class="fontsize10"><inline class="smallCaps">Administrative appeal</inline>.—</heading><content>If the Secretary denies an export certification or an Item Requiring Export Certification is detained under this subsection, the exporter, on request, shall be given a hearing on the record in accordance with <page identifier="/us/stat/136/2382">136 STAT. 2382</page>
such rules and regulations as the Secretary promulgates pursuant to section 10.</content></paragraph>
<paragraph class="fontsize10" id="y1ab65006-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab65007-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Requirements.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Training</inline>.—</heading><subparagraph class="fontsize10" id="y1ab65008-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/8/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary, the Secretary of State, the Attorney General, and the heads of all other relevant Federal agencies shall require all appropriate personnel to participate in training regarding applicable laws and consultations to facilitate positive government-to-government interactions with Indian Tribes and Native Hawaiian Organizations.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab65009-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/8/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10 smallCaps">U.S. customs and border protection training<inline class="noSmallCaps">.—</inline></heading><content>The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection, shall require all appropriate personnel of U.S. Customs and Border Protection to participate in training provided by the Secretary of the Interior or an Indian Tribe or Native Hawaiian organization to assist the personnel in identifying, handling, and documenting in a culturally sensitive manner Items Requiring Export Certification for purposes of this Act.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab6500a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/b/8/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>In developing or modifying and delivering trainings under subparagraphs (A) and (B), the applicable heads of Federal agencies shall consult with Indian Tribes and Native Hawaiian organizations.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab6500b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab6500c-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">President.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Agreements to Request Return From Foreign Countries</inline>.—</heading><chapeau>The President may request from foreign nations agreements that specify concrete measures that the foreign nation will carry out—</chapeau><paragraph class="fontsize10" id="y1ab6500d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to discourage commerce in, and collection of, Items Prohibited from Exportation;</content></paragraph>
<paragraph class="fontsize10" id="y1ab6500e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to encourage the voluntary return of tangible cultural heritage; and</content></paragraph>
<paragraph class="fontsize10" id="y1ab6500f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s5/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>to expand the market for the products of Indian art and craftsmanship in accordance with section 2 of the Act of August 27, 1935 (<ref href="/us/stat/49/891/ch748">49 Stat. 891, chapter 748</ref>; <ref href="/us/usc/t25/s305a">25 U.S.C. 305a</ref>) (commonly known as the “Indian Arts and Crafts Act”).</content></paragraph>
</subsection>

<section id="d115191e1508" identifier="/us/pl/117/258/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab65010-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3074">25 USC 3074</ref>.</p></sidenote><heading>VOLUNTARY RETURN OF TANGIBLE CULTURAL HERITAGE.</heading><subsection class="firstIndent0 fontsize10" id="y1ab69e31-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Liaison</inline>.—</heading><content>The Secretary and the Secretary of State shall each designate a liaison to facilitate the voluntary return of tangible cultural heritage.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab69e32-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Trainings and Workshops</inline>.—</heading><content>The liaisons designated under subsection (a) shall offer to representatives of Indian Tribes and Native Hawaiian organizations and collectors, dealers, and other individuals and organizations trainings and workshops regarding the voluntary return of tangible cultural heritage.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab69e33-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Referrals</inline>.—</heading><paragraph class="fontsize10" id="y1ab69e34-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall refer individuals and organizations to 1 or more Indian Tribes and Native Hawaiian organizations with a cultural affiliation to tangible cultural heritage for the purpose of facilitating the voluntary return of tangible cultural heritage.</content></paragraph>
<paragraph class="fontsize10" id="y1ab69e35-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab69e36-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">List.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Referral representatives</inline>.—</heading><content>The Secretary shall compile a list of representatives from each Indian Tribe and Native Hawaiian organization for purposes of referral under paragraph (1).<page identifier="/us/stat/136/2383">136 STAT. 2383</page></content></paragraph>
<paragraph class="fontsize10" id="y1ab69e37-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><content>The Secretary shall consult with Indian Tribes, Native Hawaiian organizations, and the Native working group convened under section 8(a) before making a referral under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="y1ab69e38-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Third-party experts</inline>.—</heading><content>The Secretary may use third parties with relevant expertise, including institutions of higher education, museums, dealers, and collector organizations, in determining to which Indian Tribe or Native Hawaiian organization an individual or organization should be referred under paragraph (1).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab69e39-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Legal Liability</inline>.—</heading><content>Nothing in this section imposes on any individual or entity any additional penalties or legal liability.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab6c54a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Tax Documentation</inline>.—</heading><content>In facilitating the voluntary return of tangible cultural heritage under this section, the Secretary shall include provision of tax documentation for a deductible gift to an Indian Tribe or Native Hawaiian organization, if the recipient Indian Tribe or Native Hawaiian organization consents to the provision of tax documentation.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab6c54b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s6/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Repatriation Under Native American Graves Protection and Repatriation Act</inline>.—</heading><content>The voluntary return provisions of this section shall apply to a specific item of tangible cultural heritage only to the extent that the repatriation provisions under section 7 of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3005">25 U.S.C. 3005</ref>) do not apply to the item of tangible cultural heritage.</content></subsection>

<section id="d115191e1618" identifier="/us/pl/117/258/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab6c54c-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3075">25 USC 3075</ref>.</p></sidenote><heading>INTERAGENCY WORKING GROUP.</heading><subsection class="firstIndent0 fontsize10" id="y1ab73a7d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab73a7e-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Designation.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab73a7f-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary shall designate a coordinating office to convene an interagency working group consisting of representatives from the Departments of the Interior, Justice, State, and Homeland Security.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab73a80-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Goals</inline>.—</heading><chapeau>The goals of the interagency working group convened under subsection (a) are—</chapeau><paragraph class="fontsize10" id="y1ab73a81-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>to facilitate the repatriation to Indian Tribes and Native Hawaiian organizations of items that have been illegally removed or trafficked in violation of applicable law;</content></paragraph>
<paragraph class="fontsize10" id="y1ab73a82-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>to protect tangible cultural heritage, cultural items, and archaeological resources still in the possession of Indian Tribes and Native Hawaiian organizations; and</content></paragraph>
<paragraph class="fontsize10" id="y1ab73a83-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><chapeau>to improve the implementation by the applicable Federal agencies of—</chapeau><subparagraph class="fontsize10" id="y1ab73a84-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3001/etseq">25 U.S.C. 3001 et seq.</ref>) (including <ref href="/us/usc/t18/s1170">section 1170 of title 18, United States Code</ref>, as added by that Act);</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab73a85-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Archaeological Resources Protection Act of 1979 (<ref href="/us/usc/t16/s470aa/etseq">16 U.S.C. 470aa et seq.</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab73a86-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>other relevant Federal laws.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab73a87-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Responsibilities</inline>.—</heading><chapeau>The interagency working group convened under subsection (a) shall—</chapeau><paragraph class="fontsize10" id="y1ab73a88-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>aid in implementation of this Act and the amendments made by this Act, including by aiding in—</chapeau><subparagraph class="fontsize10" id="y1ab73a89-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the voluntary return of tangible cultural heritage under section 6; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab73a8a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>halting international sales of items that are prohibited from being trafficked under Federal law; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab73a8b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>collaborate with—<page identifier="/us/stat/136/2384">136 STAT. 2384</page></chapeau><subparagraph class="fontsize10" id="y1ab73a8c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Native working group convened under section 8(a);</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab73a8d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the review committee established under section 8(a) of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3006/a">25 U.S.C. 3006(a)</ref>);</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab73a8e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>the Cultural Heritage Coordinating Committee established pursuant to section 2 of the Protect and Preserve International Cultural Property Act (<ref href="/us/pl/114/151">Public Law 114–151</ref>; <ref href="/us/usc/t19/s2601">19 U.S.C. 2601 note</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab73a8f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s7/c/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>any other relevant committees and working groups.</content></subparagraph>

<section id="d115191e1755" identifier="/us/pl/117/258/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab73a90-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3076">25 USC 3076</ref>.</p></sidenote><heading>NATIVE WORKING GROUP.</heading><subsection class="firstIndent0 fontsize10" id="y1ab7d6d1-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab7d6d2-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Establishment.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>The Secretary shall convene a Native working group consisting of not fewer than 12 representatives of Indian Tribes and Native Hawaiian organizations with relevant expertise, who shall be nominated by Indian Tribes and Native Hawaiian organizations, to advise the Federal Government in accordance with this section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab7d6d3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Recommendations</inline>.—</heading><chapeau>The Native working group convened under subsection (a) may provide recommendations regarding—</chapeau><paragraph class="fontsize10" id="y1ab7d6d4-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the voluntary return of tangible cultural heritage by collectors, dealers, and other individuals and non-Federal organizations that hold such tangible cultural heritage; and</content></paragraph>
<paragraph class="fontsize10" id="y1ab7d6d5-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the elimination of illegal commerce of cultural items and archaeological resources in the United States and foreign markets.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab7d6d6-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Requests</inline>.—</heading><chapeau>The Native working group convened under subsection (a) may make formal requests to initiate certain agency actions, including requests that—</chapeau><paragraph class="fontsize10" id="y1ab7d6d7-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Department of Justice initiate judicial proceedings domestically or abroad to aid in the repatriation cultural items and archaeological resources; and</content></paragraph>
<paragraph class="fontsize10" id="y1ab7d6d8-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Department of State initiate dialogue through diplomatic channels to aid in that repatriation.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab7d6d9-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Agency and Committee Assistance</inline>.—</heading><paragraph class="fontsize10" id="y1ab7d6da-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>On request by the Native working group convened under subsection (a), the agencies and committees described in paragraph (2) shall make efforts to provide information and assistance to the Native working group.</content></paragraph>
<paragraph class="fontsize10" id="y1ab7d6db-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Description of agencies and committees</inline>.—</heading><chapeau>The agencies and committees referred to in paragraph (1) are the following:</chapeau><subparagraph class="fontsize10" id="y1ab7d6dc-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The Department of the Interior.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab7d6dd-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The Department of Justice.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab7d6de-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>The Department of Homeland Security.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab7d6df-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The Department of State.</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab7d6e0-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>The review committee established under section 8(a) of the Native American Graves Protection and Repatriation Act (<ref href="/us/usc/t25/s3006/a">25 U.S.C. 3006(a)</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab7d6e1-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/d/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>The Cultural Heritage Coordinating Committee established pursuant to section 2 of the Protect and Preserve International Cultural Property Act (<ref href="/us/pl/114/151">Public Law 114–151</ref>; <ref href="/us/usc/t19/s2601">19 U.S.C. 2601 note</ref>).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab7d6e3-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s8/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Applicability of Federal Advisory Committee Act</inline>.—</heading><content>The Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) shall not apply to the Native working group convened under subsection (a).</content></subsection>

<section id="d115191e1905" identifier="/us/pl/117/258/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab7d6e4-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3077">25 USC 3077</ref>.</p></sidenote><heading>TREATMENT UNDER FREEDOM OF INFORMATION ACT.</heading><subsection class="firstIndent0 fontsize10" id="y1ab82505-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Except as provided in subsection (c), the following information shall be exempt from disclosure under <ref href="/us/usc/t5/s552">section 552 of title 5, United States Code</ref>:</chapeau><paragraph class="fontsize10" id="y1ab82506-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>Information that a representative of an Indian Tribe or Native Hawaiian organization—</chapeau><subparagraph class="fontsize10" id="y1ab82507-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>submits to a Federal agency pursuant to this Act or an amendment made by this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y1ab82508-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>designates as sensitive or private according to Native American custom, law, culture, or religion.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y1ab82509-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Information that any person submits to a Federal agency pursuant to this Act or an amendment made by this Act that relates to an item for which an export certification is denied under this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab8250a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>For purposes of subsection (a), this Act shall be considered a statute described in <ref href="/us/usc/t5/s552/b/3/B">section 552(b)(3)(B) of title 5, United States Code</ref>.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y1ab8250b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/258/s9/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>An Indian Tribe or Native Hawaiian organization may request and shall receive its own information, as described in subsection (a), from the Federal agency to which the Indian Tribe or Native Hawaiian organization submitted the information.</content></subsection>

<section id="d115191e1971" identifier="/us/pl/117/258/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab8250c-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab8250d-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3078">25 USC 3078</ref>.</p></sidenote><heading>REGULATIONS.</heading><content style="-uslm-lc:I658120">  Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Secretary of State, the Secretary of Homeland Security, and the Attorney General, and after consultation with Indian Tribes and Native Hawaiian organizations, shall promulgate rules and regulations to carry out this Act.</content></section>
<section id="d115191e1985" identifier="/us/pl/117/258/s11" style="-uslm-lc:I658142"><num class="fontsize12" value="11">SEC. 11. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1ab8250e-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x1ab8250f-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t25/s3079">25 USC 3079</ref>.</p></sidenote><heading>AUTHORIZATION OF APPROPRIATIONS.</heading><content style="-uslm-lc:I658120">  There is authorized to be appropriated to carry out this Act $3,000,000 for each of fiscal years 2022 through 2027.</content></section>
<section id="d115191e1999" identifier="/us/pl/117/258/s12" style="-uslm-lc:I658142"><num class="fontsize12" value="12">SEC. 12. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the <page identifier="/us/stat/136/2386">136 STAT. 2386</page>
Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
