<section id="d63305e94" identifier="/us/pl/117/255/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Community Disaster Resilience Zones Act of 2022</shortTitle>”.</content></section>
<section id="d63305e104" identifier="/us/pl/117/255/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x3d3d932a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 101(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121/b">42 U.S.C. 5121(b)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y3d3d932b-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/255/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (5), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="y3d3d932c-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/255/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (6), by <amendingAction type="add">adding</amendingAction> “<quotedText>; and</quotedText>” at the end; and</content></paragraph>

<section id="d63305e151" identifier="/us/pl/117/255/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>NATURAL HAZARD RISK ASSESSMENT.</heading><subsection class="firstIndent0 fontsize10" id="y3d3e7d8f-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/255/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Title II of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5131/etseq">42 U.S.C. 5131 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y3d402b40-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="206">“SEC. 206. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d402b41-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s5136">42 USC 5136</ref>.</p></sidenote><heading class="fontsize12">NATURAL HAZARD RISK ASSESSMENT.</heading><subsection class="firstIndent0 fontsize10" id="y3d402b42-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="y3d402b43-e818-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Community disaster resilience zone</inline>.—</heading><content>The term ‘<term>community disaster resilience zone</term>’ means a census tract designated by the President under subsection (d)(1).</content></paragraph>
<paragraph class="fontsize10" id="y3d402b44-e818-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Eligible entity</inline>.—</heading><chapeau>The term ‘<term>eligible entity</term>’ means—</chapeau><subparagraph class="fontsize10" id="y3d402b45-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>a State;</content></subparagraph>
<subparagraph class="fontsize10" id="y3d402b46-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>an Indian tribal government; or</content></subparagraph>
<subparagraph class="fontsize10" id="y3d402b47-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>a local government.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d402b48-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Products</inline>.—</heading><chapeau>The President shall continue to maintain a natural hazard assessment program that develops and maintains products that—</chapeau><paragraph class="fontsize10" id="y3d405259-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>are available to the public; and</content></paragraph>
<paragraph class="fontsize10" id="y3d40525a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>define natural hazard risk across the United States.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d40525b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Features</inline>.—</heading><chapeau>The products maintained under subsection (b) shall, for lands within States and areas under the jurisdiction of Indian tribal governments—</chapeau><paragraph class="fontsize10" id="y3d40525c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>show the risk of natural hazards; and</content></paragraph>
<paragraph class="fontsize10" id="y3d40525d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>include ratings and data for—</chapeau><subparagraph class="fontsize10" id="y3d40525e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>loss exposure, including population equivalence, buildings, and agriculture;</content></subparagraph>
<subparagraph class="fontsize10" id="y3d40525f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>social vulnerability;<page identifier="/us/stat/136/2364">136 STAT. 2364</page></content></subparagraph>
<subparagraph class="fontsize10" id="y3d405260-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>community resilience; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3d405261-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>any other element determined by the President.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d405262-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Community Disaster Resilience Zones Designation</inline>.—</heading><paragraph class="fontsize10" id="y3d405263-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d405264-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 30 days after the date on which the President makes the update and enhancement required under subsection (e)(4), and not less frequently than every 5 years thereafter, the President shall identify and designate community disaster resilience zones, which shall be—</chapeau><subparagraph class="fontsize10" id="y3d405265-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the 50 census tracts assigned the highest individual hazard risk ratings; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3d405266-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>subject to paragraph (3), in each State, not less than 1 percent of census tracts that are assigned high individual risk ratings.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3d405267-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Risk ratings</inline>.—</heading><chapeau>In carrying out paragraph (1), the President shall use census tract risk ratings derived from a product maintained under subsection (b) that—</chapeau><subparagraph class="fontsize10" id="y3d405268-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>reflect—</chapeau><clause class="fontsize10" id="y3d405269-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>high levels of individual hazard risk ratings based on an assessment of the intersection of—</chapeau><subclause class="fontsize10" id="y3d40526a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>loss to population equivalence;</content></subclause>
<subclause class="fontsize10" id="y3d40526b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>building value; and</content></subclause>
<subclause class="fontsize10" id="y3d40526c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>agriculture value;</content></subclause>
</clause>
<clause class="fontsize10" id="y3d40526d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>high social vulnerability ratings and low community resilience ratings; and</content></clause>
<clause class="fontsize10" id="y3d40526e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any other elements determined by the President; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y3d40526f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>reflect the principal natural hazard risks identified for the respective census tracts.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3d405270-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Geographic balance</inline>.—</heading><chapeau>In identifying and designating the community disaster resilience zones described in paragraph (1)(B)—</chapeau><subparagraph class="fontsize10" id="y3d405271-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>for the purpose of achieving geographic balance, when applicable, the President shall consider making designations in coastal, inland, urban, suburban, and rural areas; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3d405272-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the President shall include census tracts on Tribal lands located within a State.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3d405273-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Duration</inline>.—</heading><content>The designation of a community disaster resilience zone under paragraph (1) shall be effective for a period of not less than 5 years.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d405274-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d405275-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Review and Update</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of the Community Disaster Resilience Zones Act of 2022, and not less frequently than every 5 years thereafter, the President shall—</chapeau><paragraph class="fontsize10" id="y3d405276-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><chapeau>with respect to any product that is a natural hazard risk assessment—</chapeau><subparagraph class="fontsize10" id="y3d405277-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>review the underlying methodology of the product; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3d405278-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>receive public input on the methodology and data used for the product;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3d405279-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><chapeau>consider including additional data in any product that is a natural hazard risk assessment, such as—</chapeau><subparagraph class="fontsize10" id="y3d40527a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the most recent census tract data;</content></subparagraph>
<subparagraph class="fontsize10" id="y3d40527b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>data from the American Community Survey of the Bureau of the Census, a successor survey, a similar survey, or another data source, including data by census tract on housing characteristics and income;<page identifier="/us/stat/136/2365">136 STAT. 2365</page></content></subparagraph>
<subparagraph class="fontsize10" id="y3d40527c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>information relating to development, improvements, and hazard mitigation measures;</content></subparagraph>
<subparagraph class="fontsize10" id="y3d40527d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>data that assesses past and future loss exposure, including analysis on the effects of a changing climate on future loss exposure;</content></subparagraph>
<subparagraph class="fontsize10" id="y3d40527e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>data from the Resilience Analysis and Planning Tool of the Federal Emergency Management Agency; and</content></subparagraph>
<subparagraph class="fontsize10" id="y3d40527f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><chapeau>other information relevant to prioritizing areas that have—</chapeau><clause class="fontsize10" id="y3d405280-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>high risk levels of—</chapeau><subclause class="fontsize10" id="y3d405281-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>natural hazard loss exposure, including population equivalence, buildings, infrastructure, and agriculture; and</content></subclause>
<subclause class="fontsize10" id="y3d405282-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>social vulnerability; and</content></subclause>
</clause>
<clause class="fontsize10" id="y3d405283-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>low levels of community resilience;</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3d405284-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d405285-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p></sidenote><content>make publicly available any changes in methodology or data used to inform an update to a product maintained under subsection (b); and</content></paragraph>
<paragraph class="fontsize10" id="y3d405286-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>update and enhance the products maintained under subsection (b), as necessary.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y3d405287-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d405288-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="x3d405289-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Data.</p><p class="leftAlign firstIndent0 fontsize8" id="x3d40528a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Natural Hazard Risk Assessment Insights</inline>.—</heading><chapeau>In determining additional data to include in products that are natural hazard risk assessments under subsection (e)(2), the President shall consult with, at a minimum—</chapeau><paragraph class="fontsize10" id="y3d40528b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>the Administrator of the Federal Emergency Management Agency;</content></paragraph>
<paragraph class="fontsize10" id="y3d40528c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>the Secretary of Agriculture and the Chief of the Forest Service;</content></paragraph>
<paragraph class="fontsize10" id="y3d40528d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the Secretary of Commerce, the Administrator of the National Oceanic and Atmospheric Administration, the Director of the Bureau of the Census, and the Director of the National Institute of Standards and Technology;</content></paragraph>
<paragraph class="fontsize10" id="y3d40528e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>the Secretary of Defense and the Commanding Officer of the United States Army Corps of Engineers;</content></paragraph>
<paragraph class="fontsize10" id="y3d40528f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>the Administrator of the Environmental Protection Agency;</content></paragraph>
<paragraph class="fontsize10" id="y3d405290-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><content>the Secretary of the Interior and the Director of the United States Geological Survey;</content></paragraph>
<paragraph class="fontsize10" id="y3d405291-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><content>the Secretary of Housing and Urban Development; and</content></paragraph>
<paragraph class="fontsize10" id="y3d405292-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><content>the Director of the Federal Housing Finance Agency.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d405293-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Community Disaster Resilience Zone</inline>.—</heading><content>With respect to financial assistance provided under section 203(i) to perform a resilience or mitigation project within, or that primarily benefits, a community disaster resilience zone, the President may increase the amount of the Federal share described under section 203(h) to not more than 90 percent of the total cost of the resilience or mitigation project.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y3d405294-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="h">“(h) </num><heading class="fontsize10"><inline class="smallCaps">Resilience or Mitigation Project Planning Assistance</inline>.—</heading><paragraph class="fontsize10" id="y3d405295-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The President may provide financial, technical, or other assistance under this title to an eligible entity that plans to perform a resilience or mitigation project within, or that primarily benefits, a community disaster resilience zone.</content></paragraph>
<paragraph class="fontsize10" id="y3d405296-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Purpose</inline>.—</heading><content>The purpose of assistance provided under paragraph (1) shall be to carry out activities in preparation <page identifier="/us/stat/136/2366">136 STAT. 2366</page>
for a resilience or mitigation project or seek an evaluation and certification under subsection (i)(2) for a resilience or mitigation project before the date on which permanent work of the resilience or mitigation project begins.</content></paragraph>
<paragraph class="fontsize10" id="y3d405297-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><content>If required by the President, an eligible entity seeking assistance under paragraph (1) shall submit an application in accordance with subsection (i)(1).</content></paragraph>
<paragraph class="fontsize10" id="y3d405298-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><content>In providing assistance under paragraph (1), the President may use amounts set aside under section 203(i).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d405299-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Community Disaster Resilience Zone Project Applications</inline>.—</heading><paragraph class="fontsize10" id="y3d40529a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d40529b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirement.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If required by the President or other Federal law, an eligible entity shall submit to the President an application at such time, in such manner, and containing or accompanied by such information as the President may reasonably require.</content></paragraph>
<paragraph class="fontsize10" id="y3d40529c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Evaluation and certification</inline>.—</heading><subparagraph class="fontsize10" id="y3d40529d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d40529e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x3d40529f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 120 days after the date on which an eligible entity submits an application under paragraph (1), the President shall evaluate the application to determine whether the resilience or mitigation project that the entity plans to perform within, or that primarily benefits, a community disaster resilience zone—</chapeau><clause class="fontsize10" id="y3d4079b0-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is designed to reduce injuries, loss of life, and damage and destruction of property, such as damage to critical services and facilities; and</content></clause>
<clause class="fontsize10" id="y3d4079b1-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>substantially reduces the risk of, or increases resilience to, future damage, hardship, loss, or suffering.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y3d4079b2-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d4079b3-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Certification</inline>.—</heading><content>If the President determines that an application submitted under paragraph (1) meets the criteria described in subparagraph (A), the President shall certify the proposed resilience or mitigation project.</content></subparagraph>
<subparagraph class="fontsize10" id="y3d4079b4-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Effect of certification</inline>.—</heading><content>The certification of a proposed resilience or mitigation project under subparagraph (B) shall not be construed to exempt the resilience or mitigation project from the requirements of any other law.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y3d4079b5-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Projects causing displacement</inline>.—</heading><chapeau>With respect to a resilience or mitigation project certified under paragraph (2)(B) that involves the displacement of a resident from any occupied housing unit, the entity performing the resilience or mitigation project shall—</chapeau><subparagraph class="fontsize10" id="y3d4079b6-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>provide, at the option of the resident, a suitable and habitable housing unit that is, with respect to the housing unit from which the resident is displaced—</chapeau><clause class="fontsize10" id="y3d4079b7-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>of a comparable size;</content></clause>
<clause class="fontsize10" id="y3d4079b8-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>located in the same local community or a community with reduced hazard risk; and</content></clause>
<clause class="fontsize10" id="y3d4079b9-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>offered under similar costs, conditions, and terms;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y3d4079ba-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>ensure that property acquisitions resulting from the displacement and made in connection with the resilience or mitigation project—<page identifier="/us/stat/136/2367">136 STAT. 2367</page></chapeau><clause class="fontsize10" id="y3d4079bb-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>are deed restricted in perpetuity to preclude future property uses not relating to mitigation or resilience; and</content></clause>
<clause class="fontsize10" id="y3d4079bc-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>are the result of a voluntary decision by the resident; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y3d4079bd-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>plan for robust public participation in the resilience or mitigation project.”</content></subparagraph>

Stafford Disaster Relief and Emergency Assistance Act, as added by subsection (a) of this section, shall be construed to prohibit the Administrator of the Federal Emergency Management Agency from using amounts available to maintain and update the National Risk Index until the earlier of—</chapeau><paragraph class="fontsize10" id="y3d4079c1-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/255/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the date on which those amounts are transferred to another source; and</content></paragraph>
<paragraph class="fontsize10" id="y3d4079c2-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/255/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>3 years after the date of enactment of this Act.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y3d4079c3-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/255/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x3d4079c4-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s5136">42 USC 5136 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Applicability</inline>.—</heading><content>The amendments made by this Act shall only apply with respect to amounts appropriated on or after the date of enactment of this Act.</content></subsection>
