<section id="d115444e94" identifier="/us/pl/117/254/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Preventing PFAS Runoff at Airports Act</shortTitle>”.</content></section>
<section id="d115444e104" identifier="/us/pl/117/254/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x44ad1bae-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>TEMPORARY INCREASED COST SHARE AUTHORITY FOR AQUEOUS FILM FORMING FOAM INPUT-BASED TESTING EQUIPMENT.</heading><subsection class="firstIndent0 fontsize10" id="y44adb7ef-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t49/s47109">Section 47109 of title 49, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y44adb7f0-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Special Rule for Covered Equipment</inline>.—</heading><paragraph class="fontsize10" id="y44adb7f1-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Government’s share of allowable project costs for covered equipment and its installation shall be 100 percent.</content></paragraph>
<paragraph class="fontsize10" id="y44adb7f2-e818-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Definition of covered equipment</inline>.—</heading><content>For purposes of this subsection, the term ‘<term>covered equipment</term>’ means aqueous film forming foam input-based testing equipment that is eligible for Airport Improvement Program funding based on Federal Aviation Administration PGL 21–01, titled ‘Extension of Eligibility for stand-alone acquisition of input-based testing equipment and truck modification’, dated October 5, 2021 (or any other successor program guidance letter).</content></paragraph>
<paragraph class="fontsize10" id="y44adb7f3-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><chapeau>The higher cost share authority established in this subsection shall terminate on the earlier of—</chapeau><subparagraph class="fontsize10" id="y44addf04-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>180 days after the date on which the eligibility of covered equipment for Airport Improvement Program funding under the authority described in paragraph (2) terminates or is discontinued by the Administrator; or</content></subparagraph>
<subparagraph class="fontsize10" id="y44addf05-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>5 years after the date of enactment of this subsection.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y44addf06-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x44addf07-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s47109">49 USC 47109 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Outreach Efforts</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall conduct an outreach effort to make airports aware of the higher cost share authority established in <ref href="/us/usc/t49/s47109/g">section 47109(g) of title 49, United States Code</ref>, as added by subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y44addf08-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x44addf09-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Briefing.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Forward-looking Airport Reimbursements</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act, the Administrator of the Federal Aviation Administration shall provide a <page identifier="/us/stat/136/2362">136 STAT. 2362</page>
briefing to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives that reviews—</chapeau><paragraph class="fontsize10" id="y44addf0a-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>potential options for Congress to reimburse airports that—</chapeau><subparagraph class="fontsize10" id="y44addf0b-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>are certificated under <ref href="/us/cfr/t14/pt139">part 139 of title 14, Code of Federal Regulations</ref>; and</content></subparagraph>
<subparagraph class="fontsize10" id="y44addf0c-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>acquired covered equipment (as defined in <ref href="/us/usc/t49/s47109/g">section 47109(g) of title 49, United States Code</ref>) as added by subsection (a)—</chapeau><clause class="fontsize10" id="y44addf0d-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>with Federal funding but with a Government’s share less than 100 percent; or</content></clause>
<clause class="fontsize10" id="y44addf0e-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>without Federal funding;</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y44addf0f-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>information relevant to estimating the potential cost of providing such reimbursement;</content></paragraph>
<paragraph class="fontsize10" id="y44addf10-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the status of the Federal Aviation Administration’s outreach efforts as required under subsection (b); and</content></paragraph>
<paragraph class="fontsize10" id="y44addf11-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/c/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>any additional information the Administrator of the Federal Aviation Administration considers appropriate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y44addf12-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/254/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x44addf13-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p><p class="leftAlign firstIndent0 fontsize8" id="x44addf14-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t49/s47109">49 USC 47109 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Authorization of Appropriations</inline>.—</heading><content>The amendments made by this Act shall apply to amounts that first become available in fiscal year 2023 or thereafter.</content></subsection>
