<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula>
<section id="d63735e85" identifier="/us/pl/117/25/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>COMMODITY FUTURES TRADING COMMISSION WHISTLEBLOWER PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y5ed9b341-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Notwithstanding any other provision of law, there is established in the Treasury a separate account (referred to in this section as the “account”), the amounts in which shall be available for the sole purposes of—</chapeau><paragraph class="fontsize10" id="y5ed9b342-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>carrying out the activities described in section 23(g)(2)(B) of the Commodity Exchange Act (<ref href="/us/usc/t7/s26/g/2/B">7 U.S.C. 26(g)(2)(B)</ref>) (referred to in this section as “customer education initiatives”); and</content></paragraph>
<paragraph class="fontsize10" id="y5ed9b343-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>funding the administrative, programmatic, and personnel expenses of the Whistleblower Office and the Office of Customer Education and Outreach of the Commodity Futures Trading Commission (referred to in this section as the “Commission”) in carrying out section 23 of the Commodity Exchange Act (<ref href="/us/usc/t7/s26">7 U.S.C. 26</ref>) (referred to in this section as “non-awards expenses”).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ed9b344-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Transfers From Fund Into Account</inline>.—</heading><paragraph class="fontsize10" id="y5ed9b345-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, the Commission shall transfer up to $10,000,000 from the Commodity Futures Trading Commission Customer Protection Fund established under section 23(g)(1) of the Commodity Exchange Act (<ref href="/us/usc/t7/s26/g/1">7 U.S.C. 26(g)(1)</ref>) (referred to in this section as the “Fund”) into the account.</content></paragraph>
<paragraph class="fontsize10" id="y5ed9b346-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>Amounts transferred under paragraph (1) shall be available for obligation without further appropriation and remain available until October 1, 2022.</content></paragraph>
<paragraph class="fontsize10" id="y5ed9b347-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Remaining amounts</inline>.—</heading><content>Amounts remaining in the account that are unobligated on October 1, 2022, shall be returned to the Fund.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y5ed9b348-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Requirement for Obligations</inline>.—</heading><content>The Commission may make obligations from the account only when the unobligated balance of the Fund is insufficient to pay non-awards expenses and expenses for customer education initiatives due to awards that the Commission has ordered under section 23(b) of the Commodity Exchange Act (<ref href="/us/usc/t7/s26/b">7 U.S.C. 26(b)</ref>).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y5ed9b349-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/25/s1/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Reports to Congress</inline>.—</heading><content>The Commission shall include in each report required under section 23(g)(5) of the Commodity <page identifier="/us/stat/135/298">135 STAT. 298</page>
Exchange Act (<ref href="/us/usc/t7/s26/g/5">7 U.S.C. 26(g)(5)</ref>) the same information with respect to the account as the Commission includes in the report with respect to the Fund, to the extent the information is relevant to the account.</content></subsection>
