<section id="d115829e94" identifier="/us/pl/117/249/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Disaster Assistance for Rural Communities Act</shortTitle>”.</content></section>
<section id="d115829e104" identifier="/us/pl/117/249/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DISASTER DECLARATION IN RURAL AREAS.</heading><subsection class="firstIndent0 fontsize10" id="y729d35df-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 7(b) of the Small Business Act (<ref href="/us/usc/t15/s636/b">15 U.S.C. 636(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after paragraph (15) the following:<quotedContent><paragraph class="fontsize10" id="y729d5cf0-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">“(16) </num><heading class="fontsize10"><inline class="smallCaps">Disaster declaration in rural areas</inline>.—</heading><subparagraph class="fontsize10" id="y729d5cf1-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this paragraph—</chapeau><clause class="fontsize10" id="y729d5cf2-e818-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the term ‘<term>rural area</term>’ means any county or other political subdivision of a State, the District of Columbia, or a territory or possession of the United States that is designated as a rural area by the Bureau of the Census; and</content></clause>
<clause class="fontsize10" id="y729d5cf3-e818-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the term ‘<term>significant damage</term>’ means, with respect to property, uninsured losses of not less than 40 percent of the estimated fair replacement value or pre-disaster fair market value of the damaged property, whichever is lower.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y729d5cf4-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Disaster declaration</inline>.—</heading><chapeau>For the purpose of making loans under paragraph (1) or (2), the Administrator may declare a disaster in a rural area for which a major disaster was declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5170">42 U.S.C. 5170</ref>) and for which individual assistance was not authorized under section 408 of such Act (<ref href="/us/usc/t42/s5174">42 U.S.C. 5174</ref>) if—</chapeau><clause class="fontsize10" id="y729d5cf5-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the Governor of the State or the Chief Executive of the Indian tribal government in which the rural area is located requests such a declaration; and</content></clause>
<clause class="fontsize10" id="y729d5cf6-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any home, small business concern, private nonprofit organization, or small agricultural cooperative has incurred significant damage in the rural area.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y729d5cf7-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x729d5cf8-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">SBA report</inline>.—</heading><chapeau>Not later than 120 days after the date of enactment of this paragraph, and every year thereafter, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of <page identifier="/us/stat/136/2351">136 STAT. 2351</page>
Representatives a report on, with respect to the 1-year period preceding submission of the report—</chapeau><clause class="fontsize10" id="y729d5cf9-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>any economic injury that resulted from a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5170">42 U.S.C. 5170</ref>) in a rural area;</content></clause>
<clause class="fontsize10" id="y729d5cfa-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>each request for assistance made by the Governor of a State or the Chief Executive of an Indian tribal government under subparagraph (B)(i) and the response of the Administrator, including the timeline for each response; and</content></clause>
<clause class="fontsize10" id="y729d5cfb-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any regulatory changes that will impact the ability of communities in rural areas to obtain disaster assistance under this subsection.”</content></clause>

<subsection class="firstIndent0 fontsize10" id="y729d5cfc-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x729d5cfd-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="x729d5cfe-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s636">15 USC 636 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Regulations</inline>.—</heading><content>Not later than 120 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall issue regulations to carry out the amendment made by subsection (a).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y729d5cff-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">GAO Report</inline>.—</heading><paragraph class="fontsize10" id="y729d5d00-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/c/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Definition of rural area</inline>.—</heading><content>In this subsection, the term “<term>rural area</term>” means any county or other political subdivision of a State, the District of Columbia, or a territory or possession of the United States that is designated as a rural area by the Bureau of the Census.</content></paragraph>
<paragraph class="fontsize10" id="y729d5d01-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on—</chapeau><subparagraph class="fontsize10" id="y729d8412-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>any unique challenges that communities in rural areas face compared to communities in urbanized areas when seeking to obtain disaster assistance under section 7(b) of the Small Business Act (<ref href="/us/usc/t15/s636/b">15 U.S.C. 636(b)</ref>); and</content></subparagraph>
<subparagraph class="fontsize10" id="y729d8413-e818-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/249/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x729d8414-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x729d8415-e818-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">tions.</p></sidenote><content>legislative recommendations for improving access to disaster assistance for communities in rural areas.</content></subparagraph>
