<section id="d63851e94" identifier="/us/pl/117/248/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Protecting Firefighters from Adverse Substances Act</shortTitle>” or the “<shortTitle role="act">PFAS Act</shortTitle>”.</content></section>
<section id="d63851e107" identifier="/us/pl/117/248/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7a551202-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s323">6 USC 323</ref>.</p></sidenote><heading>GUIDANCE ON HOW TO PREVENT EXPOSURE TO AND RELEASE OF PFAS.</heading><subsection class="firstIndent0 fontsize10" id="y7a55d553-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc64-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, the Secretary of Homeland Security, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, the Director of the National Institute for Occupational Safety and Health, and the heads of any other relevant agencies, shall—</chapeau><paragraph class="fontsize10" id="y7a55fc65-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc66-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Publication.</p></sidenote><content>develop and publish guidance for firefighters and other emergency response personnel on training, education programs, and best practices;</content></paragraph>
<paragraph class="fontsize10" id="y7a55fc67-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>make available a curriculum designed to—</chapeau><subparagraph class="fontsize10" id="y7a55fc68-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>reduce and eliminate exposure to per- and polyfluoroalkyl substances (commonly referred to as “PFAS”) from firefighting foam and personal protective equipment;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc69-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>prevent the release of PFAS from firefighting foam into the environment; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc6a-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>educate firefighters and other emergency response personnel on foams and non-foam alternatives, personal protective equipment, and other firefighting tools and equipment that do not contain PFAS; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y7a55fc6b-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc6c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Website.</p><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc6d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Data.</p><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc6e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Updates.</p></sidenote><content>create an online public repository, which shall be updated on a regular basis, on tools and best practices for firefighters and other emergency response personnel to reduce, limit, and prevent the release of and exposure to PFAS.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7a55fc6f-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc70-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc71-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Curriculum</inline>.—</heading><paragraph class="fontsize10" id="y7a55fc72-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>For the purpose of developing the curriculum required under subsection (a)(2), the Administrator of the United States Fire Administration shall make recommendations to the Secretary of Homeland Security as to the content of the curriculum.<page identifier="/us/stat/136/2349">136 STAT. 2349</page></content></paragraph>
<paragraph class="fontsize10" id="y7a55fc73-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><chapeau>For the purpose of making recommendations under paragraph (1), the Administrator of the United States Fire Administration shall consult with interested entities, as appropriate, including—</chapeau><subparagraph class="fontsize10" id="y7a55fc74-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>firefighters and other emergency response personnel, including national fire service and emergency response organizations;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc75-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>impacted communities dealing with PFAS contamination;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc76-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>scientists, including public and occupational health and safety experts, who are studying PFAS and PFAS alternatives in firefighting foam;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc77-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>voluntary standards organizations engaged in developing standards for firefighter and firefighting equipment;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc78-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>State fire training academies;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc79-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>State fire marshals;</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc7a-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>manufacturers of firefighting tools and equipment; and</content></subparagraph>
<subparagraph class="fontsize10" id="y7a55fc7b-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/b/2/H" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">(H) </num><content>any other relevant entities, as determined by the Secretary of Homeland Security and the Administrator of the United States Fire Administration.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y7a55fc7c-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7a55fc7d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Review</inline>.—</heading><content>Not later than 3 years after the date on which the guidance and curriculum required under subsection (a) is issued, and not less frequently than once every 3 years thereafter, the Secretary of Homeland Security, in consultation with the Administrator of the United States Fire Administration, the Administrator of the Environmental Protection Agency, and the Director of the National Institute for Occupational Safety and Health, shall review the guidance and curriculum and, as appropriate, issue updates to the guidance and curriculum.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7a55fc7e-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Applicability of FACA</inline>.—</heading><content>The Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) shall not apply to this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y7a55fc7f-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/248/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this Act shall be construed to require the Secretary of Homeland Security to promulgate or enforce regulations under <ref href="/us/usc/t5/ch5/schII">subchapter II of chapter 5 of title 5, United States Code</ref> (commonly known as the “Administrative Procedure Act”).</content></subsection>
