<section id="d63970e94" identifier="/us/pl/117/246/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Empowering the U.S. Fire Administration Act</shortTitle>”.</content></section>
<section id="d63970e104" identifier="/us/pl/117/246/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FIRE SAFETY INVESTIGATIONS.</heading><content class="firstIndent0 fontsize10" id="x8fbde017-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Federal Fire Prevention and Control Act of 1974 (<ref href="/us/usc/t15/s2201/etseq">15 U.S.C. 2201 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y8fbe5548-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658142"><num class="fontsize12" value="38">“SEC. 38. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fbe5549-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s2235">15 USC 2235</ref>.</p></sidenote><heading class="fontsize12">INVESTIGATION AUTHORITIES.</heading><subsection class="firstIndent0 fontsize10" id="y8fbe554a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>In the case of a major fire, the Administrator may send incident investigators, which may include safety specialists, fire protection engineers, codes and standards experts, researchers, and fire training specialists, to the site of the fire to conduct a fire safety investigation as described in subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fbe554b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Investigation Required</inline>.—</heading><chapeau>A fire safety investigation conducted under this section—</chapeau><paragraph class="fontsize10" id="y8fbe7c5c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>shall be conducted in coordination and cooperation with appropriate Federal, State, local, Tribal, and territorial authorities, including Federal agencies that are authorized to investigate any fire; and</content></paragraph>
<paragraph class="fontsize10" id="y8fbe7c5d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fbe7c5e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Examination.</p></sidenote><content>shall examine the previously determined cause and origin of the fire and assess broader systematic matters to include use of codes and standards, demographics, structural characteristics, smoke and fire dynamics (movement) during the event, and costs of associated injuries and deaths.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fbe7c5f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><paragraph class="fontsize10" id="y8fbe7c60-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subject to paragraph (2), upon concluding any fire safety investigation under this section, the Administrator shall—</chapeau><subparagraph class="fontsize10" id="y8fbe7c61-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>issue a public report to the appropriate Federal, State, local, Tribal, and territorial authorities on the findings of such investigation; or</content></subparagraph>
<subparagraph class="fontsize10" id="y8fbe7c62-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>collaborate with another investigating Federal, State, local, Tribal, or territorial agency on the report of that agency.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y8fbe7c63-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fbe7c64-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>If the Administrator, in consultation with appropriate Federal, State, local, Tribal, and territorial authorities determines that issuing a report under paragraph (1) would <page identifier="/us/stat/136/2346">136 STAT. 2346</page>
have a negative impact on a potential or ongoing criminal investigation, the Administrator is not required to issue such report.</content></paragraph>
<paragraph class="fontsize10" id="y8fbe7c65-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fbe7c66-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x8fbe7c67-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each public report issued under paragraph (1) shall include recommendations on—</chapeau><subparagraph class="fontsize10" id="y8fbe7c68-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>any other buildings with similar characteristics that may bear similar fire risks;</content></subparagraph>
<subparagraph class="fontsize10" id="y8fbe7c69-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>improving tactical response to similar fires;</content></subparagraph>
<subparagraph class="fontsize10" id="y8fbe7c6a-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>improving civilian safety practices;</content></subparagraph>
<subparagraph class="fontsize10" id="y8fbe7c6b-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x8fbe7c6c-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>assessing the costs and benefits to the community of adding fire safety features; and</content></subparagraph>
<subparagraph class="fontsize10" id="y8fbe7c6d-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>how to mitigate the causes of the fire.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fbe7c6e-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Discretionary Authority</inline>.—</heading><content>In addition to a fire safety investigation conducted pursuant to subsection (a), provided doing so would not have a negative impact on a potential or ongoing criminal investigation, the Administrator may send fire investigators to conduct a fire safety investigation at the site of any fire with unusual or remarkable context that results in losses less severe than those occurring as a result of a major fire, in coordination and cooperation with the appropriate Federal, State, local, Tribal, and territorial authorities, including Federal agencies that are authorized to investigate the fire.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y8fbe7c6f-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Construction</inline>.—</heading><chapeau>Nothing in this section shall be construed to—</chapeau><paragraph class="fontsize10" id="y8fbe7c70-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>affect or otherwise diminish the authorities or the mandates vested in other Federal agencies;</content></paragraph>
<paragraph class="fontsize10" id="y8fbe7c71-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>grant the Administrator authority to investigate a major fire for the purpose of an enforcement action or criminal prosecution; or</content></paragraph>
<paragraph class="fontsize10" id="y8fbe7c72-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>require the Administrator to send investigators or issue a report for a major fire when the Administrator, in coordination and cooperation with the appropriate Federal, State, local, Tribal, and territorial authorities, determine that it may compromise a potential or ongoing criminal investigation.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y8fbe7c73-e818-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Major Fire Defined</inline>.—</heading><content>For purposes of this section, the term ‘<term>major fire</term>’ shall have the meaning given such term under regulations to be issued by the Administrator.”</content></subsection>
