<section id="d64101e94" identifier="/us/pl/117/245/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Patents for Humanity Act of 2022</shortTitle>”.</content></section>
<section id="d64101e104" identifier="/us/pl/117/245/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AWARD OF CERTIFICATES TO ACCELERATE CERTAIN MATTERS AT THE PATENT AND TRADEMARK OFFICE.</heading><subsection class="firstIndent0 fontsize10" id="y91829aad-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/245/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Award</inline>.—</heading><content><ref href="/us/usc/t35/ch2">Chapter 2 of title 35, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y91830fde-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658162"><num class="fontsize12" value="28">“§ 28.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x91830fdf-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t35/s28">35 USC 28</ref>.</p></sidenote> Award of certificates to accelerate certain matters at the Patent and Trademark Office</heading><subsection class="firstIndent0 fontsize10" id="y91830fe0-e818-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definition</inline>.—</heading><chapeau>In this section, the term ‘<term>eligible entity</term>’ means an entity that—</chapeau><paragraph class="fontsize10" id="y91830fe1-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>submits an application under subsection (d) for a patent that addresses a humanitarian issue; and</content></paragraph>
<paragraph class="fontsize10" id="y91830fe2-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>meets the requirements specified by the Director.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y91830fe3-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x91830fe4-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><chapeau>There is established a competition, to be held not less frequently than biennially, to award eligible entities certificates that can be redeemed to accelerate one of the following matters:</chapeau><paragraph class="fontsize10" id="y91830fe5-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>An ex parte reexamination proceeding, including 1 appeal to the Patent Trial and Appeal Board from that proceeding.</content></paragraph>
<paragraph class="fontsize10" id="y91830fe6-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>An application for a patent, including 1 appeal to the Patent Trial and Appeal Board from that application.</content></paragraph>
<paragraph class="fontsize10" id="y91830fe7-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>An appeal to the Patent Trial and Appeal Board of a claim twice rejected in a patent application or reissue application or finally rejected in an ex parte reexamination, without accelerating the underlying matter that generated the appeal.</content></paragraph>
<paragraph class="fontsize10" id="y91830fe8-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><content>A matter identified by the Director.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y91830fe9-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><content>The Director shall administer the competition established under subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y91830fea-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Application</inline>.—</heading><content>An entity seeking an award under subsection (b) shall submit to the Director an application at such time, in such manner, and containing such information as the Director may require.<page identifier="/us/stat/136/2344">136 STAT. 2344</page></content></subsection>
<subsection class="firstIndent0 fontsize10" id="y91830feb-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Promotion of Competition</inline>.—</heading><content>The Director shall promote the competition established under subsection (b) through the satellite offices established pursuant to section 1.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y91830fec-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Treatment as Successor</inline>.—</heading><content>The competition established under subsection (b) shall be treated as a successor to the Patents for Humanity Program (established in the notice entitled ‘Humanitarian Awards Pilot Program’, published at <ref href="/us/fr/77/6544">77 Fed. Reg. 6544</ref> (February 8, 2012)).”</content></subsection>

<subsection class="firstIndent0 fontsize10" id="y91830fed-e818-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/245/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x91830fee-e818-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t35/s28">35 USC 28 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this section, or the amendments made by this section, may be construed as affecting any action taken by the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office before the date of enactment of this Act with respect to the administration of the Patents for Humanity Program established in the notice entitled “Humanitarian Awards Pilot Program”, published at <ref href="/us/fr/77/6544">77 Fed. Reg. 6544</ref> (February 8, 2012).</content></subsection>
