<section id="d65052e92" identifier="/us/pl/117/228/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Respect for Marriage Act</shortTitle>”.</content></section>
<section id="d65052e102" identifier="/us/pl/117/228/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x22de3645-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t1/s7">1 USC 7 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x22de5d56-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y22de5d57-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family.</content></paragraph>
<paragraph class="fontsize10" id="y22de5d58-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Diverse beliefs about the role of gender in marriage are held by reasonable and sincere people based on decent and honorable religious or philosophical premises. Therefore, Congress affirms that such people and their diverse beliefs are due proper respect.</content></paragraph>
<paragraph class="fontsize10" id="y22de5d59-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Millions of people, including interracial and same-sex couples, have entered into marriages and have enjoyed the rights and privileges associated with marriage. Couples joining in marriage deserve to have the dignity, stability, and ongoing protection that marriage affords to families and children.</content></paragraph>
</section>
<section id="d65052e129" identifier="/us/pl/117/228/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPEAL OF SECTION ADDED TO <ref href="/us/usc/t28">TITLE 28, UNITED STATES CODE</ref>, BY SECTION 2 OF THE DEFENSE OF MARRIAGE ACT.</heading><content style="-uslm-lc:I658120">  <ref href="/us/usc/t28/s1738C">Section 1738C of title 28, United States Code</ref>, is <amendingAction type="repeal">repealed</amendingAction>.</content></section>
<section id="d65052e147" identifier="/us/pl/117/228/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>FULL FAITH AND CREDIT GIVEN TO MARRIAGE EQUALITY.</heading><content class="firstIndent0 fontsize10" id="x22de846a-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t28/ch115">Chapter 115 of title 28, United States Code</ref>, as amended by this Act, is further amended by <amendingAction type="insert">inserting</amendingAction> after section 1738B the following:<quotedContent><section class="centered fontsize12" id="y22deab7b-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658165"><num class="fontsize12" value="1738C">“§ 1738C.</num><heading class="fontsize12"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x22deab7c-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t28/s1738C">28 USC 1738C</ref>.</p></sidenote> Certain acts, records, and proceedings and the effect thereof</heading><subsection class="firstIndent0 fontsize10" id="y22deab7d-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>No person acting under color of State law may deny—</chapeau><paragraph class="fontsize10" id="y22deab7e-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>full faith and credit to any public act, record, or judicial proceeding of any other State pertaining to a marriage between 2 individuals, on the basis of the sex, race, ethnicity, or national origin of those individuals; or</content></paragraph>
<paragraph class="fontsize10" id="y22deab7f-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>a right or claim arising from such a marriage on the basis that such marriage would not be recognized under the law of that State on the basis of the sex, race, ethnicity, or national origin of those individuals.<page identifier="/us/stat/136/2306">136 STAT. 2306</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y22deab80-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Enforcement by Attorney General</inline>.—</heading><content>The Attorney General may bring a civil action in the appropriate United States district court against any person who violates subsection (a) for declaratory and injunctive relief.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22deab81-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Private Right of Action</inline>.—</heading><content>Any person who is harmed by a violation of subsection (a) may bring a civil action in the appropriate United States district court against the person who violated such subsection for declaratory and injunctive relief.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22deab82-e819-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">State Defined</inline>.—</heading><content>In this section, the term ‘<term>State</term>’ has the meaning given such term under section 7 of title 1.”</content></subsection>

<section id="d65052e223" identifier="/us/pl/117/228/s5" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>MARRIAGE RECOGNITION.</heading><content class="firstIndent0 fontsize10" id="x22deab83-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  <ref href="/us/usc/t1/s7">Section 7 of title 1, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> to read as follows:<quotedContent><section class="centered fontsize12" id="y22ded294-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658161"><num class="fontsize12" value="7">“§ 7.</num><heading class="fontsize12"> Marriage</heading><subsection class="firstIndent0 fontsize10" id="y22ded295-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><content>For the purposes of any Federal law, rule, or regulation in which marital status is a factor, an individual shall be considered married if that individual’s marriage is between 2 individuals and is valid in the State where the marriage was entered into or, in the case of a marriage entered into outside any State, if the marriage is between 2 individuals and is valid in the place where entered into and the marriage could have been entered into in a State.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22ded296-e819-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x22ded297-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><content>In this section, the term ‘<term>State</term>’ means a State, the District of Columbia, the Commonwealth of Puerto Rico, or any other territory or possession of the United States.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22ded298-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><content>For purposes of subsection (a), in determining whether a marriage is valid in a State or the place where entered into, if outside of any State, only the law of the jurisdiction applicable at the time the marriage was entered into may be considered.”</content></subsection>

<section id="d65052e263" identifier="/us/pl/117/228/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x22ded299-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t1/s7">1 USC 7 note</ref>.</p></sidenote><heading>NO IMPACT ON RELIGIOUS LIBERTY AND CONSCIENCE.</heading><subsection class="firstIndent0 fontsize10" id="y22def9aa-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Nothing in this Act, or any amendment made by this Act, shall be construed to diminish or abrogate a religious liberty or conscience protection otherwise available to an individual or organization under the Constitution of the United States or Federal law.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22def9ab-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Goods or Services</inline>.—</heading><content>Consistent with the <ref href="/us/cons/amd1">First Amendment to the Constitution</ref>, nonprofit religious organizations, including churches, mosques, synagogues, temples, nondenominational ministries, interdenominational and ecumenical organizations, mission organizations, faith-based social agencies, religious educational institutions, and nonprofit entities whose principal purpose is the study, practice, or advancement of religion, and any employee of such an organization, shall not be required to provide services, accommodations, advantages, facilities, goods, or privileges for the solemnization or celebration of a marriage. Any refusal under this subsection to provide such services, accommodations, advantages, facilities, goods, or privileges shall not create any civil claim or cause of action.</content></subsection>
</section>
<section id="d65052e295" identifier="/us/pl/117/228/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x22def9ac-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t1/s7">1 USC 7 note</ref>.</p></sidenote><heading>STATUTORY PROHIBITION.</heading><subsection class="firstIndent0 fontsize10" id="y22df20bd-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">No Impact on Status and Benefits Not Arising From a Marriage</inline>.—</heading><content>Nothing in this Act, or any amendment made by this Act, shall be construed to deny or alter any benefit, status, or right of an otherwise eligible entity or person which does not arise from a marriage, including tax-exempt status, tax treatment, <page identifier="/us/stat/136/2307">136 STAT. 2307</page>
educational funding, or a grant, contract, agreement, guarantee, loan, scholarship, license, certification, accreditation, claim, or defense.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y22df20be-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/228/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">No Federal Recognition of Polygamous Marriages</inline>.—</heading><content>Nothing in this Act, or any amendment made by this Act, shall be construed to require or authorize Federal recognition of marriages between more than 2 individuals.</content></subsection>

<section id="d65052e327" identifier="/us/pl/117/228/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x22df20bf-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t1/s7">1 USC 7 note</ref>.</p></sidenote><heading>SEVERABILITY.</heading><content style="-uslm-lc:I658120">  If any provision of this Act, or any amendment made by this Act, or the application of such provision to any person, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act, or any amendment made thereby, or the application of such provision to all other persons, entities, governments, or circumstances, shall not be affected thereby.</content></section>
