<section id="d117434e102" identifier="/us/pl/117/223/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Safe Connections Act of 2022</shortTitle>”.</content></section>
<section id="d117434e112" identifier="/us/pl/117/223/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430801b4-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s345">47 USC 345 note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><content style="-uslm-lc:I658120">  Except as otherwise provided in this Act, terms used in this Act that are defined in section 345(a) of the Communications Act of 1934, as added by section 4 of this Act, have the meanings given those terms in such section 345(a).</content></section>
<section id="d117434e124" identifier="/us/pl/117/223/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430828c5-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s345">47 USC 345 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x43084fd6-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y43084fd7-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s3/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Domestic violence, dating violence, stalking, sexual assault, human trafficking, and related crimes are life-threatening issues and have lasting and harmful effects on individuals, families, and entire communities.</content></paragraph>
<paragraph class="fontsize10" id="y43084fd8-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s3/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Survivors often lack meaningful support and options when establishing independence from an abuser, including barriers such as financial insecurity and limited access to reliable communications tools to maintain essential connections with family, social safety networks, employers, and support services.</content></paragraph>
<paragraph class="fontsize10" id="y43084fd9-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s3/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Perpetrators of violence and abuse described in paragraph (1) increasingly use technological and communications tools to exercise control over, monitor, and abuse their victims.</content></paragraph>
<paragraph class="fontsize10" id="y43084fda-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s3/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Communications law can play a public interest role in the promotion of safety, life, and property with respect to the types of violence and abuse described in paragraph (1). For example, independent access to a wireless phone plan can assist survivors in establishing security and autonomy.</content></paragraph>
<paragraph class="fontsize10" id="y43084fdb-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s3/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Safeguards within communications services can serve a role in preventing abuse and narrowing the digital divide experienced by survivors of abuse.</content></paragraph>
</section>
<section id="d117434e163" identifier="/us/pl/117/223/s4" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>PROTECTION OF DOMESTIC VIOLENCE SURVIVORS WITHIN COMMUNICATIONS SERVICES.</heading><content class="firstIndent0 fontsize10" id="x4308ec1c-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  Part I of title III of the Communications Act of 1934 (<ref href="/us/usc/t47/s301/etseq">47 U.S.C. 301 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><section class="centered fontsize12" id="y430a72bd-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658143"><num class="fontsize12" value="345">“SEC. 345. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a99ce-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s345">47 USC 345</ref>.</p></sidenote><heading class="fontsize12">PROTECTION OF SURVIVORS OF DOMESTIC VIOLENCE, HUMAN TRAFFICKING, AND RELATED CRIMES.</heading><subsection class="firstIndent0 fontsize10" id="y430a99cf-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:<page identifier="/us/stat/136/2281">136 STAT. 2281</page></chapeau><paragraph class="fontsize10" id="y430a99d0-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Abuser</inline>.—</heading><chapeau>The term ‘<term>abuser</term>’ means an individual who has committed or allegedly committed a covered act against—</chapeau><subparagraph class="fontsize10" id="y430a99d1-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>an individual who seeks relief under subsection (b); or</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99d2-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>an individual in the care of an individual who seeks relief under subsection (b).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a99d3-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Covered act</inline>.—</heading><subparagraph class="fontsize10" id="y430a99d4-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The term ‘<term>covered act</term>’ means conduct that constitutes—</chapeau><clause class="fontsize10" id="y430a99d5-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a crime described in section 40002(a) of the Violence Against Women Act of 1994 (<ref href="/us/usc/t34/s12291/a">34 U.S.C. 12291(a)</ref>), including domestic violence, dating violence, sexual assault, stalking, and sex trafficking;</content></clause>
<clause class="fontsize10" id="y430a99d6-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an act or practice described in paragraph (11) or (12) of section 103 of the Trafficking Victims Protection Act of 2000 (<ref href="/us/usc/t22/s7102">22 U.S.C. 7102</ref>) (relating to severe forms of trafficking in persons and sex trafficking, respectively); or</content></clause>
<clause class="fontsize10" id="y430a99d7-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>an act under State law, Tribal law, or the Uniform Code of Military Justice that is similar to an offense described in clause (i) or (ii).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430a99d8-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Conviction not required</inline>.—</heading><content>Nothing in subparagraph (A) shall be construed to require a criminal conviction or any other determination of a court in order for conduct to constitute a covered act.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a99d9-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Covered provider</inline>.—</heading><content>The term ‘<term>covered provider</term>’ means a provider of a private mobile service or commercial mobile service, as those terms are defined in section 332(d).</content></paragraph>
<paragraph class="fontsize10" id="y430a99da-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Primary account holder</inline>.—</heading><content>The term ‘<term>primary account holder</term>’ means an individual who is a party to a mobile service contract with a covered provider.</content></paragraph>
<paragraph class="fontsize10" id="y430a99db-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Shared mobile service contract</inline>.—</heading><chapeau>The term ‘<term>shared mobile service contract</term>’—</chapeau><subparagraph class="fontsize10" id="y430a99dc-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>means a mobile service contract for an account that includes not less than 2 consumers; and</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99dd-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>does not include enterprise services offered by a covered provider.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a99de-e819-11f0-bc57-ad3ac4b1618c" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Survivor</inline>.—</heading><chapeau>The term ‘<term>survivor</term>’ means an individual who is not less than 18 years old and—</chapeau><subparagraph class="fontsize10" id="y430a99df-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>against whom a covered act has been committed or allegedly committed; or</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99e0-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>who cares for another individual against whom a covered act has been committed or allegedly committed (provided that the individual providing care did not commit or allegedly commit the covered act).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430a99e1-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Separation of Lines From Shared Mobile Service Contract</inline>.—</heading><paragraph class="fontsize10" id="y430a99e2-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a99e3-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 2 business days after receiving a completed line separation request from a survivor pursuant to subsection (c), a covered provider shall, as applicable, with respect to a shared mobile service contract under which the survivor and the abuser each use a line—</chapeau><subparagraph class="fontsize10" id="y430a99e4-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>separate the line of the survivor, and the line of any individual in the care of the survivor, from the shared mobile service contract; or</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99e5-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>separate the line of the abuser from the shared mobile service contract.<page identifier="/us/stat/136/2282">136 STAT. 2282</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a99e6-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitations on penalties, fees, and other requirements</inline>.—</heading><chapeau>Except as provided in paragraphs (5) through (7), a covered provider may not make separation of a line from a shared mobile service contract under paragraph (1) contingent on any requirement other than the requirements under subsection (c), including—</chapeau><subparagraph class="fontsize10" id="y430a99e7-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>payment of a fee, penalty, or other charge;</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99e8-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>maintaining contractual or billing responsibility of a separated line with the provider;</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99e9-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>approval of separation by the primary account holder, if the primary account holder is not the survivor;</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99ea-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>a prohibition or limitation, including one described in subparagraph (A), on number portability, provided such portability is technically feasible, or a request to change phone numbers;</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99eb-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>a prohibition or limitation on the separation of lines as a result of arrears accrued by the account;</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99ec-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>an increase in the rate charged for the mobile service plan of the primary account holder with respect to service on any remaining line or lines; or</content></subparagraph>
<subparagraph class="fontsize10" id="y430a99ed-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>any other limitation or requirement not listed under subsection (c).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a99ee-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in paragraph (2) shall be construed to require a covered provider to provide a rate plan for the primary account holder that is not otherwise commercially available.</content></paragraph>
<paragraph class="fontsize10" id="y430a99ef-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Remote option</inline>.—</heading><content>A covered provider shall offer a survivor the ability to submit a line separation request under subsection (c) through secure remote means that are easily navigable, provided that remote options are commercially available and technically feasible.</content></paragraph>
<paragraph class="fontsize10" id="y430a99f0-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Responsibility for transferred telephone numbers</inline>.—</heading><content>Notwithstanding paragraph (2),<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a99f1-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote> beginning on the date on which a covered provider transfers billing responsibilities for and use of a telephone number or numbers to a survivor under paragraph (1)(A) in response to a line separation request submitted by the survivor under subsection (c), unless ordered otherwise by a court, the survivor shall assume financial responsibility, including for monthly service costs, for the transferred telephone number or numbers.</content></paragraph>
<paragraph class="fontsize10" id="y430a99f2-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><heading class="fontsize10"><inline class="smallCaps">Responsibility for transferred telephone numbers from a survivor’s account</inline>.—</heading><content>Notwithstanding paragraph (2), upon the transfer of a telephone number under paragraph (1)(B) in response to a line separation request submitted by a survivor under subsection (c), the survivor shall have no further financial responsibilities to the transferring covered provider for the services provided by the transferring covered provider for the telephone number or for any mobile device associated with the telephone number.</content></paragraph>
<paragraph class="fontsize10" id="y430a99f3-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a99f4-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Responsibility for mobile device</inline>.—</heading><content>Notwithstanding paragraph (2), beginning on the date on which a covered provider transfers billing responsibilities for and rights to a telephone number or numbers to a survivor under paragraph (1)(A) in response to a line separation request submitted by the survivor under subsection (c), unless otherwise ordered by a court, the survivor shall not assume financial responsibility for any mobile device associated with the separated line, unless the <page identifier="/us/stat/136/2283">136 STAT. 2283</page>
survivor purchased the mobile device, or affirmatively elects to maintain possession of the mobile device.</content></paragraph>
<paragraph class="fontsize10" id="y430a99f5-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">“(8) </num><heading class="fontsize10"><inline class="smallCaps">Notice to survivor</inline>.—</heading><content>If a covered provider separates a line from a shared mobile service contract under paragraph (1) and the primary account holder is not the survivor, the covered provider shall notify the survivor of the date on which the covered provider intends to give any formal notice to the primary account holder.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430a99f6-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Line Separation Request</inline>.—</heading><paragraph class="fontsize10" id="y430a99f7-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>In the case of a survivor seeking to separate a line from a shared mobile service contract, the survivor shall submit to the covered provider a line separation request that—</chapeau><subparagraph class="fontsize10" id="y430a99f8-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a99f9-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Verification.</p><p class="leftAlign firstIndent0 fontsize8" id="x430a99fa-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Records.</p></sidenote><chapeau>verifies that an individual who uses a line under the shared mobile service contract has committed or allegedly committed a covered act against the survivor or an individual in the survivor’s care, by providing—</chapeau><clause class="fontsize10" id="y430a99fb-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a copy of a signed affidavit from a licensed medical or mental health care provider, licensed military medical or mental health care provider, licensed social worker, victim services provider, or licensed military victim services provider, or an employee of a court, acting within the scope of that person’s employment; or</content></clause>
<clause class="fontsize10" id="y430a99fc-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a copy of a police report, statements provided by police, including military police, to magistrates or judges, charging documents, protective or restraining orders, military protective orders, or any other official record that documents the covered act;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430a99fd-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>in the case of relief sought under subsection (b)(1)(A), with respect to—</chapeau><clause class="fontsize10" id="y430a99fe-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a line used by the survivor that the survivor seeks to have separated, states that the survivor is the user of that specific line; and</content></clause>
<clause class="fontsize10" id="y430a99ff-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>a line used by an individual in the care of the survivor that the survivor seeks to have separated, includes an affidavit setting forth that the individual—</chapeau><subclause class="fontsize10" id="y430a9a00-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>is in the care of the survivor; and</content></subclause>
<subclause class="fontsize10" id="y430a9a01-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>is the user of that specific line; and</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430a9a02-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>requests relief under subparagraph (A) or (B) of subsection (b)(1) and identifies each line that should be separated.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a9a03-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a9a04-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notifications.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Communications from covered providers</inline>.—</heading><subparagraph class="fontsize10" id="y430a9a05-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A covered provider shall notify a survivor seeking relief under subsection (b) in clear and accessible language that the covered provider may contact the survivor, or designated representative of the survivor, to confirm the line separation, or if the covered provider is unable to complete the line separation for any reason, pursuant to subparagraphs (B) and (C).</content></subparagraph>
<subparagraph class="fontsize10" id="y430a9a06-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Remote means</inline>.—</heading><content>A covered provider shall notify a survivor under subparagraph (A) through remote means, provided that remote means are commercially available and technically feasible.</content></subparagraph>
<subparagraph class="fontsize10" id="y430a9a07-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Election of manner of contact</inline>.—</heading><chapeau>When completing a line separation request submitted by a survivor <page identifier="/us/stat/136/2284">136 STAT. 2284</page>
through remote means under paragraph (1), a covered provider shall allow the survivor to elect in the manner in which the covered provider may—</chapeau><clause class="fontsize10" id="y430a9a08-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>contact the survivor, or designated representative of the survivor, in response to the request, if necessary; or</content></clause>
<clause class="fontsize10" id="y430a9a09-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>notify the survivor, or designated representative of the survivor, of the inability of the covered provider to complete the line separation.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430a9a0a-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Enhanced protections under state law</inline>.—</heading><content>This subsection shall not affect any law or regulation of a State providing communications protections for survivors (or any similar category of individuals) that has less stringent requirements for providing evidence of a covered act (or any similar category of conduct) than this subsection.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430a9a0b-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Confidential and Secure Treatment of Personal Information</inline>.—</heading><paragraph class="fontsize10" id="y430a9a0c-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a9a0d-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding section 222(c)(2), a covered provider and any officer, director, employee, vendor, or agent thereof shall treat any information submitted by a survivor under subsection (c) as confidential and securely dispose of the information not later than 90 days after receiving the information.</content></paragraph>
<paragraph class="fontsize10" id="y430a9a0e-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in paragraph (1) shall be construed to prohibit a covered provider from maintaining, for longer than the period specified in that paragraph, a record that verifies that a survivor fulfilled the conditions of a line separation request under subsection (c).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430a9a0f-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Availability of Information to Consumers</inline>.—</heading><chapeau>A covered provider shall make information about the options and process described in subsections (b) and (c) readily available to consumers—</chapeau><paragraph class="fontsize10" id="y430a9a10-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430a9a11-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="x430a9a12-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Mobile app.</p></sidenote><content>on the website and the mobile application of the provider;</content></paragraph>
<paragraph class="fontsize10" id="y430a9a13-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>in physical stores; and</content></paragraph>
<paragraph class="fontsize10" id="y430a9a14-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>in other forms of public-facing consumer communication.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430a9a15-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">“(f) </num><heading class="fontsize10"><inline class="smallCaps">Technical Infeasibility</inline>.—</heading><paragraph class="fontsize10" id="y430a9a16-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The requirement to effectuate a line separation request pursuant to subsection (b)(1) shall not apply to a covered provider if the covered provider cannot operationally or technically effectuate the request.</content></paragraph>
<paragraph class="fontsize10" id="y430a9a17-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Notification</inline>.—</heading><chapeau>If a covered provider cannot operationally or technically effectuate a line separation request as described in paragraph (1), the covered provider shall—</chapeau><subparagraph class="fontsize10" id="y430ac128-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>notify the survivor who submitted the request of that infeasibility—</chapeau><clause class="fontsize10" id="y430ac129-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>at the time of the request; or</content></clause>
<clause class="fontsize10" id="y430ac12a-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430ac12b-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote><content>in the case of a survivor who has submitted the request using remote means, not later than 2 business days after receiving the request; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430ac12c-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provide the survivor with information about other alternatives to submitting a line separation request, including starting a new line of service.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430ac12d-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">“(g) </num><heading class="fontsize10"><inline class="smallCaps">Liability Protection</inline>.—</heading><paragraph class="fontsize10" id="y430ac12e-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A covered provider and any officer, director, employee, vendor, or agent thereof shall not be subject to liability for any claims deriving from an action taken or <page identifier="/us/stat/136/2285">136 STAT. 2285</page>
omission made with respect to compliance with this section and the rules adopted to implement this section.</content></paragraph>
<paragraph class="fontsize10" id="y430ac12f-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Commission authority</inline>.—</heading><content>Nothing in this subsection shall limit the authority of the Commission to enforce this section or any rules or regulations promulgated by the Commission pursuant to this section.”</content></paragraph>

<section id="d117434e741" identifier="/us/pl/117/223/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430ac130-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s345">47 USC 345 note</ref>.</p></sidenote><heading>RULEMAKING ON PROTECTIONS FOR SURVIVORS OF DOMESTIC VIOLENCE.</heading><subsection class="firstIndent0 fontsize10" id="y430c95f1-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph class="fontsize10" id="y430c95f2-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the term “<term>Affordable Connectivity Program</term>” means the program established under section 904(b) of division N of the Consolidated Appropriations Act, 2021 (<ref href="/us/pl/116/260">Public Law 116–260</ref>), as amended by section 60502 of the Infrastructure Investment and Jobs Act (<ref href="/us/pl/117/58">Public Law 117–58</ref>), or any successor program;</content></paragraph>
<paragraph class="fontsize10" id="y430c95f3-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the term “<term>appropriate congressional committees</term>” means the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="y430c95f4-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the term “<term>Commission</term>” means the Federal Communications Commission;</content></paragraph>
<paragraph class="fontsize10" id="y430c95f5-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the term “<term>covered hotline</term>” means a hotline related to domestic violence, dating violence, sexual assault, stalking, sex trafficking, severe forms of trafficking in persons, or any other similar act;</content></paragraph>
<paragraph class="fontsize10" id="y430c95f6-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the term “<term>designated program</term>” means the program designated by the Commission under subsection (b)(2)(A)(i) to provide emergency communications support to survivors;</content></paragraph>
<paragraph class="fontsize10" id="y430c95f7-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/6" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>the term “<term>Lifeline program</term>” means the program set forth in <ref href="/us/cfr/t47/pt54/sptE">subpart E of part 54 of title 47, Code of Federal Regulations</ref> (or any successor regulation);</content></paragraph>
<paragraph class="fontsize10" id="y430c95f8-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/7" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>the term “<term>text message</term>” has the meaning given the term in section 227(e)(8) of the Communications Act of 1934 (<ref href="/us/usc/t47/s227/e/8">47 U.S.C. 227(e)(8)</ref>); and</content></paragraph>
<paragraph class="fontsize10" id="y430c95f9-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/a/8" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>the term “<term>voice service</term>” has the meaning given such term in section 4(a) of the Pallone-Thune Telephone Robocall Abuse Criminal Enforcement and Deterrence Act (<ref href="/us/usc/t47/s227b/a">47 U.S.C. 227b(a)</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y430c95fa-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430c95fb-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rulemakings</inline>.—</heading><paragraph class="fontsize10" id="y430c95fc-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Line separations</inline>.—</heading><subparagraph class="fontsize10" id="y430c95fd-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 18 months after the date of enactment of this Act, the Commission shall adopt rules to implement section 345 of the Communications Act of 1934, as added by section 4 of this Act.</content></subparagraph>
<subparagraph class="fontsize10" id="y430c95fe-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>In adopting rules under subparagraph (A), the Commission shall consider—</chapeau><clause class="fontsize10" id="y430c95ff-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>privacy protections;</content></clause>
<clause class="fontsize10" id="y430c9600-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>account security and fraud detection;</content></clause>
<clause class="fontsize10" id="y430c9601-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>account billing procedures;</content></clause>
<clause class="fontsize10" id="y430c9602-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>procedures for notification of survivors about line separation processes;</content></clause>
<clause class="fontsize10" id="y430c9603-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>notice to primary account holders;</content></clause>
<clause class="fontsize10" id="y430c9604-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/vi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">(vi) </num><content>situations in which a covered provider cannot operationally or technically separate a telephone number or numbers from a shared mobile service contract such that the provider cannot effectuate a line separation request;<page identifier="/us/stat/136/2286">136 STAT. 2286</page></content></clause>
<clause class="fontsize10" id="y430c9605-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/vii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">(vii) </num><content>the requirements for remote submission of a line separation request, including how that option facilitates submission of verification information and meets the other requirements of section 345 of the Communications Act of 1934, as added by section 4 of this Act;</content></clause>
<clause class="fontsize10" id="y430c9606-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/viii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="viii">(viii) </num><content>feasibility of remote options for small covered providers;</content></clause>
<clause class="fontsize10" id="y430c9607-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/ix" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ix">(ix) </num><content>implementation timelines, including those for small covered providers;</content></clause>
<clause class="fontsize10" id="y430c9608-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/x" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="x">(x) </num><content>financial responsibility for transferred telephone numbers;</content></clause>
<clause class="fontsize10" id="y430c9609-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/xi" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xi">(xi) </num><content>whether and how the survivor can affirmatively elect to take financial responsibility for the mobile device associated with the separated line;</content></clause>
<clause class="fontsize10" id="y430c960a-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/xii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xii">(xii) </num><content>compliance with <ref href="/us/cfr/t47/pt64/sptU">subpart U of part 64 of title 47, Code of Federal Regulations</ref>, or any successor regulations (relating to customer proprietary network information) or any other legal or law enforcement requirements; and</content></clause>
<clause class="fontsize10" id="y430c960b-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/1/B/xiii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="xiii">(xiii) </num><content>ensuring covered providers have the necessary account information to comply with the rules and with section 345 of the Communications Act of 1934, as added by section 4 of this Act.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430c960c-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Emergency communications support for survivors</inline>.—</heading><subparagraph class="fontsize10" id="y430c960d-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 18 months after the date of enactment of this Act, or as part of a general rulemaking proceeding relating to the Lifeline program or the Affordable Connectivity Program, whichever occurs earlier, the Commission shall adopt rules that—</chapeau><clause class="fontsize10" id="y430c960e-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>designate a single program, which shall be either the Lifeline program or the Affordable Connectivity Program, to provide emergency communications support to survivors in accordance with this paragraph; and</content></clause>
<clause class="fontsize10" id="y430c960f-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>allow a survivor who is suffering from financial hardship and meets the requirements under section 345(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, without regard to whether the survivor meets the otherwise applicable eligibility requirements of the designated program, to—</chapeau><subclause class="fontsize10" id="y430c9610-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>enroll in the designated program as quickly as is feasible; and</content></subclause>
<subclause class="fontsize10" id="y430c9611-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430c9612-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>participate in the designated program based on such qualifications for not more than 6 months.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430c9613-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>In adopting rules under subparagraph (A), the Commission shall consider—</chapeau><clause class="fontsize10" id="y430c9614-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>how survivors who are eligible for relief and elected to separate a line under section 345(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, but whose lines could not be separated due to operational or technical infeasibility, can participate in the designated program; and<page identifier="/us/stat/136/2287">136 STAT. 2287</page></content></clause>
<clause class="fontsize10" id="y430c9615-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>confidentiality in the transfer and retention of any necessary documentation regarding the eligibility of a survivor to enroll in the designated program.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430c9616-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Evaluation</inline>.—</heading><chapeau>Not later than 2 years after completing the rulemaking under subparagraph (A), the Commission shall—</chapeau><clause class="fontsize10" id="y430c9617-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>evaluate the effectiveness of the Commission’s provision of support to survivors through the designated program;</content></clause>
<clause class="fontsize10" id="y430c9618-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430c9619-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>assess the detection and elimination of fraud, waste, and abuse with respect to the support described in clause (i); and</content></clause>
<clause class="fontsize10" id="y430c961a-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/C/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430c961b-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><content>submit to the appropriate congressional committees a report that includes the evaluation and assessment described in clauses (i) and (ii), respectively.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430c961c-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><content>Nothing in this paragraph shall be construed to limit the ability of a survivor who meets the requirements under section 345(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, to participate in the designated program indefinitely if the survivor otherwise qualifies for the designated program under the rules of the designated program.</content></subparagraph>
<subparagraph class="fontsize10" id="y430c961d-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><heading class="fontsize10"><inline class="smallCaps">Notification</inline>.—</heading><chapeau>A covered provider that receives a line separation request pursuant to section 345 of the Communications Act of 1934, as added by section 4 of this Act, shall inform the survivor who submitted the request of—</chapeau><clause class="fontsize10" id="y430c961e-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/E/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the existence of the designated program;</content></clause>
<clause class="fontsize10" id="y430c961f-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/E/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>who qualifies to participate in the designated program under the rules adopted under subparagraph (A) that are specially applicable to survivors; and</content></clause>
<clause class="fontsize10" id="y430c9620-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/2/E/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>how to participate in the designated program under the rules described in clause (ii).</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y430c9621-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Hotline calls</inline>.—</heading><subparagraph class="fontsize10" id="y430c9622-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this Act, the Commission shall commence a rulemaking proceeding to consider whether to, and how the Commission should—</chapeau><clause class="fontsize10" id="y430c9623-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>establish, and update on a monthly basis, a central database of covered hotlines to be used by a covered provider or a wireline provider of voice service; and</content></clause>
<clause class="fontsize10" id="y430c9624-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>require a covered provider or a wireline provider of voice service to omit from consumer-facing logs of calls or text messages any records of calls or text messages to covered hotlines in the central database described in clause (i), while maintaining internal records of those calls and messages.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430c9625-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><chapeau>The rulemaking conducted under subparagraph (A) shall include consideration of—</chapeau><clause class="fontsize10" id="y430c9626-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the ability of law enforcement agencies or survivors to access a log of calls or text messages in a criminal investigation or civil proceeding;</content></clause>
<clause class="fontsize10" id="y430c9627-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><chapeau>the ability of a covered provider or a wireline provider of voice service to—</chapeau><subclause class="fontsize10" id="y430c9628-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>identify logs that are consumer-facing; and<page identifier="/us/stat/136/2288">136 STAT. 2288</page></content></subclause>
<subclause class="fontsize10" id="y430c9629-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>omit certain consumer-facing logs, while maintaining internal records of such calls and text messages; and</content></subclause>
</clause>
<clause class="fontsize10" id="y430c962a-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>any other factors associated with the implementation of clauses (i) and (ii) to protect survivors, including factors that may impact smaller providers.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430c962b-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">No effect on law enforcement</inline>.—</heading><chapeau>Nothing in subparagraph (A) shall be construed to—</chapeau><clause class="fontsize10" id="y430c962c-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>limit or otherwise affect the ability of a law enforcement agency to access a log of calls or text messages in a criminal investigation; or</content></clause>
<clause class="fontsize10" id="y430c962d-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>alter or otherwise expand provider requirements under the Communications Assistance for Law Enforcement Act (<ref href="/us/pl/103/414">Public Law 103–414</ref>; <ref href="/us/stat/108/4279">108 Stat. 4279</ref>) or the amendments made by that Act.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y430c962e-e819-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/223/s5/b/3/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><heading class="fontsize10"><inline class="smallCaps">Compliance</inline>.—</heading><content>If the Commission establishes a central database through the rulemaking under subparagraph (A) and a covered provider updates its own databases to match the central database not less frequently than once every 30 days, no cause of action shall lie or be maintained in any court against the covered provider or its officers, employees, or agents for claims deriving from omission from consumer-facing logs of calls or text messages of any records of calls or text messages to covered hotlines in the central database.</content></subparagraph>

<section id="d117434e1155" identifier="/us/pl/117/223/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430cbd3f-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s345">47 USC 345 note</ref>.</p></sidenote><heading>EFFECTIVE DATE.</heading><content style="-uslm-lc:I658120">  The requirements under section 345 of the Communications Act of 1934, as added by section 4 of this Act, shall take effect 60 days after the date on which the Federal Communications Commission adopts the rules implementing that section pursuant to section 5(b)(1) of this Act.</content></section>
<section id="d117434e1167" identifier="/us/pl/117/223/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x430cbd40-e819-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t47/s345">47 USC 345 note</ref>.</p></sidenote><heading>SAVINGS CLAUSE.</heading><content style="-uslm-lc:I658120">   Nothing in this Act or the amendments made by this Act shall be construed to abrogate, limit, or otherwise affect the provisions set forth in the Communications Assistance for Law Enforcement Act (<ref href="/us/pl/103/414">Public Law 103–414</ref>; <ref href="/us/stat/108/4279">108 Stat. 4279</ref>) and the amendments made by that Act, any authority granted to the Federal Communications Commission pursuant to that Act or the amendments made by that Act, or any regulations promulgated by the Federal Communications Commission pursuant to that Act or the amendments made by that Act.</content></section>
<section id="d117434e1185" identifier="/us/pl/117/223/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the <page identifier="/us/stat/136/2289">136 STAT. 2289</page>
Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
