<section id="d65522e92" identifier="/us/pl/117/221/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Disaster Resiliency Planning Act</shortTitle>”.</content></section>
<section id="d65522e102" identifier="/us/pl/117/221/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x523b9c3f-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y523b9c40-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y523b9c41-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security and Governmental Affairs of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y523b9c42-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Oversight and Reform of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="y523b9c43-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s2/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Agency</inline>.—</heading><content>The term “<term>agency</term>” has the meaning given the term in <ref href="/us/usc/t5/s306">section 306 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y523b9c44-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s2/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Director</inline>.—</heading><content>The term “<term>Director</term>” means the Director of the Office of Management and Budget.</content></paragraph>
<paragraph class="fontsize10" id="y523b9c45-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s2/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Real property</inline>.—</heading><content>The term “<term>real property</term>” has the meaning given the term in section 1.856–10 of <ref href="/us/cfr/t26">title 26, Code of Federal Regulations</ref>, or any successor thereto.</content></paragraph>

<section id="d65522e163" identifier="/us/pl/117/221/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>GUIDANCE.</heading><subsection class="firstIndent0 fontsize10" id="y523c1176-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x523c1177-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 180 days after the date of enactment of this Act, the Director shall establish guidance requiring the head of each agency to incorporate natural disaster resilience into real property asset management and investment decisions made by the agency.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y523c1178-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x523c1179-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><content>The guidance required under subsection (a) shall direct each head of an agency to incorporate assessments of natural disaster risk information conducted by the agency, such as from vulnerability and other risk assessments, into real property asset management investment decisions made by the agency.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y523c117a-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Modification</inline>.—</heading><content>The Director may periodically update the guidance required under subsection (a) as the Director may determine necessary for the purpose of further enhancing natural disaster resilience.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y523c117b-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Consultation</inline>.—</heading><chapeau>In developing the guidance required under subsection (a), the Director may consult with appropriate entities, including—</chapeau><paragraph class="fontsize10" id="y523c117c-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Comptroller General of the United States;<page identifier="/us/stat/136/2278">136 STAT. 2278</page></content></paragraph>
<paragraph class="fontsize10" id="y523c117d-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Administrator of the Federal Emergency Management Agency; and</content></paragraph>
<paragraph class="fontsize10" id="y523c117e-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>any other relevant entities, as determined by the Director.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y523c117f-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><paragraph class="fontsize10" id="y523c1180-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 1 year after the date of enactment of this Act, the Director shall submit to the appropriate congressional committees a report that describes the guidance required under subsection (a).</content></paragraph>
<paragraph class="fontsize10" id="y523c1181-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/221/s3/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x523c1182-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content>Not later than 2 years after the date of enactment of this Act, the Director shall brief the appropriate congressional committees on the implementation of the guidance required under subsection (a) across agencies.</content></paragraph>
