<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa147827e-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Bridging the Gap for New Americans Act.</p></sidenote>
<section id="d66203e88" identifier="/us/pl/117/210/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Bridging the Gap for New Americans Act</shortTitle>”.</content></section>
<section id="d66203e98" identifier="/us/pl/117/210/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xa147d09f-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="ya147d0a0-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Applicable immigrants and refugees</inline>.—</heading><chapeau>The term “<term>applicable immigrants and refugees</term>”—</chapeau><subparagraph class="fontsize10" id="ya147d0a1-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>means individuals who—</chapeau><clause class="fontsize10" id="ya147d0a2-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i)</num><subclause class="inline" id="ya147d0a3-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1/A/i/I"><num value="I">(I) </num><content>are not citizens or nationals of the United States; and</content></subclause>
<subclause class="indentUp0 fontsize10" id="ya147d0a4-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1/A/i/II" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>are lawfully present in the United States and authorized to be employed in the United States; or</content></subclause>
</clause>
<clause class="fontsize10" id="ya147d0a5-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>are naturalized citizens of the United States who were born outside of the United States and its outlying possessions; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ya147d0a6-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>includes individuals described in section 602(b)(2) of the Afghan Allies Protection Act of 2009 (<ref href="/us/pl/111/8/dF/tVI">title VI of division F of Public Law 111–8</ref>; <ref href="/us/usc/t8/s1101">8 U.S.C. 1101 note</ref>).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya147d0a7-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Other terms</inline>.—</heading><content>Except as otherwise defined in this section, terms used in this Act have the definitions given such terms under section 101(a) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a">8 U.S.C. 1101(a)</ref>).</content></paragraph>

<section id="d66203e163" identifier="/us/pl/117/210/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>STUDY ON FACTORS AFFECTING EMPLOYMENT OPPORTUNITIES FOR IMMIGRANTS AND REFUGEES WITH PROFESSIONAL CREDENTIALS OBTAINED IN FOREIGN COUNTRIES.</heading><subsection class="firstIndent0 fontsize10" id="ya1486ce8-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Study Required</inline>.—</heading><paragraph class="fontsize10" id="ya1486ce9-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa1486cea-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Labor, in coordination with the Secretary of State, the Secretary of Education, the Secretary of Health and Human Services, the Secretary of Commerce, the Secretary of Homeland Security, the Administrator of the Internal Revenue Service, and the Commissioner of the Social Security Administration, shall conduct a study of the factors affecting employment opportunities in the United States for applicable immigrants and refugees who have professional credentials that were obtained in a country other than the United States.<page identifier="/us/stat/136/2246">136 STAT. 2246</page></content></paragraph>
<paragraph class="fontsize10" id="ya1486ceb-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Work with other entities</inline>.—</heading><content>The Secretary of Labor shall seek to work with relevant nonprofit organizations and State agencies to use the existing data and resources of such entities to conduct the study required under paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="ya1486cec-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Limitations on disclosure</inline>.—</heading><chapeau>Any information provided to the Secretary of Labor in connection with the study required under paragraph (1)—</chapeau><subparagraph class="fontsize10" id="ya1486ced-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>may only be used for the purposes of, and to the extent necessary to ensure the efficient operation of, such study; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya1486cee-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>may not be disclosed to any other person or entity except as provided under this subsection.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="ya1486cef-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa1486cf0-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analyses.</p></sidenote><inline class="smallCaps">Inclusions</inline>.—</heading><chapeau>The study required under subsection (a)(1) shall include—</chapeau><paragraph class="fontsize10" id="ya1486cf1-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa1486cf2-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><chapeau>an analysis of the employment history of applicable immigrants and refugees admitted to the United States during the 5-year period immediately preceding the date of the enactment of this Act, which shall include, to the extent practicable—</chapeau><subparagraph class="fontsize10" id="ya1486cf3-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a comparison of the employment applicable immigrants and refugees held before immigrating to the United States with the employment they obtained in the United States, if any, since their arrival; and</content></subparagraph>
<subparagraph class="fontsize10" id="ya1486cf4-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the occupational and professional credentials and academic degrees held by applicable immigrants and refugees before immigrating to the United States;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="ya1486cf5-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa1486cf6-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote>an assessment of any barriers that prevent applicable immigrants and refugees from using occupational experience obtained outside the United States to obtain employment in the United States;</content></paragraph>
<paragraph class="fontsize10" id="ya1486cf7-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>an analysis of available public and private resources assisting applicable immigrants and refugees who have professional experience and qualifications obtained outside of the United States to obtain skill-appropriate employment in the United States; and</content></paragraph>
<paragraph class="fontsize10" id="ya1486cf8-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa1486cf9-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="xa1486cfa-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><content>policy recommendations for better enabling applicable immigrants and refugees who have professional experience and qualifications obtained outside of the United States to obtain skill-appropriate employment in the United States.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="ya1486cfb-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 18 months after the date of the enactment of this Act, the Secretary of Labor shall—</chapeau><paragraph class="fontsize10" id="ya1486cfc-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>submit a report to Congress that describes the results of the study conducted pursuant to subsection (a); and<page identifier="/us/stat/136/2247">136 STAT. 2247</page></content></paragraph>
<paragraph class="fontsize10" id="ya1486cfd-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/210/s3/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xa1486cfe-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xa1486cff-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote>make such report publicly available on the website of the Department of Labor.</content></paragraph>
