<section id="d66504e92" identifier="/us/pl/117/206/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Blackwell School National Historic Site Act</shortTitle>”.</content></section>
<section id="d66504e102" identifier="/us/pl/117/206/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xc0e45094-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds that—</chapeau><paragraph class="fontsize10" id="yc0e45095-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>the Blackwell School, located at 501 South Abbott Street, in Marfa, Presidio County, Texas, is—</chapeau><subparagraph class="fontsize10" id="yc0e45096-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>associated with the period of racial segregation in Marfa public schools; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc0e45097-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the only extant property directly associated with Hispanic education in Marfa since the other buildings were torn down after the Blackwell School closed in 1965;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc0e45098-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the Blackwell School is a tangible reminder of the period during which the doctrine of “separate but equal” dominated education and social systems;</content></paragraph>
<paragraph class="fontsize10" id="yc0e477a9-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>despite being categorized as “white” by Texas law, Mexican Americans were regularly excluded from commingling with Anglo individuals at barbershops, restaurants, funeral homes, theaters, churches, and schools;</content></paragraph>
<paragraph class="fontsize10" id="yc0e477aa-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the spectrum of experiences of students and teachers at the Blackwell School are an important record of life in a segregated school in the context of the history of Texas and the United States;</content></paragraph>
<paragraph class="fontsize10" id="yc0e477ab-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Mexican and Mexican American culture and history in Marfa is tied to the Blackwell School, which for more than 50 years served as a leading feature of the Hispanic community, illustrating the challenge of maintaining cultural identity in a dominant Anglo society;</content></paragraph>
<paragraph class="fontsize10" id="yc0e477ac-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Hispanic influences continue to be seen in social and religious organizations, business and government institutions, and shared experiences of language, food, and music in Marfa, Texas;</content></paragraph>
<paragraph class="fontsize10" id="yc0e477ad-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><chapeau>the historic Blackwell School building is a physical record of—</chapeau><subparagraph class="fontsize10" id="yc0e477ae-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/7/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the longevity and beauty of the distinctive design and craftsmanship informed by traditional techniques and materials; and<page identifier="/us/stat/136/2237">136 STAT. 2237</page></content></subparagraph>
<subparagraph class="fontsize10" id="yc0e477af-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/7/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the transition from the purely vernacular to the period of materials, design, and workmanship made available after the arrival of the railroad;</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc0e477b0-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>the original historic school building and grounds on which the Blackwell School building stands provide an authentic setting to commemorate and interpret the history of the Blackwell School;</content></paragraph>
<paragraph class="fontsize10" id="yc0e477b1-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>the Blackwell School is closely associated with the broad patterns of local, State, and national history in the area of school segregation; and</content></paragraph>
<paragraph class="fontsize10" id="yc0e477b2-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s2/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>Mexicans and other members of the Latin American diaspora have placed a high value on education as a means of economic, social, and political advancement, but Hispanics and Latinos have not always had equitable opportunities and access to quality educational facilities in the United States.</content></paragraph>
</section>
<section id="d66504e183" identifier="/us/pl/117/206/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xc0e49ec3-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yc0e49ec4-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s3/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><content>The term “<term>map</term>” means the map entitled “Blackwell School National Historic Site Proposed Boundary”, numbered 593/178387, and dated February 2022.</content></paragraph>
<paragraph class="fontsize10" id="yc0e49ec5-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s3/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">National historic site</inline>.—</heading><content>The term “<term>National Historic Site</term>” means the Blackwell School National Historic Site established by section 4(a)(1).</content></paragraph>
<paragraph class="fontsize10" id="yc0e49ec6-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s3/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Secretary</inline>.—</heading><content>The term “<term>Secretary</term>” means the Secretary of the Interior.</content></paragraph>

<section id="d66504e218" identifier="/us/pl/117/206/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>ESTABLISHMENT OF THE BLACKWELL SCHOOL NATIONAL HISTORIC SITE.</heading><subsection class="firstIndent0 fontsize10" id="yc0e56217-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><paragraph class="fontsize10" id="yc0e56218-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Subject to paragraph (2), there is established the Blackwell School National Historic Site in the State of Texas as a unit of the National Park System to preserve, protect, and interpret for the benefit of present and future generations the Blackwell School, including—</chapeau><subparagraph class="fontsize10" id="yc0e56219-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the role of the Blackwell School as an academic and cultural cornerstone in Marfa, Texas; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc0e5621a-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the function of the Blackwell School within a segregated system of education in Texas and the United States from the period of 1885 through 1965.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc0e5621b-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Determination by secretary</inline>.—</heading><chapeau>The National Historic Site shall not be established until the date on which the Secretary determines that—</chapeau><subparagraph class="fontsize10" id="yc0e5621c-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc0e5621d-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><content>a written agreement has been entered into by the Secretary with the Marfa Unified School District providing that the Blackwell School shall be donated to the United States or co-managed with the Secretary for inclusion in a national historic site to be managed consistently with the purposes of a national historic site; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc0e5621e-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a sufficient quantity of land or an interest in land within the boundaries of the National Historic Site has been acquired to constitute a manageable unit.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc0e5621f-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Map</inline>.—</heading><paragraph class="fontsize10" id="yc0e56220-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Boundaries</inline>.—</heading><content>The boundaries of the National Historic Site shall be the boundaries generally depicted on the map.</content></paragraph>
<paragraph class="fontsize10" id="yc0e56221-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability of map</inline>.—</heading><content>The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.<page identifier="/us/stat/136/2238">136 STAT. 2238</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc0e56222-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Acquisition of Authority</inline>.—</heading><chapeau>The Secretary may only acquire any land or interest in land located within the boundary of the National Historic Site by—</chapeau><paragraph class="fontsize10" id="yc0e56223-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>donation;</content></paragraph>
<paragraph class="fontsize10" id="yc0e56224-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>purchase with donated funds; or</content></paragraph>
<paragraph class="fontsize10" id="yc0e56225-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>exchange.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc0e56226-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Administration</inline>.—</heading><paragraph class="fontsize10" id="yc0e56227-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Secretary shall administer the National Historic Site in accordance with—</chapeau><subparagraph class="fontsize10" id="yc0e56228-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="yc0e56229-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the laws generally applicable to units of the National Park System.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yc0e5622a-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Management plan</inline>.—</heading><subparagraph class="fontsize10" id="yc0e5622b-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc0e5622c-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 3 years after the date on which funds are first made available to the Secretary to prepare a general management plan for the National Historic Site, the Secretary shall prepare a general management plan for the National Historic Site in accordance with <ref href="/us/usc/t54/s100502">section 100502 of title 54, United States Code</ref>.</content></subparagraph>
<subparagraph class="fontsize10" id="yc0e5622d-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Submission</inline>.—</heading><content>On completion of the general management plan under subparagraph (A), the Secretary shall submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives the general management plan prepared under that subparagraph.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yc0e5622e-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xc0e5622f-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Contracts.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Cooperative Agreements</inline>.—</heading><content>The Secretary shall enter into cooperative agreements with the Blackwell School Alliance and other local, regional, State, academic, and nonprofit partners for interpretive and educational programming, technical assistance, and rehabilitation relating to the National Historic Site.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yc0e56230-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/206/s4/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Written Consent of Owner</inline>.—</heading><content>No private property or non-Federal public property shall be included within the boundaries of the National Historic Site or managed as part of the National Historic Site without the written consent of the owner of the property.</content></subsection>
