<section id="d66749e103" identifier="/us/pl/117/202/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd94ffe80-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s101">40 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Bulb Replacement Improving Government with High-efficiency Technology Act</shortTitle>” or the “<shortTitle role="act">BRIGHT Act</shortTitle>”.</content></section>
<section id="d66749e121" identifier="/us/pl/117/202/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd94ffe81-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t40/s3313">40 USC 3313 note</ref>.</p></sidenote><heading>GUIDANCE.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xd9502592-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xd9502593-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote> later than 1 year after the date of enactment of this Act, the Administrator of General Services shall—</chapeau><paragraph class="fontsize10" id="yd9502594-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>issue guidance to Federal agencies for the procurement and use of the most life-cycle cost effective and energy efficient lighting systems (as determined in accordance with <ref href="/us/usc/t40/s3313">section 3313 of title 40, United States Code</ref>) to increase the efficiency, effectiveness, and economy of the Federal Government; and</content></paragraph>
<paragraph class="fontsize10" id="yd9502595-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>publish on the internet or otherwise make available to State, local, and Tribal entities information on ways to improve efficiency, effectiveness, and economy by procuring and using the most life-cycle cost effective and energy efficient lighting systems (as determined in accordance with <ref href="/us/usc/t40/s3313">section 3313 of title 40, United States Code</ref>).</content></paragraph>
</section>
<section id="d66749e155" identifier="/us/pl/117/202/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PROCUREMENT OF LIFE-CYCLE COST EFFECTIVE AND ENERGY EFFICIENT LIGHTING SYSTEMS.</heading><subsection class="firstIndent0 fontsize10" id="yd950c1d6-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t40/s3313">Section 3313 of title 40, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yd950c1d7-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (h);</content></paragraph>
<paragraph class="fontsize10" id="yd950c1d8-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsections (d) through (g) as subsections (f) through (i), respectively;</content></paragraph>
<paragraph class="fontsize10" id="yd950c1d9-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> the section designation and heading and all that follows through the end of subsection (c) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><section class="centered fontsize12" id="yd951370a-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658164"><num class="fontsize12" value="3313">“§ 3313.</num><heading class="fontsize12"> Procurement of life-cycle cost effective and energy efficient lighting systems</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="yd951370b-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yd951370c-e819-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Administrator</inline>.—</heading><content>The term ‘<term>Administrator</term>’ means the Administrator of General Services.</content></paragraph>
<paragraph class="fontsize10" id="yd951370d-e819-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Lighting system</inline>.—</heading><content>The term ‘<term>lighting system</term>’ means the elements required to maintain a desired light level, <page identifier="/us/stat/136/2225">136 STAT. 2225</page>
including lamps, light fixtures, fixture distribution, sensors and control technologies, interior design elements, and daylighting sources.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yd951370e-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Procurement</inline>.—</heading><paragraph class="fontsize10" id="yd951370f-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>To the maximum extent practicable, the Administrator shall—</chapeau><subparagraph class="fontsize10" id="yd9513710-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>procure the most life-cycle cost effective and energy efficient lighting systems; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd9513711-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>ensure that procurements after the date of enactment of the BRIGHT Act of lighting systems or the individual components of lighting systems maximize life-cycle cost effectiveness and energy efficiency.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yd9513712-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Use</inline>.—</heading><content>Each public building constructed, altered, acquired, or leased by the Administrator shall be equipped, to the maximum extent practicable as determined by the Administrator, with the most life-cycle cost effective and energy efficient lighting systems for each application.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yd9513713-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Maintenance of Public Buildings</inline>.—</heading><content>Each individual component of a lighting system, including a lamp or fixture, that is replaced by the Administrator in the normal course of maintenance of public buildings shall be replaced, to the maximum extent practicable, with the most life-cycle cost effective and energy efficient lighting system possible for the application.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yd9513714-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><paragraph class="fontsize10" id="yd9513715-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Contracting options</inline>.—</heading><content>In carrying out this section, the Administrator shall consider appropriate contracting options for the procurement of the most life-cycle cost effective and energy efficient lighting systems.</content></paragraph>
<paragraph class="fontsize10" id="yd9513716-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Procurement and use</inline>.—</heading><chapeau>In making a determination under this section concerning the practicability of procuring and installing the most life-cycle cost effective and energy efficient lighting system, the Administrator shall consider—</chapeau><subparagraph class="fontsize10" id="yd9513717-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the compatibility of the lighting system with existing equipment, including consideration of a cost effective retrofit;</content></subparagraph>
<subparagraph class="fontsize10" id="yd9513718-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>whether procurement and use of the lighting system could result in interference with productivity;</content></subparagraph>
<subparagraph class="fontsize10" id="yd9513719-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>the aesthetics relating to the use of the lighting system; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd951371a-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>such other factors as the Administrator determines to be appropriate.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yd951371b-e819-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Life-Cycle Cost Effective</inline>.—</heading><content>The Administrator shall use the procedures and methods established under section 544(a) of the National Energy Conservation Policy Act (<ref href="/us/usc/t42/s8254/a">42 U.S.C. 8254(a)</ref>) in determining whether a lighting system is life-cycle cost effective.”</content></subsection>

<paragraph class="fontsize10" id="yd951371c-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><chapeau>in subsection (f) (as so redesignated)—</chapeau><subparagraph class="fontsize10" id="yd951371d-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>lighting fixture or bulb</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>lighting system</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="yd951371e-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (1), by <amendingAction type="delete">striking</amendingAction> “<quotedText>the fixture or bulb is</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>the lighting system or the individual components of the lighting system are</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="yd951371f-e819-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/202/s3/a/4/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>in paragraph (3), by <amendingAction type="delete">striking</amendingAction> “<quotedText>fixture or bulb</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>lighting system</quotedText>”;</content></subparagraph>
