<section id="d70744e88" identifier="/us/pl/117/187/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">FTC Collaboration Act of 2021</shortTitle>”.</content></section>
<section id="d70744e98" identifier="/us/pl/117/187/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x7153dbb0-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Fraud.</p></sidenote><heading>UNFAIR AND DECEPTIVE PRACTICES COOPERATION STUDY.</heading><subsection class="firstIndent0 fontsize10" id="y715477f1-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="y715477f2-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x715477f3-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Study required</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Federal Trade Commission shall conduct a study on facilitating and refining existing efforts with State Attorneys General to prevent, publicize, and penalize frauds and scams being perpetrated on individuals in the United States.</content></paragraph>
<paragraph class="fontsize10" id="y715477f4-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Requirements of study</inline>.—</heading><chapeau>In conducting the study, the Commission shall examine the following:</chapeau><subparagraph class="fontsize10" id="y715477f5-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The roles and responsibilities of the Commission and State Attorneys General that best advance collaboration and consumer protection.</content></subparagraph>
<subparagraph class="fontsize10" id="y715477f6-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The policies, procedures, and mechanisms that facilitate cooperation and communications across the Commission.</content></subparagraph>
<subparagraph class="fontsize10" id="y715477f7-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>How resources should be dedicated to best advance such collaboration and consumer protection.</content></subparagraph>
<subparagraph class="fontsize10" id="y715477f8-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The accountability mechanisms that should be implemented to promote collaboration and consumer protection.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y715477f9-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Consultation and public comment</inline>.—</heading><chapeau>In producing the study required in paragraph (1), the Commission shall—</chapeau><subparagraph class="fontsize10" id="y715477fa-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>consult with—</chapeau><clause class="fontsize10" id="y715477fb-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the National Association of State Attorneys General;</content></clause>
<clause class="fontsize10" id="y71549f0c-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>public interest organizations dedicated to consumer protection;</content></clause>
<clause class="fontsize10" id="y71549f0d-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>relevant private sector entities; and</content></clause>
<clause class="fontsize10" id="y71549f0e-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>any other Federal or State agency that the Federal Trade Commission considers necessary; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y71549f0f-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provide opportunity for public comment and advice relevant to the production of the study.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y71549f10-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x71549f11-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="x71549f12-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p><p class="leftAlign firstIndent0 fontsize8" id="x71549f13-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x71549f14-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Report to Congress</inline>.—</heading><chapeau>Not later than 6 months after the completion of the study required pursuant to subsection (a), the <page identifier="/us/stat/136/2202">136 STAT. 2202</page>
Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate, and make publicly available on the website of the Commission, a report that contains the following:</chapeau><paragraph class="fontsize10" id="y71549f15-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The results of the study.</content></paragraph>
<paragraph class="fontsize10" id="y71549f16-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Recommended best practices to enhance collaboration efforts between the Commission and State Attorneys General with respect to preventing, publicizing, and penalizing fraud and scams.</content></paragraph>
<paragraph class="fontsize10" id="y71549f17-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Quantifiable metrics by which enhanced collaboration can be measured.</content></paragraph>
<paragraph class="fontsize10" id="y71549f18-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Legislative recommendations, if any, to enhance collaboration efforts between the Commission and State Attorneys General to prevent, publicize, and penalize fraud and scams.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y71549f19-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/187/s2/c" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Commission Defined</inline>.—</heading><content>In this section, the term “<term>Commission</term>” means the Federal Trade Commission.</content></subsection>
