<section id="d71175e98" identifier="/us/pl/117/183/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb354d3e8-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s631">15 USC 631 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">SBIR and STTR Extension Act of 2022</shortTitle>”.</content></section>
<section id="d71175e113" identifier="/us/pl/117/183/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb354d3e9-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s638">15 USC 638 note</ref>.</p></sidenote><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb354fafa-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="yb354fafb-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Administration; administrator</inline>.—</heading><content>The terms “Administration” and “Administrator” mean the Small Business Administration and the Administrator thereof, respectively.</content></paragraph>
<paragraph class="fontsize10" id="yb354fafc-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Federal agency; phase i; phase ii; phase iii; sbir; sttr</inline>.—</heading><content>The terms “Federal agency”, “Phase I”, “Phase II”, “Phase III”, “SBIR”, and “STTR” have the meanings given those terms, respectively, in section 9(e) of the Small Business Act (<ref href="/us/usc/t15/s638/e">15 U.S.C. 638(e)</ref>).</content></paragraph>

<section id="d71175e147" identifier="/us/pl/117/183/s3" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REAUTHORIZATION OF SBIR AND STTR PROGRAMS AND PILOT PROGRAMS.</heading><content style="-uslm-lc:I658120">  Section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="delete">striking</amendingAction> “<quotedText>2022</quotedText>” each place that term appears and <amendingAction type="insert">inserting</amendingAction> “<quotedText>2025</quotedText>”.</content></section>
<section id="d71175e167" identifier="/us/pl/117/183/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>FOREIGN RISK MANAGEMENT.</heading><subsection class="firstIndent0 fontsize10" id="yb356cfbd-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>Section 9(e) of the Small Business Act (<ref href="/us/usc/t15/s638/e">15 U.S.C. 638(e)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb356f6ce-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in paragraph (13)(B), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></paragraph>
<paragraph class="fontsize10" id="yb356f6cf-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in paragraph (14), by <amendingAction type="delete">striking</amendingAction> the period at the end and <amendingAction type="insert">inserting</amendingAction> a semicolon; and</content></paragraph>
<paragraph class="fontsize10" id="yb356f6d0-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yb3571de1-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">“(15) </num><chapeau>the term ‘<term>covered individual</term>’ means an individual who—</chapeau><subparagraph class="fontsize10" id="yb3571de2-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>contributes in a substantive, meaningful way to the scientific development or execution of a research and development project proposed to be carried out with a research and development award from a Federal research agency; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb3571de3-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>is designated as a covered individual by the Federal research agency concerned;</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 fontsize10" id="yb3571de4-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">“(16) </num><content>the term ‘<term>foreign affiliation</term>’ means a funded or unfunded academic, professional, or institutional appointment or position with a foreign government or government-owned <page identifier="/us/stat/136/2181">136 STAT. 2181</page>
entity, whether full-time, part-time, or voluntary (including adjunct, visiting, or honorary);</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="yb3571de5-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="17">“(17) </num><content>the term ‘<term>foreign country of concern</term>’ means the People’s Republic of China, the Democratic People’s Republic of Korea, the Russian Federation, the Islamic Republic of Iran, or any other country determined to be a country of concern by the Secretary of State;</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="yb3571de6-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="18">“(18) </num><content>the term ‘<term>malign foreign talent recruitment program</term>’ has the meaning given such term in section 10638 of the Research and Development, Competition, and Innovation Act (<ref href="/us/pl/117/167/dB">division B of Public Law 117–167</ref>); and</content></paragraph>
<paragraph class="indentUp0 fontsize10" id="yb3571de7-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="19">“(19) </num><content>the term ‘<term>federally funded award</term>’ means a Phase I, Phase II (including a Phase II award under subsection (cc)), or Phase III SBIR or STTR award made using a funding agreement.”</content></paragraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yb3571de8-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Due Diligence Program to Assess Security Risks</inline>.—</heading><paragraph class="fontsize10" id="yb3571de9-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yb357931a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="vv">“(vv) </num><heading class="fontsize10"><inline class="smallCaps">Due Diligence Program to Assess Security Risks</inline>.—</heading><paragraph class="fontsize10" id="yb357931b-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb357931c-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><content>The head of each Federal agency required to establish an SBIR or STTR program, in coordination with the Administrator, shall establish and implement a due diligence program to assess security risks presented by small business concerns seeking a federally funded award.</content></paragraph>
<paragraph class="fontsize10" id="yb357931d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Risks</inline>.—</heading><chapeau>Each program established under paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="yb357931e-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>assess, using a risk-based approach as appropriate, the cybersecurity practices, patent analysis, employee analysis, and foreign ownership of a small business concern seeking an award, including the financial ties and obligations (which shall include surety, equity, and debt obligations) of the small business concern and employees of the small business concern to a foreign country, foreign person, or foreign entity; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb357931f-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>assess awards and proposals or applications, as applicable, using a risk-based approach as appropriate, including through the use of open-source analysis and analytical tools, for the nondisclosures of information required under (g)(13).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb3579320-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Administrative costs</inline>.—</heading><subparagraph class="fontsize10" id="yb3579321-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In addition to the amount allocated under subsection (mm)(1), each Federal agency required to establish an SBIR program may allocate not more than 2 percent of the funds allocated to the SBIR program of the Federal agency for the cost of establishing the due diligence program required under this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="yb3579322-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><clause class="fontsize10" id="yb3579323-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than December 31 of the year in which this subparagraph is enacted, and not later than December 31 of each year thereafter, the head of a Federal agency that exercises the authority under subparagraph (A) shall submit to the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives, the Committee on Small Business and Entrepreneurship of the Senate, and the Administrator, for the covered year—</chapeau><page identifier="/us/stat/136/2182">136 STAT. 2182</page>
<subclause class="fontsize10" id="yb3579324-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the total funds allowed to be allocated for the cost of establishing the due diligence program required under this subsection;</content></subclause>
<subclause class="fontsize10" id="yb3579325-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the total amount of funds obligated or expended under subparagraph (A); and</content></subclause>
<subclause class="fontsize10" id="yb3579326-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">“(III) </num><content>the due diligence activities carried out or to be carried out using amounts allocated under subparagraph (A).</content></subclause>

<clause class="fontsize10" id="yb3579327-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Annual report inclusion</inline>.—</heading><content>The Administrator shall include the information submitted by head of a Federal agency under clause (i) in the next annual report submitted under subsection (b)(7) after the Administrator receives such information.</content></clause>
<clause class="fontsize10" id="yb3579328-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb3579329-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Covered year</inline>.—</heading><content>In this subparagraph, the term ‘<term>covered year</term>’ means, with respect to the information required under clause (i), the year covered by the annual report submitted under subsection (b)(7) in which the Administrator is required to include such information by clause (ii).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb357932a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Termination date</inline>.—</heading><content>This paragraph shall terminate on September 30, 2025.”</content></subparagraph>

<paragraph class="fontsize10" id="yb357932b-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb357932c-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="xb357932d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s638">15 USC 638 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><subparagraph class="fontsize10" id="yb357932e-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 270 days after the date of enactment of this Act, the head of a Federal agency required to establish an SBIR or STTR program shall implement a due diligence program under subsection (vv) of section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as added by paragraph (1), at the Federal agency that, to the extent practicable, incorporates the applicable best practices disseminated under paragraph (3).</content></subparagraph>
<subparagraph class="fontsize10" id="yb357932f-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Paperwork reduction act</inline>.—</heading><content><ref href="/us/usc/t44/ch35">Chapter 35 of title 44, United States Code</ref> (commonly known as the “Paperwork Reduction Act”), shall not apply to the implementation of a due diligence program under subsection (vv) of section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as added by paragraph (1).</content></subparagraph>
<subparagraph class="fontsize10" id="yb3579330-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><content>Not later than 30 days after the date of enactment of this Act, and on a recurring basis until implementation is complete, each Federal agency required to establish a due diligence program under subsection (vv) of section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as added by paragraph (1), shall brief the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives on the implementation of the due diligence program.</content></subparagraph>

<paragraph class="fontsize10" id="yb357933c-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb357933d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s638">15 USC 638 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rule of construction</inline>.—</heading><chapeau>Nothing in subsection (vv) of section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as added by paragraph (1), shall be construed to—</chapeau><subparagraph class="fontsize10" id="yb357933e-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/b/5/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>apply to any Federal agency with a due diligence program that applies to the SBIR or STTR programs required under subsection (vv) of section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as added by paragraph (1), in existence as of the date of enactment of this Act; or</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="yb3579340-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Disclosures Regarding Ties to People’s Republic of China and Other Foreign Countries</inline>.—</heading><paragraph class="fontsize10" id="yb3579341-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/c/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">SBIR</inline>.—</heading><chapeau>Section 9(g) of the Small Business Act (<ref href="/us/usc/t15/s638/g">15 U.S.C. 638(g)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><subparagraph class="fontsize10" id="yb3579342-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s4/c/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in paragraph (11), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end;</content></subparagraph>

<clause class="fontsize10" id="yb35856be-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>has a business entity, parent company, or subsidiary located in the People’s Republic of China or another foreign country of concern; or</content></clause>
<clause class="fontsize10" id="yb35856bf-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>has an owner or covered individual that has a foreign affiliation with a research institution located in the People’s Republic of China or another foreign country of concern; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb35856c0-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the relationships and commitments described in clauses (i) through (iii) of subparagraph (A)—</chapeau><clause class="fontsize10" id="yb35856c1-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>interfere with the capacity for activities supported by the Federal agency to be carried out;</content></clause>
<clause class="fontsize10" id="yb35856c2-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>create duplication with activities supported by the Federal agency;</content></clause>
<clause class="fontsize10" id="yb35856c3-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>present concerns about conflicts of interest;</content></clause>
<clause class="fontsize10" id="yb35856c4-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>were not appropriately disclosed to the Federal agency;</content></clause>
<clause class="fontsize10" id="yb35856c5-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>violate Federal law or terms and conditions of the Federal agency; or</content></clause>

<section id="d71175e1121" identifier="/us/pl/117/183/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>REPORT ON ADVERSARIAL MILITARY AND FOREIGN INFLUENCE IN THE SBIR AND STTR PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="yb359dd8c-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Covered Agency Defined</inline>.—</heading><chapeau>In this section, the term “<term>covered agency</term>” means—</chapeau><paragraph class="fontsize10" id="yb35a049d-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the Department of Defense;</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yb35a04a1-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35a04a2-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Requirement</inline>.—</heading><paragraph class="fontsize10" id="yb35a04a3-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), not later than 180 days after the date of enactment of this Act, the head of each covered agency shall submit a report assessing the adversarial military and foreign influences in the SBIR and STTR programs at the covered agency to—</chapeau><subparagraph class="fontsize10" id="yb35a04a4-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Armed Services, the Committee on Small Business and Entrepreneurship, and the Committee on Commerce, Science, and Transportation of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb35a04a5-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Armed Services, the Committee on Small Business, and the Committee on Science, Space, and Technology of the House of Representatives.</content></subparagraph>

<paragraph class="fontsize10" id="yb35a04a6-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Department of health and human services</inline>.—</heading><chapeau>The Secretary of Health and Human Services shall submit 2 reports under paragraph (1)—</chapeau><subparagraph class="fontsize10" id="yb35a04a7-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>1 assessing the adversarial military and foreign influences in the SBIR and STTR programs of the National Institutes of Health; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb35a04a8-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>1 assessing the adversarial military and foreign influences in the SBIR and STTR programs of the Department of Health and Human Services other than those of the National Institutes of Health.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="yb35a04a9-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35a04aa-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analyses.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>Each report submitted by a covered agency under subsection (b) shall include an analysis of—</chapeau><paragraph class="fontsize10" id="yb35a04ab-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the national security and research and integrity risks of the SBIR and STTR programs of the covered agency; and</content></paragraph>
<paragraph class="fontsize10" id="yb35a04ac-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the capability of such covered agency to identify and mitigate such risks.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yb35a04ad-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Form</inline>.—</heading><content>Each report submitted under subsection (b) shall be in unclassified form, but may include a classified annex.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb35a04ae-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s6/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35a04af-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Independent Entity Contracting</inline>.—</heading><content>The head of each covered agency, in coordination with the heads of other Federal agencies, as appropriate, may enter into a contract with an independent entity to prepare a report required under subsection (b).<page identifier="/us/stat/136/2188">136 STAT. 2188</page></content></subsection>

<section id="d71175e1250" identifier="/us/pl/117/183/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>PROGRAM ON INNOVATION OPEN TOPICS.</heading><subsection class="firstIndent0 fontsize10" id="yb35aef10-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as amended by this Act, is further amended—</chapeau><paragraph class="fontsize10" id="yb35aef11-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (b)(7)—</chapeau><subparagraph class="fontsize10" id="yb35aef12-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/a/1/A" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subparagraph (G), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” at the end; and</content></subparagraph>

<subparagraph class="indentUp0 fontsize10" id="yb35b1625-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">“(J) </num><chapeau>the total number and dollar amount, and average size, of awards made by each Federal agency participating in the SBIR or STTR program, by phase, from—</chapeau><clause class="fontsize10" id="yb35b1626-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>open topics; and</content></clause>

<paragraph class="fontsize10" id="yb35b1628-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/a/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yb35b8b59-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="ww">“(ww) </num><heading class="fontsize10"><inline class="smallCaps">Program on Innovation Open Topics</inline>.—</heading><paragraph class="fontsize10" id="yb35b8b5a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35b8b5b-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Establishment</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this subsection, the Secretary of Defense shall establish innovation open topic activities using the SBIR and STTR programs of the Department of Defense in order to—</chapeau><subparagraph class="fontsize10" id="yb35b8b5c-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>increase the transition of commercial technology to the Department of Defense;</content></subparagraph>
<subparagraph class="fontsize10" id="yb35b8b5d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>expand the small business nontraditional industrial base;</content></subparagraph>
<subparagraph class="fontsize10" id="yb35b8b5e-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>increase commercialization derived from investments of the Department of Defense; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb35b8b5f-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>expand the ability for qualifying small business concerns to propose technology solutions to meet the needs of the Department of Defense.</content></subparagraph>

<paragraph class="fontsize10" id="yb35b8b60-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35b8b61-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Frequency</inline>.—</heading><content>The Secretary of Defense shall conduct not less than 1 open topic announcement at each component of the Department of Defense per fiscal year.</content></paragraph>
<paragraph class="fontsize10" id="yb35b8b62-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35b8b63-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Briefing</inline>.—</heading><chapeau>Not later than 180 days after the date of enactment of this subsection, the Secretary of Defense shall provide a briefing on the establishment of the program required under paragraph (1) to—</chapeau><subparagraph class="fontsize10" id="yb35b8b64-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the Committee on Armed Services and the Committee on Small Business and Entrepreneurship of the Senate; and</content></subparagraph>

<paragraph class="fontsize10" id="yb35b8b6b-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the number of awards under the SBIR and STTR programs made to first-time applicants and first-time awardees;<page identifier="/us/stat/136/2189">136 STAT. 2189</page></content></paragraph>

<paragraph class="fontsize10" id="yb35b8b6d-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>a description of outreach and assistance efforts by the Department of Defense to encourage and prepare new and diverse small business concerns to participate in the program established under subsection (ww) of section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as added by subsection (a);</content></paragraph>
<paragraph class="fontsize10" id="yb35b8b6e-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>the length of time to review and disburse awards under such subsection (ww), evaluated in a manner enabling normalized comparisons of such times taken by each Federal agency that is required to establish an SBIR or STTR program and offers open topics;</content></paragraph>
<paragraph class="fontsize10" id="yb35b8b6f-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35b8b70-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>the ratio, and an assessment, of the amount of funding allocated towards open topics as compared to conventional topics at each Federal agency that is required to establish an SBIR or STTR program and offers open topics; and</content></paragraph>
<paragraph class="fontsize10" id="yb35b8b71-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s7/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>a comparison of the types of technology and end users funded under open topics compared to the types of technology and end users funded under conventional topics.</content></paragraph>

</section>
<section id="d71175e1461" identifier="/us/pl/117/183/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>INCREASED MINIMUM PERFORMANCE STANDARDS FOR EXPERIENCED FIRMS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb35ceb02-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as amended by this Act, is further amended—</chapeau><paragraph class="fontsize10" id="yb35ceb03-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s8/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (b)(7), by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="fontsize10" id="yb35d1214-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">“(K) </num><content>the minimum performance standards established under subsection (qq), including any applicable modifications under paragraph (3) of such subsection, and the number of small business concerns that did not meet those minimum performance standards, provided that the Administrator does not publish any personally identifiable information, the identity of each such small business concern, or any otherwise sensitive information; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb35d1215-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="L">“(L) </num><content>the aggregate number and dollar amount of SBIR and STTR awards made pursuant to waivers under subsection (qq)(3)(E), provided that the Administrator does not publish any personally identifiable information, the identity of each such small business concern, or any otherwise sensitive information;”</content></subparagraph>

modified under clause (i), the small business concern may not receive more than 20 total Phase I awards and Phase II awards under subsection (cc) from each Federal agency during the 1-year period beginning on the date on which such determination is made.</content></clause>
<clause class="fontsize10" id="yb35dfc80-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Covered period defined</inline>.—</heading><content>In this subparagraph, the term ‘<term>covered period</term>’ means a consecutive period of 5 fiscal years preceding the most recent fiscal year.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb35dfc81-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfc82-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Progress to phase iii success</inline>.—</heading><clause class="fontsize10" id="yb35dfc83-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfc84-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirements.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Each minimum performance standard established under paragraph (2)(A)(ii) shall—</chapeau><subclause class="fontsize10" id="yb35dfc85-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>with respect to a small business concern that received or receives more than 50 Phase II awards during a covered period, require an average of $250,000 of aggregate sales and investments per Phase II award received during such covered period; and</content></subclause>
<subclause class="fontsize10" id="yb35dfc86-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>with respect to a small business concern that received or receives more than 100 Phase II awards during a covered period, require an average of $450,000 of aggregate sales and investments per Phase II award received during such covered period.</content></subclause>
</clause>
<clause class="fontsize10" id="yb35dfc87-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Consequence of failure to meet standard</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfc88-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xb35dfc89-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote>If the head of a Federal agency determines that a small business concern that received a Phase I award from the agency is not meeting an applicable increased minimum performance standard modified under clause (i), the small business concern may not receive more than 20 total Phase I awards and Phase II awards under subsection (cc) from each agency during the 1-year period beginning on the date on which such determination is made.</content></clause>
<clause class="fontsize10" id="yb35dfc8a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Documentation</inline>.—</heading><subclause class="fontsize10" id="yb35dfc8b-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A small business concern that is subject to an increased minimum performance standard described in clause (i) shall submit to the Administrator supporting documentation evidencing that all covered sales of the small business concern were properly used to meet the increased minimum performance standard.</content></subclause>
<subclause class="fontsize10" id="yb35dfc8c-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><heading class="fontsize10"><inline class="smallCaps">Covered sale defined</inline>.—</heading><chapeau>In this clause, the term ‘<term>covered sale</term>’ means a sale by a small business concern—</chapeau><item class="fontsize10" id="yb35dfc8d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">“(aa) </num><content>that the small business concern claims to be attributable to an SBIR or STTR award;</content></item>
<item class="fontsize10" id="yb35dfc8e-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>for which no amount of the payment was or is made using Federal funds;</content></item>
<item class="fontsize10" id="yb35dfc8f-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="cc">“(cc) </num><content>which the small business concern uses to meet an applicable increased minimum performance standard under clause (i); and</content></item>
<item class="fontsize10" id="yb35dfc90-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="dd">“(dd) </num><content>that was or is received during the 5 fiscal years immediately preceding the fiscal year in which the small business concern uses <page identifier="/us/stat/136/2191">136 STAT. 2191</page>
the sale to meet the increased minimum performance standard.</content></item>
</subclause>

<clause class="fontsize10" id="yb35dfc91-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Covered period defined</inline>.—</heading><content>In this subparagraph, the term ‘<term>covered period</term>’ means a consecutive period of 10 fiscal years preceding the most recent 2 fiscal years.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb35dfc92-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Patents for increased minimum performance standards</inline>.—</heading><content>A small business concern with respect to which an increased minimum performance standard under subparagraph (B) applies may not meet the increased minimum performance standard by obtaining patents.</content></subparagraph>
<subparagraph class="fontsize10" id="yb35dfc93-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Effective date</inline>.—</heading><content>Subparagraphs (A) through (C) shall take effect on April 1, 2023.</content></subparagraph>
<subparagraph class="fontsize10" id="yb35dfc94-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Waiver</inline>.—</heading><clause class="fontsize10" id="yb35dfc95-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Administrator may, upon the request of a senior official of a Federal agency, grant a waiver with respect to a topic for the SBIR or STTR program of the Federal agency if—</chapeau><subclause class="fontsize10" id="yb35dfc96-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>the topic is critical to the mission of the Federal agency or relates to national security; and</content></subclause>
<subclause class="fontsize10" id="yb35dfc97-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>the official submits to the Administrator a request for the waiver in accordance with clause (iii).</content></subclause>

<clause class="fontsize10" id="yb35dfc98-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Waiver effects</inline>.—</heading><content>If the Administration grants a waiver with respect to a topic for the SBIR or STTR program of a Federal agency, subparagraphs (A)(ii) and (B)(ii) shall not prohibit any covered small business concern from receiving an SBIR or STTR award under such topic.</content></clause>
<clause class="fontsize10" id="yb35dfc99-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Agency request and congressional notification</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfc9a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 15 days before the release of a solicitation including a topic for which a senior official of a Federal agency is requesting a waiver under clause (i), the senior official shall submit to the Administrator, the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives, and the Committee on Small Business and Entrepreneurship of the Senate a request for the waiver.</content></clause>
<clause class="fontsize10" id="yb35dfc9b-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><heading class="fontsize10"><inline class="smallCaps">Administrator determination and congressional notification</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfc9c-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 15 days after receiving a request for a waiver under clause (i), the Administrator shall make a determination with respect to the request and notify the senior official at the Federal agency that made the request, the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives, and the Committee on Small Business and Entrepreneurship of the Senate of the determination.</content></clause>
<clause class="fontsize10" id="yb35dfc9d-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subparagraph:</chapeau><subclause class="fontsize10" id="yb35dfc9e-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">Covered small business concern</inline>.—</heading><content>The term ‘<term>covered small business concern</term>’ means a small business concern that is subject to the consequences under subparagraph (A)(ii) or (B)(ii) pursuant to a determination by the head of a Federal agency that such small business concern did <page identifier="/us/stat/136/2192">136 STAT. 2192</page>
not meet an increased minimum performance standard that was applicable to such small business concern.</content></subclause>
<subclause class="fontsize10" id="yb35dfc9f-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfca0-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Senior official</inline>.—</heading><content>The term ‘<term>senior official</term>’ means an individual appointed to a position in a Federal agency that is classified above GS–15 pursuant <ref href="/us/usc/t5/s5108">section 5108 of title 5, United States Code</ref>, or any equivalent position, as determined by the Administrator.</content></subclause>

</subparagraph>
<subparagraph class="fontsize10" id="yb35dfca1-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><clause class="fontsize10" id="yb35dfca2-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfca3-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Lists.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Not later than July 1, 2023, and annually thereafter, the Administrator shall submit to Congress a list of the small business concerns that did not meet—</chapeau><subclause class="fontsize10" id="yb35dfca4-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>an applicable minimum performance standard established under paragraph (1)(A)(ii) or (2)(A)(ii); or</content></subclause>
<subclause class="fontsize10" id="yb35dfca5-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>an applicable increased minimum performance standard.</content></subclause>
</clause>
<clause class="fontsize10" id="yb35dfca6-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><heading class="fontsize10"><inline class="smallCaps">Waivers</inline>.—</heading><content>Each list submitted under clause (i) shall identify each small business concern that received an SBIR or STTR award pursuant to a waiver granted under subparagraph (E) by the Administrator during the period covered by the list.</content></clause>
<clause class="fontsize10" id="yb35dfca7-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><heading class="fontsize10"><inline class="smallCaps">Confidentiality</inline>.—</heading><content>Each list submitted under clause (i) shall be confidential and exempt from disclosure under <ref href="/us/usc/t5/s552/b/3">section 552(b)(3) of title 5, United States Code</ref> (commonly known as the ‘Freedom of Information Act’).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb35dfca8-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35dfca9-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Implementation</inline>.—</heading><content>Not later than April 1, 2023, the Administration shall implement the increased minimum performance standards under this paragraph.</content></subparagraph>
<subparagraph class="fontsize10" id="yb35dfcaa-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><heading class="fontsize10"><inline class="smallCaps">Rules of construction</inline>.—</heading><chapeau>Nothing in this paragraph shall be construed—</chapeau><clause class="fontsize10" id="yb35dfcab-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>to prohibit a small business concern from participating in a Phase I (or Phase II if under the authority of subsection (cc)) of an SBIR or STTR program under paragraph (1)(B) or (2)(B) solely on the basis of a determination by the head of a Federal agency that the small business concern is not meeting an increased minimum performance standard; or</content></clause>
<clause class="fontsize10" id="yb35dfcac-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>to prevent the head of a Federal agency from implementing more restrictive limitations on the number of federally funded Phase I awards and direct to Phase II awards under subsection (cc) that may be awarded to a small business concern than the limitations described in subparagraphs (A)(ii) and (B)(ii).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb35dfcad-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>This paragraph shall terminate on September 30, 2025.”</content></subparagraph>

<subparagraph class="fontsize10" id="yb35dfcaf-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s8/2/D" role="instruction" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentDown1 fontsize10" id="yb35e49d0-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35e49d1-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Inspector general audit</inline>.—</heading><chapeau>Not later than 1 year after the date on which the Administrator implements the increased minimum performance standards under paragraph (3), and periodically thereafter, the Inspector General of the Administration shall—</chapeau><page identifier="/us/stat/136/2193">136 STAT. 2193</page>
<subparagraph class="fontsize10" id="yb35e49d2-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>conduct an audit on whether the small business concerns subject to increased minimum performance standards under paragraph (3)(B) verified—</chapeau><clause class="fontsize10" id="yb35e49d3-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><chapeau>the sales by and investments in the small business concerns—</chapeau><subclause class="fontsize10" id="yb35e49d4-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35e49d5-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>during the 5 fiscal years immediately preceding the fiscal year in which the small business concern used such sales and investments to meet an applicable increased performance standard; and</content></subclause>
<subclause class="fontsize10" id="yb35e49d6-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><content>as a direct result of a Phase I award or Phase II award made under subsection (cc) during the covered period (as defined in paragraph (3)(B)(iv)), consistent with the definition of Phase III, as applicable;</content></subclause>
</clause>
<clause class="fontsize10" id="yb35e49d7-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><chapeau>any third-party revenue the small business concerns list as investments or incomes to meet the increased minimum performance standard—</chapeau><subclause class="fontsize10" id="yb35e49d8-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>is a direct result of a Phase I award or Phase II award made under subsection (cc) during the covered period (as defined in paragraph (3)(B)(iv)); and</content></subclause>
<subclause class="fontsize10" id="yb35e49d9-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">“(II) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35e70ea-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><content>consistent with the requirements of the Administrator as in effect on September 30, 2022, or any successor requirements; and</content></subclause>
</clause>
<clause class="fontsize10" id="yb35e70eb-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>any dollar amounts such small business concerns list as investments or income to meet such increased minimum performance standard the providence of which is unclear and that is not directly attributable to a Phase I award or Phase II award made under subsection (cc) during the covered period (as defined in paragraph (3)(B)(iv)), consistent with the definition of Phase III, as applicable;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb35e70ec-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35e70ed-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>assess the self-certification requirements for the minimum performance standards established under paragraph (2)(A)(ii) and the increased minimum performance standards under paragraph (3)(B); and</content></subparagraph>
<subparagraph class="fontsize10" id="yb35e70ee-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35e70ef-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives a report on the audit conducted under subparagraph (A) and the assessment conducted under subparagraph (B).</content></subparagraph>

<paragraph class="indentDown1 fontsize10" id="yb35e70f0-e81a-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">Increased minimum performance standard defined</inline>.—</heading><content>In this subsection, the term ‘<term>increased minimum performance standard</term>’ means a minimum performance standard established under paragraph (1)(A)(ii) or (2)(A)(ii) as modified under subparagraph (A) or (B), respectively, of paragraph (3) with respect to a small business concern.”</content></paragraph>

<section id="d71175e1999" identifier="/us/pl/117/183/s9" style="-uslm-lc:I658141"><num class="fontsize12" value="9">SEC. 9. </num><heading>PROHIBITION AGAINST WRITING SOLICITATION TOPICS.</heading><subsection class="firstIndent0 fontsize10" id="yb35e70f1-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s9/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 9 of the Small Business Act (<ref href="/us/usc/t15/s638">15 U.S.C. 638</ref>), as amended by this Act, is further amended by <amendingAction type="add">adding</amendingAction> at the end the following subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="yb35e9802-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="xx">“(xx) </num><heading class="fontsize10"><inline class="smallCaps">Additional Provisions Relating to Solicitation Topics</inline>.—</heading><paragraph class="fontsize10" id="yb35e9803-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35e9804-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Processes.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>A Federal agency required to establish an SBIR or STTR program shall implement a multi-level review <page identifier="/us/stat/136/2194">136 STAT. 2194</page>
and approval process within the Federal agency for solicitation topics to ensure adequate competition and that no private individual or entity is shaping the requirements for eligibility for the solicitation topic after the selection of the solicitation topic, except that the Federal agency may amend the requirements to clarify the solicitation topic.</content></paragraph>
<paragraph class="fontsize10" id="yb35e9805-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Referral</inline>.—</heading><content>A Federal agency that does not comply with paragraph (1) shall be referred to the Inspector General of the Administration for further investigation.”</content></paragraph>

<section id="d71175e2056" identifier="/us/pl/117/183/s10" style="-uslm-lc:I658142"><num class="fontsize12" value="10">SEC. 10. </num><heading>GAO STUDY ON MULTIPLE AWARD WINNERS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb35f0d36-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d37-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d38-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d39-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d3a-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time periods.</p><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d3b-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analyses.</p></sidenote> later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives a report, which shall be made publicly available, on small business concerns that are awarded not less than 50 Phase II awards under the SBIR or STTR programs during the consecutive period of 10 fiscal years preceding the most recent 2 fiscal years, including, to the extent practicable, an analysis of—</chapeau><paragraph class="fontsize10" id="yb35f0d3c-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s10/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the impact of the small business concerns on the SBIR and STTR programs;</content></paragraph>
<paragraph class="fontsize10" id="yb35f0d3d-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s10/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the ratio of the number of Phase II awards received by the small business concerns to the total number of Phase II awards;</content></paragraph>
<paragraph class="fontsize10" id="yb35f0d3e-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s10/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the ability of the small business concerns to commercialize and meet the tenets of the SBIR and STTR programs;</content></paragraph>
<paragraph class="fontsize10" id="yb35f0d3f-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s10/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>the impact on new entrants and seeding technology necessary to the Federal agency mission or commercial markets and, with respect to the Department of Defense, whether the types of technology the small business concerns are pursuing are primarily hardware, software, or system components for the warfighter;</content></paragraph>
<paragraph class="fontsize10" id="yb35f0d40-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s10/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d41-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>an evaluation and study of varying levels of award caps and lifetime program earning caps;</content></paragraph>
<paragraph class="fontsize10" id="yb35f0d42-e81a-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/183/s10/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35f0d43-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Assessment.</p></sidenote><content>an assessment of the increased minimum performance standards under paragraph (3) of section 9(qq) of the Small Business Act (<ref href="/us/usc/t15/s638/qq">15 U.S.C. 638(qq)</ref>), as added by section 8, on the behavior of those concerns and on the SBIR and STTR programs, and whether to continue such increased minimum performance standards; and</content></paragraph>

<section id="d71175e2130" identifier="/us/pl/117/183/s11" style="-uslm-lc:I658142"><num class="fontsize12" value="11">SEC. 11. </num><heading>GAO REPORT ON SUBCONTRACTING IN SBIR AND STTR PROGRAMS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb35f5b67-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb35f5b68-e81a-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluations.</p></sidenote> later than 1 year after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business and the Committee on Science, Space, and Technology of the House of Representatives a report evaluating, to the extent practicable, the following:</chapeau><page identifier="/us/stat/136/2195">136 STAT. 2195</page>
