<section id="d71973e99" identifier="/us/pl/117/172/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1073a2fe-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Public Safety Officer Support Act of 2022</shortTitle>”.</content></section>
<section id="d71973e114" identifier="/us/pl/117/172/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x1073a2ff-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10281">34 USC 10281 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x1073f120-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y1073f121-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Every day, public safety officers, including police officers, firefighters, emergency medical technicians, and others, work to maintain the safety, health, and well-being of the communities they serve.</content></paragraph>
<paragraph class="fontsize10" id="y1073f122-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>This means public safety officers are routinely called to respond to stressful and potentially traumatic situations, often putting their own lives in danger.</content></paragraph>
<paragraph class="fontsize10" id="y1073f123-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>This work not only puts public safety officers at-risk for experiencing harm, serious injury, and cumulative and acute trauma, but also places them at up to 25.6 times higher risk for developing post-traumatic stress disorder when compared to individuals without such experiences.</content></paragraph>
<paragraph class="fontsize10" id="y1073f124-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Psychological evidence indicates that law enforcement officers experience significant job-related stressors and exposures that may confer increased risk for mental health morbidities (such as post-traumatic stress disorder and suicidal thoughts, ideation, intents, and behaviors) and hastened mortality.</content></paragraph>
<paragraph class="fontsize10" id="y1073f125-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>Public safety officers often do not have the resources or support they need, leaving them at higher risk for long-term mental health consequences.</content></paragraph>
<paragraph class="fontsize10" id="y1073f126-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Whereas, although the Department of Defense already considers servicemember suicides to be line-of-duty deaths and provides Federal support to eligible surviving families, the Federal Government does not recognize public safety officer suicides as deaths in the line of duty.</content></paragraph>
<paragraph class="fontsize10" id="y1073f127-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>In 2017, the Department of Justice approved 481 claims under the Public Safety Officers’ Benefits Program under subpart 1 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281/etseq">34 U.S.C. 10281 et seq.</ref>), but not one of them for the more than 240 public safety officers who died by suicide that year.<page identifier="/us/stat/136/2099">136 STAT. 2099</page></content></paragraph>
<paragraph class="fontsize10" id="y1073f128-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>Public safety officers who have died or are disabled as a result of suicide or post-traumatic stress disorder do not qualify for the Public Safety Officers’ Benefits Program, despite the fact that public safety officers are more likely to die by suicide than from any other line-of-duty cause of death.</content></paragraph>
</section>
<section id="d71973e173" identifier="/us/pl/117/172/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>PUBLIC SAFETY OFFICER DEATH BENEFITS FOR POST-TRAUMATIC STRESS DISORDER, ACUTE STRESS DISORDER, OR TRAUMA AND STRESS RELATED DISORDERS.</heading><subsection class="firstIndent0 fontsize10" id="y10748d69-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s3/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Section 1201 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281">34 U.S.C. 10281</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="firstIndent0 fontsize10" id="y107529aa-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="o">“(o) </num><heading class="fontsize10"><inline class="smallCaps">Post-traumatic Stress Disorder, Acute Stress Disorder, or Trauma and Stress Related Disorders</inline>.—</heading><paragraph class="fontsize10" id="y107529ab-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><subparagraph class="fontsize10" id="y107529ac-e81b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Mass casualty event</inline>.—</heading><chapeau>The term ‘<term>mass casualty event</term>’ means an incident resulting in casualties to not fewer than 3 victims, including—</chapeau><clause class="fontsize10" id="y107529ad-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>an incident that exceeds the normal resources for emergency response available in the jurisdiction where the incident takes place; and</content></clause>
<clause class="fontsize10" id="y107529ae-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>an incident that results in a sudden and timely surge of injured individuals necessitating emergency services.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y107529af-e81b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Mass fatality event</inline>.—</heading><content>The term ‘<term>mass fatality event</term>’ means an incident resulting in the fatalities of not fewer than 3 individuals at 1 or more locations close to one another with a common cause.</content></subparagraph>
<subparagraph class="fontsize10" id="y107529b0-e81b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><heading class="fontsize10"><inline class="smallCaps">Mass shooting</inline>.—</heading><chapeau>The term ‘<term>mass shooting</term>’ means a multiple homicide incident in which not fewer than 3 victims are killed—</chapeau><clause class="fontsize10" id="y107529b1-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>with a firearm;</content></clause>
<clause class="fontsize10" id="y107529b2-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>during one event; and</content></clause>
<clause class="fontsize10" id="y107529b3-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>in one or more locations in close proximity.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y107529b4-e81b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><heading class="fontsize10"><inline class="smallCaps">Exposed</inline>.—</heading><chapeau>The term ‘<term>exposed</term>’ includes—</chapeau><clause class="fontsize10" id="y107529b5-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>directly experiencing or witnessing an event; or</content></clause>
<clause class="fontsize10" id="y107529b6-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>being subjected, in an intense way, to aversive consequences of the event (including a public safety officer collecting human remains).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y107529b7-e81b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><heading class="fontsize10"><inline class="smallCaps">Traumatic event</inline>.—</heading><chapeau>The term ‘<term>traumatic event</term>’ means, in the case of a public safety officer exposed to an event, an event that is—</chapeau><clause class="fontsize10" id="y107529b8-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a homicide, suicide, or the violent or gruesome death of another individual (including such a death resulting from a mass casualty event, mass fatality event, or mass shooting);</content></clause>
<clause class="fontsize10" id="y107529b9-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>a harrowing circumstance posing an extraordinary and significant danger or threat to the life of or of serious bodily harm to any individual (including such a circumstance as a mass casualty event, mass fatality event, or mass shooting); or</content></clause>
<clause class="fontsize10" id="y107529ba-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>an act of criminal sexual violence committed against any individual.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y107529bb-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x107529bc-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Personal injury sustained in line of duty</inline>.—</heading><chapeau>As determined by the Bureau—</chapeau><page identifier="/us/stat/136/2100">136 STAT. 2100</page>
<subparagraph class="fontsize10" id="y107529bd-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>post-traumatic stress disorder, acute stress disorder, or trauma and stress related disorders suffered by a public safety officer and diagnosed by a licensed medical or mental health professional, shall be presumed to constitute a personal injury within the meaning of subsection (a), sustained in the line of duty by the officer, if the officer was exposed, while on duty, to one or more traumatic events and such exposure was a substantial factor in the disorder;</content></subparagraph>
<subparagraph class="fontsize10" id="y107529be-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>post-traumatic stress disorder, acute stress disorder, or trauma and stress related disorders, suffered by a public safety officer who has contacted or attempted to contact the employee assistance program of the agency or entity that the officer serves, a licensed medical or mental health professional, suicide prevention services, or another mental health assistance service in order to receive help, treatment, or diagnosis for post-traumatic stress disorder or acute stress disorder, shall be presumed to constitute a personal injury within the meaning of subsection (a), sustained in the line of duty by the officer, if the officer, was exposed, while on duty, to one or more traumatic events and such exposure was a substantial factor in the disorder; and</content></subparagraph>
<subparagraph class="fontsize10" id="y107529bf-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>post-traumatic stress disorder, acute stress disorder, or trauma and stress related disorders, suffered by a public safety officer who was exposed, while on duty, to one or more traumatic events shall be presumed to constitute a personal injury within the meaning of subsection (a), sustained in the line of duty by the officer if such exposure was a substantial factor in the disorder.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y107529c0-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x107529c1-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Presumption of death or total disability</inline>.—</heading><chapeau>A public safety officer shall be presumed to have died or become permanently and totally disabled (within the meaning of subsection (a) or (b)) as the direct and proximate result of a personal injury sustained in the line of duty, if (as determined by the Bureau) the officer either—</chapeau><subparagraph class="fontsize10" id="y107529c2-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>took an action, which action was intended to bring about the officer’s death and directly and proximately resulted in such officer’s death or permanent and total disability and exposure, while on duty, to one or more traumatic events was a substantial factor in the action taken by the officer; or</content></subparagraph>
<subparagraph class="fontsize10" id="y107529c3-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x107529c4-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>took an action within 45 days of the end of exposure, while on duty, to a traumatic event, which action was intended to bring about the officer’s death and directly and proximately resulted in such officer’s death or permanent and total disability, if such action was not inconsistent with a psychiatric disorder.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y107529c5-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Applicability of limitations on benefits</inline>.—</heading><subparagraph class="fontsize10" id="y107529c6-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Intentional actions</inline>.—</heading><content>Section 1202(a)(1) shall not apply to any claim for a benefit under this part that is payable in accordance with this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="y107529c7-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Substance use</inline>.—</heading><content>Section 1202(a)(2) shall not preclude the payment of a benefit under this part if the benefit is otherwise payable in accordance with this subsection.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y107529c8-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x107529c9-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective dates.</p><p class="leftAlign firstIndent0 fontsize8" id="x107529ca-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10281">34 USC 10281 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Retroactive Applicability</inline>.—</heading><page identifier="/us/stat/136/2101">136 STAT. 2101</page>
<paragraph class="fontsize10" id="y107529cb-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Except as provided in paragraph (2), the amendments made by this section shall—</chapeau><subparagraph class="fontsize10" id="y107529cc-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s3/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>take effect on the date of enactment of this Act; and</content></subparagraph>
<subparagraph class="fontsize10" id="y107529cd-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/172/s3/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>apply to any matter pending, before the Bureau of Justice Assistance or otherwise, on the date of enactment of this Act, or filed (consistent with pre-existing effective dates) or accruing after that date.</content></subparagraph>

to Congress a report that details benefits issued pursuant to subsection (o) of section 1201 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10281">34 U.S.C. 10281</ref>), as added by section 3, and includes any recommendations to improve that subsection.</content></section>
