<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x54c87658-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">COVID–19 EIDL Fraud Statute of Limitations Act of 2022.</p></sidenote>
<section id="d79004e97" identifier="/us/pl/117/165/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x54c89d69-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t15/s9001">15 USC 9001 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">COVID–19 EIDL Fraud Statute of Limitations Act of 2022</shortTitle>”.</content></section>
<section id="d79004e112" identifier="/us/pl/117/165/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x54c89d6a-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p></sidenote><heading>EXTENSION OF STATUTE OF LIMITATIONS FOR CERTAIN COVID–19 ECONOMIC INJURY DISASTER LOAN PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="y54c8c47b-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/165/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Certain Economic Injury Disaster Loans</inline>.—</heading><content>Section 7(b) of the Small Business Act (<ref href="/us/usc/t15/s636/b">15 U.S.C. 636(b)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> after paragraph (15) the following new paragraph:<quotedContent><paragraph class="fontsize10" id="y54c8c47c-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">“(16) </num><heading class="fontsize10"><inline class="smallCaps">Statute of limitations</inline>.—</heading><content>Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to a loan made under this subsection in response to COVID–19 during the covered period (as defined in section 1110(a) of the CARES Act) shall be filed not later than 10 years after the offense was committed.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y54c8c47d-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/165/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">EIDL Advances</inline>.—</heading><content>Section 1110(e) of the CARES Act (<ref href="/us/usc/t15/s9009/e">15 U.S.C. 9009(e)</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new paragraph:<quotedContent><paragraph class="fontsize10" id="y54c8c47e-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">“(9) </num><heading class="fontsize10"><inline class="smallCaps">Statute of limitations</inline>.—</heading><content>Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to the use of an advance received under this subsection shall be filed not later than 10 years after the offense was committed.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y54c8c47f-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/165/s2/c" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Targeted EIDL Advances</inline>.—</heading><content>Section 331 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<ref href="/us/usc/t15/s9009b">15 U.S.C. 9009b</ref>) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y54c8eb90-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">Statute of Limitations</inline>.—</heading><content>Notwithstanding any other provision of law, any criminal charge or civil enforcement action alleging that a borrower engaged in fraud with respect to the <page identifier="/us/stat/136/1363">136 STAT. 1363</page>
