<section id="d79140e94" identifier="/us/pl/117/163/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Harriet Tubman Bicentennial Commemorative Coin Act</shortTitle>”.</content></section>
<section id="d79140e104" identifier="/us/pl/117/163/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6fa4aee9-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="y6fa4aeea-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Harriet Tubman was a formerly enslaved abolitionist who guided about 70 people from slavery to freedom in 10 years.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aeeb-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>Born in March 1822, Tubman was a notable abolitionist who not only freed herself, but also freed others from slavery.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aeec-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>Harriet Ross Tubman, born Araminta “Minty” Ross, was born enslaved on the plantation of Anthony Thompson in Dorchester County, Maryland.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aeed-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>With the help of the Underground Railroad network, in the fall of 1849, Tubman escaped from Poplar Neck in Caroline County, Maryland, heading north to freedom in Pennsylvania.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aeee-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>With the passing of the Fugitive Slave Act as part of the Compromise of 1850, the operations to help enslaved persons escape became dangerous and she risked her life to rescue them from slavery.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aeef-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Despite passage of the Compromise of 1850 and the Fugitive Slave Act, Tubman continued her work, escorting her refugees to Canada instead.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef0-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>It was during the 1850s that Tubman made 13 trips back to Maryland, guiding approximately 70 enslaved persons to the North, including family members, and providing instruction to about 70 more who found their way to freedom on their own.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef1-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>Regardless of the arduous process of helping fugitive enslaved persons escape through the Underground Railroad, not a single person was recaptured under Tubman’s supervision.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef2-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/9" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="9">(9) </num><content>During 1859, Tubman aided abolitionist John Brown by recruiting supporters for his raid on Harper’s Ferry, a planned insurrection against slaveholders in Virginia and Maryland.<page identifier="/us/stat/136/1354">136 STAT. 1354</page></content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef3-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/10" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="10">(10) </num><content>In the beginning of the Civil War, Tubman served as a spy, cook, and nurse in South Carolina and Florida.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef4-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/11" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="11">(11) </num><content>Tubman also recruited newly freed African-American men to join regiments of African-American soldiers called United States Colored Troops.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef5-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/12" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="12">(12) </num><content>In recognition of her abilities, Tubman served as an army scout and spy for Major General David Hunter and Colonel James Montgomery. Harriet Tubman was inducted into the Military Intelligence Corps Hall of Fame.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef6-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/13" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="13">(13) </num><content>Tubman distinguished herself as the first woman to lead an armed expedition in the Civil War, the Combahee River Raid, resulting in more than 700 enslaved persons in South Carolina being freed.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef7-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/14" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="14">(14) </num><content>After the Civil War, Tubman frequently sheltered and fed newly freed enslaved persons at her home on South Street in Auburn, New York, which she purchased from Secretary of State William Henry Seward, even though she had little money herself. She found a means to an end by working as a domestic, selling produce from her garden, taking in donations of food, loans from friends, and raising pigs on her farm.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef8-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/15" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="15">(15) </num><content>Tubman became active in the women’s movement as early as 1860. She attended meetings and gave speeches in her home State of New York, as well as in Boston and Washington, D.C.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aef9-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/16" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="16">(16) </num><content>Tubman was an avid advocate for African-American women and their civil rights. In 1896, she was invited as a speaker at the first meeting of the National Association of Colored Women in Washington, D.C.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aefa-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/17" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="17">(17) </num><content>Although living in financial insecurity, Tubman transferred a 25-acre parcel of land to the African Methodist Episcopal Zion Church in 1903, which eventually became The Harriet Tubman Home for the Aged and Indigent Negroes. At the time, few social services existed for elderly and ill people of color.</content></paragraph>
<paragraph class="fontsize10" id="y6fa4aefb-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s2/18" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="18">(18) </num><content>Escaping slavery, risking everything to save her family and friends, aiding enslaved persons in escape from slavery, leading a military raid, championing the cause of women’s suffrage, advocating for civil rights and access to health care, Harriet Tubman is an individual that has performed achievements that have had profound impacts on history and culture in the United States.</content></paragraph>

<section id="d79140e207" identifier="/us/pl/117/163/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>COIN SPECIFICATIONS.</heading><subsection class="firstIndent0 fontsize10" id="y6fa54b3c-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Denominations</inline>.—</heading><chapeau>In commemoration of Harriet Tubman, the Secretary of the Treasury (hereafter referred to in this Act as the “Secretary”) shall mint and issue the following coins:</chapeau><paragraph class="fontsize10" id="y6fa54b3d-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10 smallCaps">$5 gold coins<inline class="noSmallCaps">.—</inline></heading><chapeau>Not more than 50,000 $5 coins, which shall—</chapeau><subparagraph class="fontsize10" id="y6fa54b3e-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>weigh 8.359 grams;</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa54b3f-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>be struck on a planchet having a diameter of 0.850 inches; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa54b40-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>contain at least 90 percent gold.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6fa54b41-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10 smallCaps">$1 silver coins<inline class="noSmallCaps">.—</inline></heading><chapeau>Not more than 400,000 $1 coins, which shall—</chapeau><subparagraph class="fontsize10" id="y6fa54b42-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>weigh 26.73 grams;</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa54b43-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>be struck on a planchet having a diameter of 1.500 inches; and<page identifier="/us/stat/136/1355">136 STAT. 1355</page></content></subparagraph>
<subparagraph class="fontsize10" id="y6fa54b44-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>contain at least 90 percent silver.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y6fa54b45-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Half-dollar clad coins</inline>.—</heading><chapeau>Not more than 750,000 half-dollar coins which shall—</chapeau><subparagraph class="fontsize10" id="y6fa54b46-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>weigh 11.34 grams;</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa54b47-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>have a diameter of 1.205 inches; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa54b48-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/a/3/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>be minted to the specifications for half-dollar coins contained in <ref href="/us/usc/t31/s5112/b">section 5112(b) of title 31, United States Code</ref>.</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa54b49-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Legal Tender</inline>.—</heading><content>The coins minted under this Act shall be legal tender, as provided in <ref href="/us/usc/t31/s5103">section 5103 of title 31, United States Code</ref>.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa54b4a-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Numismatic Items</inline>.—</heading><content>For purposes of sections 5134 and 5136 of <ref href="/us/usc/t31">title 31, United States Code</ref>, all coins minted under this Act shall be considered to be numismatic items.</content></subsection>

<section id="d79140e327" identifier="/us/pl/117/163/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DESIGNS OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="y6fa5996b-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Design Requirements</inline>.—</heading><paragraph class="fontsize10" id="y6fa5996c-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The designs of the coins minted under this Act shall be emblematic of the legacy of Harriet Tubman as an abolitionist. At least one obverse design shall bear the image of Harriet Tubman.</content></paragraph>
<paragraph class="fontsize10" id="y6fa5996d-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Designation and inscriptions</inline>.—</heading><chapeau>On each coin minted under this Act, there shall be—</chapeau><subparagraph class="fontsize10" id="y6fa5996e-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>an inscription of Harriet Tubman;</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa5996f-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>a designation of the value of the coin;</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa59970-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>an inscription of the year “2024”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6fa59971-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>inscriptions of the words “Liberty”, “In God We Trust”, “United States of America”, and “E Pluribus Unum”.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa59972-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Selection</inline>.—</heading><chapeau>The designs for the coins minted under this Act shall be—</chapeau><paragraph class="fontsize10" id="y6fa59973-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fa59974-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>selected by the Secretary, after consultation with the National Underground Railroad Freedom Center in Cincinnati, Ohio, The Harriet Tubman Home, Inc. in Auburn, New York, and the Commission of the Fine Arts; and</content></paragraph>
<paragraph class="fontsize10" id="y6fa59975-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s4/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fa59976-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Review.</p></sidenote><content>reviewed by the Citizens Coinage Advisory Committee.</content></paragraph>
</subsection>
</section>
<section id="d79140e403" identifier="/us/pl/117/163/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>ISSUANCE OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="y6fa5c087-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Quality of Coins</inline>.—</heading><content>Coins minted under this Act shall be issued in uncirculated and proof qualities.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa5c088-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Mint Facility</inline>.—</heading><content>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa5c089-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Period for Issuance</inline>.—</heading><content>The Secretary may issue coins under this Act only during the period beginning on January 1, 2024, and ending on December 31, 2024.</content></subsection>

<section id="d79140e435" identifier="/us/pl/117/163/s6" style="-uslm-lc:I658141"><num class="fontsize12" value="6">SEC. 6. </num><heading>SALE OF COINS.</heading><subsection class="firstIndent0 fontsize10" id="y6fa60eaa-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Sale Price</inline>.—</heading><chapeau>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</chapeau><paragraph class="fontsize10" id="y6fa60eab-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>the face value of the coins;</content></paragraph>
<paragraph class="fontsize10" id="y6fa60eac-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>the surcharge provided under section 7(a) with respect to the coins; and</content></paragraph>
<paragraph class="fontsize10" id="y6fa60ead-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa60eae-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Bulk Sales</inline>.—</heading><content>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa60eaf-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Prepaid Orders</inline>.—</heading><page identifier="/us/stat/136/1356">136 STAT. 1356</page>
<paragraph class="fontsize10" id="y6fa60eb0-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of the coins.</content></paragraph>
<paragraph class="fontsize10" id="y6fa60eb1-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s6/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Discount</inline>.—</heading><content>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</content></paragraph>

<section id="d79140e502" identifier="/us/pl/117/163/s7" style="-uslm-lc:I658141"><num class="fontsize12" value="7">SEC. 7. </num><heading>SURCHARGES.</heading><subsection class="firstIndent0 fontsize10" id="y6fa65cd2-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>All sales of coins issued under this Act shall include—</chapeau><paragraph class="fontsize10" id="y6fa683e3-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>a surcharge of $35 per coin for the $5 coins;</content></paragraph>
<paragraph class="fontsize10" id="y6fa683e4-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>a surcharge of $10 per coin for the $1 coins; and</content></paragraph>
<paragraph class="fontsize10" id="y6fa683e5-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>a surcharge of $5 per coin for the half-dollar coin.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa683e6-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Distribution</inline>.—</heading><paragraph class="fontsize10" id="y6fa683e7-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in paragraph (2), subject to <ref href="/us/usc/t31/s5134/f">section 5134(f) of title 31, United States Code</ref>, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary equally to the National Underground Railroad Freedom Center in Cincinnati, Ohio, and The Harriet Tubman Home, Inc. in Auburn, New York, for the purpose of accomplishing and advancing their missions.</content></paragraph>
<paragraph class="fontsize10" id="y6fa683e8-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Exception</inline>.—</heading><content>Notwithstanding <ref href="/us/usc/t31/s5134/f/1">section 5134(f)(1) of title 31, United States Code</ref>, if an entity described in paragraph (1) of this subsection raises funds from private sources in an amount that is less than the total amount of the proceeds of the surcharge derived from the sale of the coins issued under this Act, the Secretary shall promptly pay to the other entity the proceeds of such surcharge.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa683e9-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Audits</inline>.—</heading><content>The National Underground Railroad Freedom Center in Cincinnati, Ohio, and The Harriet Tubman Home, Inc. in Auburn, New York, shall be subject to the audit requirements of <ref href="/us/usc/t31/s5134/f/2">section 5134(f)(2) of title 31, United States Code</ref>, with regard to the amounts received under subsection (b).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y6fa683ea-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s7/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under <ref href="/us/usc/t31/s5112/m/1">section 5112(m)(1) of title 31, United States Code</ref>. The Secretary of the Treasury may issue guidance to carry out this subsection.</content></subsection>

<section id="d79140e591" identifier="/us/pl/117/163/s8" style="-uslm-lc:I658141"><num class="fontsize12" value="8">SEC. 8. </num><heading>FINANCIAL ASSURANCES.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x6fa683eb-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  The Secretary shall take such actions as may be necessary to ensure that—</chapeau><paragraph class="fontsize10" id="y6fa683ec-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s8/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</content></paragraph>
<paragraph class="fontsize10" id="y6fa683ed-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/163/s8/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>no funds, including applicable surcharges, are disbursed to any recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, winning design compensation, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent <page identifier="/us/stat/136/1357">136 STAT. 1357</page>
with sections 5112(m) and 5134(f) of <ref href="/us/usc/t31">title 31, United States Code</ref>.</content></paragraph>
