<section id="d79780e88" identifier="/us/pl/117/158/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d17a97b-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1751">42 USC 1751 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Keep Kids Fed Act of 2022</shortTitle>”.</content></section>
<section id="d79780e103" identifier="/us/pl/117/158/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SUPPORT FOR CHILD NUTRITION PROGRAMS.</heading><subsection class="firstIndent0 fontsize10" id="y9d19301c-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d19301d-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1753">42 USC 1753 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="y9d19301e-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Temporary lunch reimbursement</inline>.—</heading><content>Each lunch served under the school lunch program authorized under the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1751/etseq">42 U.S.C. 1751 et seq.</ref>) shall receive additional reimbursement in the amount of 40 cents.</content></paragraph>
<paragraph class="fontsize10" id="y9d19301f-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Temporary breakfast reimbursement</inline>.—</heading><content>Each breakfast served under the school breakfast program established by section 4 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1773">42 U.S.C. 1773</ref>) shall receive additional reimbursement in the amount of 15 cents.</content></paragraph>
<paragraph class="fontsize10" id="y9d193020-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d193021-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>The additional reimbursement amounts authorized under this subsection shall only be available for the school year beginning July 2022.</content></paragraph>
<paragraph class="fontsize10" id="y9d193022-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Appropriations</inline>.—</heading><subparagraph class="fontsize10" id="y9d193023-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>There is appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to carry out this subsection.</content></subparagraph>
<subparagraph class="fontsize10" id="y9d193024-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/a/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Disbursement</inline>.—</heading><content>A State agency shall disburse funds made available under subparagraph (A) to school food authorities participating in the school meal programs described in paragraphs (1) and (2).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y9d193025-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Extension of Waivers</inline>.—</heading><chapeau>Section 2202 of the Families First Coronavirus Response Act (<ref href="/us/usc/t42/s1760">42 U.S.C. 1760 note</ref>; <ref href="/us/pl/116/127">Public Law 116–127</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y9d193026-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><chapeau>in subsection (a)(1)—</chapeau><subparagraph class="fontsize10" id="y9d193027-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in the matter preceding subparagraph (A), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>due to the COVID–19 pandemic</quotedText>” after “<quotedText>(<ref href="/us/usc/t42/s1760/l">42 U.S.C. 1760(l)</ref>)</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="y9d193028-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>and</quotedText>” after the semicolon and <amendingAction type="insert">inserting</amendingAction> “<quotedText>or</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9d193029-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/1/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="delete">striking</amendingAction> subparagraph (B) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subparagraph class="indentUp0 fontsize10" id="y9d19573a-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>ensuring continuity of program operation under a qualified program.”</content></subparagraph>

</paragraph>
<paragraph class="fontsize10" id="y9d19573b-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (d)—</chapeau><subparagraph class="fontsize10" id="y9d19573c-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> paragraph (2); and</content></subparagraph>
<subparagraph class="fontsize10" id="y9d19573d-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>the following:</quotedText>” in the matter preceding paragraph (1) and all that follows through “<quotedText>A summary</quotedText>” in paragraph (1) and <amendingAction type="insert">inserting</amendingAction> “<quotedText>a summary</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9d19573e-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="delete">striking</amendingAction> subsection (e) and <amendingAction type="insert">inserting</amendingAction> the following:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y9d19a55f-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">“(e) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><paragraph class="fontsize10" id="y9d19a560-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Nationwide waivers</inline>.—</heading><content>The authority of the Secretary to establish or grant a waiver under subsection (a) shall expire on September 30, 2022.</content></paragraph>
<paragraph class="fontsize10" id="y9d19a561-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Waiver restriction</inline>.—</heading><chapeau>After June 30, 2022, a waiver established or granted under subsection (a) shall only apply to schools or summer food service program food service sites—</chapeau><subparagraph class="fontsize10" id="y9d19a562-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>operating—</chapeau><clause class="fontsize10" id="y9d19a563-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>the qualified program described in subsection (f)(1)(D); or</content></clause>
<clause class="fontsize10" id="y9d19a564-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>the option described in section 13(a)(8) of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1761/a/8">42 U.S.C. 1761(a)(8)</ref>); and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y9d19a565-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>not operating the qualified program described in subsection (f)(1)(A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9d19a566-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Other waivers</inline>.—</heading><subparagraph class="fontsize10" id="y9d19a567-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Child and adult care food program waiver</inline>.—</heading><content>The authority of the Secretary to establish or grant a waiver under subsection (b) shall expire on June 30, 2022.</content></subparagraph>
<subparagraph class="fontsize10" id="y9d19a568-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Meal pattern waiver</inline>.—</heading><content>The authority of the Secretary to establish or grant a waiver under subsection (c) shall expire on June 30, 2023.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9d19a569-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Limitations</inline>.—</heading><content>A waiver authorized by the Secretary under this section shall not be in effect after the date on which the authority of the Secretary to establish or grant that waiver under this subsection expires.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y9d19cc7a-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d19cc7b-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Appropriation</inline>.—</heading><chapeau>There are appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to provide waivers under section 2202(a) of the Families First Coronavirus Response Act (<ref href="/us/usc/t42/s1760">42 U.S.C. 1760 note</ref>; <ref href="/us/pl/116/127">Public Law 116–127</ref>) that apply—</chapeau><paragraph class="fontsize10" id="y9d19cc7c-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d19cc7d-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>only during the months of May through September in 2022; and</content></paragraph>
<paragraph class="fontsize10" id="y9d19cc7e-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>to—</chapeau><subparagraph class="fontsize10" id="y9d19cc7f-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the summer food service program for children under section 13 of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1761">42 U.S.C. 1761</ref>); or</content></subparagraph>
<subparagraph class="fontsize10" id="y9d19cc80-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the option described in section 13(a)(8) of that Act (<ref href="/us/usc/t42/s1761/a/8">42 U.S.C. 1761(a)(8)</ref>).</content></subparagraph>

</subsection>
<subsection class="firstIndent0 fontsize10" id="y9d19cc81-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d19cc82-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1760">42 USC 1760 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Nationwide Waiver for School Year 2022-2023</inline>.—</heading><paragraph class="fontsize10" id="y9d19cc83-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>For purposes of school year 2022-2023, the Secretary of Agriculture may establish waivers under section 12(l) of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1760/l">42 U.S.C. 1760(l)</ref>)—</chapeau><subparagraph class="fontsize10" id="y9d19cc84-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>on a nationwide basis; and</content></subparagraph>
<subparagraph class="fontsize10" id="y9d19cc85-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>without regard to the requirements under paragraphs (1), (2), and (3) of such section that a State or eligible service provider shall submit an application for a waiver request.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y9d19cc86-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Sunset</inline>.—</heading><content>A nationwide waiver established by the Secretary of Agriculture under section 12(l) of the Richard B. <page identifier="/us/stat/136/1311">136 STAT. 1311</page>
Russell National School Lunch Act (<ref href="/us/usc/t42/s1760/l">42 U.S.C. 1760(l)</ref>) pursuant to paragraph (1) shall not be in effect after June 30, 2023.</content></paragraph>
</subsection>

<section id="d79780e481" identifier="/us/pl/117/158/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x9d19cc87-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t42/s1766">42 USC 1766 note</ref>.</p></sidenote><heading>CHILD AND ADULT CARE FOOD PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y9d1a1aa8-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><paragraph class="fontsize10" id="y9d1a1aa9-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Temporary additional reimbursement for 2022-2023 school year</inline>.—</heading><content>Each meal and supplement served under the program authorized by section 17 of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1766">42 U.S.C. 1766</ref>) shall receive additional reimbursement in the amount of 10 cents.</content></paragraph>
<paragraph class="fontsize10" id="y9d1a1aaa-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Limitation</inline>.—</heading><content>The additional reimbursement amount authorized under paragraph (1) shall only be available for the school year beginning July 2022.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y9d1a1aab-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Tier Determinations for 2022-2023 School Year</inline>.—</heading><content>For the school year beginning July 2022, a tier II family or group day care home described in subsection (f)(3)(A)(iii) of section 17 of the Richard B. Russell National School Lunch Act (<ref href="/us/usc/t42/s1766">42 U.S.C. 1766</ref>) shall be considered a tier I family or group day care home for purposes of the program authorized under that section.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y9d1a1aac-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/158/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Appropriations</inline>.—</heading><content>There are appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary to carry out this section.</content></subsection>
