<section id="d80199e92" identifier="/us/pl/117/150/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xdee054da-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t6/s101">6 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">State and Local Government Cybersecurity Act of 2021</shortTitle>”.</content></section>
<section id="d80199e107" identifier="/us/pl/117/150/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AMENDMENTS TO THE HOMELAND SECURITY ACT OF 2002.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xdee0ca0b-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Subtitle A of title XXII of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s651/etseq">6 U.S.C. 651 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="ydee0ca0c-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/150/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in section 2201 (<ref href="/us/usc/t6/s651">6 U.S.C. 651</ref>), by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="ydee0ca0d-e81b-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7) </num><heading class="fontsize10"><inline class="smallCaps">SLTT entity</inline>.—</heading><content>The term ‘<term>SLTT entity</term>’ means a domestic government entity that is a State government, local government, Tribal government, territorial government, or any subdivision thereof.”</content></paragraph>
</quotedContent>; and</content></paragraph>
<paragraph class="fontsize10" id="ydee0ca0e-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/150/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in section 2209 (<ref href="/us/usc/t6/s659">6 U.S.C. 659</ref>)—</chapeau><subparagraph class="fontsize10" id="ydee0ca0f-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/150/s2/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in subsection (c)(6), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>operational and</quotedText>” before “<quotedText>timely</quotedText>”;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee0ca10-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/150/s2/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in subsection (d)(1)(E), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>, including an entity that collaborates with election officials,</quotedText>” after “<quotedText>governments</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee0ca11-e81b-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/150/s2/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subsection class="indentDown2 firstIndent0 fontsize10" id="ydee13f42-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="p">“(p) </num><heading class="fontsize10"><inline class="smallCaps">Coordination on Cybersecurity for SLTT Entities</inline>.—</heading><paragraph class="fontsize10" id="ydee13f43-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Coordination</inline>.—</heading><chapeau>The Center shall, upon request and to the extent practicable, and in coordination as appropriate with Federal and non-Federal entities, such as the Multi-State Information Sharing and Analysis Center—</chapeau><subparagraph class="fontsize10" id="ydee16654-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>conduct exercises with SLTT entities;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee16655-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>provide operational and technical cybersecurity training to SLTT entities to address cybersecurity risks or incidents, with or without reimbursement, related to—</chapeau><clause class="fontsize10" id="ydee16656-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>cyber threat indicators;</content></clause>
<clause class="fontsize10" id="ydee16657-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>defensive measures;</content></clause>
<clause class="fontsize10" id="ydee16658-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>cybersecurity risks;</content></clause>
<clause class="fontsize10" id="ydee16659-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>vulnerabilities; and</content></clause>
<clause class="fontsize10" id="ydee1665a-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>incident response and management;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee1665b-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>in order to increase situational awareness and help prevent incidents, assist SLTT entities in sharing, in real time, with the Federal Government as well as among SLTT entities, actionable—</chapeau><page identifier="/us/stat/136/1296">136 STAT. 1296</page>
<clause class="fontsize10" id="ydee1665c-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>cyber threat indicators;</content></clause>
<clause class="fontsize10" id="ydee1665d-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>defensive measures;</content></clause>
<clause class="fontsize10" id="ydee1665e-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>information about cybersecurity risks; and</content></clause>
<clause class="fontsize10" id="ydee1665f-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>information about incidents;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee16660-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>provide SLTT entities notifications containing specific incident and malware information that may affect them or their residents;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee16661-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><chapeau>provide to, and periodically update, SLTT entities via an easily accessible platform and other means—</chapeau><clause class="fontsize10" id="ydee16662-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>information about tools;</content></clause>
<clause class="fontsize10" id="ydee16663-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>information about products;</content></clause>
<clause class="fontsize10" id="ydee16664-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>resources;</content></clause>
<clause class="fontsize10" id="ydee16665-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>policies;</content></clause>
<clause class="fontsize10" id="ydee16666-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">“(v) </num><content>guidelines;</content></clause>
<clause class="fontsize10" id="ydee16667-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vi">“(vi) </num><content>controls; and</content></clause>
<clause class="fontsize10" id="ydee16668-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="vii">“(vii) </num><content>other cybersecurity standards and best practices and procedures related to information security, including, as appropriate, information produced by other Federal agencies;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="ydee16669-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>work with senior SLTT entity officials, including chief information officers and senior election officials and through national associations, to coordinate the effective implementation by SLTT entities of tools, products, resources, policies, guidelines, controls, and procedures related to information security to secure the information systems, including election systems, of SLTT entities;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee1666a-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>provide operational and technical assistance to SLTT entities to implement tools, products, resources, policies, guidelines, controls, and procedures on information security;</content></subparagraph>
<subparagraph class="fontsize10" id="ydee1666b-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>assist SLTT entities in developing policies and procedures for coordinating vulnerability disclosures consistent with international and national standards in the information technology industry; and</content></subparagraph>
<subparagraph class="fontsize10" id="ydee1666c-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>promote cybersecurity education and awareness through engagements with Federal agencies and non-Federal entities.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown2 firstIndent0 fontsize10" id="ydee1666d-e81b-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="q">“(q) </num><heading class="fontsize10"><inline class="smallCaps">Report</inline>.—</heading><content>Not later than 1 year after the date of enactment of this subsection, and every 2 years thereafter, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland<page identifier="/us/stat/136/1297">136 STAT. 1297</page>
