<enactingFormula style="-uslm-lc:I658120"><i>  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</i></enactingFormula><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0b8acfdf-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Supply Chain Security Training Act of 2021.</p><p class="leftAlign firstIndent0 fontsize8" id="x0b8acfe0-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t41/s1703">41 USC 1703 note</ref>.</p></sidenote>
<section id="d124763e92" identifier="/us/pl/117/145/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Supply Chain Security Training Act of 2021</shortTitle>”.</content></section>
<section id="d124763e102" identifier="/us/pl/117/145/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TRAINING PROGRAM TO MANAGE SUPPLY CHAIN RISK.</heading><subsection class="firstIndent0 fontsize10" id="y0b8b4411-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0b8b4412-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>Not later than 180 days after the date of the enactment of this Act, the Administrator of General Services, through the Federal Acquisition Institute, shall develop a training program for officials with supply chain risk management responsibilities at Federal agencies.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y0b8b4413-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Content</inline>.—</heading><chapeau>The training program shall be designed to prepare such personnel to perform supply chain risk management activities and identify and mitigate supply chain security risks that arise throughout the acquisition lifecycle, including for the acquisition of information and communications technology. The training program shall—</chapeau><paragraph class="fontsize10" id="y0b8b4414-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>include, considering the protection of classified and other sensitive information, information on current, specific supply chain security threats and vulnerabilities; and</content></paragraph>
<paragraph class="fontsize10" id="y0b8b4415-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>be updated as determined to be necessary by the Administrator.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0b8b4416-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Coordination and Consultation</inline>.—</heading><chapeau>In developing and determining updates to the training program, the Administrator shall—</chapeau><paragraph class="fontsize10" id="y0b8b4417-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>coordinate with the Federal Acquisition Security Council, the Secretary of Homeland Security, and the Director of the Office of Personnel Management; and</content></paragraph>
<paragraph class="fontsize10" id="y0b8b4418-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>consult with the Director of the Department of Defense’s Defense Acquisition University, the Director of National Intelligence, and the Director of the National Institute of Standards and Technology.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y0b8b4419-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Guidance</inline>.—</heading><paragraph class="fontsize10" id="y0b8b441a-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0b8b441b-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Deadline.</p></sidenote>—</heading><chapeau>Not later than 180 days after the training program is developed under subsection (a), the Director of the Office of Management and Budget shall promulgate guidance to Federal agencies requiring executive agency adoption and use of the training program. Such guidance shall—</chapeau><subparagraph class="fontsize10" id="y0b8b441c-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>allow executive agencies to incorporate the training program into existing agency training programs; and<page identifier="/us/stat/136/1270">136 STAT. 1270</page></content></subparagraph>
<subparagraph class="fontsize10" id="y0b8b441d-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>provide guidance on how to identify executive agency officials with supply chain risk management responsibilities.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0b8b441e-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s2/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Availability</inline>.—</heading><content>The Director of the Office of Management and Budget shall make the guidance promulgated under paragraph (1) available to Federal agencies of the legislative and judicial branches.</content></paragraph>

<section id="d124763e201" identifier="/us/pl/117/145/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>REPORTS ON IMPLEMENTATION OF PROGRAM.</heading><content style="-uslm-lc:I658120">  Not<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x0b8b6b2f-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote> later than 180 days after the completion of the first course, and annually thereafter for the next three years, the Administrator of General Services shall submit to the appropriate congressional committees and leadership a report on implementation of the training program required under section 2.</content></section>
<section id="d124763e213" identifier="/us/pl/117/145/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>DEFINITIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="x0b8b9240-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120">  In this Act:</chapeau><paragraph class="fontsize10" id="y0b8b9241-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Appropriate congressional committees and leadership</inline>.—</heading><chapeau>The term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="fontsize10" id="y0b8b9242-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Homeland Security and Governmental Affairs and the Committee on Armed Services of the Senate; and</content></subparagraph>
<subparagraph class="fontsize10" id="y0b8b9243-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Oversight and Reform and the Committee on Armed Services of the House of Representatives.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y0b8b9244-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Information and communications technology</inline>.—</heading><content>The term “<term>information and communications technology</term>” has the meaning given the term in <ref href="/us/usc/t41/s4713/k">section 4713(k) of title 41, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y0b8b9245-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Executive agency</inline>.—</heading><content>The term “<term>executive agency</term>” has the meaning given the term in <ref href="/us/usc/t41/s133">section 133 of title 41, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y0b8b9246-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Federal agency</inline>.—</heading><content>The term “<term>Federal agency</term>” means any agency, committee, commission, office, or other establishment in the executive, legislative, or judicial branch of the Federal Government.<page identifier="/us/stat/136/1270">136 STAT. 1270</page></content></paragraph>
<paragraph class="fontsize10" id="y0b8b9247-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/145/s4/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Training program</inline>.—</heading><content>The term “<term>training program</term>” means the training program developed pursuant to section 2(a).</content></paragraph>
