<section id="d81042e115" identifier="/us/pl/117/144/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>SOUTH FLORIDA HARMFUL ALGAL BLOOMS AND HYPOXIA ASSESSMENT AND ACTION PLAN.</heading><subsection class="firstIndent0 fontsize10" id="y18fb8355-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/144/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>The Harmful Algal Bloom and Hypoxia Research and Control Act of 1998 (<ref href="/us/pl/105/383">Public Law 105–383</ref>; <ref href="/us/usc/t33/s4001/etseq">33 U.S.C. 4001 et seq.</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y18fb8356-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/144/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> sections 605 through 609<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fb8357-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">33 USC</p><p class="leftAlign firstIndent0 fontsize8" id="x18fb8358-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">4005–4009.</p></sidenote> as sections 606 through 610, respectively; and</content></paragraph>
<paragraph class="fontsize10" id="y18fb8359-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/144/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after section 604 the following:<quotedContent><section class="centered fontsize12" id="y18fc1f9a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658143"><num class="fontsize12" value="605">“SEC. 605. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc1f9b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadlines.</p><p class="leftAlign firstIndent0 fontsize8" id="x18fc46ac-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t33/s4004a">33 USC 4004a</ref>.</p></sidenote><heading class="fontsize12">SOUTH FLORIDA HARMFUL ALGAL BLOOMS AND HYPOXIA.</heading><subsection class="indentDown1 firstIndent0 fontsize10" id="y18fc46ad-e81c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">“(a) </num><heading class="fontsize10"><inline class="smallCaps">South Florida</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46ae-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote>—</heading><chapeau>In this section, the term ‘<term>South Florida</term>’ means—</chapeau><paragraph class="fontsize10" id="y18fc46af-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><content>all lands and waters within the administrative boundaries of the South Florida Water Management District;</content></paragraph>
<paragraph class="fontsize10" id="y18fc46b0-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>regional coastal waters, including Biscayne Bay, the Caloosahatchee Estuary, Florida Bay, Indian River Lagoon, and St. Lucie River Estuary; and</content></paragraph>
<paragraph class="fontsize10" id="y18fc46b1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>the Florida Reef Tract.</content></paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y18fc46b2-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">“(b) </num><heading class="fontsize10"><inline class="smallCaps">Integrated Assessment</inline>.—</heading><paragraph class="fontsize10" id="y18fc46b3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">Interim integrated assessment</inline>.—</heading><content>Not later than 540 days after the date of enactment of the South Florida Clean Coastal Waters Act of 2021, the Task Force, in accordance with the authority under section 603, shall complete and submit to Congress and the President an interim integrated assessment.</content></paragraph>
<paragraph class="fontsize10" id="y18fc46b4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Finalized integrated assessment</inline>.—</heading><content>Not later than 3 years after the date of enactment of the South Florida Clean Coastal Waters Act of 2021, the Task Force shall finalize, and submit to Congress and the President, the interim integrated assessment required by paragraph (1).</content></paragraph>
<paragraph class="fontsize10" id="y18fc46b5-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Contents of integrated assessment</inline>.<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46b6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Examination.</p></sidenote>—</heading><chapeau>The integrated assessment required by paragraphs (1) and (2) shall examine the causes, consequences, and potential approaches to reduce harmful algal blooms and hypoxia in South Florida, <page identifier="/us/stat/136/1267">136 STAT. 1267</page>
and the status of, and gaps within, current harmful algal bloom and hypoxia research, monitoring, management, prevention, response, and control activities that directly affect the region by—</chapeau><subparagraph class="fontsize10" id="y18fc46b7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>Federal agencies;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46b8-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>State agencies;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46b9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>regional research consortia;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46ba-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>academia;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46bb-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>private industry;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46bc-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>nongovernmental organizations; and</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46bd-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>Indian tribes (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<ref href="/us/usc/t25/s5304">25 U.S.C. 5304</ref>)).</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y18fc46be-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Action Plan</inline>.—</heading><paragraph class="fontsize10" id="y18fc46bf-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 3 years and 180 days after the date of the enactment of the South Florida Clean Coastal Waters Act of 2021, the Task Force shall develop and submit to Congress a plan, based on the integrated assessment under subsection (b), for reducing, mitigating, and controlling harmful algal blooms and hypoxia in South Florida.</content></paragraph>
<paragraph class="fontsize10" id="y18fc46c0-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>The plan submitted under paragraph (1) shall—</chapeau><subparagraph class="fontsize10" id="y18fc46c1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>address the monitoring needs identified in the integrated assessment under subsection (b);</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46c2-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46c3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Timeline.</p><p class="leftAlign firstIndent0 fontsize8" id="x18fc46c4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Budget.</p></sidenote><content>develop a timeline and budgetary requirements for deployment of future assets;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46c5-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><chapeau>identify requirements for the development and verification of South Florida harmful algal bloom and hypoxia models, including—</chapeau><clause class="fontsize10" id="y18fc46c6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>all assumptions built into the models; and</content></clause>
<clause class="fontsize10" id="y18fc46c7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>data quality methods used to ensure the best available data are utilized; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y18fc46c8-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>propose a plan to implement a remote monitoring network and early warning system for alerting local communities in the region to harmful algal bloom risks that may impact human health.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y18fc46c9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Requirements</inline>.—</heading><chapeau>In developing the action plan, the Task Force shall—</chapeau><subparagraph class="fontsize10" id="y18fc46ca-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46cb-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>consult with the State of Florida, and affected local and tribal governments;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46cc-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46cd-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>consult with representatives from regional academic, agricultural, industry, and other stakeholder groups;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46ce-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>ensure that the plan complements and does not duplicate activities conducted by other Federal or State agencies, including the South Florida Ecosystem Restoration Task Force;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46cf-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>identify critical research for reducing, mitigating, and controlling harmful algal bloom events and their effects;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46d0-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46d1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Evaluation.</p></sidenote><content>evaluate cost-effective, incentive-based partnership approaches;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46d2-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>ensure that the plan is technically sound and cost-effective;</content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46d3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>utilize existing research, assessments, reports, and program activities; <page identifier="/us/stat/136/1268">136 STAT. 1268</page></content></subparagraph>
<subparagraph class="fontsize10" id="y18fc46d4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x18fc46d5-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Federal Register, publication.</p><p class="leftAlign firstIndent0 fontsize8" id="x18fc46d6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Summary.</p><p class="leftAlign firstIndent0 fontsize8" id="x18fc46d7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p></sidenote><content>publish a summary of the proposed plan in the Federal Register at least 180 days prior to submitting the completed plan to Congress; and</content></subparagraph>
