<section id="d81233e88" identifier="/us/pl/117/140/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Commission To Study the Potential Creation of a National Museum of Asian Pacific American History and Culture Act</shortTitle>”.</content></section>
<section id="d81233e98" identifier="/us/pl/117/140/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>ESTABLISHMENT OF COMMISSION.</heading><subsection class="firstIndent0 fontsize10" id="y310d7887-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>There is established the Commission to Study the Potential Creation of a National Museum of Asian Pacific American History and Culture (hereafter in this Act referred to as the “Commission”).</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y310d7888-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x310d7889-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Appointments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Membership</inline>.—</heading><chapeau>The Commission shall be composed of 8 members, of whom—</chapeau><paragraph class="fontsize10" id="y310d788a-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>2 members shall be appointed by the majority leader of the Senate;</content></paragraph>
<paragraph class="fontsize10" id="y310d788b-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>2 members shall be appointed by the Speaker of the House of Representatives;</content></paragraph>
<paragraph class="fontsize10" id="y310d788c-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>2 members shall be appointed by the minority leader of the Senate; and</content></paragraph>
<paragraph class="fontsize10" id="y310d788d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>2 members shall be appointed by the minority leader of the House of Representatives.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y310d788e-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Qualifications</inline>.—</heading><chapeau>Members of the Commission shall be appointed to the Commission from among individuals, or representatives of institutions or entities, who possess—</chapeau><paragraph class="fontsize10" id="y310d788f-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1)</num><subparagraph class="inline" id="y310d7890-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/A"><num value="A">(A) </num><content>a demonstrated commitment to the research, study, or promotion of Asian Pacific American history, art, political or economic status, or culture; and</content></subparagraph>
<subparagraph class="indentUp0 fontsize10" id="y310d7891-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/B" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B)</num><clause class="inline" id="y310d7892-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/B/i"><num value="i">(i) </num><content>expertise in museum administration;</content></clause>
<clause class="indentUp0 fontsize10" id="y310d7893-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/B/ii" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>expertise in fundraising for nonprofit or cultural institutions;</content></clause>
<clause class="indentUp0 fontsize10" id="y310d7894-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/B/iii" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>experience in the study and teaching of Asian Pacific American history;</content></clause>
<clause class="indentUp0 fontsize10" id="y310d7895-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/B/iv" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>experience in studying the issue of the representation of Asian Pacific Americans in art, life, history, and culture at the Smithsonian Institution; or</content></clause>
<clause class="indentUp0 fontsize10" id="y310d7896-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/1/B/v" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>extensive experience in public or elected service;</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y310d7897-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>experience in the administration of, or the planning for, the establishment of, museums; or</content></paragraph>
<paragraph class="fontsize10" id="y310d7898-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/c/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>experience in the planning, design, or construction of museum facilities.<page identifier="/us/stat/136/1260">136 STAT. 1260</page></content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y310d7899-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Deadline for Initial Appointment</inline>.—</heading><content>The initial members of the Commission shall be appointed not later than the date that is 90 days after the date of enactment of this Act.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y310d789a-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Vacancies</inline>.—</heading><chapeau>A vacancy in the Commission—</chapeau><paragraph class="fontsize10" id="y310d789b-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>shall not affect the powers of the Commission; and</content></paragraph>
<paragraph class="fontsize10" id="y310d789c-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>shall be filled in the same manner as the original appointment was made.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y310d789d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Chairperson</inline>.—</heading><content>The Commission shall, by majority vote of all of the members, select 1 member of the Commission to serve as the Chairperson of the Commission.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y310d789e-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s2/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>No employee of the Federal Government may serve as a member of the Commission.</content></subsection>

<section id="d81233e251" identifier="/us/pl/117/140/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><heading>DUTIES OF THE COMMISSION.</heading><subsection class="firstIndent0 fontsize10" id="y310e3bef-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Reports</inline>.—</heading><paragraph class="fontsize10" id="y310e3bf0-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x310e3bf1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Recommenda-</p><p class="leftAlign firstIndent0 fontsize8" id="x310e3bf2-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">tions.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Plan of action</inline>.—</heading><content>The Commission shall submit to the President and Congress a report containing the recommendations of the Commission with respect to a plan of action regarding the feasibility of establishing and maintaining a National Museum of Asian Pacific American History and Culture in Washington, DC, and its environs (hereafter in this Act referred to as the “Museum”).</content></paragraph>
<paragraph class="fontsize10" id="y310e3bf3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Report on issues</inline>.—</heading><chapeau>The Commission shall submit to the President and Congress a report that addresses the following issues:</chapeau><subparagraph class="fontsize10" id="y310e3bf4-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>The availability and cost of collections to be acquired and housed in the Museum.</content></subparagraph>
<subparagraph class="fontsize10" id="y310e3bf5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>The impact of the Museum on existing Asian Pacific American history-related museums.</content></subparagraph>
<subparagraph class="fontsize10" id="y310e3bf6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x310e3bf7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Consultation.</p></sidenote><content>In consultation with the Smithsonian Institution, develop criteria for evaluating possible locations for the Museum in Washington, DC, and its environs.</content></subparagraph>
<subparagraph class="fontsize10" id="y310e3bf8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><content>The feasibility of the Museum becoming part of the Smithsonian Institution, taking into account the Museum’s potential impact on the Smithsonian’s existing facilities maintenance backlog, collections storage needs, and identified construction or renovation costs for new or existing museums.</content></subparagraph>
<subparagraph class="fontsize10" id="y310e3bf9-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/E" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">(E) </num><content>The governance and organizational structure from which the Museum should operate.</content></subparagraph>
<subparagraph class="fontsize10" id="y310e3bfa-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/F" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">(F) </num><content>Best practices for engaging Asian Pacific Americans in the development and design of the Museum.</content></subparagraph>
<subparagraph class="fontsize10" id="y310e3bfb-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/2/G" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">(G) </num><content>The cost of constructing, operating, and maintaining the Museum.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y310e3bfc-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Deadline</inline>.—</heading><content>The reports required under paragraphs (1) and (2) shall be submitted not later than the date that is 18 months after the date of the first meeting of the Commission.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y310e3bfd-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Fundraising Plan</inline>.—</heading><paragraph class="fontsize10" id="y310e3bfe-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commission shall develop a fundraising plan that will address the ability to support the establishment, operation, and maintenance of the Museum through contributions from the public.</content></paragraph>
<paragraph class="fontsize10" id="y310e3bff-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Considerations</inline>.—</heading><content>In developing the fundraising plan under paragraph (1), the Commission shall consider issues relating to funding the operations and maintenance of the Museum in perpetuity without reliance on appropriations of Federal funds.<page identifier="/us/stat/136/1261">136 STAT. 1261</page></content></paragraph>
<paragraph class="fontsize10" id="y310e3c00-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Independent review</inline>.—</heading><content>The Commission shall obtain an independent review of the viability of the plan developed under paragraph (1) and such review shall include an analysis as to whether the plan is able to achieve the level of resources necessary to fund the construction of the Museum and the operations and maintenance of the Museum in perpetuity without reliance on appropriations of Federal funds.</content></paragraph>
<paragraph class="fontsize10" id="y310e3c01-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Submission</inline>.—</heading><content>The Commission shall submit the plan developed under paragraph (1) and the review conducted under paragraph (3) to the Committees on House Administration, Natural Resources, and Appropriations of the House of Representatives and the Committees on Rules and Administration, Energy and Natural Resources, and Appropriations of the Senate.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="y310e3c02-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Legislation To Carry Out Plan of Action</inline>.—</heading><content>Based on the recommendations contained in the report submitted under paragraphs (1) and (2) of subsection (a), the Commission shall submit for consideration to the Committees on House Administration, Natural Resources, and Appropriations of the House of Representatives and the Committees on Rules and Administration, Energy and Natural Resources, and Appropriations of the Senate recommendations for a legislative plan of action on the feasibility of establishing and constructing the Museum.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y310e3c03-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s3/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x310e3c04-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">National Conference</inline>.—</heading><content>Not later than 18 months after the date on which the initial members of the Commission are appointed under section 2, the Commission may, in carrying out the duties of the Commission under this section, convene a national conference relating to the Museum, to be comprised of individuals committed to the advancement of the life, art, history, and culture of Asian Pacific Americans.</content></subsection>
</section>
<section id="d81233e404" identifier="/us/pl/117/140/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><heading>ADMINISTRATIVE PROVISIONS.</heading><subsection class="firstIndent0 fontsize10" id="y310ed845-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Compensation</inline>.—</heading><paragraph class="fontsize10" id="y310ed846-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>A member of the Commission—</chapeau><subparagraph class="fontsize10" id="y310ed847-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>shall not be considered to be a Federal employee for any purpose by reason of service on the Commission; and</content></subparagraph>
<subparagraph class="fontsize10" id="y310ed848-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>shall serve without pay.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y310ed849-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Travel expenses</inline>.—</heading><content>A member of the Commission shall be allowed a per diem allowance for travel expenses, at rates consistent with those authorized under <ref href="/us/usc/t5/ch57/schI">subchapter I of chapter 57 of title 5, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="y310ed84a-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Gifts, bequests, and devises</inline>.—</heading><content>The Commission may solicit, accept, use, and dispose of gifts, bequests, or devises of money, services, or real or personal property for the purpose of aiding or facilitating the work of the Commission.</content></paragraph>
<paragraph class="fontsize10" id="y310ed84b-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/a/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Federal advisory committee act</inline>.—</heading><content>The Commission shall not be subject to the Federal Advisory Committee Act (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y310ed84c-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Termination</inline>.—</heading><content>The Commission shall terminate on the date that is 30 days after the date on which the final versions of the reports required under section 3 are submitted.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y310ed84d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Funding</inline>.—</heading><paragraph class="fontsize10" id="y310ed84e-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/c/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commission shall be solely responsible for acceptance of contributions for, and payment of the expenses of, the Commission.<page identifier="/us/stat/136/1262">136 STAT. 1262</page></content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y310ed850-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><heading class="fontsize10"><inline class="smallCaps">Director and Staff of Commission</inline>.—</heading><paragraph class="fontsize10" id="y310ed851-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Director and staff</inline>.—</heading><subparagraph class="fontsize10" id="y310ed852-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Commission may employ and compensate an executive director and any other additional personnel that are necessary to enable the Commission to perform the duties of the Commission.</content></subparagraph>
<subparagraph class="fontsize10" id="y310ed853-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Rates of pay</inline>.—</heading><content>Rates of pay for persons employed under subparagraph (A) shall be consistent with the rates of pay allowed for employees of a temporary organization under <ref href="/us/usc/t5/s3161">section 3161 of title 5, United States Code</ref>.</content></subparagraph>

<paragraph class="fontsize10" id="y310ed854-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Not federal employment</inline>.—</heading><content>Any individual employed under this section shall not be considered a Federal employee for the purpose of any law governing Federal employment.</content></paragraph>
<paragraph class="fontsize10" id="y310ed855-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Technical assistance</inline>.—</heading><subparagraph class="fontsize10" id="y310ed856-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subject to subparagraph (B), on request of the Commission, the head of a Federal agency may provide technical assistance to the Commission.</content></subparagraph>
<subparagraph class="fontsize10" id="y310ed857-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/140/s4/d/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Prohibition</inline>.—</heading><content>No Federal employees may be detailed to the Commission.</content></subparagraph>

<section id="d81233e582" identifier="/us/pl/117/140/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><heading>DETERMINATION OF BUDGETARY EFFECTS.</heading><content style="-uslm-lc:I658120">  The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled “Budgetary Effects of PAYGO Legislation” for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</content></section>
