<section id="d125184e94" identifier="/us/pl/117/138/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Veterans Rapid Retraining Assistance Program Restoration and Recovery Act of 2022</shortTitle>”.</content></section>
<section id="d125184e104" identifier="/us/pl/117/138/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>RESTORATION OF ENTITLEMENT UNDER VETERANS RAPID RETRAINING ASSISTANCE PROGRAM.</heading><subsection class="firstIndent0 fontsize10" id="y4dd4b845-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/138/s2/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau>Section 8006 of the American Rescue Plan Act of 2021 (<ref href="/us/pl/117/2">Public Law 117–2</ref>), as amended by the Training in High-demand Roles to Improve Veteran Employment Act (<ref href="/us/pl/117/16">Public Law 117–16</ref>),<sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4dd4b846-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3001">38 USC 3001 note</ref> prec.</p></sidenote> is further amended—</chapeau><paragraph class="fontsize10" id="y4dd4b847-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/138/s2/a/1" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="redesignate">redesignating</amendingAction> subsection (n) as subsection (o); and</content></paragraph>
<paragraph class="fontsize10" id="y4dd4b848-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/138/s2/a/2" role="instruction" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>by <amendingAction type="insert">inserting</amendingAction> after subsection (m), the following new subsection (n):<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y4dd4df59-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="n">“(n) </num><heading class="fontsize10"><inline class="smallCaps">Effects of Closure of an Educational Institution or Disapproval of a Program of Education</inline>.—</heading><paragraph class="fontsize10" id="y4dd4df5a-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4dd4df5b-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Determination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Any payment of retraining assistance under subsection (d)(1) shall not be charged against any entitlement to retraining assistance described in subsection (a) if the Secretary determines that an individual was unable to complete a course or program of education as a result of —</chapeau><subparagraph class="fontsize10" id="y4dd4df5c-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the closure of an educational institution; or</content></subparagraph>
<subparagraph class="fontsize10" id="y4dd4df5d-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>the disapproval of a program of education by the State approving agency or the Secretary when acting in the role of the State approving agency.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y4dd4df5e-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Period not charged</inline>.—</heading><content>The period for which, by reason of this subsection, retraining assistance is not charged shall be equal to the full amount of retraining assistance provided for enrollment in the program of education.</content></paragraph>
<paragraph class="fontsize10" id="y4dd4df5f-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Halt of payments to certain educational institutions</inline>.—</heading><content>In the event of a closure or disapproval, as described in paragraph (1), the educational institution shall not receive any further payments under subsection (d).</content></paragraph>
<paragraph class="fontsize10" id="y4dd4df60-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Recovery of funds</inline>.—</heading><content>In the event of a closure or disapproval, as described in paragraph (1), any payment already made under subsection (d) to the educational institution shall be considered an overpayment and constitute a liability of such institution to the United States.”</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="y4dd4df61-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/138/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Conforming Amendment</inline>.—</heading><content>In subsection (b)(3) of such section, strike the period and insert “, except for an individual described in subsection (n).”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="y4dd4df62-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/138/s2/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x4dd4df63-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s3001">38 USC 3001 note</ref> prec.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by this section shall apply as if included in the American Rescue Plan Act of 2021 (<ref href="/us/pl/117/2">Public Law 117–2</ref>).</content></subsection>
