<section id="d125308e94" identifier="/us/pl/117/136/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Strengthening Oversight for Veterans Act of 2021</shortTitle>”.</content></section>
<section id="d125308e104" identifier="/us/pl/117/136/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>TESTIMONIAL SUBPOENA AUTHORITY OF THE INSPECTOR GENERAL OF THE DEPARTMENT OF VETERANS AFFAIRS.</heading><subsection class="firstIndent0 fontsize10" id="y6fbe354c-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/136/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content><ref href="/us/usc/t38/s312">Section 312 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="add">adding</amendingAction> at the end the following new subsection:<quotedContent><subsection class="firstIndent0 fontsize10" id="y6fbeaa7d-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d)</num><paragraph class="inline" id="y6fbeaa7e-e81c-11f0-bc57-ad3ac4b1618c"><num value="1">(1)</num><subparagraph class="inline" id="y6fbeaa7f-e81c-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><content>In addition to the authority otherwise provided by the Inspector General Act of 1978 (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) and in accordance with the requirements of this subsection, the Inspector General, in carrying out the provisions of this section, may require by subpoena the attendance and testimony of witnesses as necessary in the performance of the functions assigned to the Inspector General by the Inspector General Act of 1978 (<ref href="/us/usc/t5/app">5 U.S.C. App.</ref>) and this section, which in the case of contumacy or refusal to obey, such subpoena shall be enforceable by order of any appropriate district court of the United States.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa80-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>The Inspector General may not require by subpoena the attendance and testimony under subparagraph (A) of—</chapeau><clause class="fontsize10" id="y6fbeaa81-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>any current Federal employee; or</content></clause>
<clause class="fontsize10" id="y6fbeaa82-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any witness as part of any criminal proceeding.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa83-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><content>The authority to issue a subpoena under paragraph (1) may not be delegated.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa84-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3)</num><subparagraph class="inline" id="y6fbeaa85-e81c-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa86-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote><content>The Inspector General shall notify the Attorney General of the intent to issue a subpoena under paragraph (1).</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa87-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa88-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><content>Not later than 10 days after the date on which the Attorney General is notified pursuant to subparagraph (A), the Attorney General may object in writing to the issuance of the subpoena if the subpoena will interfere with an ongoing investigation and, if the Attorney General makes such an objection, the Inspector General may not issue the subpoena.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa89-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>If the Attorney General does not object in writing to the issuance of the subpoena during the 10-day period described in subparagraph (B), the Inspector General may issue the subpoena.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa8a-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><chapeau>Before requiring by subpoena under paragraph (1) the attendance and testimony of a witness, the Inspector General shall, to the degree practicable—<page identifier="/us/stat/136/1252">136 STAT. 1252</page></chapeau><subparagraph class="fontsize10" id="y6fbeaa8b-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa8c-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Notification.</p></sidenote><content>notify the witness of the intent of the Inspector General to issue the subpoena; and</content></subparagraph>
<subparagraph class="fontsize10" id="y6fbeaa8d-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>provide the witness an opportunity to attend and testify voluntarily.</content></subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa8e-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><content>Whenever requiring by subpoena under paragraph (1) the attendance and testimony of a witness, the Inspector General shall, to the greatest extent practicable, travel to residence of the witness, the principal place of business of the witness, or other similar location that is in proximity to the residence of the witness.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa8f-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">“(6)</num><subparagraph class="inline" id="y6fbeaa90-e81c-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa91-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Reports.</p></sidenote><content>Along with each semiannual report submitted by the Inspector General pursuant to section 5(b) of the Inspector General Act of 1978 (<ref href="/us/usc/t5/app5">5 U.S.C. App. 5</ref>(b)), the Inspector General shall include a report on the exercise of the authority provided by paragraph (1).</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa92-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa93-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Time period.</p></sidenote><chapeau>Each report submitted under subparagraph (A) shall include, for the most recently completed six-month period, the following:</chapeau><clause class="fontsize10" id="y6fbeaa94-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>The number of testimonial subpoenas issued and the number of individuals interviewed pursuant to such subpoenas.</content></clause>
<clause class="fontsize10" id="y6fbeaa95-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>The number of proposed testimonial subpoenas with respect to which the Attorney General objected under paragraph (3)(B).</content></clause>
<clause class="fontsize10" id="y6fbeaa96-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>A discussion of any challenges or concerns that the Inspector General has encountered exercising the authority provided by paragraph (1).</content></clause>
<clause class="fontsize10" id="y6fbeaa97-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>Such other matters as the Inspector General considers appropriate.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa98-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">“(7)</num><subparagraph class="inline" id="y6fbeaa99-e81c-11f0-bc57-ad3ac4b1618c"><num value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa9a-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Termination date.</p></sidenote><content>The authority provided by paragraph (1)(A) shall terminate on May 31, 2025.</content></subparagraph>
<subparagraph class="indentUp0 firstIndent0 fontsize10" id="y6fbeaa9b-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>The termination of authority by subparagraph (A) shall not affect the enforceability of a subpoena issued under paragraph (1)(A) before the date of such termination.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y6fbeaa9c-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/136/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaa9d-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s312">38 USC 312 note</ref>.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Effective Date</inline>.—</heading><paragraph class="fontsize10" id="y6fbeaa9e-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/136/s2/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Subsection (d) of <ref href="/us/usc/t38/s312">section 312 of title 38, United States Code</ref>, as added by subsection (a), shall take effect on the date of the enactment of this Act.</content></paragraph>
<paragraph class="fontsize10" id="y6fbeaa9f-e81c-11f0-bc57-ad3ac4b1618c" identifier="/us/pl/117/136/s2/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x6fbeaaa0-e81c-11f0-bc57-ad3ac4b1618c" style="-uslm-lc:I658180">Applicability.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Semiannual report</inline>.—</heading><content>Paragraph (6) of subsection (d) <page identifier="/us/stat/136/1253">136 STAT. 1253</page>
of such section, as so added, shall apply beginning on the date that is seven months after the first day of the first fiscal year beginning after the date of the enactment of this Act.</content></paragraph>
