<section id="d81761e98" identifier="/us/pl/117/133/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92011c81-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t38/s101">38 USC 101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Dr. Kate Hendricks Thomas Supporting Expanded Review for Veterans In Combat Environments Act</shortTitle>” or the “<shortTitle role="act">Dr. Kate Hendricks Thomas SERVICE Act</shortTitle>”.</content></section>
<section id="d81761e116" identifier="/us/pl/117/133/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>REVISION OF BREAST CANCER MAMMOGRAPHY POLICY OF DEPARTMENT OF VETERANS AFFAIRS TO PROVIDE MAMMOGRAPHY SCREENING FOR VETERANS WHO SERVED IN LOCATIONS ASSOCIATED WITH TOXIC EXPOSURE.</heading><subsection class="firstIndent0 fontsize10" id="y920191b2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/a" role="instruction" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><chapeau><ref href="/us/usc/t38/s7322">Section 7322 of title 38, United States Code</ref>, <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="y920191b3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (a), by <amendingAction type="delete">striking</amendingAction> “<quotedText>The</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">In General</headingText>.—The</quotedText>”;</content></paragraph>
<paragraph class="fontsize10" id="y920191b4-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>in subsection (b)—</chapeau><subparagraph class="fontsize10" id="y920191b5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/a/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>The</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText><headingText class="smallCaps">Standards for Screening</headingText>.—The</quotedText>”; and</content></subparagraph>
<subparagraph class="fontsize10" id="y920191b6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/a/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>in paragraph (2)(B), by <amendingAction type="insert">inserting</amendingAction> “<quotedText>a record of service in a location and during a period specified in subsection (d),</quotedText>” after “<quotedText>risk factors,</quotedText>”; and</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="y920191b7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following new subsections:<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="y92022df8-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">“(c) </num><heading class="fontsize10"><inline class="smallCaps">Eligibility for Screening for Veterans Exposed to Toxic Substances</inline>.—</heading><content>The Under Secretary for Health shall ensure that, under the policy developed under subsection (a), any veteran who, during active military, naval, or air service, was deployed in support of a contingency operation in a location and during a period specified in subsection (d), is eligible for a mammography screening by a health care provider of the Department.</content></subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="y92022df9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">“(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92022dfa-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Country listing.</p><p class="leftAlign firstIndent0 fontsize8" id="x92022dfb-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determinations.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Locations and Periods Specified</inline>.—</heading><paragraph class="inline" id="y92022dfc-e81c-11f0-a1e4-69761a48a15a"><num value="1">(1) </num><chapeau>The locations and periods specified in this subsection are the following:</chapeau><subparagraph class="fontsize10" id="y92022dfd-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>Iraq during following periods:</chapeau><clause class="fontsize10" id="y92022dfe-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>The period beginning on August 2, 1990, and ending on February 28, 1991.</content></clause>
<clause class="fontsize10" id="y92022dff-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>The period beginning on March 19, 2003, and ending on such date as the Secretary determines burn pits are no longer used in Iraq.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92022e00-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>The Southwest Asia theater of operations, other than Iraq, during the period beginning on August 2, 1990, and ending <page identifier="/us/stat/131/1239">131 STAT. 1239</page>
on such date as the Secretary determines burn pits are no longer used in such location, including the following locations:</chapeau><clause class="fontsize10" id="y92022e01-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>Kuwait.</content></clause>
<clause class="fontsize10" id="y92022e02-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>Saudi Arabia.</content></clause>
<clause class="fontsize10" id="y92022e03-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>Oman.</content></clause>
<clause class="fontsize10" id="y92022e04-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>Qatar.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="y92022e05-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>Afghanistan during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Afghanistan.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e06-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>Djibouti during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Djibouti.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e07-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="E">“(E) </num><content>Syria during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Syria.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e08-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="F">“(F) </num><content>Jordan during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Jordan.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e09-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="G">“(G) </num><content>Egypt during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Egypt.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e0a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="H">“(H) </num><content>Lebanon during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Lebanon.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e0b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">“(I) </num><content>Yemen during the period beginning on September 11, 2001, and ending on such date as the Secretary determines burn pits are no longer used in Yemen.</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e0c-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="J">“(J) </num><content>Such other locations and corresponding periods as set forth by the Airborne Hazards and Open Burn Pit Registry established under section 201 of the Dignified Burial and Other Veterans’ Benefits Improvement Act of 2012 (<ref href="/us/pl/112/260">Public Law 112–260</ref>; <ref href="/us/usc/t38/s527">38 U.S.C. 527 note</ref>).</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e0d-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="K">“(K) </num><content>Such other locations and corresponding periods as the Secretary, in collaboration with the Secretary of Defense, may determine appropriate in a report submitted under paragraph (2).</content></subparagraph>

<paragraph class="indentUp0 firstIndent0 fontsize10" id="y92022e0e-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92022e0f-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="x92022e10-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>Not later than two years after the date of the enactment of the Dr. Kate Hendricks Thomas Supporting Expanded Review for Veterans In Combat Environments Act, and not less frequently than once every two years thereafter, the Secretary of Veterans Affairs, in collaboration with the Secretary of Defense, shall submit to Congress a report specifying other locations and corresponding periods for purposes of paragraph (1)(K).</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y92022e11-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><content>A location under this subsection shall not include any body of water around or any airspace above such location.</content></paragraph>
<paragraph class="indentUp0 firstIndent0 fontsize10" id="y92022e12-e81c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="x92022e13-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><chapeau>In this subsection, the term ‘<term>burn pit</term>’ means an area of land that—</chapeau><subparagraph class="fontsize10" id="y92022e14-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>is used for disposal of solid waste by burning in the outdoor air; and</content></subparagraph>
<subparagraph class="fontsize10" id="y92022e15-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>does not contain a commercially manufactured incinerator or other equipment specifically designed and manufactured for the burning of solid waste.”</content></subparagraph>

<subsection class="firstIndent0 fontsize10" id="y92022e16-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/133/s2/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Report on Breast Cancer Rates for Veterans Deployed to Certain Areas</inline>.—</heading><content>Not later than two years after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives <page identifier="/us/stat/131/1240">131 STAT. 1240</page>
a report that compares the rates of breast cancer among members of the Armed Forces deployed to the locations and during the periods specified in <ref href="/us/usc/t38/s7322/d">section 7322(d) of title 38, United States Code</ref>, as added by subsection (a), as compared to members of the Armed Forces who were not deployed to those locations during those periods and to the civilian population.</content></subsection>
