<section id="d82050e88" identifier="/us/pl/117/13/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0a9c684-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s10101">34 USC 10101 note</ref>.</p></sidenote><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">COVID–19 Hate Crimes Act</shortTitle>”.</content></section>
<section id="d82050e103" identifier="/us/pl/117/13/s2" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0a9c685-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s30501">34 USC 30501 note</ref>.</p></sidenote><heading>FINDINGS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb0aa62c6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Congress finds the following:</chapeau><paragraph class="fontsize10" id="yb0aa62c7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>Following the spread of COVID–19 in 2020, there has been a dramatic increase in hate crimes and violence against Asian-Americans and Pacific Islanders.</content></paragraph>
<paragraph class="fontsize10" id="yb0aa62c8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>According to a recent report, there were nearly 3,800 reported cases of anti-Asian discrimination and incidents related to COVID–19 between March 19, 2020, and February 28, 2021, in all 50 States and the District of Columbia.</content></paragraph>
<paragraph class="fontsize10" id="yb0aa62c9-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>During this time frame, race has been cited as the primary reason for discrimination, making up over 90 percent of incidents, and the United States condemns and denounces any and all anti-Asian and Pacific Islander sentiment in any form.</content></paragraph>
<paragraph class="fontsize10" id="yb0aa62ca-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>Roughly 36 percent of these incidents took place at a business and more than 2,000,000 Asian-American businesses have contributed to the diverse fabric of American life.</content></paragraph>
<paragraph class="fontsize10" id="yb0aa62cb-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>More than 1,900,000 Asian-American and Pacific Islander older adults, particularly those older adults who are recent immigrants or have limited English proficiency, may face even greater challenges in dealing with the COVID–19 pandemic, including discrimination, economic insecurity, and language isolation.</content></paragraph>
<paragraph class="fontsize10" id="yb0aa62cc-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><chapeau>In the midst of this alarming surge in anti-Asian hate crimes and incidents, a shooter murdered the following 8 people in the Atlanta, Georgia region, 7 of whom were women and 6 of whom were women of Asian descent:<sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62cd-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Xiaojie Tan.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62ce-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Daoyou Feng.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62cf-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Delaina Ashley Yaun González.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62d0-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Paul Andre Michels.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62d1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Soon Chung Park.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62d2-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Hyun Jung Grant.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62d3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Suncha Kim.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62d4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Yong Ae Yue.</p></sidenote></chapeau><subparagraph class="fontsize10" id="yb0aa62d5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s2/6/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>Xiaojie Tan.</content></subparagraph>

those affected by this senseless tragedy and incidents of hate that have affected the Asian and Pacific Islander communities.</content></paragraph>

<section id="d82050e214" identifier="/us/pl/117/13/s3" style="-uslm-lc:I658141"><num class="fontsize12" value="3">SEC. 3. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0aa62de-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s30501">34 USC 30501 note</ref>.</p></sidenote><heading>REVIEW OF HATE CRIMES.</heading><subsection class="firstIndent0 fontsize10" id="yb0aa89ef-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s3/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0aa89f0-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0aa89f1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Designation.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In General</inline>.—</heading><content>Not later than 7 days after the date of enactment of this Act, the Attorney General shall designate an officer or employee of the Department of Justice whose responsibility during the applicable period shall be to facilitate the expedited review of hate crimes (as described in <ref href="/us/usc/t18/s249">section 249 of title 18, United States Code</ref>) and reports of any such crime to Federal, State, local, or Tribal law enforcement agencies.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb0aa89f2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s3/b" role="definitions" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Applicable Period Defined</inline>.—</heading><content>In this section, the term “<term>applicable period</term>” means the period beginning on the date on which the officer or employee is designated under subsection (a), and ending on the date that is 1 year after the date on which the emergency period described in subparagraph (B) of section 1135(g)(1) of the Social Security Act (<ref href="/us/usc/t42/s1320b–5/g/1">42 U.S.C. 1320b–5(g)(1)</ref>) ends, except that the Attorney General may extend such period as appropriate.</content></subsection>

<section id="d82050e256" identifier="/us/pl/117/13/s4" style="-uslm-lc:I658141"><num class="fontsize12" value="4">SEC. 4. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0aa89f3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s30501">34 USC 30501 note</ref>.</p></sidenote><heading>GUIDANCE.</heading><subsection class="firstIndent0 fontsize10" id="yb0aab104-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s4/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Guidance for Law Enforcement Agencies</inline>.—</heading><chapeau>The Attorney General shall issue guidance for State, local, and Tribal law enforcement agencies, pursuant to this Act and other applicable law, on how to—</chapeau><paragraph class="fontsize10" id="yb0aab105-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s4/a/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>establish online reporting of hate crimes or incidents, and to have online reporting that is equally effective for people with disabilities as for people without disabilities available in multiple languages as determined by the Attorney General;</content></paragraph>
<paragraph class="fontsize10" id="yb0aab106-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s4/a/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>collect data disaggregated by the protected characteristics described in <ref href="/us/usc/t18/s249">section 249 of title 18, United States Code</ref>; and</content></paragraph>
<paragraph class="fontsize10" id="yb0aab107-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s4/a/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>expand public education campaigns aimed at raising awareness of hate crimes and reaching victims, that are equally effective for people with disabilities as for people without disabilities.</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0aab108-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s4/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0aab109-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Coordination.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Guidance Relating to COVID–19 Pandemic</inline>.—</heading><content>The Attorney General and the Secretary of Health and Human Services, in coordination with the COVID–19 Health Equity Task Force and community-based organizations, shall issue guidance aimed at raising awareness of hate crimes during the COVID–19 pandemic.</content></subsection>

<section id="d82050e306" identifier="/us/pl/117/13/s5" style="-uslm-lc:I658141"><num class="fontsize12" value="5">SEC. 5. </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0aad81a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Khalid Jabara and Heather Heyer National Opposition to Hate, Assault, and Threats to Equality Act </p><p class="leftAlign firstIndent0 fontsize8" id="xb0aad81b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">of 2021. </p><p class="leftAlign firstIndent0 fontsize8" id="xb0aad81c-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180"><ref href="/us/usc/t34/s30507">34 USC 30507</ref>.</p></sidenote><heading>JABARA-HEYER NO HATE ACT.</heading><subsection class="firstIndent0 fontsize10" id="yb0ae5a8d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="a">(a) </num><heading class="fontsize10"><inline class="smallCaps">Short Title</inline>.—</heading><content>This section may be cited as the “<shortTitle role="section">Khalid Jabara and Heather Heyer National Opposition to Hate, Assault, and Threats to Equality Act of 2021</shortTitle>” or the “<shortTitle role="section">Jabara-Heyer NO HATE Act</shortTitle>”.</content></subsection>
<subsection class="firstIndent0 fontsize10" id="yb0ae5a8e-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="b">(b) </num><heading class="fontsize10"><inline class="smallCaps">Findings</inline>.—</heading><chapeau>Congress finds the following:</chapeau><paragraph class="fontsize10" id="yb0ae5a8f-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>The incidence of violence known as hate crimes, or crimes motivated by bias, poses a serious national problem.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a90-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>According to data obtained by the Federal Bureau of Investigation, the incidence of such violence increased in 2019, the most recent year for which data is available.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a91-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>In 1990, Congress enacted the Hate Crime Statistics Act (<ref href="/us/pl/101/275">Public Law 101–275</ref>; <ref href="/us/usc/t28/s534">28 U.S.C. 534 note</ref>) to provide the Federal Government, law enforcement agencies, and the public with data regarding the incidence of hate crime. The Hate Crime Statistics Act and the Matthew Shepard and James <page identifier="/us/stat/135/267">135 STAT. 267</page>
Byrd, Jr. Hate Crimes Prevention Act (<ref href="/us/pl/111/84/dE">division E of Public Law 111–84</ref>; <ref href="/us/stat/123/2835">123 Stat. 2835</ref>) have enabled Federal authorities to understand and, where appropriate, investigate and prosecute hate crimes.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a92-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><content>A more complete understanding of the national problem posed by hate crime is in the public interest and supports the Federal interest in eradicating bias-motivated violence referenced in <ref href="/us/usc/t18/s249/b/1/C">section 249(b)(1)(C) of title 18, United States Code</ref>.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a93-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/5" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><content>However, a complete understanding of the national problem posed by hate crimes is hindered by incomplete data from Federal, State, and local jurisdictions through the Uniform Crime Reports program authorized under <ref href="/us/usc/t28/s534">section 534 of title 28, United States Code</ref>, and administered by the Federal Bureau of Investigation.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a94-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/6" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="6">(6) </num><content>Multiple factors contribute to the provision of inaccurate and incomplete data regarding the incidence of hate crime through the Uniform Crime Reports program. A significant contributing factor is the quality and quantity of training that State and local law enforcement agencies receive on the identification and reporting of suspected bias-motivated crimes.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a95-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/7" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="7">(7) </num><content>The problem of crimes motivated by bias is sufficiently serious, widespread, and interstate in nature as to warrant Federal financial assistance to States and local jurisdictions.</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a96-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/b/8" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="8">(8) </num><content>Federal financial assistance with regard to certain violent crimes motivated by bias enables Federal, State, and local authorities to work together as partners in the investigation and prosecution of such crimes.</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yb0ae5a97-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="c">(c) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph class="fontsize10" id="yb0ae5a98-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/1" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Hate crime</inline>.—</heading><content>The term “<term>hate crime</term>” means an act described in section 245, 247, or 249 of <ref href="/us/usc/t18">title 18, United States Code</ref>, or in section 901 of the Civil Rights Act of 1968 (<ref href="/us/usc/t42/s3631">42 U.S.C. 3631</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a99-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/2" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Priority agency</inline>.—</heading><chapeau>The term “<term>priority agency</term>” means—</chapeau><subparagraph class="fontsize10" id="yb0ae5a9a-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>a law enforcement agency of a unit of local government that serves a population of not less than 100,000, as computed by the Federal Bureau of Investigation; or</content></subparagraph>
<subparagraph class="fontsize10" id="yb0ae5a9b-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>a law enforcement agency of a unit of local government that—</chapeau><clause class="fontsize10" id="yb0ae5a9c-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>serves a population of not less than 50,000 and less than 100,000, as computed by the Federal Bureau of Investigation; and</content></clause>
<clause class="fontsize10" id="yb0ae5a9d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>has reported no hate crimes through the Uniform Crime Reports program in each of the 3 most recent calendar years for which such data is available.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae5a9e-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/3" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">State</inline>.—</heading><content>The term “<term>State</term>” has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10251">34 U.S.C. 10251</ref>).</content></paragraph>
<paragraph class="fontsize10" id="yb0ae5a9f-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/4" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Uniform crime reports</inline>.—</heading><chapeau>The term “<term>Uniform Crime Reports</term>” means the reports authorized under <ref href="/us/usc/t28/s534">section 534 of title 28, United States Code</ref>, and administered by the Federal Bureau of Investigation that compile nationwide criminal statistics for use—</chapeau><subparagraph class="fontsize10" id="yb0ae5aa0-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>in law enforcement administration, operation, and management; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb0ae5aa1-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><content>to assess the nature and type of crime in the United States.<page identifier="/us/stat/135/268">135 STAT. 268</page></content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae5aa2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/c/5" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">(5) </num><heading class="fontsize10"><inline class="smallCaps">Unit of local government</inline>.—</heading><content>The term “<term>unit of local government</term>” has the meaning given the term in section 901 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<ref href="/us/usc/t34/s10251">34 U.S.C. 10251</ref>).</content></paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0ae5aa3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="d">(d) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae5aa4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">State and local governments.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Reporting of Hate Crimes</inline>.—</heading><paragraph class="fontsize10" id="yb0ae5aa5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Implementation grants</inline>.—</heading><subparagraph class="fontsize10" id="yb0ae5aa6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Attorney General may make grants to States and units of local government to assist the State or unit of local government in implementing the National Incident-Based Reporting System, including to train employees in identifying and classifying hate crimes in the National Incident-Based Reporting System.</content></subparagraph>
<subparagraph class="fontsize10" id="yb0ae5aa7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Priority</inline>.—</heading><content>In making grants under subparagraph (A), the Attorney General shall give priority to States and units of local government that develop and implement the programs and activities described in subsection (f)(2)(A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae5aa8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Reporting</inline>.—</heading><subparagraph class="fontsize10" id="yb0ae5aa9-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Compliance</inline>.—</heading><clause class="fontsize10" id="yb0ae5aaa-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae5aab-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0ae5aac-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in clause (ii), in each fiscal year beginning after the date that is 3 years after the date on which a State or unit of local government first receives a grant under paragraph (1), the State or unit of local government shall provide to the Attorney General, through the Uniform Crime Reporting system, information pertaining to hate crimes committed in that jurisdiction during the preceding fiscal year.</content></clause>
<clause class="fontsize10" id="yb0ae5aad-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Extensions; waiver</inline>.—</heading><chapeau>The Attorney General—</chapeau><subclause class="fontsize10" id="yb0ae5aae-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2/A/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>may provide a 120-day extension to a State or unit of local government that is making good faith efforts to comply with clause (i); and</content></subclause>
<subclause class="fontsize10" id="yb0ae5aaf-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2/A/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>shall waive the requirements of clause (i) if compliance with that subparagraph by a State or unit of local government would be unconstitutional under the constitution of the State or of the State in which the unit of local government is located, respectively.</content></subclause>
</clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae5ab0-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/d/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Failure to comply</inline>.—</heading><content>If a State or unit of local government that receives a grant under paragraph (1) fails to substantially comply with subparagraph (A) of this paragraph, the State or unit of local government shall repay the grant in full, plus reasonable interest and penalty charges allowable by law or established by the Attorney General.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0ae5ab1-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="e">(e) </num><heading class="fontsize10"><inline class="smallCaps">Grants for State-run Hate Crime Hotlines</inline>.—</heading><paragraph class="fontsize10" id="yb0ae5ab2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Grants authorized</inline>.—</heading><subparagraph class="fontsize10" id="yb0ae5ab3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Attorney General shall make grants to States to create State-run hate crime reporting hotlines.</content></subparagraph>
<subparagraph class="fontsize10" id="yb0ae5ab4-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Grant period</inline>.—</heading><content>A grant made under subparagraph (A) shall be for a period of not more than 5 years.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae5ab5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Hotline requirements</inline>.—</heading><chapeau>A State shall ensure, with respect to a hotline funded by a grant under paragraph (1), that—</chapeau><subparagraph class="fontsize10" id="yb0ae5ab6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>the hotline directs individuals to—</chapeau><clause class="fontsize10" id="yb0ae5ab7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>law enforcement if appropriate; and</content></clause>
<clause class="fontsize10" id="yb0ae5ab8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>local support services;<page identifier="/us/stat/135/269">135 STAT. 269</page></content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae5ab9-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>any personally identifiable information that an individual provides to an agency of the State through the hotline is not directly or indirectly disclosed, without the consent of the individual, to—</chapeau><clause class="fontsize10" id="yb0ae81ca-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>any other agency of that State;</content></clause>
<clause class="fontsize10" id="yb0ae81cb-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>any other State;</content></clause>
<clause class="fontsize10" id="yb0ae81cc-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>the Federal Government; or</content></clause>
<clause class="fontsize10" id="yb0ae81cd-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><content>any other person or entity;</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae81ce-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/C" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">(C) </num><chapeau>the staff members who operate the hotline are trained to be knowledgeable about—</chapeau><clause class="fontsize10" id="yb0ae81cf-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/C/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>applicable Federal, State, and local hate crime laws; and</content></clause>
<clause class="fontsize10" id="yb0ae81d0-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/C/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>local law enforcement resources and applicable local support services; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae81d1-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/D" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">(D) </num><chapeau>the hotline is accessible to—</chapeau><clause class="fontsize10" id="yb0ae81d2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/D/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>individuals with limited English proficiency, where appropriate; and</content></clause>
<clause class="fontsize10" id="yb0ae81d3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/2/D/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>individuals with disabilities.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae81d4-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/e/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Best practices</inline>.—</heading><content>The Attorney General shall issue guidance to States on best practices for implementing the requirements of paragraph (2).</content></paragraph>

<subsection class="firstIndent0 fontsize10" id="yb0ae81d5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="f">(f) </num><heading class="fontsize10"><inline class="smallCaps">Information Collection by States and Units of Local Government</inline>.—</heading><paragraph class="fontsize10" id="yb0ae81d6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="yb0ae81d7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/1/A" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">Covered agency</inline>.—</heading><chapeau>The term “<term>covered agency</term>” means—</chapeau><clause class="fontsize10" id="yb0ae81d8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/1/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>a State law enforcement agency; and</content></clause>

<subparagraph class="fontsize10" id="yb0ae81da-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/1/B" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Eligible entity</inline>.—</heading><chapeau>The term “<term>eligible entity</term>” means—</chapeau><clause class="fontsize10" id="yb0ae81db-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/1/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>a State; or</content></clause>
<clause class="fontsize10" id="yb0ae81dc-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/1/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>a unit of local government that has a priority agency.</content></clause>

<paragraph class="fontsize10" id="yb0ae81dd-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><heading class="fontsize10"><inline class="smallCaps">Grants</inline>.—</heading><subparagraph class="fontsize10" id="yb0ae81de-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>The Attorney General may make grants to eligible entities to assist covered agencies within the jurisdiction of the eligible entity in conducting law enforcement activities or crime reduction programs to prevent, address, or otherwise respond to hate crime, particularly as those activities or programs relate to reporting hate crimes through the Uniform Crime Reports program, including—</chapeau><clause class="fontsize10" id="yb0ae81df-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>adopting a policy on identifying, investigating, and reporting hate crimes;</content></clause>
<clause class="fontsize10" id="yb0ae81e0-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>developing a standardized system of collecting, analyzing, and reporting the incidence of hate crime;</content></clause>
<clause class="fontsize10" id="yb0ae81e1-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>establishing a unit specialized in identifying, investigating, and reporting hate crimes;</content></clause>
<clause class="fontsize10" id="yb0ae81e2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><chapeau>engaging in community relations functions related to hate crime prevention and education such as—</chapeau><subclause class="fontsize10" id="yb0ae81e3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/iv/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>establishing a liaison with formal community-based organizations or leaders; and<page identifier="/us/stat/135/270">135 STAT. 270</page></content></subclause>
<subclause class="fontsize10" id="yb0ae81e4-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/iv/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>conducting public meetings or educational forums on the impact of hate crimes, services available to hate crime victims, and the relevant Federal, State, and local laws pertaining to hate crimes; and</content></subclause>
</clause>
<clause class="fontsize10" id="yb0ae81e5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/A/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><content>providing hate crime trainings for agency personnel.</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae81e6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Subgrants</inline>.—</heading><content>A State that receives a grant under subparagraph (A) may award a subgrant to a unit of local government within the State for the purposes under that subparagraph, except that a unit of local government may provide funding from such a subgrant to any law enforcement agency of the unit of local government.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae81e7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><heading class="fontsize10"><inline class="smallCaps">Information required of states and units of local government</inline>.—</heading><subparagraph class="fontsize10" id="yb0ae81e8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>For each fiscal year in which a State or unit of local government receives a grant or subgrant under paragraph (2), the State or unit of local government shall—</chapeau><clause class="fontsize10" id="yb0ae81e9-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>collect information from each law enforcement agency that receives funding from the grant or subgrant summarizing the law enforcement activities or crime reduction programs conducted by the agency to prevent, address, or otherwise respond to hate crime, particularly as those activities or programs relate to reporting hate crimes through the Uniform Crime Reports program; and</content></clause>
<clause class="fontsize10" id="yb0ae81ea-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae81eb-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Reports.</p></sidenote><content>submit to the Attorney General a report containing the information collected under clause (i).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae81ec-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Semiannual law enforcement agency report</inline>.—</heading><clause class="fontsize10" id="yb0ae81ed-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae81ee-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Requirement.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>In collecting the information required under subparagraph (A)(i), a State or unit of local government shall require each law enforcement agency that receives funding from a grant or subgrant awarded to the State or unit of local government under paragraph (2) to submit a semiannual report to the State or unit of local government that includes a summary of the law enforcement activities or crime reduction programs conducted by the agency during the reporting period to prevent, address, or otherwise respond to hate crime, particularly as those activities or programs relate to reporting hate crimes through the Uniform Crime Reports program.</content></clause>
<clause class="fontsize10" id="yb0ae81ef-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><heading class="fontsize10"><inline class="smallCaps">Contents</inline>.—</heading><chapeau>In a report submitted under clause (i), a law enforcement agency shall, at a minimum, disclose—</chapeau><subclause class="fontsize10" id="yb0ae81f0-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>whether the agency has adopted a policy on identifying, investigating, and reporting hate crimes;</content></subclause>
<subclause class="fontsize10" id="yb0ae81f1-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>whether the agency has developed a standardized system of collecting, analyzing, and reporting the incidence of hate crime;</content></subclause>
<subclause class="fontsize10" id="yb0ae81f2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/III" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="III">(III) </num><content>whether the agency has established a unit specialized in identifying, investigating, and reporting hate crimes;</content></subclause>
<subclause class="fontsize10" id="yb0ae81f3-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/IV" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="IV">(IV) </num><chapeau>whether the agency engages in community relations functions related to hate crime, such as—<page identifier="/us/stat/135/271">135 STAT. 271</page></chapeau><item class="fontsize10" id="yb0ae81f4-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/IV/aa" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="aa">(aa) </num><content>establishing a liaison with formal community-based organizations or leaders; and</content></item>
<item class="fontsize10" id="yb0ae81f5-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/IV/bb" style="-uslm-lc:I658130"><num class="fontsize10" style="-uslm-lc:emspace2" value="bb">(bb) </num><content>conducting public meetings or educational forums on the impact of hate crime, services available to hate crime victims, and the relevant Federal, State, and local laws pertaining to hate crime; and</content></item>
</subclause>
<subclause class="fontsize10" id="yb0ae81f6-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/3/B/ii/V" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="V">(V) </num><content>the number of hate crime trainings for agency personnel, including the duration of the trainings, conducted by the agency during the reporting period.</content></subclause>

</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae81f7-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/4" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">(4) </num><heading class="fontsize10"><inline class="smallCaps">Compliance and redirection of funds</inline>.—</heading><subparagraph class="fontsize10" id="yb0ae81f8-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/4/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae81f9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>Except as provided in subparagraph (B), beginning not later than 1 year after the date of this Act, a State or unit of local government receiving a grant or subgrant under paragraph (2) shall comply with paragraph (3).</content></subparagraph>
<subparagraph class="fontsize10" id="yb0ae81fa-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/4/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><heading class="fontsize10"><inline class="smallCaps">Extensions; waiver</inline>.—</heading><chapeau>The Attorney General—</chapeau><clause class="fontsize10" id="yb0ae81fb-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/4/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>may provide a 120-day extension to a State or unit of local government that is making good faith efforts to collect the information required under paragraph (3); and</content></clause>
<clause class="fontsize10" id="yb0ae81fc-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/f/4/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>shall waive the requirements of paragraph (3) for a State or unit of local government if compliance with that subsection by the State or unit of local government would be unconstitutional under the constitution of the State or of the State in which the unit of local government is located, respectively.</content></clause>
</subparagraph>
</paragraph>
</subsection>
<subsection class="firstIndent0 fontsize10" id="yb0ae81fd-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="g">(g) </num><heading class="fontsize10"><inline class="smallCaps">Requirements of the Attorney General</inline>.—</heading><paragraph class="fontsize10" id="yb0ae81fe-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><heading class="fontsize10"><inline class="smallCaps">Information collection and analysis; report</inline>.—</heading><chapeau>In order to improve the accuracy of data regarding the incidence of hate crime provided through the Uniform Crime Reports program, and promote a more complete understanding of the national problem posed by hate crime, the Attorney General shall—</chapeau><subparagraph class="fontsize10" id="yb0ae81ff-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/1/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><content>collect and analyze the information provided by States and units of local government under subsection (f) for the purpose of developing policies related to the provision of accurate data obtained under the Hate Crime Statistics Act (<ref href="/us/pl/101/275">Public Law 101–275</ref>; <ref href="/us/usc/t28/s534">28 U.S.C. 534 note</ref>) by the Federal Bureau of Investigation; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb0ae8200-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/1/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae8201-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Time period.</p><p class="leftAlign firstIndent0 fontsize8" id="xb0ae8202-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Effective date.</p></sidenote><content>for each calendar year beginning after the date of enactment of this Act, publish and submit to Congress a report based on the information collected and analyzed under subparagraph (A).</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb0ae8203-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb0ae8204-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Analysis.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Contents of report</inline>.—</heading><chapeau>A report submitted under paragraph (1) shall include—</chapeau><subparagraph class="fontsize10" id="yb0ae8205-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/A" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">(A) </num><chapeau>a qualitative analysis of the relationship between—</chapeau><clause class="fontsize10" id="yb0ae8206-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/A/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>the number of hate crimes reported by State law enforcement agencies or other law enforcement agencies that received funding from a grant or subgrant awarded under paragraph (2) through the Uniform Crime Reports program; and</content></clause>
<clause class="fontsize10" id="yb0ae8207-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/A/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>the nature and extent of law enforcement activities or crime reduction programs conducted by <page identifier="/us/stat/135/272">135 STAT. 272</page>
those agencies to prevent, address, or otherwise respond to hate crime; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb0ae8208-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">(B) </num><chapeau>a quantitative analysis of the number of State law enforcement agencies and other law enforcement agencies that received funding from a grant or subgrant awarded under paragraph (2) that have—</chapeau><clause class="fontsize10" id="yb0ae8209-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/i" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">(i) </num><content>adopted a policy on identifying, investigating, and reporting hate crimes;</content></clause>
<clause class="fontsize10" id="yb0ae820a-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/ii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">(ii) </num><content>developed a standardized system of collecting, analyzing, and reporting the incidence of hate crime;</content></clause>
<clause class="fontsize10" id="yb0ae820b-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/iii" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">(iii) </num><content>established a unit specialized in identifying, investigating, and reporting hate crimes;</content></clause>
<clause class="fontsize10" id="yb0ae820c-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/iv" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">(iv) </num><chapeau>engaged in community relations functions related to hate crime, such as—</chapeau><subclause class="fontsize10" id="yb0ae820d-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/iv/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>establishing a liaison with formal community-based organizations or leaders; and</content></subclause>
<subclause class="fontsize10" id="yb0ae820e-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/iv/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>conducting public meetings or educational forums on the impact of hate crime, services available to hate crime victims, and the relevant Federal, State, and local laws pertaining to hate crime; and</content></subclause>

<clause class="fontsize10" id="yb0ae820f-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/v" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="v">(v) </num><chapeau>conducted hate crime trainings for agency personnel during the reporting period, including—</chapeau><subclause class="fontsize10" id="yb0ae8210-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/v/I" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="I">(I) </num><content>the total number of trainings conducted by each agency; and</content></subclause>
<subclause class="fontsize10" id="yb0ae8211-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/13/s5/g/2/B/v/II" style="-uslm-lc:I658128"><num class="fontsize10" style="-uslm-lc:emspace2" value="II">(II) </num><content>the duration of the trainings described in subclause (I).</content></subclause>
