<section id="d82188e94" identifier="/us/pl/117/129/s1" style="-uslm-lc:I658146"><num class="bold" value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I658120">  This Act may be cited as the “<shortTitle role="act">Access to Baby Formula Act of 2022</shortTitle>”.</content></section>
<section id="d82188e104" identifier="/us/pl/117/129/s2" role="instruction" style="-uslm-lc:I658141"><num class="fontsize12" value="2">SEC. 2. </num><heading>AUTHORITY TO ADDRESS CERTAIN EMERGENCIES, DISASTERS, AND SUPPLY CHAIN DISRUPTIONS.</heading><chapeau class="indentUp0 firstIndent0 fontsize10" id="xb873a3de-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120">  Section 17 of the Child Nutrition Act of 1966 (<ref href="/us/usc/t42/s1786">42 U.S.C. 1786</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="fontsize10" id="yb873a3df-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/129/s2/1" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">(1) </num><content>in subsection (b), by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><paragraph class="indentUp0 fontsize10" id="yb873a3e0-e81c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="24">“(24) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb873a3e1-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Definition.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Supply chain disruption</inline>.—</heading><content>The term ‘<term>supply chain disruption</term>’ means a shortage of supplemental foods that impedes the redemption of food instruments, as determined by the Secretary.”</content></paragraph>

<paragraph class="fontsize10" id="yb873a3e2-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/129/s2/2" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">(2) </num><content>in subsection (h)(8), by <amendingAction type="add">adding</amendingAction> at the end the following:<quotedContent><subparagraph class="fontsize10" id="yb873caf3-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="L">“(L) </num><heading class="fontsize10"><inline class="smallCaps">Infant formula cost containment contract requirement</inline>.—</heading><clause class="fontsize10" id="yb873caf4-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary shall require that each infant formula cost containment contract renewed or entered into on or after the date of the enactment of the Access to Baby Formula Act of 2022 includes remedies in the event of an infant formula recall, including how an infant formula manufacturer would protect against disruption to program participants in the State.</content></clause>
<clause class="fontsize10" id="yb873caf5-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb873caf6-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Compliance.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Rebates</inline>.—</heading><content>In the case of an infant formula recall, an infant formula manufacturer contracted to provide infant formula under this section shall comply with the contract requirements under clause (i).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb873caf7-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="M">“(M) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb873caf8-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Deadline.</p><p class="leftAlign firstIndent0 fontsize8" id="xb873caf9-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Procedures.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Memorandum of understanding</inline>.—</heading><content>Not later than 30 days after the date of the enactment of the Access to Baby Formula Act of 2022, the Secretary shall ensure there is a memorandum of understanding between the Secretary and the Secretary of Health and Human Services that includes procedures to promote coordination and information sharing between the Department of Agriculture and the Department of Health and Human Services regarding any supply chain disruption, including a supplemental food recall.”</content></subparagraph>
</quotedContent>; and</content></paragraph>
<paragraph class="fontsize10" id="yb873cafa-e81c-11f0-a1e4-69761a48a15a" identifier="/us/pl/117/129/s2/3" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">(3) </num><content>by <amendingAction type="add">adding</amendingAction> at the end the following:<page identifier="/us/stat/136/1226">136 STAT. 1226</page>
<quotedContent><subsection class="indentDown1 firstIndent0 fontsize10" id="yb8748e4b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="r">“(r) </num><heading class="fontsize10"><inline class="smallCaps">Emergencies and Disasters</inline>.—</heading><paragraph class="fontsize10" id="yb8748e4c-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Notwithstanding any other provision of law, during an emergency period, the Secretary may modify or waive any qualified administrative requirement for one or more State agencies if—</chapeau><subparagraph class="fontsize10" id="yb8748e4d-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the qualified administrative requirement cannot be met by State agencies during any portion of the emergency period under the conditions which prompted the emergency period; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e4e-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the modification or waiver of such a requirement—</chapeau><clause class="fontsize10" id="yb8748e4f-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is necessary to provide assistance under this section; and</content></clause>
<clause class="fontsize10" id="yb8748e50-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>does not substantially weaken the nutritional quality of supplemental foods provided under this section.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb8748e51-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Duration</inline>.—</heading><content>A waiver established under this subsection may be available for a period of not greater than the emergency period and the 60 days after the end of such emergency period.</content></paragraph>
<paragraph class="fontsize10" id="yb8748e52-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Definitions</inline>.—</heading><chapeau>In this subsection:</chapeau><subparagraph class="fontsize10" id="yb8748e53-e81c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><heading class="fontsize10"><inline class="smallCaps">Emergency period</inline>.—</heading><chapeau>The term ‘<term>emergency period</term>’ means a period during which there exists—</chapeau><clause class="fontsize10" id="yb8748e54-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>a public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<ref href="/us/usc/t42/s247d">42 U.S.C. 247d</ref>);</content></clause>
<clause class="fontsize10" id="yb8748e55-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>any renewal of such a public health emergency pursuant to such section 319;</content></clause>
<clause class="fontsize10" id="yb8748e56-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iii">“(iii) </num><content>a presidentially declared major disaster as defined under section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121/etseq">42 U.S.C. 5121 et seq.</ref>); or</content></clause>
<clause class="fontsize10" id="yb8748e57-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="iv">“(iv) </num><content>a presidentially declared emergency as defined under section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121/etseq">42 U.S.C. 5121 et seq.</ref>).</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb8748e58-e81c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><heading class="fontsize10"><inline class="smallCaps">Qualified administrative requirement</inline>.—</heading><content>The term ‘<term>qualified administrative requirement</term>’ means a requirement under this section or a regulatory requirement issued pursuant to this section.</content></subparagraph>
</paragraph>
</subsection>
<subsection class="indentDown1 firstIndent0 fontsize10" id="yb8748e59-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658120"><num class="fontsize10" style="-uslm-lc:emspace2" value="s">“(s) </num><heading class="fontsize10"><inline class="smallCaps">Supply Chain Disruptions</inline>.—</heading><paragraph class="fontsize10" id="yb8748e5a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="1">“(1) </num><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><chapeau>Notwithstanding any other provision of law, during a supply chain disruption, including a supplemental food product recall, the Secretary may modify or waive any qualified administrative requirement for one or more State agencies if—</chapeau><subparagraph class="fontsize10" id="yb8748e5b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>the qualified administrative requirement cannot be met by State agencies during any portion of the supply chain disruption, including a supplemental food product recall, under the conditions which prompted such disruption or recall; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e5c-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><chapeau>the modification or waiver of such a requirement—</chapeau><clause class="fontsize10" id="yb8748e5d-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><content>is necessary to provide assistance under this section; and</content></clause>
<clause class="fontsize10" id="yb8748e5e-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><content>does not substantially weaken the nutritional quality of supplemental foods provided under this section.</content></clause>
</subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb8748e5f-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="2">“(2) </num><heading class="fontsize10"><inline class="smallCaps">Waiver authority</inline>.—</heading><chapeau>The Secretary may, under a waiver or modification under paragraph (1)—</chapeau><page identifier="/us/stat/136/1227">136 STAT. 1227</page>
<subparagraph class="fontsize10" id="yb8748e60-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><content>permit authorized vendors to exchange or substitute authorized supplemental foods obtained with food instruments beyond exchanges for an identical (exact brand and size) food item;</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e61-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>waive any requirement with respect to medical documentation for the issuance of noncontract brand infant formula, except for the requirements for participants receiving Food Package III (as defined in <ref href="/us/cfr/t7/s246.10/e/3">section 246.10(e)(3) of title 7, Code of Federal Regulations</ref> (as in effect on the date of the enactment of this subsection));</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e62-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><content>waive the maximum monthly allowance for infant formula; and</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e63-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="D">“(D) </num><content>waive any additional qualified administrative requirement to address a supply chain disruption, including a supplemental food product recall.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb8748e64-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="3">“(3) </num><heading class="fontsize10"><inline class="smallCaps">Duration</inline>.—</heading><chapeau>A waiver or modification established under this subsection—</chapeau><subparagraph class="fontsize10" id="yb8748e65-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><chapeau>may be—</chapeau><clause class="fontsize10" id="yb8748e66-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="i">“(i) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb8748e67-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p></sidenote><content>available for a period of not more than 45 days, to begin on a date determined by the Secretary; and</content></clause>
<clause class="fontsize10" id="yb8748e68-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658126"><num class="fontsize10" style="-uslm-lc:emspace2" value="ii">“(ii) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb8748e69-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notice.</p></sidenote><content>renewed so long as the Secretary provides notice at least 15 days before such renewal; and</content></clause>
</subparagraph>
<subparagraph class="fontsize10" id="yb8748e6a-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><content>shall not be available after the date that is 60 days after the supply chain disruption for which such waiver is established ceases to exist.</content></subparagraph>
</paragraph>
<paragraph class="fontsize10" id="yb8748e6b-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="4">“(4) </num><heading class="fontsize10"><inline class="smallCaps">Transparency</inline>.—</heading><subparagraph class="fontsize10" id="yb8748e6c-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="A">“(A) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb8748e6d-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Determination.</p><p class="leftAlign firstIndent0 fontsize8" id="xb8748e6e-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">In general</inline>.—</heading><content>If the Secretary determines that a supply chain disruption exists and issues a waiver or modification under this subsection, the Secretary shall notify each State agency affected by such disruption and include with such notification an explanation of such determination.</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e6f-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="B">“(B) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb8748e70-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Public information.</p><p class="leftAlign firstIndent0 fontsize8" id="xb8748e71-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Web posting.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">Publication</inline>.—</heading><content>The Secretary shall make each determination described in subparagraph (A) publicly available on the website of the Department.</content></subparagraph>
<subparagraph class="fontsize10" id="yb8748e72-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658124"><num class="fontsize10" style="-uslm-lc:emspace2" value="C">“(C) </num><sidenote><p class="leftAlign firstIndent0 fontsize8" id="xb8748e73-e81c-11f0-a1e4-69761a48a15a" style="-uslm-lc:I658180">Notification.</p></sidenote><heading class="fontsize10"><inline class="smallCaps">State agency requirements</inline>.—</heading><content>In the case of a waiver or modification under this subsection related to infant formula, a State agency notified under subparagraph (A) shall notify each infant formula manufacturer that has a contract with such State agency with respect to such notification.<page identifier="/us/stat/136/1228">136 STAT. 1228</page></content></subparagraph>

<paragraph class="fontsize10" id="yb8748e74-e81c-11f0-a1e4-69761a48a15a" role="definitions" style="-uslm-lc:I658122"><num class="fontsize10" style="-uslm-lc:emspace2" value="5">“(5) </num><heading class="fontsize10"><inline class="smallCaps">Qualified administrative requirement defined</inline>.—</heading><content>For purposes of this subsection, the term ‘<term>qualified administrative requirement</term>’ has the meaning given the term in subsection (r).”</content></paragraph>
